REGULAR MEETING
AUGUST 4, 1964
The City Council of the City of Arcadia, California met in
regular session in the Council Chamber of the "Arcadia City Hall
on August 4, 1964 at 8 P.M.

MOTION by Councilman Balser, seconded by Councilman Reibold and
carried unanimously that the Minutes of July ~1, 1964 as submitted
in writing be APPROVED.
Planning Commission Res. No. 518 recommending the reclassification
of specified property into C-C & D (Community Commercial and
architectural overlay) and recommending the reg~lations to be
imposed thereon under Zone 'D'.
This hearing was continued from July 21, 1964 for the sole purpose
of receiving documentary evidence. Councilman Balser MOVED that the
record be augmented by the inclusion of the verbatim transcript of
the statements and testimony of Messrs. Nicklin, Goebel, Gutoff and
Phelps. Motion seconded by Councilman Forman and carried unanimously.
Councilman Forman then MOVED that the record also be augmented by

the inclusion of the excerpts from a letter receiv~d by Mr. Goebel
from the Atchison, Topeka and Santa Fe Railway Comp'any which had
been submitted by Mr. Goebel. Motion seconded by Councilman Reibold
and carried unanimously.
Brief discussion he~d with Richard English, Chairman of the Chamber
of Commerce Industrial Committee, regarding the limitation of building
area and the measurement of vibration.
Councilman Forman MOVED that inasmuch as deliberations on this matter
will be postponed the hearing be CLOSED. Motion seconded by Council-
man Reibold and carried unanimously.
Planning Commission Res. No. 519 recommending that properties at
1225 and 1229 Lovell Avenue be placed in Zone P(automobile parking).
The Planning Director explained plans for the proposed development
at said address and projecturals were displayed. He explained that
the additional parking was to be used to provide additional parking
facilities for the height-limit building to'be constructed on the
adjoining property (604 to 620 W. Duarte Road) which has been re-
classified into Zones C-O, H & D; that the or'iginal plan had called
for all surface parking but the Pl~nning Commission had encouraged
the applicant to include about 33 underground parking spaces and
167 surface parking spaces.

Councilman Considine stated in part that it was his recollection
that there were five lots approved for the eight-story building
and that it was to be occupied by fifteen doctors; that he was
under the impression that the developer contemplated surface
parking and not underground. He asked how the request for addi-
tional surface parking came about.
Mr. Phelps explained that the number of parking spaces had been
determined by the Planning Commission and the City Council; that
the underground parking area had been encouraged by the Planning
Commission.
Mayor Turner then declared the hearing open.

Henry Hege, 651 W. Duarte Road, attorney for the applicant, stated
in part that it had never been intended that the number of doctors
to occupy the building be limited to fifteen and that the original
plan had called for all surface parking; that the Planning Commission
had urged consideration for underground parking and when the
financial institution refused to loan on the plans which called for
subterranean parking the applicant felt that by the elimination of
the underground facilities he should provide this additional surface
parking area. \
Michael Blake, 1245 Lovell Avenue, spoke to a former consideration
given to the closing of Lovell Avenue at Duarte Road; that the
residents are against it. He was advised that the closing of the
street is not before the City Council at this time; that if it is
ever proposed it must be accomplished through street closing pro-
cedures which require posting and giving notice to all in the area.
Councilman Considine stated further in part that such closing could
possibly come about and the residents in greater West Arcadia do not
desire further comme~cwal zoning as they feel that if the one lot
on Naomi Avenue between Baldwin and Lovell Avenues had not been zoned
commercially the R-l zoning might have been retained on Naomi Avenue.
Discussion held on the use of the additional lot over the original
request and it was brought out that under the zoning there is a
transitional use allowed of the adjacent lot.
Councilman Reibold MOVED that the hearing be CLOSED. Motion seconded
by Councilman Forman and carried unanimously.
Councilman Balser was informed that the plan still calls for the 10'
screening on Lovell Avenue.
Councilman Reibold stated in part that in his opinion underground
parking would bring about more density of population than would surface
parking which is more in keeping with the over-all desires of those
opposed to commercial zoning; that he would support the recommendation.

Councilman Forman was of the opinion that the additional parking would
be an asset to the total area and favored the surface parking over
subterranean because of the open space and circulation.
Mayor Turner stated in part that he would agree that surface parking
affords less congestion than underground.
Councilman Considine commented further that he did not object to the
building which has already been zoned and approved and that he under-
stands the economics of the surface parking, but that he can foresee
a problem for those who would like to keep the area residential.
Councilman Forman MOVED that the recommendation of the Planning Com-
mission as contained in its Res. No. 518 be APPROVED. Motion seconded
by Councilman Reibold and carried on roll call vote as follows:.

