Councilman Robert J. Considine Mayor George L. Forman PRESENT: ABSENT : Councilmen Arth, Butterworth, Considine, Rage, Forman None , The Minutes of the Regular Meeting of June 21, 1966 were APPROVED on MOTION by Councilman Butterworth, seconded by Councilman Hage and carried unanimously. The Planning Director explained that by Resolution No. 594 the Planning Commission had granted a conditional use permit to the Union Oil Company to allow the expansion of an existing service station at 11 E. Live Oak Avenue upon conditions specified therein; that the Commission recommended the waiving of Arcadia Municipal Code Sections 9273.4.9,. Part 1 Section 9275.4.11, Part 4 Section 9275.4.11 and Section 9275.4.16 as the size, shape and location of the existing facilities make the application of all of the Code requirements governing drive-in businesses inappropriate or inapplicableG It was MOVED by Councilman Hage, seconded by Councilman Considine and carried unanimously that the City Council waive the provisions of Code Sections as listed above, such waiver to become effective c~ncurrent with the effective date of the Conditional Use Permit. Councilman Arth did not participate in the discussion or the vote due to his affiliation with the Union Oil Company. The Planning Commission recommended approval of the tentative map of Tract No. 27195 - Oakhaven Road extension. It was noted that this subdivision 'tract map was originally approved by both the Commission and the City Council in July of 1963; that the time period between said approval of the tentative map and recordation of the final map has expired, consequently another approval is required. Upon being advised that there are no significant changes in the maps, it was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried unanimously that tentative map of Tract No. 27195 be approved subject to conditions imposed on the original approval (Report of April 17, 1963). It was MOVED by Councilman Considine, seconded by Councilman Hage and carried unanimously that a public hearing be scheduled for July 19, 1966 at 8 P.M. on the appeal filed by the Harbor Service Stations, Inc., from the decision of the Planning Commission in its denial of L 7-5-66 ADDITIONAL BEDS (Convalescent Home Baldwin Ave.) F6ll PERSONNEL BOARD IR COMMUNICATION (Mrs. Tuvey) F1l49 17:6823 an application for a conditional use permit to allow the construction of a service station on the northwest corner of Duarte Road and Golden West Avenue. Pursuant to Section III of Resolution No. 3316, it was MOVED by Councilman Hage, seconded by Councilman Butterworth and carried unanimously that the owner of a Convalescent Home at 1614 S. Baldwin Avenue, Orlando Clarizio, be permitted to convert two existing storage rooms into two four-bed convalescent rooms. 1 The Planning Director had advised that the request is well within the density requirements of the Arcadia Municipal Code; that the original variance and/or conditional use permit was granted on November 15, 1960 for a 66 bed facility; that with the additional 8 beds the total of 74 would still be somewhat below the 117 which could be permitted under present standards. The following resolution was adopted on MOTION by Councilman Butterworth, seconded by Councilman Arth and carried unanimously: RESOLVED, that the recommendation of the Personnel Board be approved and that Section 1 of Rule VIII of the Personnel Rules and Regulations be amended to read as follows: "Persons appointed to all permanent positions, entrance or promotional, in the uniformed service of the Police and Fire'Departments shall be on probation for twelve months before attaining permanent status. Persons appointed to other permanent positions shall be on probation for a period of six months before attaining permanent status. During the probationary period a probationer may be discharged or demoted (if he holds permanent status in a lower class) without right of appeal if the appointing power deems him unfit or unsatisfactory for service. No person shall attain permanent status unless and until (1) the appointing officer certifies in writing to the City Manager that the employee is satisfactory and has been permanently appointed to the position in which he has held a probationary appointment, or (2) upon the failure of the appointing power to remove the employee from his position, within 5 days after written notice from the City Manager that such employee's probationary period has been or within 5 days will be completed and that either permanent certification or dismissal of the employee must be accomplished, Upon the request of any employee who has completed, or within 5 days will complete, his prescribed probationary period, the City Manager shall notify the appointing power of such fact and that permanent certification or discharge of the employee is required. Any such action shall be made a matter of record in the minutes of the Personnel Board at its next regular meeting." I Mayor Forman ordered filed the communication expressing appreciation for the favorable action of the City Council in approving the request for annexation to the City of property on South Tenth Avenue. 2. 7-5-66 PERSONNEL (Clough) F1143 1 MAY COMPANY (opening) F85B WORK ACCEPTANCE (Wilkinson) F1133A CONTRACT AWARD (Duarte Road) F1143A 1 17:6824 It was MOVED by Councilman Considine, seconded by Councilman Butterworth and carried on roll call vote as follows that the City retain the services of Frank Clough to act as negotiator in the acquisition of property for the Duarte Road improvement between Baldwin Avenue and the westerly City Limits on the same financial basis as previously arranged: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Hage, Forman None None It was MOVED by Councilman Arth, seconded by Councilman Considine and carried-unanimously that the request of the Associated Auxiliaries of the Arcadia Methodist Hospital for an extension of their charitable solicitation permit be APPROVED. Purpose is the sponsoring of the formal invitational opening of the new May Company on August 6, 1966. A charge of $2.50 is being made