DECEMBER 6, 1966
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the Arcadia City RaIl on
December 6, 1966 at 8 P.M.

Mayor Pro Tempore' Considine presented on behalf of the legislative
body a plaque honoring Joseph C. Boggio for his years of service on
the Civil Defense and Disaster Board.
On MOTION by Councilman Arth, seconded;by Councilman Rage and carried
unanimously the minutes of the Regular Meeting of November 15, 1966
were APPROVED as submitted in writing.
It was MOVED by Councilman Butterworth, seconded by Councilman Rage
and carried unanimously that provisions of the procedural ordinance
be waived in order to take agenda items out of sequence for the
convenience of Councilman Butterworth who asked to be excused for
emergency reasons.
It was MOVED by Councilman Arth, seconded by Councilman Butterworth
and carried on roll call vote as follows that the City Council accept
the recommendation of the City Manager and the Purchasing Officer and
award the contract for the purchase of a truck-mounted aerial tower
in the amount of $15,051.49 to Wegge Motors; that all other bids be
1~ rejected; that any informalities or irregularities in the bids or
l~, bidding process be waived and that the Mayor and City Clerk be and
they are hereby authorized to execute a contract in form approved by

An appeal was filed by the owner of the Winslow Product Engineering
Co~poration from the decision of the Building Official, the Director
of Public Works and the Fire Chief in denying permission to occupy a
pa~t of a newly constructed addition to the plant located at 47 E.
St. Joseph Street prior to the installation of a sprinkler system.
Th~ City Manager summarized the report dated November 30, 1966 setting
fo~th reasons for denial based on Uniform Building Code Sections 306a,
306c and 306d providing that an occupancy permit may not be issued
until and unless all provisions are complied with, assuring the mini-
mUm safety standards as specified in the Code.
It was the consensus of the City Council that it was not of a mind to I
oV~rride the recommendation of the staff and it was therefore MOVED
by Councilman Butterworth, seconded by Councilman Hage and carried on
roll call vote that the appeal be denied.

Th~ City Attorney presented, explained the content and read the title
of Resolution No. 3916 entitled: "A RESOLUTION AND ORDER OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION
TO PAY OUT OF ITS MUNICIPAL FUNDS ONE HUNDRED PER CENT (100%) OF THE
AMOUNT OF TAXES TO BE DERIVED FROM THE AREA OF THE METROPOLITAN
WATER DISTRICT OF SOUTHERN CALIFORNIA WITHIN THE CITY OF ARCADIA FOR
THE FISCAL YEAR BEGINNING JULY 1, 1967, AS SUCH AMOUNT OF ,TAXES SHALL
BE FIXED IN AUGUST, 1967, BY RESOLUTION OF THE BOARD OF DIRECTORS OF
SUCH METROPOLITAN WATER DISTRICT."

The outstanding performance of the Arcadia High School Band in all of
its events and particularly in the recent winning over 73 other bands
in Long Beach was referred to by Mayor Pro Tempore Considine. It was
the consensus of the City Council that an appropriate communication
be directed to the Band commending it and expressing appreciation on
behalf of the City.
At 8:20 P.M. Councilman Butterworth took leave of the meeting.

Application for business permit to allow the installation and
'operation of one skill game (model car raceway) at the Santa Anita
Bowl, 188 Las Tunas Drive.
Mayor Pro Tempore Considine declared the hearing open and no one
desiring to speak to the matter the hearing was CLOSED on MOTION by
Councilman Arth, ,seconded by Councilman ~age ~nd, carried unanimously.
Whereupon it was MOVED by Councilman Arth" seconded by Councilman
Hage and carried unanimously that the application be approved and
that a business permit be issued to Robert R. Read for said instal-
lation and .operation.
An appeal was filed by Mrs. Lorraine Hiday from'the decision of the
Planning Commission and the Modification Committee in its denial of
permission to use a non-conforming laundry sign at 813 W. Huntington
Drive. The Planning Director explained the basis on which the request
was denied by said commission; that the sign had originally been in-
stalled without benefit of proper permits; that the property is now in
c-o and D zone (professional office use)that the business of a
laundromat is non-confirming but permitted to remain and that the
sign should comply with c-o zoning restrictions.
Mayor Pro Tempore Considine declared the hearing open and Mrs. Hiday
addressed Council to the matter, stating in part that she had
purchased the business as a package deal; that the sien had been
installed prior to the sale and she had not been aware of the
~ircumstances. She outlined improvements which she had made to the
business and stated it is imperative to the success of the laundry
, that it display sufficient advertising and mentioned that the sign is
already hidden to some degree by Some trees. She distributed pictures
of the building and its surroundings and asked for favorable
consideration of her ,~equ~st.
A representative of the A & A Sign Company stated in part that this
was the first time the Company had neglected to secure a permit prior
to installing a sign and attriboced it to the timing of the opening
by the new owner, Mrs. Hiday.
Ernest Knew, 809 W. Huntington Drive, owner and lessor of the subject
property asked that permission be granted for the continued use of the
sign in order to enable the business to be successful; that the
property represented his life savings and wa~ his income.
No one else desiring to be heard the hearing was CLOSED on MOTION by
Councilman Hage, seconded by Councilman Arth and carried unanimously.
The City Council studied the photographs which reflected a vast
improvement in the appearance of the building and observed that it is
a step in the right direction and indicated that the owner and
operator of the business express stability and permanency which is
most desirable and beneficial to the City. Whereupon it was MOVED by
Councilman Hage, seconded by Councilman Arth and carried unanimously
that the sign be permitted to remain, and that any banners which are
currently hanging from the trees be removed. It was noted that the
approval applies to this one sign only - no other signs to be displayed
or permitted.

