REGULAR MEETING
APRIL 18, 1967
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the Arcadia City Hall on April 18,
1967 at 8 p.m.

On MOTION by Councilman Considine, seconded by Councilman Arth and
carried unanimously the Minutes of the Regular Meeting of April 4,
1967 were APPROVED as submitted in writing. Councilman Butterworth
abstained from voting as he was absent from said meeting.
Councilman Hage presented special awards to members in attendance on
the Citizens Advisory Auditorium Committee.
Mayor Forman presented awards to members in attendance on the
Citizens Advisory Capital Projects Committee.
Councilman Arth presented awards to members in attendance on the
Citizens Advisory General Plan Committee.
Councilman Considine presented awards to members in attendance on the
Citizens Advisory Land Committee.
Reports of the above committees have been submitted to the City
Council.
Special award was presented to the Arcadia High School Band in honor
of its outstanding performances during the past year.
Prior to the election of the new Mayor for the ensuing year, Mayor
Forman expressed his appreciation for the cooperation and confidence
of the City Council, the City Clerk, City Attorney, City Manager and
all members of the staff during his tenure as Mayor, for the patience
and understanding of his wife, Carol, and his family; also for the
opportunity of working with the citizens in an effort to resolve
their problems and for the experiences in connection with the office
as presiding officer during the last year.

Mayor Considine declared the hearing open on Planning Commission
Resolution No. 608 concerning conditional uses and recommending the
amendment of the Arcadia Municipal Code therefor.
Indicating a desire for additional information it was MOVED by
Councilman Butterworth, seconded by Councilman Forman and carried
unanimously that a staff report be prepared and submitted for
consideration at the next regular meeting (May 2, 1967),
Mayor Considine declared the hearing open on Planning Commission
Resolution No. 609 recommending the amendment of the Arcadia
Municipal Code with respect to zoning regulations as they pertain to
Zones C-l, C-2, C-M and M-l. No one desiring to speak to the matter
the hearing was CLOSED on MOTION by Councilman Forman, seconded by
Councilman Arth and carried unanimously.

It was MOVED by Councilman Forman, seconded by Councilman Arth that
the recommendations contained in Planning Commission Resolution
No. 609 be APPROVED.
Prior to vote the Planning Director recommended the amending of
Arcadia Municipal Code Section 9261.3.1 in order for the proposed
provisions to also apply to the Zone C-O section of the zoning
ordinance. Whereupon it was MOVED by Councilman Forman, seconded by
Councilman Arth that the motion be amended to include said Zone C-O.
The primary motion was then unanimously carried.
Planning Commission Resolution No. 6l0-A recommending that the
properties bounded by Santa Anita Avenue, California Street, First
Avenue and Duarte Road, remain in their present classification and

that the proceedings instituted by said Commission for the
elimination of "H" zone therefrom be terminated.
Councilman Butterworth stated in part that a considerable amount of
discussio~ had been held on the matte~ and refer~ed to hearings
conducted by the Commission. He noted that the recommendation is
by a majority of the commission Wherein it was suggested that the
question be considered within the fr'amework of the' proposed general
plan. Whereupon he MOVED that the recommendation of the Planning
Commission be accepted and FILED. Motion seconded by Councilman
Forman and carried unanimously.
Donald S. Camphouse, 1770 Oakwood Drive, Chairman of the Citizens
Advisory Capital Project Committee, submitted its report reflectihg
projects recommended for development over a five year period, as far
as practical. It was MOVED by Councilman Forman, seconded by
,Councilman Arth and carried unanimously, that the ,eport be accepted
and reviewed during budget consideration sessions, The Committee
was commended for i~s efforts on behalf of the City.
On MOTION by Councilman Forman, seconded by Councilman Butterworth
and carried on roll call vote as follows, the contract for the
purchase of ten poli~e patrol cars, one station wagon and one 2-door
sedan in the total amount of $18,955.36 (to' include heavy duty,
roller-type, rear wheel bearings for the police cars and oil pressure
gauges for all vehicles) was awarded to Mackaig and Sons. All other
bids were rejected and any irregularities or informalities in the
bids or bidding,process were waived and the Mayor and City Clerk were
authorized to 'execute the contract in form approved by the City
Attorney. It was noted that trade-in allowances were reflected in'
the total amount of the bid.

