CITY COUNCIL OF THE CITY OF ARCADIA
ADJOURNED REGULAR MEETING
DECEMBER 10, 1966
Pursuant to the order of adjournment of the regular meeting of the
City Council of December 6, 1966, the City Council of the City of
Arcadia met in adjourned regular session on December 10, 1966 at
9 A.M., in the Conference Room of the City Hall.,

The City Manager summarized in detail his report dated December 2,
1966 covering areas for Council consideration in deliberating the
need and possible source of additional revenue to finance city
membership in the Metropolitan Water District and to finance and
determine priority in capital project needs of the water system (all
material on file in the office of the City Clerk). The recapitu-
lation of proposed rate revisions (attached hereto) reflected bi-
monthly billings indicating cost per cubic feet and increase over
present costs, all based on meter sizes and broken down into
different plans. It was particularly noted that the water rate for
Plan 'B' would be 19~ per 100 cubic feet and all other plans would
be l8~ per 100 cubic feet.
Concerning capital project needs, he stated in part that although the
so-called Montgomery report has not as yet been updated it was noted
that re-examination of both capital needs and replenishment costs has
resulted in a showing of increased dollar needs rather than a
reduction; that the rate recommendations revolve around approximately
an annual need of $227,000; that it must be determined if that amount
would accomplish the anrua 1 need s over a period of the next seven
years. It was his observation that it would.
Mayor Forman retired from the meeting at 9:30 A.M.
Conrad T. Reibold, 272 W. Longden Avenue, former City Councilman and
the City's representative on the Upper San Gabriel Valley Water Ass'n.
stated in part that if Council is convinced that an urgency exists he
would suggest placing the amount necessary on the property taxes. He
referred to non-water users like the May Company and the new Pantry
Market development and compared what the City would receive for the
purpose if placed on water bills and what the City would receive if
it were based on the assessed valuation of property. He also remarked
that the City would be charged in the lawsuit accounting with the
total gallonage pumped under the Basich Lease, but the pumpers will
not pay any portion of the City's financial obligation even though
the City's obligation be increased by their pumpage. He did not feel
that the standby concept of rate making was appropriate for water.
Mayor Forman returned to the meeting at 9:50 A.M.
Considerable discussion was held on whether or not all or part of the
charge should be placed on the ad valorem tax or raised by one of the

various methods set forth in detail on the recapitulation summary.
It was the consensus of the City Council that a plan be adopted at
this time which would raise the necessary revenue for operation,
mainten~nce and capital projects for this year; that after the
completion of the updating of the report on capital project needs of
the water system that further considerations be undertaken by the
Council. Mayor Forman then called for a poll of the Councilmen's
preference in the proposed plans:
Councilman Butterworth stated in part that he was categorically
against raising water rates for the purpose of discharging the City's
charge for the Metropolitan Water District assessment, but since the
rest of the Council had voted otherwise to require that the assessment
be met from water revenue that in his opinion Plan 'A' was the most
acceptable and least burdensome plan from the standpoint of the
homeowner and consequently be favored Plan 'A'. (He later voted with
the majority for Modified Plan 'H'.)

Councilman Hage favored Plan 'B' and stated in part that he would
like to see more of the charge borne by the actual water user rather
than on a standby basis; that in his opinion this is not the time to
place it on the tax bill but wait for developments during the year.
Councilman Arth favored Plan 'B' with some modifications as he would
rather see the water rate increased by l~ per 100 cubic feet and
reduce the minimum thereby deferring any increase at this particular
time.
Councilman Considine favored Modified Plan 'H' and stated in part
that as long as the Council has already determined that the charge
should be raised through water revenue that in his opinion most of
the charge should be left in the water billing structure so the
people may follow what the City is doing and understand the logic
behind it; that if there is need for additional funds in the future
there is still the water rate to work with or go the ad valorem tax
route.
Mayor Forman favored Modified Plan 'H' and felt strongly that the
charge should be borne by the water users and not placed on the
property taxes; that during the coming year developments may alter
the situation.
Whereupon it was MOVED by Councilman Considine, seconded by Council-
man Butterworth and carried on a 3 to 2 vote as follows that the City
Council adopt Modified Plan 'H' for the ensuing year. (Ordinance
No. 1333 INTRODUCED later in the meeting - see Page 3.)

Director of Public Works and the Fire Chier made detailed inspections
of a new structure nearing completion at 47 E. St. Joseph Street and
the existing buildings attached and affected by the new addition.

completion of the structure by the installation of an automatic' fire
sprinkling system as required:
1. The automatic fire sprinklers' required 'by' the Building
Code and contemplated under Building Per~it ff2l436 are
completed throughout structures A, B & C, as'noted on
'the plan's submitted and approved for the aforesaid
Building Permit by not later than February 15, 1967.
2. That occupation of the new structure be limited to the
westerly 15 feet of said new structure and the most
westerly office known as the "Shop Foreman's New Office".
3. That prior to limited occupation,as set forth in #2 above,
heat detector fire alarm devices be installed in number,
locations and type meeting with the full approval of the
Fire Department.
4. That prior to limited occupation as set forth in #2 above,
portable fire extinguishing equipment ,be installed in
'number, location, size and type as p:escribed by the Fire
Department.
It was noted that the owner concurs with the conditions.
will be issued a temporary occupancy permit to allow him

The City Manager advised that the Citizens' Advisory Capital Projects
Committee and the City Council in study sessions agree with staff
recommendations that the 1958 analysis of capital needs for the water
system be updated promptly; that two proposals have now been received
for performing this work, 1) James M. Montgomery and 2) Wilsey & Ham,
both consulting firms.
It was noted that the firm of James M. Montgomery made the original
evaluation which was highly satisfactory to the City Council at the
time and should be in a position to update their work with a
sU9stantial carryover of information previously compiled, whereupon
it was MOVED by Councilman Arth, seconded by Councilman Considine and
carried on roll call vote as follows that the firm of James M.
Montgomery be employed to analyze the capital project needs of the

The City Attorney presented for the first time, explained the content
and read,the title of Ordinance No. 1333, entitled: '''AN ORDINANCE OF

7531.1, 7531.1.1, AND 7531.2 OF THE ARCADIA MUNICIPAL CODE WITH
RESPECT TO WATER RATES."

and carried on roll call vote as follows that the reading of the full
body of Ordinan~e No. 1333 be waived:
