AUGUST 16, 1966 The City Council of the City of Arcadia, California met in regular session in the Council Chamber of the Arcadia City Hall on August 16, 1966 at 8 P,M. Albert Berkompas, Elder of the Arcadia Christian Reformed Church Mayor Pro Tempore Robert J. Considine PRESENT: ABSENT: Councilmen Arth, Butterworth, Hage, Considine Mayor Forman The Minutes of the Regular Meeting of August 2, 1966 were APPROVED as submitted in writing on MOTION by Councilman Butterworth, seconded by Councilman Hage and carried unanimously. Application of Charles D. Collins, dba Transwestern Bowling Corporation, for a business permit to allow the operation of a bowling alley, billiard room, coffee shop, cocktail bar and a restaurant at 188 W. Las Tunas Drive. The location being that of the forme~Santa \,-....- Anita Bowl which has been closed for two months.. Mayor Pro Tempore Considine declared the hearing open. No one desiring to be heard the hearing was CLOSED on MOTION by Councilman Arth, seconded by Councilman Hage and carried unanimously. Following considerable discussion in which the City Council expressed its strong desire to restrict the serving and consuming of alcoholic beverages other than beer to specific areas, it was MOVED by Councilman Hage, seconded by Councilman Butterworth and carried unani- mously that the application of Charles D. Collins be APPROVED and that a business permit for a bowling alley, billiard room, coffee shop, cocktail bar and a restaurant at 188 W. Las Tunas Drive be issued subject to and upon the express condition that no alcoholic beverages, other than beer, be permitted to be sold, served, consumed or possessed on the premises except in the cocktail lounge and the bona fide restaurant area, if so licensed by the Alcoholic Beverage Control Board, and that in no event shall intoxicating beverages, other than beer, be permitted to be sold, served, consumed or possessed on the concourse, in the spectator section or in the area used for bowling itself, and that an affidavit be filed annually prior to the renewal of its permit to the effect that he is aware of this condition and is enforcing the same. Amended application of J. Edward Vander Meulen for a business permit to operate an exclusive social club at the Bowling Square, 1020 S. Baldwin Avenue, and to permit dancing in the recreation center therein (alcoholic beverages to be served in the area). The original application had been denied by City Council inasmuch as there is no 1. 8-16-66 17:6847 provision in the Arcadia Municipal Code for the wa1v1ng of the regulation prohibiting public dances where intoxicating liquor is served. Mr. Vander Meulen amended his application and is now seeking to operate a membership social club with dancing permitted, Mayor Pro Tempore Considine declared the hearing open and Mr, Vander Meulen as lessee of the Bowling Square outlined the proposed operation, explaining that the recreation room accommodates 260 persons; that he has been requested by many of his patrons for this additional recreational facility; that he would control the activity to the satisfaction of the City and would welcome surveillance and inspection at any time. He stated further that only those with membership cards would be admitted with their guests; that he would have a combo type of entertainment as part of the dancing facilities. He explored the physical layout of the establishment describing the separation of the cocktail bar from the concourse and the bowling lanes, I Discussion ensued on the family aspect of bowling and the Council's desire to see that alcoholic beverages other than beer are not served or consumed in any area outside the cocktail lounge or the restaura~t if there be one. It was agreed that dancing is a wholesome activity but concern was expressed that the patronage would be difficult to control, Mr. Vander Meulen assured the City Council that he would comply with the regulation pertaining to the area in which alcoholic beverages mayor may not be served or consumed. He was informed that the two other similar establishments in the City will be notified in this regard, No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Butterworth, seconded by Councilman Hage and carried unanimously. Councilman Butterworth stated in part that he would like to accommo- date the applicant, but that the City Council must do what is best for the community and that in his judgment Arcadia is not a community suitable for this particular type of operation; that it is akin to a night club and it would be extremely difficult to control the patronage; that if this application were approved, the City Council would have no basis on'which to deny applications for the same type of operation filed by other businesses of like kind; that for said reasons, in his opinion, the granting of the requested permit would be injurious, detrimental and harmful to the health, safety, morals and welfare of