ment of a portion of Duarte Road (1100 W. Duarte Road - southwest

At 8:50 P.M. a 5-minute recess was declared. The meeting reconvened
at 8:55 P.M.
Planning Commission recommendation concerning amendments to the
Zoning Section of the Arcadia Municipal Code as contained in its
Resolution No. 598. The public hearing portion of the matter was
closed on November ~and continued until this date.
Reference was made to intervening meetings with the Planning
Commission wherein Commission members expressed a desire to restudy
certain areas of the contents of said resolution, to the contents of
a letter from the local Chamber of Commerce objecting to certain
sections and to the fact that the two absent members of the legis-
lative body would not have an opportunity to consider and vote on the
recommendation.
With Councilman Arth and Rage in accord Mayor Pro Tempore Considine
referred the matter back to the Planning Commission for reconsideration \
and reexamination of the over-all conditional use division, the I
minimum building size (12,500 sq. ft.) and other minor items which
have been raised by staff which could then be worked out with the
Commission.
Planning Commission Resolution No. 601 recommending denial of a zone
variance application filed by Norman L. Scheinman to permit the
construction of a shopping center on property located at 250 W.
Colorado Boulevard.

adjacent properties are R-l and R-3 and developed with a motel, church
and a mixture of uses; that the granting of commercial uses as
requested in said location would be detrimental to the public health
and welfare and injurious to property or improvements in the vicinity

Planning Commission Resolution No. 602 denying the Application for
conditional 'use permit to enlarge existing convalescent facilities at
1601 S. Baldwin Avenue. The City Council accepted the matter as
information only inasmuch as an appeal had not been filed from said
decision.
Planning Commission Resolution No.' 603 recommending approval of an
application filed by Lum's of Arcadia, Inc., for a zone variance from
Section 9263.3.1 of the Arcadia Municipal Code to permit the conduct
of an outdoor eating establishment without providing the full amount
of parking required on 'property located at 1220 S. Baldwin Avenue.
It was noted that there are exceptional circumstances applicable to
subject property inasmuch as the property is an older development
surrounded by new development which has severely limited subject
property's ability to provide additional parking.
It was MOVED by Councilman Arth, seconded by Councilman Hage and
carried unanimously that the recommendation of the Planning Commission
be sustained.

Planning Commission Resolution No. 604 granting a conditional use
permit upon specified conditions to Lum's of Arcadia, Inc., to
construct and operate a restaurant with an open patio at 1220 S.
Baldwin Avenue and recommending the waiver of certain Municipal Code
requirements. Conditions upon which the application was approved are
set forth in said resolution.
The City Council accepted as information only the notice of the
approval, however, in order to waive the recommended Municipal Code
requirements it was MOVED by, Councilman Rage, seconded by Councilman
Arth and carried unanimously that the provisions of Title 3 and Title
5 and Section 9263.6.4 of Title 6 of Division 3 of Part 6 of Chapter 2
of Article IX of the Arcadia Municipal Code be waived for,the reason
that the strict adherence to said provisions would be inappropriate or
inapplicable to the intended use of the property in view of its
proposed expansion.
It Was MOVED by Councilman Arth, seconded by Councilman Rage and
carried unanimously that the final map of Tract No. 25615 be APPROVED
subject to continued compliance with the original conditions of
approval. Property located at 1101, 1111, 1131 South Second Avenue.
The City Council acknowledged receipt of a communication from,
R. D. Murray commending the police and fire departments in the
immediate and efficient handling of a recent incident.
The City Council delayed further deliberations on proposals for
additional water revenues until Saturday December 10.

