CITY COUNCIL OF THE CITY OF ARCADIA
JUNE 3, 1964
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the City Hall at 8:00 P.M.,
June 3, 1964.

The Minutes of the City Council Meeting of May 19, 1964 as
submitted in writing, were APPROVED on MOTION by Councilman
Considine, seconded by Councilman Forman and carried unanimously.
APPEAL - from Planning Commission Resolution No. 511 recommending
denial of the Special Use request of the Soland Corporation for
permission to construct and operate a drag strip on property
partially located within the City.
The City Clerk advised of the receipt of a petition containing
974 signatures from persons within the El Monte Postal area; also
communications for and against the request. She also read into the
record communications from 1) Los Angeles County Regional Planning
Commission objecting to the proposal due to the close proximity to
residential areas which would be materially detrimental to
residents, property owners and property values within such areas,
'and 2) City of El Monte City Council, stating in part that the
proposal was objected to due to the strenuous objections received
from area residents and property owners and also that the streets
are insufficient at this time to cope with the inevitable traffic
problems which would result. Reference was also made to a
communication from the attorney for the applicants, William N.
Bowie, Jr., in which a continuation of the matter was requested.
The Council did not object to the continuation of the Hearing other
than in the area of time, due to the forthcoming heavy agenda.
Mayor Pro Tempore Reibold declared the hearing open and discussed
procedure with Mr. Bowie who advised that he did have new evidence
which he would like to have sufficient time to prepare for presen-
tat ion.
Mayor Pro Tempore Reibold stated that if new evidence were to be
presented, the matter should go back to the Planning Commission for
further hearing after notice. The Planning Director indicated that
because of hearings already scheduled, it might well be the end of
August before the Commission could hold such a hearing. Mr. Bowie
then stated that he would present no new evidence but still wanted

a continuance to prepare an orderly presentation so as to save
time.
Mayor Pro Tempore Reibold then stated that Council would hear from
anyone who could not attend the meeting at the continued date.
Eugene B. Shapiro, representing the Equestrian Trails, Inc.,
referred to riding trails partially located within the City; that
the Drag Strip would constitute a danger to the riders and could
result in injuries and lawsuits. In answer to a query by
Councilman Considine, Mr. Shapiro stated in part that he did not I
know of a lawsuit as a result of a Drag Strip which was formerly
operated near Lower Azusa Road and close to a riding trail.
Councilman Considine stated further that he would be interested in
information along this line.
Cecil Willingham, San Gabriel Board of Realtors representative,
expressed a desire that the matter be heard at this time.
MOTION was then made by Councilman Balser, seconded by Councilman
Considine and carried unanimously that the Hearing be continued
until the regular Council meeting of JULY 7, 1964 at 8 P.M.
An application was filed with the Planning Commission in compliance
with the requirements of California Senate Bill No. 600 which
provides that prior to the sale of condominium apartments tentative
and final tract maps must be approved by the governing body of the
City in which the tract is located.
The Planning Commission recommended approval subject to specified
conditions. The owner requests elimination of Condition No.6 which
requires the removal of the easterly ten feet of the existing garage;
that the structural walls supporting the east end of the building be
removed and reduced to a six foot ornamental wall.
Henry Hege, 651 W.,Duarte Road, representing the owner, reiterated
the basis for requesting the elimination of the condition as
contained in his communication of May 29, 1964; that the garage was
constructed in accordance with plans which were approved in
November 1963 and that the garage has been completed; that the
removal of the supporting walls will weaken the structural support
of the garage and submitted a letter for the record from the First
Federal Savings & Loan Association in which it refused to permit
the removal of one garage on the basis that the loan was made in
accordance with the plans which were approved. Mr. Hege also
submitted for the record a letter from Petray & Knowles, Engineers,
in which it was stated that the removal of the end masonry wall
would increase the fire hazard to adjacent property and that the
removal would result i~ an unsafe structure.

Ed Roeters, owner of the property south of subject property, stated
in part that in his opinion it would create a monetary loss to him
to have the wall in front of his building; that one of his apartment
units will be placed in an unwholesome atmosphere due to the wall;
that the wall blocks his building from view from one portion of
the street. He asked Council to consider the matter from his point
of view.

regarding setbacks were granted by the Modification Committee and

the plans subsequently approved, a permit issued, and the building
at present is ninety per cent completed; that the Committee perhaps
should have considered the problem now before Council; that the
error, if any, is in esthetics not in Code adherence; that the
builder has exceeded the Building Code requirements in construction.
An inquiry made of Mr. Hege brought out plans for rather elaborate
landscaping around the wall including decorative illumination.
MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that Council approve the tentative map of Tract
No. 22901 upon the conditions recommended by the Planning Commission
with the exception of Condition No.6, and that the landscaping be
carried out according to the plan reviewed by Council at this
meeting.
MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously that a public hearing be scheduled for Tuesday
June 16, 1964 at 8 P.M. on Planning Commission Resolution No. 513
recommending the creation of a new zoning district and changes in
the text of Zones C-O, C-l and M-l.
MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously that a public hearing be scheduled for JULY 7,
1964 at 8 P.M. on Planning Commission Resolution No. 516
recommending reclassification of property in the Central Area to
C-l and D, and to Zone M-l P.I,D.
Upon the Council indicating its approval of the recommendation of the
City Manager and the Director of Public Works approving the budget
for gas tax allocation, the City Attorney presented, explained the
content and read the title of Resolution No. 3681, entitled: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
ADOPTING BUDGET FOR EXPENDITURE OF GAS TAX ALLOCATION FOR MAJOR
CITY STREETS FOR 1964-1965."

