The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the City H~ll on October 6, 1964
at 8 P.M.

The Minutes of the Regular Meeting of September 15, 1964 were
approved on MOTION by Councilman Reibold, seconded by Councilman
Forman and carried unanimously except that Mayor Turner abstained
from voting due to his absence from said meeting. The Minutes of the
Adjourned Regular Meeting of September 24, 1964 were approved on

MOTION by Councilm~n Balser, seconded by Councilman Reibold and
carried unanimously.
Planning Commission Res. No. 529 recommending the denial of a zone
variance request by the Arcadia Christian Reformed Church to permit
the use of property at 121 W. Lemon Avenue for off-street parking and
the existing residence for Sunday School purposes. The matter had
been before the City Council on September 1, 1964 at which time a
public hearing was scheduled on motion of the Council.
Projecturals were reviewed and the background was explored by the
Planning Director stating that the surrounding property is R-l zoned;
that the existing building would have to be reconstructed to comply
with the Building Code; that the parking is qeeded but would be
better located if provided on the lot immediately north of the
existing site which, would permit diagonal parking.
Mayor Turner then declared the hearing open.
William I. Van Worden, representing the Church Council, stated in
part that when the application was filed he was not aware that the
existing residence would not comply with the. Building Code for class
rooms and asked that if. approval is granted for parking that the
house be permitted to remain, as it could be.u~ed as a rental which
would help defray costs. He also stated in part that to be required
to construct a 6' wall along the north property line, curbs and
gutters on Lemon Avenue and a 5' sidewalk along Baldwin Avenue would
place a heavy finapcial burden on the Church,
Victor Compas and Ben Nelson both favored the zone variance. John
Cameron asked th~t' the parking lot be paved tf the variance were
approved. Craig>ttndberg asked that the lighting be adjusted to
prevent glare and:~lso referred to the noise emanating from the
Church recreational activities.

The hearing was closed on MOTION by Councilman Balser, seconded by
Councilman Reibold and carried unanimously.
Councilman Balser stated in part that the City is fortunate that its
churches grow and that the City has a responsibility to make provision
for such growth; that with the widening of Baldwin Avenue and the
advent of the freeway the traffic hazard at this location will
increase; that the City Council should give serious consideration to
the request.
It was the consensus of the City Council that items brought up are I
covered in the conditions imposed by the Planning Commission if the
variance should be granted, except that Item Nos. 1 and 2e should be
deleted. l)Residence on parking lot for Church purposes and 2e) wall
to be constructed to the north of the existing Church property.
Councilman Reibold then MOVED that the variance be granted subject to
conditions outlined in Res. No. 529 except that Nos. 1 and 2e be
deleted. Councilman Balser seconded the motion which was carried
unanimously.
Mr. Reinschmidt (north side of the Church property) asked that a wall
be provided for the extension of the 7 parking spaces which are
currently being constructed.
The City Council concurred and Councilman Forman MOVED for an
amendment to the motion; that a wall be constructed for the extension
of the 1 parking spaces - the figures to be consistent with the wall
and the parking lot. Motion seconded by Councilman Reibold and
carried unanimously.
This matter was before the City Council for legal clarification,
having been heard and approved on September 1, 1964. Planning
Commission Resolution No. 525 (property on West Duarte Road and on
Golden West Avenue) and Resolution No. 531 (property in the
unincorporated area on Golden West Avenue and on Naomi Avenue -
proposed Annexation No. 33 Uninhabited). The property was recom-
mended for C-l and D zoning.
Mayor Turner declared the hearing open.
Councilman Reibold MOVED that the proceedings and all testimony given
at the public hearing held before the City Council on September 1,
1964 be made a part of this record. Councilman Forman seconded the
motion which was carried unanimously.
No one desiring to be heard, Councilman Reibold MOVED that the
hearing be closed. Councilman Forman seconded the motion which was
carried unanimously.

Councilman Forman then MOVED that the City Council approve the
Planning Commission recommendations as contained in Resolution
Nos. 525 and 531, subject to conditions as amended by the City
Council at the hearing of September 1, 1964. Councilman Balser
seconded the motion.

what could very probably be to the detriment of that which is already
properly zoned and when we have also an adequate amount of properly
zoned business property in the City which I believe is not being
properly used; and I do not think it is to the betterment of Arcadia
to annex and rezone .properties for the benefit of developers who are
here to bring into being a shopping center that is not going to be a
credit to the City in the long run".