the City and the inhabitants thereof. Whereupon he MOVED that the application be DENIED for said reasons. Councilman Hage concurred and seconded the motion, Some discussion ensued on the right of the City Council to consider each application on its own merit with Councilman Arth of the opinion that it has such right, ,Mayor Pro Tempore Considine expressed his concern that persons of all ages including teenagers could gain ad- mittance to the recreation room although the applicant would make an earnest effort to supervise, He then called for the roll call vote: 1 AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine None Mayor Forman 2, 8-16-66 WAIVER OF CONDITIONS (Union Oil Company) p ~ ~up 1 . FIELD MEET /f',PK LMD Nos. 27 & 28 1 ACCEPTANCE OF..WORK (Osborn) !J. / / t/-t/ 17 : 6848 In granting a conditional use permit to the Union Oil Company for the removal of all existing facilities and the reconstruction of a residential type of two-bay service station on property located at 1127 S, Baldwin Avenue, the Planning Commission recommended the waiver of certain municipal code requirements (Resolution No. 595), as being inappropriate or not applicable to the intended use of the property in view of its proposed expansion, to wit: 1. The planter island on Baldwin Avenue and Duarte Road with a minimum width of three (3) feet along the Duarte Road side, 2. Parking requirements of Zone C-2 substituted for those indicated on the plan. It was MOVED by Councilman Butterworth, seconded by Councilman Hage and carried on roll call vote as follows that the requirements of Section 9275.4,5 and Paragraph 1 of Section 9275,4.11 of the Arcadia Municipal Code be WAIVED, as recommended by the Planning Commission in its Resolution No, 595: AYES: NOES: ABSENT: ABSTAIN: Councilmen Butterworth, Hage, Considine None Mayor Forman Councilman Arth, did not participate in the discussion or vote due to his affiliation with the subject Company. It was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried on roll call vote as follows that the request of the Horseless Carriage Club for permission to hold its annual Field Meet at the Santa Anita Race Track on Sunday, September 25, 1966 be APPROVED and that any fees connected therewith be and they are hereby WAIVED. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine None Mayor Forman In keeping with the annual policy of the City of forming Lighting Maintenance Districts for street lights installed within subdivisions and other projects during the past twelve months and incorporating Districts which expire at the end of the year, it was MOVED by Councilman Hage, seconded by Councilman Butterworth and carried unanimously that the City Engineer be instructed to file reports of costs and the District to be assessed in accordance with the pro- visions of the Municipal Lighting,Maintenance District Act of 1927, Division 14, Part 3 of the Streets and Highways Code, Said report to be filed September 6, 1966, Upon advice from the Assistant City Engineer and the City Manager Pro Tempore that the work as performed by Osborn Constructors in the improvement of Michillinda Avenue from Huntington Drive to Sunset Boulevard has been completed satisfactorily, it was MOVED by Councilman Arth, seconded by, Councilman Hage and carried on roll call vote as follows that the work be accepted and that final payment be made in accordance with the contract and it is hereby authorized. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine None Mayor Forman 3. 8-16-66 ACCEPTANCE OF EQUIPMENT (Waukesha) J/Oc9-0 OFFICIAL ASSESSED VALUATIONS ORDINANCE NO, 1326 Adopted ORDINANCE NO. 1327 Adopted 17;6849 Upon advice from the Water Manager and the City Manager Pro Tempore that the contract with Waukesha Motor Company for furnishing a gas engine prime mover for a pumping unit at St. Joseph Booster Pump Station has been satisfactorily completed, it was MOVED by Councilman Hage, seconded by Councilman Butterworth and carried on roll call vote as follows that final payment be and it is hereby AUTHORIZED in accordance with the terms of the contract: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine , None Mayor Forman 1 It was MOVED by Councilman Butterworth, seconded by Councilman Hage and carried unanimously that the certified assessed valuations for 1966-67 as submitted by the Los Angeles County Auditor-Controller be received and FILED. Said report reflected a Grand Total of $120,472,190. - an increase of 2.6% over the 1965-66 figure. Whereupon the City Attorney presented, explained the content and read the title of Ordinance No. 1326, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION FOR THE FISCAL YEAR BEGINNING JULY 1, 1966," MOTION by Councilman Butterworth, seconded by Councilman Hage and carried on roll call vote as follows that the reading of the full body of Ordinance No, 1326 be waived: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine None