Considine PRESENT: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None MOTION by Councilman Arth, seconded by Councilman Butterworth and carried unanimously that the Minutes of the regular meeting of October 3, 1967 be approved as submitted in writing. Application of the Arcadia Convalescent Hospital by Orlando Clarizio, as owner, was filed with the Planning Commission requesting a conditional use permit for the expansion of the existing hospital complex on property located at 1601 S. Baldwin .Avenue, and for the construction of a retirement home at 710-734 W. Camino Real. It was noted in Section 1 of Planning Commission Resolution No. 620 recommending the granting of said conditional use permit that although a prior application for similar use was denied particularly because of its proposed extension to the residential properties to the south, the site design presently proposed includes features which indicate a high level of desirability in terms of compatibility with adjacent properties; that the use requested is proper for the location; that th~ site is adequate in size and shape to accommodate said use and that the granting of such use permit will not adversely affect the comprehensive general plan. It was also set forth in Section 2 of said resolution that the recommendation for approval of said application was subject to compliance with all applicable regulations of the Arcadia Municipal Code except such 'portions of Part 5, Chapter 2 of Article IX thereof as may be waived by the City Council and upon numerous additional conditions spelled out therein. It was MOVED by Councilman Forman, seconded by Councilman Hage that the recommendation of the Planning Commission be sustained; that portions of the Arcadia Municipal Code requirements set forth in Part 5, Chapter 2 of Article IX be waived as being inappropriate and not applicable and that a conditional use permit be granted the applicant upon conditions specified in Planning Commission Resolution No. 620. It was Councilman Arth's observation that the proposed number of accommodations (252) would result in too much density for the type of operation in ,the particular location. 1. 10-18-67 t"" TRACT NO. 26886 Tentative Map .:;.: 1 j/. I..... ..,:. - M (.", ~ 17:7120 Following clarification of some of the conditions to be imposed, roll call was taken: AYES: NOES: ABSENT: Councilmen Butterworth, Forman, Hage, Considine Counci lman Arth None The Planning Commission, in recommending approval of this tentative tract proposed for property located at 343 W. Colorado Street, noted that the subdivider failed to record the map within the one year time period from the date of the original approval of the tentative map (June 7, 1966) and that the same conditions of approval be imposed at this time. The City Manager and Acting Director of Public Works recommended the following additional conditions in view of the timing and location of said tract. 1 1. Work within the Colorado Street right-of-way be confined to Mondays and off-peak hours during the racing season, and no work to be done on Saturdays or holidays during that same period. 2. Bonds in the amount of the estimated cost of improvement conditioned upon the faithful performance of ' the subdivision agreement. The bonds are to be released upon filing of a' Notice of Completion by the developer subsequent to acceptance of the improvement by the City Council. It was MOVED by Councilman Rage, seconded by Councilman Arth and carried on roll call vote as follows that the tentative map of Tract No. 26886 be APPROVED subject to conditions as imposed Ju~~., 7', 1966 plus two additional conditions as outlined above. ':.,', AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Rage, Considine None None The following bids were received on October 16, 1967, for the reconstruction, realignment, and signalization of the intersection of Naomi and Baldwin Avenues, the lowest bid being made by Paul Gardner Corporation in the amount of $17,869.28. Rahn $17,869.28 17,911.28 20,087.55 20,246.00 MOTION was made by Councilman Arth, seconded by Councilman Hage and 1 carried on roll call vote as follows that the City Council accept the recommendation of the City Manager; that a contract for said intersection be awarded to Paul Gardner Corporation in the amount of $17,869.28; that all other bids be rejected; that any ,irregularities, or informalities in the bids or bidding process be waived, and that the Mayor and City Clerk be authorized to execute such contract