The existing status of the Live Oak business district had been
incorporated in a report submitted to the City Council on September
24, 1964 along with a recommendation from the Planning Commission
that the entire area be placed in a moratorium until public hearings
on the zone variance application for a new shopping center at the
northwest corner of Santa Anita and Live Oak had been completed and
decisions reached on zoning for the entire area,
Councilman Reibold stated in part that he certainly had no objection
to a study of an area which might result in changes being made, but
that he was unalterably opposed to the use of a moratorium; that in
his opinion it would be a misuse of Council authority and power.
Councilman Forman stated in part that if there should be need of a
moratorium in the future it could be considered at that time; that
for the present he did not see where it would be detrimental to the
City to permit the subject property to continue in its present zoning.
He further commented that should an attractive development present
itself Council would have an opportunity of reviewing same in
variance proceedings.
Mayor Turner stated for the record: "I would like to commend the
Planning Commission for a very fine comprehensive report. It was
excellently done and is certainly going to be a fine guideline to
start from in the redevelopment of this area which from my personal
observation in the last few days has led me to believe that it is
necessary and highly desirable. This condition did not happen over a
short period of time. As a matter of fact it has been years in the
making and I concur with Councilmen Reibold and Forman that another
three months is not going to materially caus~ the situation to be any
worse and I would also be opposed to placing the property in a
moratorium."
Councilman Balser stated in part that the report reflects the
conditions as they exist; that establishing a moratorium is a serious
matter and that in his opinion nothing would be gained; that he is
opposed to a moratorium but highly in favor of the studies.
Councilman Considine then MOVED that in line with Council thinking
the City Council not accept the recommendation of the Planning
Commission for the creation of a moratorium in the Live Oak business
area; that the studies which were so capably presented be continued.
Motion seconded by Councilman Balser and carried unanimously.

call vote as follows that the low bid of Paul Sanker Company in the
amount of $15,944.00 for the landscaping of Huntington Drive median
strip (between Santa Anita and Second Avenues) be accepted; that any
irregularities or informalities in the bids or bidding process be
waived and that the Mayor and City Clerk be authorized to execute a
contract in form approved by the City Attorney; that $17,000 be
appropriated from Reserve fOF Capital Projects Account No. 285 in the
General Fund and transferred.._to Capital Improvement Projects Account
No. 236 (Beautification of Huntington Drive median - Santa Anita to
Second Avenue).

The recommendation of the City Manager was approved on MOTION by
Councilman Forman, seconded by Councilman Considine and carried on
roll call vote as follows that the low bid of the Mead House Wrecking
Company in the amount of $4,169.40 be accepted for the second phase
of the demolition and removal of buildings for the combined City Yard
project; that any irregularities or informalities in the bids or
bidding process be waived; that all other bids be rejected and that
the sum of $4,500 be transferred from Reserve for Capital Projects
Account No. 285 in the General Fund to Capital Improvement Account
No. 303 Combined City Yard Site Demolition.

MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously that the plans and specifications be accepted and
that authorization .be granted for the call for bids for the con-
struction of an equipment service garage on the combined city yard
site.
MOTION by Councilman Reibold, seconded by Councilman Forman and
carried unanimously that the Mayor and City Clerk be authorized to
execute a new Grant of Easement prepared by the Southern California
Edison Company. This is necessary in connection with the con-
struction of the Orange Grove Reservoir No.5 in the relocation of
the electric line and appurtenances serving the wells and pumping
facilities at said plant.

be authorized to execute an Agreement for the purchase, for $1.00,
by the City of the State's Title to certain tax deeded land south

A comprehensive report, prepared by the Administrative Assistant, on
the proposed County Health Code which is to be adopted by reference,
was discussed at length. The report contained background of the
subject matter and also the newly adopted County Public Health
License Ordinance. .
The City Attorney thereupon presented for the first time, explained
the content and read the title of Ordinance No. 1264, entitled: "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
AMENDING CHAPTER 6 OF ARTICLE V OF THE ARCADIA MUNICIPAL CODE BY
REPEALING SECTIONS 5602.1, 5602.2, 5602.3, 5602.4 AND 5602.5 THEREOF,
AMENDING SECTION 5600 THEREOF AND BY ADDING A NEW SECTION 5602.1
THERETO AMENDING CHAPTER VI OF THE HEALTH CODE!'.

MOTION by Councilman Considine, seconded by Councilman Forman
and carried unanimously that the request of Wesley C. Couch for
relief from the moratorium and the issuance of a license to operate
a pharmacy at 208 S First Avenue be APPROVED. Permission was granted
subjec~ to compliance with contemplated zoning standards, except for
the pre-existing parking deficiency (limited parking in rear of store).
Request for relief from the moratorium to permit LeRoy V. Smith to
lease a store building from Mrs. Helen B. Heidenreich, owner of
property at 111 S. First Avenue. The proposed lease would be for 10
years and the business would be that of an automotive parts and
supply, that 40% would be retail and the balance wholesale.