Police Chief concerning an appropriation to cover expenses of extra
policing during the 1960-67 thoroughbred racing season be approved
and that the sum of $73,206 be appropriated from General Fund Unap-

was noted that the request is less than the appropriation for 1965-66.

Pursuant to the request of Harold K. 'Schone, former City Manager, it

It was MOVED by Councilman Arth, seconded b~ Councilman Hage and
carried unanimously that permission be granted the Arcadia Busines~
Association to install Christmas decorations on the center median
,light standards on Huntington Drive, from Santa,Anita Avenue tp
Second Avenue. Said installation to be to the satisfaction of the
Director of Public Works.
The City Council expressed the,hope that a,request such as this could
be submitted at an earlier date in the future.
The City Manager advised that the last 'official population estimate
was in December 1963 which 'set the population of the City, at 47,100;
that recent discussions with the State Agency' 'indicate that a current
estimate might raise this figure slightly. He recommended the
preparation of a new estimate as 'of December 1, 1966 and the co~tract
cost 'with the State to be $270.

on roll call vote as follows the following'Minute Resolution was
adopted:

Upon the advice of the City Manager that the City of Sierra Madre had
altered its position on reaching' an'agreement with the County Flood
Control District to improve the ability of the Sierra Madre Wash to
handle excessive water, it was MOVED by Councilman Hage, seconded
by Councilman Arth and carried unanimously that the Mayor and.City
Manager be and they are hereby authorized to submit a letter to the
Sierra Madre City Council informing'it of the City's concern and
requesting that continued efforts be made to 'reach an agreement with
the District providing greater protection to Arcadia.

The City Council concurred in the Manager's suggestion that the
proposed study of the Towne Center be postponed; that he had received
information that a report will be made by a private firm on the feasi-
bility of a Department Store in the area. The City Council expressed

a desire to peruse such a study if and when available. Hence, the
Agreement authorized for execution on November 15, 1966 with
Jerry A. Rogers, consultant, will not be exercised at this
time.
The recommendation of the City Manager I concerning a changed
assignment and reclassification of a clerk-typist position to that
of clerk-steno was APPROVED on MOTION by Councilman Arth, seconded

It was noted that the clerk-typist has been assigned full time to the
Business License and Purchasing Office and by changing the classi-
fication it will be possible to utilize the employee in other
departments during work load periods, vacation and the like. Budget-
ary transfers will not be required until the end of the year at which
time the work distribution will have been determined.
Don Ehr, former member of the City Personnel Board, inquired whether
or not the aforementioned matter had been before the Board prior to
its submission to the City Council. He was informed that it had not.
Discussion ensued on which agency acts first with Councilman Considine
stating in part that in his mind there is a question as to whether or
not the Board should review classifications and assignments of
changes and then submit its recommendations to the City Council; that
if the Council misuses various boards and/or commissions they lose
their utility to the Council; that if matters such as this are not to
go to the Board it should be clearly defined so that the Board and all
concerned will understand.
The City Attorney and the City Manager referred to the responsibilities
of the Personnel Board as set forth in the City Charter and discussion
was held on whether or not reorganization, reassignment of responsi-
bilities and procedural changes should first be submitted to the
Personnel Board, in which case the Charter would have to be revised
in that particular area.
The City Council concurred in Councilman Considine's suggestion that
liaison for the Council on the Personnel Board, Councilman Butterworth,
explain to the Board the reasoning in this instance; that it is not
the desire of the Council to bypass the Board. Clarification of
policy relating to the subject matter to be prepared.
The City Manager summarized the report of the Director of Public
Works dated November 30, 1966 recommending installation of traffic
channelization at the intersection of Baldwin Avenue and Duarte Road.
He explained that at the request of the West Arcadia Business &
Professional Association and other interested individuals, the
Engineering and Police Departments conducted traffic studies to
determine improvements necessary to promote traffic safety and reduce
vehicular congestion in said area. The report incorporated accident
records from October 1958 to date and reveal an average annual
increase from five to fourteen accidents during the past five-year
period. The recommended channelization would provide two through
lanes and a left turn storage bay in each direction.

