Rev. Eugene E. Collins, Arcadia Friends Church Mayor Elton D. Phillips PRESENT: ABSENT: Councilmen Balser, Butterworth, Reibold, Turner, Phillips None MOTION by Councilman Turner, seconded by Councilman Reibold and carried unanimously that the Minutes of March 17, 1964 be APPROVED as submitted. Application of James W. Clarke, dba Arcadia Directory Company, re- questing business permit to allow door to door solicitation of residents for pertinent data to be included in a city directory and the door to door solicitation of merchants for advertising to be included in said directory. Mayor Phillips declared the hearing open and inquired if anyone desired to speak on the subject matter. Applicant, Mr. Clarke, identified himself from the audience. Discussion held by the Councilmen with Councilman Butterworth stating in part ~hat in voting for an antisolicitation ordinance the residents clearly indicated they do not desire to be disturbed by door to door solicitors; that in his opinion this desire must be respected. Discussion held on whether or not two permits are required, one for the solicitation of residents and a separate one for the solicitation of merchants for advertising for inclusion in the directory which would be presented free of charge to the residents, but would be used by the merchants of the city. The City Manager advised that the Chamber of Commerce had endorsed the project. Mr. Clarke addressed the Council, summarizing the procedure. Consensus of the Council being that the overwhelming vote of the people for antisolicitation regulation should be respected, MOTION was made by Councilman Butterworth, seconded by Councilman Balser and carried on roll call vote as follows that the application be denied. AYES: Councilmen Balser, Butterworth, Reibold, Turner, ,Phillips NOES: None ABSENT: None 1. 4-7-64 HEARING (Zone Variance - Howser) (F 1041) 16:6213 Planning Commission Resolution No. 507 recommending the denial of a zone variance application) to allow the construction of a 20-unit apartment development on property located at 241 W. Colorado Boulevard. The denial recommendation was appealed by the applicants. The City Clerk read into the record contents of a petition filed by nine property owners residing on Oakhurst Lane recommending the granting of the application providing certain restrictions are made a part of the conditions; i.e., driveway entrance and exit, setback from Oakhurst Lane, architecture of the structures and the portion of property facing Oakhurst Lane not be used as a service area. I Ernest Mayer, Planning Department, presented a report stating in part that the application is for three apartment buildings containing twenty units; that the site contains 55,550 sq. ft., with 460 ft. frontage on Colorado Boulevard; the the site is in and almost entirely surrounded by R-l property. Orientation pictorials were displayed depicting design, usable open space, building height, setbacks, site area, parking space; zoning projecturals displayed R-l areas. Exceptions created by zone variances were summarized. Traffic characteristics were explored. It was stated that at the present time approximately 14,500 vehicles travel this intersection in both directions during a 24 hour period; that it is estimated that 35,000 cars will travel the intersection in a 24 hour period in 1980; that the advent of the freeway will not lighten the load; that 74 accidents have occurred within one sixth of a mile of the subject property since 1959 including 4 fatalities in separate accidents; that there is an existing traffic hazard. Adjacent undeveloped land and the basis on which the Planning Commission recommended denial was discussed, the Commission having indicated it would look with favor on the subject property developed into fine residences. Renderings of the proposed construction were reviewed as were the recommended conditions set forth by the Commission should the variance be granted. Mayor Phillips declared the hearing open and announced that the appellant would first be heard. Fred N. Howser, representing the applicants, stated in part that the property has from time to time been rezoned for professional buildings, cocktail lounge, restaurant, motel and multiple units; that because of the traffic hazard it is not conducive to residential development; that it faces a busy intersection and that the subter- ranean nature of the property precludes it from development into residences. I Twelve photographs were entered into the record, each depicting different views of the property. Mr. C. S. Northrop, Architect, 65 E. Foothill Boulevard, presented charts and explained the contents of each; variances which had been granted in the past were indicated; the areas in favor of the appli- cation and against the application were indicated; dimensions of the property were given; there would remain 31,318 sq. ft. of buildable property after street widenings, setbacks, etc. Everett P. Mansur, Planning Consultant, discussed the recommendation of the Planning Commission and, in part, stated that property ad- joining subject property to the east is R-3; across a part of Colorado 2. 