ADJOURNED REGULAR MEETING

ROLL CALL
Pursuant to the order of adjournment of the adjourned regular meeting
of the City Council 'of July 21, 1964, the City Council of the City of
Arcadia met in adjourned regular session in the Council Chamber of
the City Hall at 8:00 P.M., July 27, 1964.

Planning Commission Resolution No. 520 recommending the granting of
a variance to permit the filling of an abandoned gravel pit upon
specified conditions. (Property located on the north side of Clarke
Street east of Peck Road).
LIAI~~,rt ~as explained that the subject property consists for the most part
of an abandoned gravel pit, the quarrying operations have been
completed and it is now proposed to be filled with inert material;
that it is now totally unfit for any surface use and the property in
order to be usable must be brought up to grade.

No ~ritten appeal having been filed and no one desiring to be heard,
MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that the recommendation of the Planning
Commission as contained in its Resolution No. 520 be APPROVED in
acc~rdance with the conditions specified therein with the added
condition that all fill must be inert material as described in the
regulations of the Regional Water Pollution Control Board standards
and specifications.

The Planning Director explained reasons for the recommendation of the
Planning Commission for denial of the proposed subdivision in the
vicinity of Second Avenue and La Sierra Drive. It was the opinion
of the Commission that the tract as proposed would preclude the future
orderly development of cul-de-sacs in the area. The Commission had
suggested that the subdivision be moved one lot to the north or to the
south, with which the developer could not comply inasmuch as the
necessary property was not available at the' present time.

Alfred Allen, representing the subdivider, explained how in his
opinion the development could proceed under City standards.
It ~as the consensus of the City Council that to approve the
tentative map of Tract No. 23146 would preclude the future develop-
ment of the land to its highest use, whereupon Councilman Forman
MOVED that the recommendation of the Planning Commission be sustained
and that tentative map of Tract No. 23146 be disapproved. Motion
seconded by Councilman Balser and carried on roll call vote as

The request of the First Baptist Church of Temple City for the
waiving of a filing fee in connection with a zone variance appli-
cation filed by the Church with the Planning Commission was denied
on MOTION by Councilman Balser, seconded by Councilman Reibold and
carried unanimously. The report on fees which have been waived
during the past 6 years was made a part of the record and the City
Council was also advised that the Planning Commission had recommended
denial of the zone variance application of the Church.
The request of the Los Angeles County Fair Association for permission
to erect banners publicizing its annual County Fair was APPROVED on
MOTION by Councilman Reibold, seconded by Councilman Considine and
carried unanimously. Installation to be under the supervision of the
Director of Public Works.

The request of Peer Clausen & Son for permission to install an
aluminum awning at 121 N. Santa Anita Avenue was APPROVED on MOTION
by Councilman ,Considine, seconded by Councilman Balser and carried
unanimously.
The request of the Daily News Post newspaper officials for permission
to occupy the premises at 24 E. Huntington Drive as an office was
APPROVED on MOTION by Councilman Forman, seconded by Councilman
Considine and carried unanimously.
The request of the Association to operate temporarily at 41 E. Live
Oak Avenue was considered. Henry Hege, attorney, advised that the
variance from the building code was being requested inasmuch as the
building proposed to be used temporarily as an office was noncon-
forming for commercial purposes; that it was located on the rear of
the lot on which the new structure will be built and ready for
occupancy by January 1, 1964 at which time the temporary quarters
will be vacated and the building removed. He further stated that no
structural alterations are to be made.
Discussion ensued on whether or not the matter should be held over
pending submission of the plans to the Building Department.
Councilman Forman MOVED that the matter be placed on the next agenda.
However, in the essence of'time a further MOTION was made by
Councilman Reibold, seconded by Councilman Considine and carried
unanimously that the request for permission to occupy the building
at 41 E. Live Oak Avenue for a six month period be APPROVED; that the
plans for any improvement be submitted to the Building Department
prior to the issuance of any permit and that an application for a
business license be filed with the License Department.

The request of the City Refuse Company for a new 10 year contract was
taken under advisement by the City Council on February 4, 1964. The
City Manager, following instructions, submitted a comprehensive report
including a chronological summary of the refuse service, analyses of
costs, recommended revisions of the Code and other pertinent data.
Councilman Considine advised of the receipt of a letter from an
apartment building owner which indicated that during the current
contract period the price of container pick up for apartment
buildings fluctuated substantially. Discussion held on the rates set

