HomeMy WebLinkAboutJANUARY 26,1967 I ROLL CALL ANNEXATION NO. 40 INHABITED ~//6;U I 17 :6946 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA SPECIAL MEETING JANUARY 26, 1967 Pursuant to the consent to and waiver of Notice of Special Meeting of the City Council, signed by all members of the City Council, and on file with the City Clerk prior to 7 p.m., a special meeting of the Arcadia City Council was called to order by Mayor Forman at 7 p;m. on January 26, 1967, in the Council Chamber of the Arcadia City Hall. PRESENT: ABSENT: Councilman Arth, Butterworth, Considine, Rage, Forman None The City Manager advised that he had received a communication dated January 26, 1967 signed by three property owners and residents of a specific area requesting annexation to the City; that he also had on file a prior petition containing 630 signatures of residents in the same territory requesting annexation to theCity; that the area is between Michillinda Avenue and Rosemead Boulevard, and between Foothill Boulevard and the Temple City boundaries, and includes the Anoakia School area on Foothill Boulevard. It was suggested that inasmuch as the Planning Commission is in an adjourned session at this'particular time, the proposal be referred to the City Planning Commission for its report or recommendation. Whereupon it was MOVED by Councilman Butterworth, seconded by Councilman Considine and carried unanimously that the matter be referred to the City Planning Commission for report or recommendation as required by the Government Code. The City Attorney therefor explained the initial steps involved in the annexation of inhabited territory. Councilman Arth stated in part that he was opposed to taking any action on the proposed annexation in this manner; that although he had concluded in his own mind that it would be better for the City of Arcadia to have full control of the subject area, he would support the proposal only if the residents of Arcadia and those within the proposed annexation territory had first been given an opportunity to be heard on the matter; that he also felt the study which had been prepared by the combined efforts of the Cities of 'Pasadena and Arcadia (dated September 1966) should be reviewed by the City Council before moving ahead; that it would not be showing good faith with Pasadena to do otherwise. It was pointed out by the City Attorney that any action taken at this meeting would only approve the filing of the proposal with the Local Agency Formation Commission; that after approval of that Commission, notice of intent to circulate an annexation petition, the circulation of such petition, the holding of a protest hearing, and the holding of an election by the residents of the subject area must follow. 1. 1-26-67 RESOLUTION NO. 3924 Adopted ~ 1D'fJ J \\ ADJOURNMENT 17 :6947 Councilman Butterworth observed in part that, in his op~n~on, this is a prov~sional step to preserve the City's legal position, subject to later full public hearings; that he will listen to the people and feel free to change his position if during the hearings it is dis~losed that it is in the best interests of the City to change that position. Reference was made to areas being considered in the proposed annexation, especially the Anoakia School property (now a County island for all practical purposes), and the area west of Michillinda Boulevard (now mainly residential), the annexation of which would permit theCity to control the zoning and development thereof. I The Assistant Planning Director returned with the report and recom- mendation of the Planning Commission, which was thereupon discussed. It was then MOVED by Councilman Butterworth, seconded by Councilman Considine and carried unanimously that the report be received and duly filed. Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 3924 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION TO THE CITY OF ARCADIA OF CONTIGUOUS INHABITED TERRITORY DESIGNATED AS ANNEXATION NO. 40, WEST ARCADIA INHABITED." MOTION by Councilman Hage, seconded by Councilman Considine and carried on roll call vote as follows that the reading of the full body of Resolution No. 3924 be waived: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Hage, Forman None None Councilman Hage further MOVED that Resolution No. 3924 be adopted. Motion seconded by Councilman Considine and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Butterworth, Considine, Hage, Forman Councilman Arth None It was noted by the City Attorney that the foregoing only commits the City Council to the filing of the annexation proposal with the Local Agency Formation Commission of Los Angeles County, and that the City Council will have the power to terminate the proceedings at any time prior to the election within the territory.