4-7-64 16:6214 I Boulevard is R-3 according to the Zoning Map of the City; that the recent amendment to the Zoning Ordinance permitting high rise apartment development indicates the Planning Commission and City Council recognize the need and desirability for additional multiple dwelling units; that in his opinion the freeway will eliminate some R-3 property east of Santa Anita Avenue which is a few blocks east of subject property; that the central area plan will eliminate additional R-3 in this area and will also eliminate R-3 property east of Santa Anita between Huntington Drive and California Street. Mr. Mansur stated that if the property were developed into single family dwellings with individual driveways there would be a greater traffic hazard. Reference was made to a filled-in gully extending the entire length of the property from northwest to southeast which had been as much as 23 feet deep; that it is soft and consists of sand, silt, rock, asphalt and trash; that to compact fill the gully would unreasonably increase the cost of construction of single family dwellings; that the present deed restrictions which do not expire until 1970 require 12,000 sq. ft. for each single family residence and this would only permit four residences to be developed; that there are no restrictions concerning multiple dwellings. He further stated in part that the property is adjacent to C-l and C-2 usage and that variances have been granted for a restaurant, cocktail lounge, 10-unit bungalow hotel, professional office building; and that in his opinion ex- ceptional circumstances are more indicated now than at the time the previous variances were granted. Reference was made to Resolution No. 487 adopted by the City of Arcadia January 2, 1929, adopting a highway plan; that Colorado Street was shown as a major highway and Colorado Boulevard as a pro- posed secondary highway, the two streets joining in front of the subject property. Resolution No. 3299 adopted September 20, 1960 established truck routes which travel in front of subject property; Resolution No. 3645 adopted February 4, 1964 established a Select System of City streets; that there are only 12 streets which are primary arterials including Colorado Street, Colorado Boulevard and Colorado Place and that the subject property is at the junction of the primary arterials, which indicates in his opinion that there are ex- ceptional and extraordinary circumstances applicable to the problem involved. I Mr. Mansur further stated in part that the assessed valuation of the subject property is $16,400, the area is 55,550 sq. ft.; that it is taxed on the basis of R-3 property; and that the building of the pro- posed development could not be injurious to the other property in the vicinity, referring to the adjacent uses which generate traffic. Mike Vallone, Builder, 1028 Park Avenue, Arcadia, discussed the renderings on display which reflected a proposed shake roof, siding for the exterior, stone veneer with a modern appearance which could be readily converted into a ranch style. Efforts were made to please the neighbors on Oakhurst Lane. Discussion was held on the recommendation that all ingress and egress be made from Colorado Boulevard. Everett Watt, realtor, stated in part that he had listed this proper- ty for the past six years and that the only interest evinced was for business and apartment usage; that to dig out the fill and to compact fill make it almost prohibitive to a prospective purchaser. 3. 4-7-64 16:6215 Dr. D. M. Donisthorpe, 248 Oakhurst Lane, addressed Council urging that there be an entrance and exit on Colorado Boulevard; that there are 40 cars on Oakhurst Lane at the present time and that the ad- ditional cars from the apartment dwellings would make it more hazard- ous. George Lewis, 240 Oakhurst Lane, stated in part that somehow there must be a transition from residential to commercial; that in his opinion no one would purchase subject property for residential use; that an apartment development appears to be a natural transition. Mr. Lewis suggested that the City investigate the situation as far as traffic is concerned. 