Extensive discussion held on retail and wholesale businesses; it was
brought out that an automotive parts store is not permissible either
in the current C-2 zoning ur the proposed C-l and D zoning; that a
10 year lease seems excessive as it might interfere with a good
proper development as termination dates are not easy to eliminate
after being imposed.
Consensus of the City Council being that the proposed business is
not in keeping with the redevelopment plans for the area, MOtION was
made by Councilman Reibold, seconded by Councilman Balser and carried
unanimously that the request be denied.
The City Attorney presented, explained the content and read the
title of RESOLUTION NO. 3724, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DESIGNAtING THE INTER-

Mayor Turner ordered filed the communication from the First Avenue
Parent-Teacher Association recommending that a bond issue for an
auditorium be placed on the February 1965 ballot.
Communication from Hutchings Motor Inc. for relief from the mora-
torium for permission to construct and operate an automotive center
at 33-41 Morlan Place. Communications favoring the request were

This matter had been before the City Council previously at which
time it was stated that it was difficult for the owner of the
property to negotiate for utilization of the land for the uses
described in the new C-l and D Zone.
It was the consensus of the City Council that although the services
of an automotive center, including a car wash, are needed in the
community, that this is not a proper location and not consistent with
the concept for the total area which has been so long in the develop-
ment; that it is a major piece of property and should remain in C-l
and D zoning. Mayor Turner observed that he had made a suggestion
that plot plans and schematics be submitted in order for the City
Council to determine if there was any compatibility with the permissi-
ble usage but they were not received. He then ordered the communi-
cation filed.
On MOTION by Councilman Balser, seconded by Councilman Forman and
carried on roll call vote as follows the City Council accepted the
recommendation of the City Manager and awarded the contract for the
modification of the St. Joseph Booster Pump Station to the only
bidder, Pylon, Inc., in the amount of $20,321.00; that the Mayor and
City Clerk be authorized to execute said contract in form approved by
the City Attorney; that the City Manager be authorized to issue a
Change Order deleting 3 requirements resulting in. a savings of '.$2500
to the City arid that $18,500 be transferred from Account No. 471-70-1
to Account No. 41l-70-3.in the 1964-65 Water Department Budget.

It was noted that many telephone calls and inquiries have been
received by the City Councilmen regarding this matter, both in favor
and opposed to the levying of the motel transient tax which shall
become effective February 1, 1965.

Discussion held on the contents of Resolution No. 3715 pertaining to
the proposed animal hospital at 111 - 121 E. Foothill Boulevard with
Mayor Turner favoring the deletion of a registered landscape architecr
and calling for a qualified landscape architect instead. What
constitutes objectionable noises emanating from such a facility also
explored.
Mrs. Ruth Magill, 1120 Highland Oaks Drive, presented a petition
signed by owners of eight properties on Highland Oaks Drive requesting
a delay in the adoption of this resolution; that they had not under-
stood the procedure governing the filing of an appeal and desired to
present further evidence of the incompatibility of an animal hospital
at the proposed location.
Frank Robinson, 136 E. Sycamore Avenue, spoke in opposition.
MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously that the City Council delay action on the
recommendation of,the Planning Commission for two weeks providing
time in which an appeal may be filed in accordance with the Municipal
Code requirement applicable thereto.

California Cities' meeting; that proposed by-laws of the Southern
California Association (SCAG) were approved; certain priorities of
criteria on annexations approved; Revenue Taxation Committee
Chairman reported that 60 Cities and 6 Counties throughout the State
had adopted the hotel-motel bed tax; that certain Charter Cities in
Los Angeles County have adopted the 2~ cigarette tax; that he had
attended a most interesting City of Commerce dedication. He further
advised that the League officials were looking forward to attending
the annual meeting to be held in Arcadia on January 21, 1965.
Mayor Turner advised of a forthcoming Baldwin Park Fire Station
dedication.
The City Council was in accord with a suggestion by Mayor Turner that
the Procedural Ordinance be put into booklet form.
Mayor Turner had the unanimous agreement of the City Council in
suggesting that the Independent Cities and the Contract Cities
organizations be eliminated; that the League of California Cities
could handle the same work in committee; that no real purpose is
being served by the two organizations and that the League is becoming
more cohesive and interested.
At 11:10 P.M. Mayor Turner adjourned the meeting.