The Planning Commission considered this tentative map acceptable
w~th the exception of the substandard area of Lot 6 and re-
commends approval subject to conditions. Property is located on
the south side of Foothill Boulevard at 250 W. Foothill Boulevard;
seven Zone R-l lots are proposed for development.
MOTION by Councilman Reibold, seconded by Councilman Considine
and carried unanimously that the recomrnendati~n of the Planning
Commission be accepted and that the tentative map of Tract No.
29178 be APPROVED subject to the following conditions:
1. Increase the area of Lot 6 to exceed 7500 sq. ft.
2. The existing setback on Foothill Boulevard shall be modified
to allow construction of structures 30 feet from property line.
3. A covenant drafted in a manner acceptable to the City Attorney
shall be filed with the City and recorded; such covenant shall
state that the existing recreation building on the south portion
of Lot 4 shall be used for recreation purposes only by the '
owner or his guests and shall not be rented, leased or other-
wise used by clubs or groups or other organizations.
4. Install all standard street improvements required by the sub-
division ordinance. Improvements, grades ~nd drainage shall be
to the satisfaction of the Director of Public Works. Sewer and
storm drain easement to be 15 feet wide. Drainage to freeway
right of way to be acceptable to Division of Highways and plans
to be signed by that agency.
5. Provide all easements required for and install underground
utilities. '
6. Remove all structures and buildings within or across the tract
boundary. These removals or relocations' shall comply to all
City ordinapces, codes and regulations and be done to the
satisfaction of the Department of Public Works. Those portions
of the two :kain structures shown to remain are excepted.
7. Water services shall comply with the requirements of the Uniform
Plumbing Code and shall be approved by ~~e Water Superintendent.
8. Fire hydrants shall be installed in loca,ions and in a manner
satisfactory to the Fire Chief.
9.
Dedicate to the City the proposed 50 foot street and provide
5 foot easements for sidewalks and planting purposes. Dedicate
10 feet for Foothill Boulevard.

Planning Commission Res. No. 523 recommending approval of zone
variance application to permit the use of'an existing single
family dwelling at 166 Bonita Street in an R-3 zone as a Red
Cross Chapter office. Although no official action may be taken
until the time for appeal elapses, in the interest of time the
City Attorney was i~structed ON MOTION by Councilman Reibold, '
seconded by Councilman Balser and carried unanimously, to prepare
and have ready for the next regular meeting a resolution granting
the variance as recommended by the Planning Commission, providing
no written appeal is filed within the required time.
Upon advice of the City Manager and the Water S~perintendent
that Holton Construction Company have satisfactorily completed
the construction of a concrete block wall at the Baldwin
Reservoir, MOTION was made by Councilman Considine, seconded by
Councilman Forman and carried unanimously on roll call vote as
follows that the work be accepted and final payment authorized
in accordance with the terms of the contract.

Upon advice of the City Manager that under date of July 23,
1964 the Chief of .Police, in accordance with Section 6314.4 of
the Arcadia Municipal Code, notifed the Pacific Patrol, Division
of the American Security Rangers, Inc., that its business license
was suspended for the primary reason that the organization is no
longer licensed by the State of California and that at the next
regular City Council meeting a recommendation that said permit
be revoked will be considered by the City Council. No one de-
siring to be heard on the matter MOTION was made by Councilman
Forman, seconded by Councilman Reibold and carried unanimously
that the permit be and it is hereby revoked in accordance and
for the reasons stated by the Chief of Police.
MOTION by Councilman Considine, seconded by Councilman Balser
and carried unanimously that the City Council accept the re-
commendation of the City Manager and the Water Superintendent
and approve the specifications for the cleaning and cement
mortar lining of water mains in place; that the City Clerk be
and she is hereby authorized to call for bids in conformance
with said specifications, expenditures for the project is pro-
vided in the 1964-65 Budget - Water Reserve and Depreciation
Fund - Major Projects, Main Replacement and Mortar Lining Item
471-70-1; said bids to be received and opened August 17, 1964
at 11 A.M., bids to be tabulated and results submitted to the
City Council.

