CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING FEBRUARY 1, 1966 The City Council of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 P.M., February 1, 1966. Mr. Robert K. Oliver, Arcadia Church of Christ Mayor Conrad T. Reibold PRESENT: ABSENT: Councilmen Balser, Considine, Turner, Reibold Councilman Forman The Minutes of the Regular Meeting of January 18, 1966 were APPROVED on MOTION by Councilman Turner, seconded by Councilman Considine and carried unanimously. Planning Commission Resolution No. 577 recommending the reclassifi- cation of all properties presently zoned C-3 into Zone C-2. The Planning Director explained the contents of said resolution and projecturals were reviewed depicting the areas where properties were so zoned. Mayor Reibold declared the hearing open. No one desiring to be heard, it was MOVED by Councilman Turner, seconded by Councilman Balser and carried unanimously that the hearing be CLOSED. It was then MOVED by Councilman Turner, seconded by Councilman Considine and carried unanimously that the City Council APPROVE the recommendation of the Planning Commission as contained in its Resolution No. 577; that all properties presently zoned C-3'be rezoned to C-2 and that the City Attorney prepare an ordinance amending the Arcadia Municipal Code in accordance therewith. It was MOVED by Councilman Balser, seconded by Councilman Considine and carried unanimously that February 15, 1966 be set as the date of a public hearing on Planning Commission Resolution No. 579 recom- mending reclassifying property at 12, 14, 16 and 18 Campus Drive from Zone R-3 to Zone C-2. Discussion held on the possibility of two-story construction within Tract No. 24105 (1234 - 1308 S. Second Avenue) and it was the consensus of the City Council that only one-story homes should be permitted in order to provide privacy for the surrounding residences and the subdivider having submitted a house location plan indicating only one-story homes, it was MOVED by Councilman Balser, seconded by Councilman Turner and carried unanimously that the final map of Tract No. 24105 be APPROVED subject to continued compliance with the conditions of approval of the tentative map and with a further provision that the developer execute a covenant that the lots in the tract be restricted to only one-story homes. 1. 2-1- 66 CONSTRUC'tION CORPORATlON YARD (contract awarded) J-110 FIRE PREVENTION CODE A; 1;(.(/ WORK ACCEPTANCE d /1:1./ TRACT NO. 22377 FINAL 1-EPTANCE IOb~ WORK ACCEPTANCE :J /I~~ 17:6721 The City Manager repcr ted on the following bids received for the . construction of the Corporation Yard: O. Coyle Company, had requested withdrawal of his bid before it was opened and read and recommended that the award be made to LEONARD FULLMER, whereupon it was MOVED by Councilman Balser, seconded by Councilman Turner and carried on rot! call vote as follows that O. K. Coyle Company be permitted to with- draw its bid due to circumstances as set forth in its communication dated January 25, 1966; that the contract be awarded to said Leonard Fullmer in the amount of $368,000; that all other bids be rejected; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk be authorized to execute the contract in form approved by the City Attorney; that the sum of $136,500 be transferred from Water Fund Surplus Account No. 290 in the General Fund to Capital Projects Account No. 309 - Corporation Yard Construction. AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reibold None Councilman Forman The recommendation of the City Manager concerning the adoption by reference of the 1965 Fire Prevention Code as recommended by the American Insurance Association was APPROVED on MOTION by Councilman Turner, seconded by Councilman Considine and carried unanimously, and that the City Attorney prepare the necessary ordinance for Council consideration. On MOTION by Councilman Considine, seconded by Councilman Balser and carried on roll call vote as follows the work as performed by Eric L. Peterson in the construction of the first phase of the sidewalk program be ACCEPTED and FINAL payment authorized in accordance with the terms of the contract: AYES: Councilmen Balser, Considine, Turner, Reibold NOES: None ABSENT: Councilman Forman 1 It was MOVED by Councilman Turner, seconded by Councilman Considine and carried unanimously that the streets in Tract No, 22377 (Estrella Avenue west of Baldwin Avenue) be accepted for maintenance by the" City as all improvements have been completed in accordance with requirements and conditions imposed by the City Council. AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reihold None Councilman Forman It was MOVED by Councilman Turner, seconded by Councilman Balser and carried on the following roll call vote that the City purchase from John E. Noyes Ford Company one I-ton paint truck in the amount of $4,107.13 without a related trade-in; that a purchase be made from Wegge Motors of one 2 1/2-ton and one 2-ton