Funds are available in the respective budgets - Police Department's
share $15,124.52, Fire Department's share $2,070.13 and Water
Department's share $1,760.71.
It was MOVED by Councilman Hage, seconded by Councilman Arth and
carried unanimously that the recommendation of the Director of
Public Works and the City Manager pertaining to increased plan check
fees and street cut deposits be APPROVED and'that the City, Attorney
prepare revisions to the Arcadia Municipal' Code as outlined in the
report of April 13, 1967. ' .
The City Manager and the Director of Public Works advised of the
acquisition of agreements of, purchase and sale covering property as
listed herein in connection with the widening of Duarte Road between
El Monte and Holly Avenues; that the cost of acquisition will be

It was MOVED by Councilman Butterworth, seconded by Councilman Arth
and carried on roll call vote as follows that the City Manager be
authorized to proceed with the various steps necessary to consummate
said acquisition and to execute all legal documents, in form approved
by the City Attorney, and that payments be authorized to the property
owners at such time as the documents have been executed and are ready
for recordation of the actual transfer of property.

The City Manager and Director of Public Works presented a report of
projects presently budgeted, gas tax funds available and the
recommended 1967-68 budget. On MOTION by Councilman Butterworth,
seconded by Councilman Forman and carried on roll call vote as
follows the recommendation as reflected in the report dated April 13,
1967 was approved as the gas tax program for the ensuing fiscal year.

George McGill, representing the new owners of Bowling Square, Inc.,
1020 S. Baldwin Avenue, requested a temporary business permit to
allow them to operate immediately as a convenience to the bowlers who
are presently participating in league tournaments. He stated that he

will make formal application in compliance with the City's regulation,
but that the procedure will take about two weeks to place ,the matter
pefore the City Council. He advised that he was aware of and would
comply with the prohibition against the serving of alcoholic
peverages on the concourse, spectator section and the bowling area
itself and would sign an affidavit to'that effect.
Whereupon it was MOVED by Councilman Butterworth, seconded by
Councilman Hage and carried unanimously that the City Manager be and
he is hereby authorized to issue a temporary business permit for a
period not to extend beyond the next regular City Council meeting
(May 2, 1967) after the City Manager has assured himself that it is
proper to issue such a permit. The City Attorney will prepare the
appropriate ordinance providing for temporary permits, said ordinance
to be in effect for 45 days only.
Bob Nickel, 542~ Fairview Avenue, asked what the objections were
concerning night racing at Santa Anita Race Track. He stated in his
opinion it would help the local tax structure; that he is currently
employed at the track and in answer to his question about the
possibility of other sporting events he was advised that it depended
on the type, the hours and the like.
Councilman Arth stated in part that the local residents and those of
surrounding areas did not desire night racing and mentioned problems
of noise, excessive night traffic which could create a hazard for
police and fire emergencies; that in his opinion it would downgrade
the city and would be similar to a carnival operating at night.
Councilman Considine stated in part that the race track revenue has
helped the city's financial situation substantially through the
years, but that the revenue from night racing would not offset the
increased traffic or noise levels.
The City Attorney presented for the second time, explained the content
and read the title of Ordinance No. 1341 entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION
8130.5 OF THE ARCADIA MUNICIPAL CODE (BUILDING PERMIT FEES).