by the City Council in its Resolution No. 2790 adopted in 1956 at
which time there were relatively few apartments in the City; that it
is now recommended that the resolution be amended to provide for an
established charge for containers. Considerable discussion ensued
with the owner of the Company, Paul Thorsen, participating.
MOTION was made by Councilman Reibold,
seconded by Councilman Balser and carried unanimously that a proposed
new contract be drawn up incorporating the recommendations of the
City Manager in his report dated July 15, 1964; the monthly
franchise fee be increased' to $600 with no free City pick-up; that
there be a provision for a right of appeal through the City Manager
or the Director of Public Works; that the number of refuse haulers
licensed in the commercial area be limited to five. That the draft
of the proposed new agreement be submitted to the City Council for
study of specific definitions.
The Minutes of the regular meeting of the Personnel Board of July 9
were referred to in part by the City Manager. The Minutes indicated
a vote by the Board members of three to one that no change be made in
the holidays currently being allowed the City no~uniformed employees.
The City Manager recommended that Lincoln's, Veteran's and Columbus
Day be eliminated as holidays each year and that State Election Days
occurring in even numbered years be also eliminated. He further
recommended that any holiday falling on a Saturday be observed on the
preceding Friday as is the custom when a holiday falls on a Sunday,
it is observed on the following Monday.
Mayor Turner advised those in the audience that although this was not
a public hearing the City Council would hear from those who desired
to be heard. He asked that presentations be brief and not repe-
titious.
Roger Myers, President of the Arcadia City Employee Association,
advised that Earl Pulsifer would speak on behalf of the Association.
Mr. Pulsifer spoke at length referring to surveys of other cities;
to the City Manager's remarks as outlined in the Personnel Board
Minutes of said date; that the reduction in holidays would be felt in
morale and recruiting. He stated in substance that the uniformed
personnel were not being reduced in holiday benefits and also
received the salary increase which'was granted city personnel with
one exception on July 1, 1964; that the purpose of holidays for
employees was being overlooked.
Discussion ensued with the consensus of the City Council being that
the City has endeavored and believe it has accomplished the goal of
bringing the salaries up to what is being paid by private industry;
that private industry does not receive the number of holidays
currently being granted the city employees; that the City Council
felt that the employee would prefer the salary increase. It was
agreed among the Council members that perhaps communication between
the City Council and the employee could have been improved upon in
order for the employee to better understand its viewpoint in granting
the salary increase.
Councilman Balser then MOVED that Section 5 of the Personnel Rules
and Regulations be amended and that Lincoln's Day, Columbus Day,
Veterans Day and the State Election Days occurring every other year
be eliminated. Motion seconded by Councilman Reibold and carried
unanimously.

The City Manager presented for the second time, explained the content
and read the title of Ordinance No. 1248, entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING
CHAPTER 2 OF ARTICLE IX OF THE ARCADIA MUNICIPAL CODE:BY AMENDING
SECTION 9233 ,THEREOF; BY, ADDING THERETO A NEW SECTION 9231.18; AND BY
ADDING TO PART 6 THEREOF A NEW DIVISION 8 ENTITLED "C-C COMMUNITY
COMMERCIAL ZONE" CONTAINING TITLES 1 AND 2 AND SECTIONS 9268.1

The Planning Director submitted to members of the City Council a
report on the measurement of noise and commented that additional
material will go to Council for clarification purposes.
The City Manager referred to the ordinance incorporating regulations
for Zone P.I.D. (Planned Industrial District). Some discussion was
held on its contents and it was the consensus of the City Council
that the Mayor and/or the Councilmen and staff put into writing
suggestions and circulate them among the legislative body so they may
be studied prior to the next meeting.

A copy of a resolution adopted by the City of Culver City
recommending local control of gambling was ordered filed.

MINUTES
ARCADIA CITY COUNCIL
JULY 30, 1964
Pursuant to Resolution No. 3370, members of the City Council met in
the Conference Room of the City Hall on July 30, 1964 at 7:30 P.M.

OTHERS PRESENT: City Manager Schone, City Engineer Lortz,
City Attorney Nicklin
Discussion held on the proposed Hotel-Motel tax. If and when Council
so dictates a public hearing will be scheduled. A letter will go
forward to hotel-motel owners with a copy of the proposed ordinance.
A tentative date of November 1, 1964 was given considerat~on.
Discussion on proposed alignment of the Foothill Freeway which would
go through the cities of Duarte and Bradbury. The Director of Public
Works had a written report. The consensus was that the City should
take no stand one way or another.
, Discussion also held on the Revised Supplemental agreement of the
Foothill Freeway through Arcadia. 'This matter will come before
Council on August 4, 1964.
Brief discussion held on pound charges.
Arcadia Avenue extension discussed. The matter will appear before
Council on August 4, 1964. Consideration given to purchasing one
parcel at $35,750.00 at 1103 La Cadena which will materially help in
the eventual extension from Baldwin Avenue to La Cadena.
It was felt that an entire meeting should be held on Data Processing
and one on the possible communication report submitted by the City
Manager some time ago.

It was the consensus of the City Council that the Procedural Manual
should take precedence. The City Attorney will have it ready for
Council consideration at the next study session - August 27, 1964.