flatracks in the amount of $8,589.97 including trade-in allowances for trucks (No. 170 and 172); that Truck No. 168 be sold outright to Mr. Glen Covert in the amount of $407.00; that all other bids be rejected; that any infor- malities or irregularities in the bids or bidding process be waived and that the Mayor and City Clerk be authorized to execute the contracts in form approved by the City Attorney. AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reihold None Councilman Forman It was noted that funds in the amount of $12,900 are available in Account No. 433.51. In continuance of the widening of Duarte Road from Baldwin Avenue to the westerly City limits and between Holly and El Monte Avenues, it was reported that the City has secured signed grant deeds of easement and the appropriate agreements for purchase and sale covering eleven (11) parcels; that prior to final recordation and payment, all required reconveyances and consents to subordination will be secured, as well as an up-dated condemnation report from the Title Insurance and Trust Company. Therefore, in the interest of expediting the property acquisition and payment to the property owners, it was MOVED by Councilman Considine, seconded by Councilman Balser and carried on roll call vote as follows that the City Manager or his agent be authorized to execute the various signed purchase and sale agreements, in form approved by the City Attorney, and to make payment to the property owners at such time as said documents have been executed and are ready for recordation and actual transfer of property owners. AYES: NOES: ABSENT: CouncilmenjBalser, Considine, Turner, Reihold None Councilman Forman It was MOVED by Councilman Balser, seconded by Councilman Considine and carried unanimously that the City Council reconsider a portion of the wording in the Procedure of Policy in connection with the acquisition and disposal of property by the City which was adopted by the City Council on January 18, 1966. 3. 2-1-66 17 :6723 Whereupon Councilman Turner commented that he appreciated the time and effort Mayor Reibold had given the remarks made by him (Turner) at the previous meeting; that although the suggested new wording does not fully meet what he had in mind it is a great step toward better programming of sales and acquisition of property than originally and MOVED that the policy as amended be APPROVED. Motion seconded by Councilman Considine and carried unanimously. NEW WORDING: Page 1, second paragraph under GENERAL POLICY, insert after "no broker" the words "and/or salesman", Page 1, first paragraph, under SALE POLICY in the I second line the word Ilfurther" to be inserted between the words nis" and "deemedll. The word "could" changed to "should". Page 2, Section 8 has been added, reading as follows: "Nothing contained herein shall prohibit the City from selling directly to a purchaser without payment of a commission provided that the Council had not heretofore declared the land to be excess and available for sale on a competitive basis." Adopted The City Manager presented, explained the content of Resolution No. 3850 concerning participation by City officers and supervisory employees in Service Clubs and other community organizations; that it provides for the encouragement of such participation although the City does not reimburse for such activities; that he does not now recommend nor does he intend to recommend in the future that the City pay the dues or expenses of such participation. RESOLUTION NO. 3850 Whereupon the City Attorney read the title of Resolution No. 3850 entitled: "A RESOLUTION OF THE CIlY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, RELATIVE TO PARTICIPATION IN SERVICE CLUBS AND ACTIVITIES BY CITY OFFICERS AND SUPERVISORY EMPLOYEES." Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reibold None Councilman Forman Mayor Reibold commended the City Attorney on his recent presentation on Home Rule before the Assembly Committee on Criminal Procedure. The City Manager stated in part that he had received several calls relative to a recent television program which inferred that the race. track was to be redeveloped into another use; that he had contacted the track officials and had been informed the program had not been authorized by the track, nor had the renderings which were used I during the program been prepared by persons connected with the track; that it had no intentions in this regard. In answer to an inquiry by Councilman Turner as to the status of a new format for the agenda which he had suggested some months ago, the City Manager advised that as soon as "Project Skiploader" was completed the Assistant City Manager would be able to give it his attention. I On MOTION by Mayor Reibold, seconded by Councilman Turner and carried unanimously, J. Lyle Cunningham, 475 Oxford Drive, was appointed to fill out the unexpired term of Thomas Sullivan on the Personnel Board. Said term to expire June 30, 1968. At 8:45 P.M.