Consideration given the request of Bernard Koch for annexation
to the City of his property at 5736 Row1anlAvenue, Temple City
after detachment from Temple City. Mr. Koch had been advised
on May 6, 1964 to discontinue efforts for annexation as the City
Departments had studied the proposal and recommended against such
annexation, said findings incorporated in a communication from
the City Manager to the City Council under date of July 30, 1964.
Mr. Koch had subsequently asked for reconsideration and listed
12 reasons why in his opinion his property should become part of
the City of Arcadia. The Planning Director had replied in detail
in his report of July 27, 1964. Denial of the request was again
recommended. Discussion ensued and MOTION was made by Council-
man Balser, seconded by Councilman Forman and carried unanimously
that the request be denied as the annexation would create a devel-
opement not in keeping with City standards.

Upon recommendation of the City Manager the following property
acquisitions were authorized:

the City Manager and the City Attorney take necessary steps for

priated from Reserve for Capital Projects Account No. 285 in the
General Fund and transferred to Capital Improvement Projects

vehicular traffic controls at Live Oak and Las Tunas Drive on

The City Manager chronologically explained the history of the
proposed extension of Arcadia Avenue from Baldwin to La Cadena
Avenues; that the street is now improved to a full width to
approximately midway in the block and the right of way has been
obtained or will be obtained in the immediate future for the
southern portion of the required right of way to a full 167'
west of La Cadena Avenue. He advised further that the property
at 1103 La Cadena is required in Order to have an outlet for
Arcadia Avenue; that the City had at one time negotiated for
this property; that it is now available and recommended its
acquisition.
MOTION by Councilman Balser, 'seconded by Councilman Forman that
the City proceed with the acquisition of 1103 La Cadena Avenue
in the amount of $35,750 from Kenneth K. Krohn; that the Manager
be authorized to execute escrow documents on behalf of the City
in form approved by the City Attorney and that $35,950 be appro-
priated from Reserve for Capital Projects Accou~t No. 285 in the
General Fund and transferred to Capital Projects Account No. 235
Property Purchase - Arcadia Avenue.

Further discussion held. It was brought out that the house would
either be rented or removed depending on its condition. Mayor
Turner was of the opinion that if the street were needed, the
property owners would evince sufficient interest and would grant
the land needed for the street; that the property being approved
for purchase may be needed for the street but he could not see
the City becoming part of sub-standard s~reet construction~
Councilman Forman observed that from a water drainage standpoint
the street should be extended. Councilman Considine was advised
that this procedure does not dedicate the property for street
purposes.
ROLL CALL VOTE was then taken on the MOTION.

MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that the recommendation of the City Manager,
the Director of Public Works and the Water Superintendent be
APPROVED and that the City accept the improvements in Tract Nos.
27647 and 29221 (Longley Way easterly of E1 Monte Avenue) for
maintenance and the surety bonds deposited by the subdivider
released from further liability.
MOTION by Councilman Forman seconded by Councilman Considine
and carried on roll call vote as follows that the Street Lighting
Report (District Nos. 16 and 23) filed by the Director of ,Public
Works on July 21, 1964 for the tax levying purpose be amended to
provide for the new schedule in rates for Mercury Vapor Lamps
which was effective July 1, 1964':

Councilman Reibold MOVED, seconded by Councilman Forman and
carried on roll cal~ vote as follows that the City Council
award the contract for the work to the low bidder, J. D.
Diffenbaugh, Inc., in the amount of $20,311.00; that all
other bids be rejected; that any irregularities or informalities
in the bids or bidding process be waived and:that the Mayor and
City Clerk be authorized to execute such contract on behalf of

The City Manager advised of the receipt of what appears to the
staff to be a final agreement with the State Division of Highways
for the Foothill Freeway through the City. The areas of dif-
ference from the original agreement explored and it was the
consensus of the City Council that the pr~posed improvements
will be advantageous to the City.
Whereupon the City Attorney presented, explained the content
and read the title of Resolution No. 3696, entitled: "A RESOLUTION
OF TIlE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE WITH THE STATE OF CALIFORNIA
DEPARTMENT OF pUBLIC WORKS, DIVISION OF HIGHWAYS, AN AGREEMENT
FOR THE CLOSING OR RELOCATION OF CITY STR~~TS, THE CONSTRUCTION
OF FRONTAGE AND OTHER LOCAL ROADS, FOR CARRYING CITY STREETS OVER
OR UNDER THE FREEWAY, AND FOR OTHER CONSTRUCTION AFFECTING CITY
STREETS IN SAID CITY, SAID AGREEMENT SUPER~EDING A SIMILAR AGREF-

Upon recommendation of the Recreation Commission and the City
Manager MOTION was made by Councilman Forman, seconded by Council-
man Balser and carried unanimously that the City Manager be
authorized to declare the intent of the City Council to acquire
property at 1410, 1416, 1422 and 1432 S. Sixth Avenue if and when
the parcels are placed on the market for sale. The'property would
be used in conjunction with the Camino Gro~e School facilities and
maintained as a neighborhood Park.
The recommendation of the Recreation Commission was APPROVED on
MOTION by Councilman Reibold, seconded by Councilman Forman and
carried on roll call vote as follows that the City purchase four
sets of 100 seat bleachers and three ping pong tables from the
Parks and Recreation Facilities Fund, IN the amount of $3000.