1 Mr. Howser concluded his remarks with a request for relief and/or suggestions. The following persons then spoke in opposition to the proposed development: Robert Whitmore, Jr., 512 Santa Maria Road, read a petition dated February 22, 1964 expressing opposition to the zone variance appli- cation signed by owners of 27 properties in the college area. Mr. Whitmore stated in part that he is concerned for the safety of the children; that with the racing season traffic, the use of the downhill grade as a favorite racing spot and the additional traffic the situation would become worse; that he would not object to a l-story apartment building which was recommended and outlined by the Planning Department but that two stories would, in his opinion, be deleterious to the fine residential character of the area; that restrictions on Santa Maria Road limited residences to 1 story and that if two-story construction were permitted he would be deprived of his property right; that with reference to the chart reflecting those in favor of the construction most of those were tenants in the, existing apartment building, not property owners. He suggested that perhaps when the apartment building (Anita Oaks) was constructed the problem of the fill on subject property could have emanated from that source; that during the last 8 years there have been six cars on his front lawn including one fatality; that fast traffic does exist on Colorado Boulevard. In conclusion he urged Council to deny the appli- cation. Mrs. Monica Roach, 301 Harvard Drive, indicated on a projectural the location of homes which are selling for between $40,000 and $55,000 on Harvard Drive. She suggested the preparation of new architectural sketches with the opportunity to review same. She stated in part that she could represent about 99 percent of the residents living in Colorado Oaks and they would all like to have the property developed in accordance with the recommendation of the Planning Commission. O. J. Skelton, 306 Harvard Drive, read a communication directed to Kermit Ferguson, Chairman of the Planning Commission, and dated February 4, 1964, outlining objections to the variance application. I Kenneth White, 322 W. Colorado Street, was concerned for the safety of the children who must board school buses at the intersection. He referred to the traffic situation and commented that it could be alleviated by blocking off Harvard from Colorado Boulevard. He urged denial of the application. 4. 4-7-64 1IIr."'" ",..., I 16:6216 Lou Welch, 428 W. Colorado Street, agreed with the former speakers, and expressed concern that similar development might be approved for the old nursery property. Mary Welch, 428 W. Colorado Street, stated in part that in her opinion apartment developments were not the proper environments for raising children and that the traffic situation would be adversely effected. MOTION by Councilman Turner, seconded by Councilman Butterworth that the hearing be CLOSED. Motion carried unanimously. Discussion held on conditions stipulated by the Planning Department should the variance be granted. Complete review of the recommen- dations with Mr. Howser was then taken section by section. Councilman Butterworth stated in part that the property is apparently sterilized as it now stands; that it appears to be' agreed upon that it is not suitable for R-l development. Councilman Reibold stated in part that in his opinion the basic issue is one of property rights; that with the traffic flow pattern entered into the record that 40 additional cars would not make any sub- stantial difference; that the residents in the area appear to be the most careful of drivers; that he could personally attest to the traffic situation on Oakhurst Lane. Councilman Balser was of the opinion that the traffic hazard would increase should R-l zoning be permitted with each residence having a separate driveway. Mayor Phillips commented on the traffic situation having been empha- sized. He stated further in part that this would undoubtedly set a pattern for the balance of the undeveloped land located near the railroad track. Applicant's counsel having concurred in the other conditions recom- mended by the Planning Department, Councilman Turner MOVED: that the recommendation of the Planning Commission as contained in its Resolution No. 507 be disapproved; that the zone variance be granted on the conditions recommended'by the Planning Department excepting 'AI and 'B' thereof; that the requirement for installation of lights contained in No.9 be omitted; that driveway and tree locations be subject to approval of the State Division of Highways; that the other recommendations of the Planning Department be followed and that in consultation with the Planning Department as to the best method whereby it can be accomplished, conditions No. 11 and 14 be combined so as to permit the building to be moved easterly 