Paul Beckquist, owner and operator of a camera shop located at
672 W. Duarte Road, asked Council to consider the position of the
shop owners on the south side of Duarte Road just east of Baldwin
Avenue; that customers currently are permitted to park directly in
front of the shops for short periods of time; that there is very
limited parking in the rear of his store. fie expressed concern that
the new traffic regulation prohibiting_parking in the stalls referred
to would adversely effect his business.
Don Ehr, Assistant Store Manager for Hinshaw's Department Store and
representing the Arcadia Parking, Inc., and,the West Arcadia Business
& Professional Association, stated in part that for many years they
have been asking for left turn lanes at the subject intersection;
that it is the only intersection on Duarte Road in the City without
such lanes; that the safety and improved traffic flow will far out-
weigh the few parking spaces which will be lost; that the proposal is
wholeheartedly supported and urged approval of the plan.
Arlene Herbert, 1206 S. Baldwin Avenue, stated that she felt the plan
would be detrimental to her business as she caters to family trade
and expressed the need for adequate parking for her customers.
Russell Augsburger, 676 W. Duarte Road, stated in part that the
situation is becoming more hazardous and urged app:oval.
Lee Tidwell, 674 W. Duarte Road, referred to the customers who make
brief stops in the parking stalls proposed for elimination by the
ptan - and asked for some assistance in the parking situation.
Fred Nelson, Manager of the West Arcadia Bank of America, referred to
ample parking in the rear of the stores on the east side of Baldwin
Avenue; that perhaps some method could be devised for customers to
use the area by eliminating the all-day parking by employees of
surrounding stores. The removal of the existing Edison poles was
also explored as a means of providing more parking in the lot.
It was the consensus of the City Council that studies and reports
indicate the urgent need for traffic channelization at the subject
area and that steps should be taken to assist in providing parking
for the customers of the small stores. Whereupon it was MOVED by
Councilman Hage, seconded by Councilman Arth and carried on roll call
vote as follows that the traffic channelization of the Baldwin and
Duarte intersection proceed; that the Planning Commission study the
scope and make recommendations on the parking problem and that the
City Attorney work with the Association in arriving at some type of
control of parking in order t~ secure maximum utility therefrom.

is hereby authorized in accordance with the terms of the contract.

The City Council accepted the annual financial report (1965-66) as
submitted by the City Manager.
The employment of an engineering firm to recommend on the needs of
the Water Department was deferred to the adjourned meeting of
December 10, 1966.
James Winslow, owner and operator of an engineering firm at 47 E.
St. Joseph Street, asked for reconsideration of the denial of his
request for the issuance of an occupancy permit of the new concrete
block steel roofed insulated building addition to his plant. He
stated in part that he desires to move in some machinery prior to the
completion of the installation of a sprinkler system as required by
Code. He distributed a copy of an agreement with the company doing
this work which indicated completion in approximately 60 days. He
referred to pressure from the defense industry to which effort his
business is directly related.

He explained that if there be a fire hazard it would be to his own
operation because the building is far removed from anything else in
the immediate area; that there is nothing combustible inside the
building and that fire extinguishers are maintained therein. He
concluded his remarks by asking if there would be any condition under
which he could operate his business during the period of sprinkler
installation.
The Director of Public Works stated in part that the problem is
primarily one to be basically determined by the Fire Chief who is the
expert in this particular field and suggested that a meeting be held
with the Building Official, the Fire Chief and Mr. Winslow to
ascertain what if anything would be acceptable in lieu of or in
substitution of the requirement.
Councilman Considine expressed understanding of the problem faced by
Mr. Winslow and stated in part that he would like to assist him if at
all possible without jeopardizing personnel or surrounding property
and suggested that a study be made to determine under what conditions
it would be safe to operate without undue hazard recognizing that the
sprinkler system is being actively worked upon.
It was Councilman Arth's and Hage's feeling that in view of the report
from the staff and their deep concern from a safety standpoint they
could not reverse the recommendation of those entrusted with seeing
that the code requirements are complied with.

The matter of reconsideration of the decision was placed on the agenda
for the adjourned regular meeting (December 10) and during the interim
staff will make detailed inspections of the new structure to determine
if a temporary permit could be granted based upon the statement by
Mr. Winslow that the permanent sprinkler system will be installed in
approximately 60 days.
The City Attorney presented for the second time, explained the content
and read the title of Ordinance No. 1332, entitled: "AN ORDINANCE OF