The City Attorney had prepared Resolution No. 3931 per instructions
from Councilman Arth who felt that it simplifies the original
resolution which had been adopted on the same matter; that as drawn
the City would be saying to the State that the community is opposed
to night racing and if the bill passes, the City requests local
option be given to the community to accept it or not. He felt it is
incumbent upon the City Council to take stands on problems such as
this.
Councilman Forman expressed concern about taking formal action at
this time; that if the bill eventually does pass there is a 90-day
waiting period before its effectiveness; that a Charter City can
move fast to make any amendments it might feel necessary for the
protection of its citizens; that he was concerned with the 'local
option'; that perhaps the same result could be obtained by writing
individual letters by the Councilme:c and individuals.
Councilman Butterworth reminded the City Council that he had brought
,up the same matter some six to eight weeks ago and had specifically
asked for the adoption of a resolution opposing not only night racing
but any extension of the racing season; that it was the opinion of
the Council at that time that such action should be delayed until
the Planning Commission had announ~ed their proposal against night
racing; that the Commission is not taking action at this time and
that he still' favors and supports Council action stating its
opposition to any extension of the racing. season, nighttime or
otherwise. That he is reasonably satisfied most of the citizens
would be against any extension.
Councilman Hage stated in part that he was totally 'in agreement with
the resolution, but that at one of the Planning Commission meetings'
a representative of the Race Track had made the statement that any
premature resolution on the City's part would hurt the track's
opposition to night racing in Sacramento; that he felt the
Assemblyman and Senator representing the area were opposed to night
racing.
The City Attorney commented that he understood the appearance of the
attorney for the track at the Commission's meeting. was in oppositi~n

to the adoption of a resolution which would amend the zoning
ordinance at this time to preclude night racing upon the theory that
it weakened the track's position before the legislature; that he
would have taken it to mean that they would appreciate the City's
support in their stated position that they oppose night racing
themselves.
Mr. Mauch, 891 W. Huntington Drive, spoke briefly stating in part
that ',e did not think the track was in favor of night racing, but that
he would think the majority of the residents would favor it, but that
he did not believe it would come to the City, as night racing does
not do well on a large track, needing a more confined area.

Councilman Forman then moved to defer any action on the resolution
until the State Assembly has taken action. Councilman Hage seconded
the motion and inquired if an opinion could be obtained from the
track officials; that he would like to see the matter continued
until the next regular meeting. Councilman Arth was against
deferring, that if action is to be taken it should be done before
the bill is passed.
Councilman Forman then amended his motion to postpone action on the
resolution until the next regular meeting of the City Council in
order for all members to study the bill. Councilman Hage seconded
the motion which was carried on the following roll call vote.

Notification to be forwarded to the Local Agency Formation Commission
that Mayor Robert J. Considine is now the presiding officer of the
City.
The City Manager advised of an invitation to witness a demonstration
of the Sierra Madre Rescue Team.
On MOTION by Councilman Forman, seconded by Councilman Arth and
carried unanimously the request of the Interrational Brotherhood of
Electrical Wor~ers for the waiving of the required admissions tax to
be charged for' ~ picnic to be held at the rafe track on May 13 be
granted; insurance covering all activities to be provided, proper
safety precautions to be taken in all archery booths and trap
shooting facilities, and that no speed events be permitted involving
animals or machines.
On MOTION by Co'uncilman Forman, seconded by Councilman Butterworth
and carried unanimously provisions of the procedural ordinance were
waived in order to consider the following items.

carried on roll call vote as follows, the City Council approved the
City Manager's recommendation that the City absorb the deficit in
the operational cost of the swimming pool on high school property
for the balance of the year - approximate figure $564. It was noted
that a study will be made at a later date of the hours and charges.

Mayor Considine asked Councilmen Forman and Hage to attend a meeting
with Pasadena City officials on April 26 at Eaton's Restaurant to
discuss the proposed annexation. It was noted that the hearing
before the Local Agency Formation Commission was continued until
May 24.
For the record: "I wish to commend you, Mayor Forman, on a very fine
job during the past year. You have certainly devoted long hours and
have given of yourself very generously. I hope I can do as well."

He then asked for the preference of the individual Councilmen as to'
which Board and/or Commission he would like to serve as Council
liaison; that he would attempt to comply and that he would endeavor
to place a heavier assignment to the new councilmen to give them
varied activity.
At 9:58 p.m. Mayor Considine adjourned the meeting to Sunday
April 23, 1967 at 8 p.m. in the Conference Room.