Communication suggesting that a study be undertaken by the Planning
Commission to determine the changes required in Zone R-O to make
regulations in said zone at least as restrictive as the present
deed restrictions (which will expire in the near future). Area in
question is north of Foothill Boulevard to the northern boundary of
the City between Michillinda and Baldwin Avenues.

MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that the request be referred to staff; that an
effort be made to assist the property owners to achieve their goal
without the necessity of changing the zoning ordinance.
MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that a business permit be issued to David Jones
and Jack Renner, dba Classic Carpet Cleaners. 302 N. First Avenue.
Said building to be used only as a business office, with the actual
carpet cleaning conducted elsewhere.
The City ,Manager read a communication from the Director of Public
Works summarizing the background and contents of two covenants
which were executed in September 1961; that the easement was
retained for possible access to adjacent property now owned by the
County Flood Control District; that the debris basins are filling
with silt and eventually the land may be returned to the City for
recreation purposes. During the interim owners of subject property
may use the property but may not construct buildings on the easement;
that the street was originally vacated at the request of the property
owners of Lots 94 and 95, Tract No. 17853 so that the street could
not be used for heavy truck hauling by the County Flood Control
District vehicles.
Discussion ensued with the consensus of the Council being that it
was desirable to maintain the present status; that a structure
should not be built on the easement which would prevent the City
from future use of the street as an access road should it become
possible to so do.
MOTION by Councilman Considine, seconded by Councilman Balser and I
carried unanimously that the recommendation of the Director of
Public Works be accepted and that the status quo be maintained,
thereby denying the request for vacation of the south 20 feet of
easement on Doshier Avenue.
MOTION by 'Councilman Forman, seconded by Councilman Balser and
carried unanimously that the request for relief in the moratorium'
area for the remodeling of buildings at 142-144 E. Huntington Drive
be APPROVED and that a building permit be authorized subject to
compliance with all building regulations. Said building to be
occupied by the Cooper Office Furniture Company.

Continuing the acquisition of property for the consolidation of the
City Yards, MOTION made by Councilman Forman, seconded by Councilman
Balser and carried on roll call vote as follows that the recom-
mendation of the City Manager be approved and that Council authorize
the purchase of property located at 46 - 52 S. Fourth Avenue, from
R. R. Shackelford in the amount of $48,500, the seller to have the
right of occupancy until August 1, 1964; that the City Manager be and
he is hereby authorized to execute escrow instruments on behalf of
the City on form prepared by the City Attorney; that the sum of
$49,000 be appropriated from Reserve for Capital Improvements Account
No. 285 in the General Fund and transferred to Capital Improvement
Projects,Account No. 302, Property Purchase - Combined City Yards.

carried unanimously that the request of the Applied Optics and
Mechanics,. Inc., for relief from the moratorium for the construction
of a building at 400 N. Rolyn Place be APPROVED; that a building
permit be issued subject to compliance with all applicable city
regulations.
MOTION by Councilman Forman, seconded by Councilman Balser and
carried on roll call vote as follows that the American Legion
Arcadia Post No. 247 be permitted to sell fireworks on July 2, 3
and 4, 1964; that the permit deposit in accordance with Arcadia
Municipal Code, Section 6424.2.4 be waived and that the Post be
permitted to conduct its annual fireworks' display in the Los
Angeles County Park located in Arcadia on the night of July 4,
1964.

Harold J. Berg'Who has an option to purchase the property to use in
conjunction with a proposed shopping center for which an application
for change of zone is being filed concurrently herewith.
Henry Hege, representing the applicant, addressed Council briefly
and introduced Mr. Richard T. Hartshorn who is proposing to construct
a market in the center. Projecturals were reviewed depicting
elevations, architecture, etc. Council evinced interest in the
development.
MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously that the request of Robert W. Theisen for a
permit to occupy the rear building at 12 S. Santa Anita Avenue be
approved, subject to conditions outlined below as stipulated by the
Planning Department:

1. No trucks doing business as a part of or with this
office shall be parked on the property.
2. All signs proposed for the building shall comply with
regulations recommended for adoption by the Planning
Commission for Zone C-l-D.
On recommendation of the City Manager, Councilman Balser MOVED that
the term "wages" as used in the contract with the Holton Construction
Company, Inc., be construed and deemed to include:
1. Federal Insurance Contributions (Social Security)
2. Federal Unemployment tax
3. State of California Unemployment tax
4. Union - Health and Welfare, Pension, Vacation and
Apprenticeship Fund
5. Workmen1s compensation

Councilman Balser MOVED that the City Manager submit a letter of
commendation to Senator Thomas H. Kuchel for his stand on the issue.
Motion seconded by Councilman Forman and carried unanimously.
Mr. and Mrs. Richter Casper, owners of 146 - 148 E. Huntington Drive,
addressed Council seeking information as to just what businesses were
acceptable for their property; that it is empty at the present time
and it is essential to them that it be rented. They were advised
to confer with the Planning Department to ascertain what type of
business would be acceptable.
Councilman Balser MOVED that the name of Thomas B. Mc Kibben,
1033 Paloma Drive, Arcadia be placed in nomination to replace
Mrs. Charles Morse on the Sister City Commission. Said term to
expire June 30, 1965. ,The motion was seconded by Councilman
Considine and carried unanimously.
Councilman Forman stated for the record that he is associated with
the H. H. Goddard Realty Company but that he has no financial
interest in the Company or in any of its transactions except those
which he personally handles, and that his commissions are confined
to the result of his own efforts; that this statement of his
position will continue for future reference until such time as he
announces a change therein.
The City Attorney commented that he will prepare a formal opinion
on conflict of interests.