The City Manager advised of a communication from John F. Stewart
Chairman of the Rodeo Committee of the Arcadia Mounted Police
Association requesting official approval in order for the
Association to sponsor the RCA Rodeo proposed to be held in
the Pasadena Rose Bowl on January 24, 1965. The Association
would hope to turn over a sizeable percentage of the proceeds
from ticket sales to the Arcadia Chamber of Commerce to under-
write the entry and construction of a float in the annual Pasadena
Rose Parade with the remainder to be placed in trust for the
Mounted Police Building Fund. Council approval is required
because of the name of the organization and semi-official ties
with the Police Department.

Discussion ensued with Mr. Stewart participating. Concern was
expressed in the method and/or wording of the approach to the
resident by telephone solicitation for ticket sales. Mr. Stewart
stated in part that the Association would not ask for contribu-
tions, only bona fide ticket sales and that if the project is a
success it would be sponsored each year which would assure the
City's representation in the Parade. He also advised that the
Chamber of Commerce was in accord with the project.
It was the consensus of the City Council that the event be
approved in princi~le insofar as sponsorship is concerned and
if the plan is repeated next year it should be reviewed by the
City Council. It was brought out that the main endeavor for
ticket sales would be made via mail contact the second year.
MOTION was then made by Councilman Balser, seconded by Council-
man Forman and carried unanimously that the project be APPROVED
in principle and that the City sponsor the Arcadia Mounted Police
Association in its holding of the rodeo and that the City Council
review the results of the first year's operation prior to approval
of the project next year.
Mr. Goebel, attorney for the A & A Building Materials Company,
was advised that the matter in which he is interested (Community
Commercial zoning in the Central Area) would not be discussed at
this meeting; that he will be so advised by agenda notice.
The communication from the Church of the Latter Day Saints
pertaining to support of a bond election for a school-community
auditorium to be built on high school property was ordered received
and filed.

The City Attorney presented, explained the content and read the
title of Resolution No. 3694, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, AMENDING SECTION 5 "HOLID\YS" OF
RULE IX--"LEAVES" OF THE PERSONNEL RULES AND REGULATIONS".

Harold Sumner, 375 W. Camino Real, presented a proposed Pro-
clamation to recognize Free Enterprise Day on Monday, October
5, 1964 and every year thereafter. He asked the'City Council
to consider proclaiming such a day. . Counci1man'Considine
advised that he had received a letter rel"ting to the same
matter and asked that copies be circulated among' the legislative
body along with a copy of the material submitted by Mr. Sumner.
The City Clerk will duplicate the material and see that it is
distributed as requested.
Robert Arth, 1017 Catalpa Road, representing the Rancho Santa
Anita Association, observed that the Association had protested
any raising of the grade at Michillinda Avenue. He was assured
by the Director of Public Works that there have been no changes
in the elevation concept.

William Hovanitz, 1160 W. Orange Grove Avenue, evinced interest
in the freeway as it is proposed to be constructed at Michillinda.
Mrs. William Barton, 518 Fairview Avenue, referred to the proposed
extension of Arcadia Avenue asking if and when it becomes a reality
could an appropriate fence be constructed affording privacy for her
property. She was advised that the Director of Public Works will
contact her to discuss' the matter.

The City Attorney distributed copies of the Amicus Curiae brief
filed on behalf of Arcadia and other cities in the Long Beach
Gambling Ordinance case. He also commented on the forthcoming
hearing in Los Angeles of the Senate Fact Finding ~ommittee on
Home Rule on September 24, 1964.
Mayor Turner reminded the officials of the Independent Cities'
Seminar to be held in Palm Springs September 19 and 20, 1964.
The resignation from the Sister City Commission by L. Halden
. Wentworth, former Chamber of Commerce manager, was accepted.
The vacancy will not be filled until after the appointment of a
new Chamber manager.