with full proceeds going to the auxiliaries and will be used for the procurement of lifesaving equipment for the hospital. It was MOVED by Coun~ilman Considine, seconded by Councilman Hage and carried on roll call vote as follows the work as satisfactorily completed by W. R. Wilkinson Company, Inc., in the improvement of Santa Clara Street extension, Second Avenue to the Wash, be ACCEPTED and that final payment be made in accordance with-the terms of the contract: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Hage, Forman None None The City Manager Pro Tempore and the Director of Public Works submitted the following tabulation of bids received for the im- provement of Duarte Road from Baldwin Avenue to the West City Limits and recommended the award of contract to the low bidder: Osborn Constructors F. Councilman Hage and carried on roll call vote as follows that the low bid of William R. Hahn, electrical contractor, in the amount of $23,980 be accepted; that all other bids be rejected; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk execute the contract in form approved by the City Attorney: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Rage, Forman None None It was noted that this project is to be financed from Capital Projects Account No. 249 and was previously approved by the City Council. Review of the possibility of the City's membership in the Southern California Association of Governments will be held at the Study Session scheduled for August 25, 1966. The Councilmen expressed a desire to have additional informative data and the possibility of having a representative of the organization present at the time of review was explored. At the suggestion of Councilman Arth the matter of the moratorium imposed on property within the Chicago Park Tract by Ordinance No. 1324 was placed on the agenda for this meeting. Councilman Arth stated for the record: "That I would not favor an indefinite continuation of the moratorium or any action which could lead to a Community Redevelopment Agency at a time such as this when we actually have developers ready, willing and able to go ahead with developments in the area." In order to consider the following two items prov~s~ons of the 1 Procedural Ordinance were waived on MOTION by Councilman Butterworth, seconded by Councilman Considine and carried unanimously. It was MOVED by Councilman Arth, seconded by Councilman Hage and carried unanimously that permission be granted the Chariots Car Club to hold its seat belt clinic on July 15, 16, 17, 1966 in the parking area at the rear of Hinshaw's Department Store; hours to be 10 A.M. until 5 P.M. and that the appropriate business permit be issued. 4. 7-5-66 RESOLUTION NO. 3887 Adopted (Property acquisition- condemnation) 1 F1l43 CENTRAL AREA PROPERTY nsp F899 1 MERIT SYSTEM (Personnel) 17:6826 Upon the advice of the City Manager Pro Tempore and the Director of Public Works that the staff has been unable to secure the necessary Partial Reconveyances in connection with three parcels of property on Duarte Road, and that same must be acquired before construction of the street widening program can commence between Baldwin Avenue and the West City Limits, the following resolution was adopted. The City Attorney presented, explained the content and read the title of Resolution No. 3887, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC PURPOSES AND ORDERING THE ACQUISITION THEREOF." \ MOTION by Councilman Considine, seconded by Councilman Hage and carried on roll call vote as follows that the reading of the full body of Resolution No. 3887 be waived: AYES: NOES: ABSENT: Councilmen Arth,.Butterworth, Considine, Rage, Forman None None Councilman Considine further MOVED that Resolution No. 3887 be adopted. Motion seconded by Councilman Hage and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Rage, Forman None None Councilman Considine stated in part that as a result of a meeting he, Councilman Hage and the City Manager Pro Tempore had with prospective developers of property in the downtown area two things became evident to him, 1) the need for further definition of what types of businesses the City Council wants or does not want in the area, and 2) that there are two pieces of property that intersperses with City-owned property and that if they should be independently developed it would preclude the orderly development of the total area as anticipated by the City. Following extensive discussion the Planning Department was requested to prepare a list of desirable businesses for the City Council to consider as a contingent to the sale of City-owned property in the so-called Towne Center. It was pointed out that the reason the City purchased property in the subject area was to be able to control the type of development. Councilman Considine suggested that a review of the City's merit system be made by the Personnel Board; also that a review be made of the possibility of scheduling salary review periods so that salaries may be completely finalized prior to the presentation of the budget to the City Council. Discussion ensued on the primary functions .of the Personnel Board under the City Charter and it was noted that it is a recommending body to the City Council on Civil service rules and regulations, acts in an advisory capacity to the City Council on problems con- cerning personnel administration, hears appeals of persons in the 5. 7-5-66 17:6827 classified service and makes investigations as may be deemed advisable concerning how the personnel system is being administered. It was the consensus of the City Council that both the review of the merit system and the rescheduling of the salary system study should await the arrival of the new City Manager. Mayor Forman notified the Councilmen that the League of California Cities will be holding its General Membership Meeting in Inglewood On July 21; that those desiring to attend should contact the City Manager Pro Tempore. At 9:15 P.Mo Mayor Forman adjourned the meeting to an Executive Session on July 7, 1966 at 7 A.M. for the purpose of continuing the consideration of a new City Manager.