Mayor Forman Councilman Butterworth further MOVED that Ordinance No. 1326 be introduced and adopted. Meulen) -5~11 17: 6850 The City Council acknowledged the communication from Dr. Ray Allen Young setting forth some suggested physical improvements made by property owners to be affected by,the widening of Duarte Road between Holly and El Monte Avenues, The City Manager Pro Tempore advised that he had responded to Mr. Young informing him that the City will keep the property owners informed of developments as they progress. It was then MOVED by Councilman Butterworth, seconded by Councilman Hage and carried unanimously that the staff proceed along the lines outlined in the City Manager's communication dated August 10, 1966. Upon advice that the improvements in Tract No, 29178 (Oakdale Lane) have been completed in accordance with the requirements as imposed by the Planning Commission and the City Council it was MOVED by Councilman Butterworth, seconded by Councilman Hage and carried unanimously that the streets in said subdivision be accepted for maintenance by the City. In order to consider the following matter it was MOVED by Councilman Butterworth, seconded by Councilman Hage and carried unanimously that the provisions of the Procedural Ordinance be WAIVED. The City Attorney reminded the City Council that he had been authorized and directed to file condemnation on a total of five parcels of land for the widening of Duarte Road west of Baldwin Avenue; that the actions had been filed; that only this afternoon he had received an offer to settle one parcel (No, 22) at the price fixed by the City's appraiser; that he anticipated that other properties would likewise offer to settle at the price fixed by the appraiser. He advised further that in order to expedite the acqui- sitions and to avoid the necessity of bringing each one of the parcels before the City Council separately he would recommend that the staff be authorized to acquire each of said parcels at,the price established by the City's appraiser, Harrison Baker, Jr. Whereupon it was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried on roll call vote as follows that the staff be authorized to conclude the acquisition of parcel Nos. 2, 8, 12, 22, and 59 at a figure not in excess of that established by the City's appraiser, Harrison Baker, Jr" upon which the condemnation actions were instituted: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine None Mayor Forman J. Edward Vander Meulen addressed the City Council referring once again to his application for a business permit to hold dances for a Bowling Club at the Bowling Square, 1020 S, Baldwin Avenue, Although the City Council had denied his application for permission to hold nightly dances in a recreation room, he was advised of Section 6412.9 of the Arcadia Municipal Code which permits occasional dances by a Club, permission for which is granted by the License Officer and does not require City Council approval unless complaints are received. It was the consensus of the City Council that the denial of a nightly dance permit was not intended to preclude the issuance of permits to clubs under said section by the staff; that if the staff ever feels that the privilege under this section is abused or being avoided by subterfuge the staff can bring the matter to the Council, 5, 8-16- 66 ORDINANCE NO. 1325 ~ ADOPTED ~ '0U J\ RESOLUTION NO, 3893 Adopted :!J-sro RESOLUTION NO. 3894 Adopted p : 0-u.p 17: 6851 second The City Attorney presented for the ~ time, explained the content and read the title of Ordinance No, 1325, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING, THE ARCADIA MUNICIPAL CODE BY ADDING, TO DIVISION 2 OF PART 2 OF CHAPTER 5 OF ARTICLE VIII A NEW SECTION 8522,5 ENTITLED "HISTORICAL AND ARCHITECTURAL STRUCTURES." RESOLUTION NO. 3897 Councilman Butterworth presented and read in full Resolution No. 3897, entitled: "A RESOLUTION.OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, MEMORIALIZING THE SUPREME SACRIFICE OF PFC RODNEY CASSELMAN," Adopted MOTION by Councilman Butterworth, seconded by Councilman Hage and carried on roll call vote as follows that Resolution No. 3897 be adopted: 1 AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Hage, Considine None Mayor Forman ARTH Councilman Arth asked staff to look into a parking matter in the Rancho Santa Anita area. The parking situation surrounding the May Company was also discussed briefly with the City Manager advising that problems appear to be diminishing and that staff will continue its study of traffic and parking in the area, RAGE Councilman Hage noted the desire of the Planning Commission to meet 7, 8-16-66 , ADJOURNMENT 17 :6853 with the City Council. A definite date to be scheduled which will be convenient to all. At 9:50 P.M. Mayor Pro Tempore Considine adjourned the meeting to an Executive Session for the purpose of considering pending litigation, At 10:15 P,M."