on behalf of the City for the performance of the contract and in the 'amount specified, in form approved by the City Attorney; and all other bid deposits be returned. Funds are provided in the 1966-67 Budget, Capital Improvement Projects Account #253 - Baldwin Avenue/ Naomi Avenue Street Construction. It was agreed that time is of the essence in view of what lies ahead on the proposed revisions; that the project should progress poH,",~. haste and should be accomplished as economically as possible. Whereupon it was MOVED by Councilman Forman, seconded by Councilman Arth and carried on roll call vote as follows that the law firm of Martin & Flandrick be employed at a rate of $25.00 per hour, not to exceed one hundred (100) hours without further authority of the City Council, and that the principals personally do the work. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None None MOTION by Councilman Forman, seconded by Councilman Hage and carried unanimously that the City Council grant permission to the Santa Anita School PTA to hold its annual carnival on Saturday, October 28 from 12 noon until 6 p.m.; that any permit fees be waived. Evidence of blanket insurance coverage to be made available to the City. MOTION by Councilman Forman, seconded by Councilman Hage and carried unanimously that the City Council grant permission to the Highland Oaks School PTA to hold its annual carnival on Saturday, October 21; that any permit fees be waived. Upon recommendation of the City Manager it was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried unanimously that the First Church of Christ, Scientist be permitted to place temporary signs on its property for the purpose of advertising three lectures. The Church is in the process of constructing its new facilities. The signs are to be placed and removed on the following dates: Placed October 21, 1967 January 13, 1968 April 2, 1968 Removed November 5, 1967 January 27, 1968 April 17, 1968 Upon recommendation by the Acting Director of Public Works and the City Manager Pro Tempore that the work has been satisfactorily completed, it was MOVED by Councilman Forman, seconded by Councilman Hage and carried on roll call vote as follows, the the City Council accept the work as completed by Louis S. Lopez for the improvement of Duarte Road - Holly Avenue to El Monte Wash - and that final payment be authorized in accordance with the terms of the contract; and that the bond be released at the designated time. Certificate of appropriate insurance to be evidenced. AUDIENCE PARTICIPATION 1/../,'1! ORDINANCE NO. 1363 Adopted ;'.. O~? ORDINANCE NO. 1365 Introduced Herb Miller, 1025 El Sur, expressed appreciation to the Gity Council and staff for assistance in the recent rock exhibit. He noted that the Lapidary Society meets on the second Tuesday of each month at the City Library and invited all interested persons to attend. Mayor Considine, on behalf of the City Council, commended Mr. Miller on the event. 1 The City Manager presented for the second time, explained the content and read the title of Ordinance No. 1363, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARGADIA, CALIFORNIA AMENDING CHAPTER 7 OF ARTICLE VII OF THE ARCADIA MUNICIPAL CODE BY RENUMBERING SECTIONS 7721.1.9 AND 7721.1.10 THEREOF, BY ADDING THERETO A NEW SECTION 7721.1.9 AND BY AMENDING SECTIONS 7711.9 AND 7731.2.6.1 THEREOF. Motion seconded by Councilman Butterworth and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None None 4. 10-18- 67 RESOLUTION NO. 3964 Adopted 117/ 1 COMMITTEE APPOINTMENT (Charter) ADJOURNMENT 1 17:7123 The City Attorney presented, explained the content and read the title of Resolution No. 3964, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING APPLICATION FOR CHANGE FROM ZONES R-O AND C-2 TO ZONES C-2 AND D TO PERMIT THE CONSTRUCTION OF A SHOPPING CENTER ON PROPERTY LOCATED AT 723 AND 731 WEST FOOTHILL BOULEVARD IN SAID CITY." MOTION by Councilman Hage, seconded by Councilman Arth and carried on roll call vote as follows that the reading of the full body of Resolution No. 3964 be waived: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None None Councilman Hage further MOVED that Resolution No. 3964 be adopted. Motion seconded by Councilman Arth and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None None Councilman Arth placed in nomination the name of Lewis D. Lawrence, 246 Angelo Place, to replace Judge John Saunders on the Citizens' Charter Revision Committee. Mr. ,Saunders recently resigned.