5 feet if the 30' dedication of Oakhurst Lane is made and the 40' setback from its new centerline be adhered to. Duarte Road. Said recommendation appealed by the applicant and a public hearing was scheduled for May 19, 1964 at 8 P.M. on MOTION by Councilman Reibold, seconded by Councilman Turner and carried unanimously. Planning Commission Resolution No. 508 recommending denial of zone variance application to allow construction of a Temple and Religious School on property located at 1111 to and including 1205 S. First Avenue SUSTAINED by the City Council on MOTION of Councilman Reibold, seconded by Councilman Butterworth and carried unanimously. I Planning Commission Resolution No. 510 recommending denial of zone variance application to allow second dwelling at 315 Le Roy Avenue. Communication read from the attorney for the applicant requesting continuance of a decision on the matter was granted on MOTION by Councilman Balser, seconded by Councilman Turner and carried unani- mously that said matter be placed on the agenda for May 5, 1964. MOTION by Councilman Turner, seconded by Councilman Reibold and carried unanimously that tentative map of Tract No. 29532 (525 to 605 Fairview Avenue) be approved subject to specified conditions contained in report (on file in office of the City Clerk). The request of the Arcadia TV Center for permission to replace its existing sign at 129 E. Huntington Drive was DENIED on MOTION by Councilman Balser, seconded by Councilman Butterworth and carried unanimously. It was the consensus of the City Council that determi- nation on requests of this nature within the moratorium area should be withheld pending the decision on sign control which matter had been continued until May 18, 1964. MOTION by Councilman Reibold, seconded by Councilman Butterworth and carried on roll call vote as follows that the request of H. R. Halverson for refund of one half of the business license fee paid by him ($6.00) be denied, based on Section 6214.5.2 of the Arcadia Municipal Code which reads in part ". . . the City shall refund to the former licensee seventy-five per cent of the unused portion of the license fee if the total amount of such unused portion exceeds $12.00". ' AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Reibold, Turner, Phillips None None I Report of the City Manager and its attachments, having been submitted to the City Council, was explored at length. A proposal for a major heliport in the Arcadia Civic Center near the City Hall by the Los Angeles Airways, Inc. includes a ten year lease to operate 28 passenger helicopters for the carrying of passengers, mail and property. The report contained the recommendation that alternate sites should also be considered. 6. 4-7-64 WATER PLAN (Pacific I Southwest) , (485 A) FLOOD CONTROL (Bond Issue) (A) RESOLUTION NO. 3662 STREET LIGHTS (No; Santa Anita) I (P: Utilities Lighting STATE HIGHWAY MAINTENANCE P: Roads + Links (State Highways) 16:6218 Mayor Phillips and Councilman Butterworth expressed strong support of the proposal and stated that everything should be done to encourage the locating of a heliport in the City. The matter was continued until such time as the incoming Councilmen have had an opportunity to study the proposal. MOTION by Councilman Turner, seconded by Councilman Balser and carried unanimously that Council adopt a resolution supporting the stand of the Metropolitan Water District and oppose Secretary of the Interior Udall's modified Pacific Southwest Water Plan. Upon said adoption copies of the Resolution to be forwarded to the Legislature in Sacramento and Washington. MOTION by Councilman Turner, seconded by Councilman Reibold and unanimously carried that a Resolution be adopted recommending placing the proposed $200,000 Flood Control Bond Issue on November 1964 ballot. The City Attorney then presented, explained the content and read the title of Resolution No. 3662, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ENDORSING THE PROPOSED COUNTY 1964 STORM DRAIN BOND ISSUE". MOTION by Councilman Turner, seconded by Councilman Reibold and carried on roll call vote as follows that the reading of the full body of Resolution No. 3662 be waived: AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Reibold, Turner, Phillips None None Councilman Turner further MOVED that Resolution No. 3662 be adopted. MOTION by Councilman Turner, seconded by Councilman Balser and carried unanimously that the request of Winslow Engineering Company for permission to modify, alter and occupy an existing building located at the northwest corner of First Avenue and St. Joseph Street be approved; that the staff be instructed to work with the Engineering Company and that 10' be dedicated.
