CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
OCTOBER 20, 1964
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the City RaIl at 8:00 P.M.,
October 20, 1964.

MOTION by Councilman Reibold, seconded by Councilman Considine and
carried unanimously that the'Minutes of the regular meeting of
October 6, 1964 be approved as submitted in ,writing.
Planning Commission Resolution No. 533 recommending the classifi-
cation and the reclassification to Zones C-1 and C-2 and also to
Zone D (architectural overlay) of the property located at the south-
west corner of Second Avenue and Duarte Road - 134-138. 140, 160 &
186,E. Duarte Road and 915-921 S. Second Avenue.
The Planning Director explained that the property is presently C-l,
R-l and R-2 and is bounded on 3 sides by commercial properties; that
to the south it is R-1 and that the corner is vacant land; that the
Planning Commission had held two public hearings and a meeting with
the adjacent property owners, the developers and the staff in an
endeavor to work out some of the differences between all concerned.
Comprehensive projectura1s were viewed showing proposed development
including present site characteristics, the proposed service station,
the market and sate11ite shops. Building coverage, parking ratio
and the height of the building were explored, with emphasis placed
on the south elevation which is the critical area as far as the
adjacent property owners are concerned.
Mayor Turner then declared the hearing open and the following
persons addressed the City Council:
L. C. Smul1 , Vice President of Lands and Buildings, Inc., 811 W.
Seventh Street, Los Angeles, stated in part that as developers of
the property they had worked closely with the City departments, the
Commission and the property owners in order to establish a good,
uniform desirable development which economically would be sound and
justified, that architectural1y every effort had been made to soften
the effect of the structures through adequate and attractive
landscaping; that the 14 ft. building height agreed upon is the
lowest profile the market has ever constructed; that all plans for
the shopping center have been made in order to negate any adverse
effects to the property owners on the south with whom they had

reached a basic agreement, Re stated further that they had not had
an opportunity to discuss with the Commission any of the regulations
with which they did not wholly agree; that in his opinion they are
more a matter of specifics than change.
Discussion then held on the noise factor emanating from loading
operations. It was stated by Mr. Smull that the market has absolute
schedules for the food merchandise but that the produce is the main
problem; that it is impossible for the market to guarantee that a
store will be serviced at certain hours in this particular department.
Discussion held on the size of the sign. It was stated by Mr. Smull
that Alpha Beta Market uses standard signs which are mass produced
and in most cities the requirement permits tower signs to he 52 ft.
but such is not true in Arcadia; that for the protection of the
adjacent property owners to the south the sign has been designed and
situated in the plans in such a manner that it cannot be seen by them.

Robert Runtley, 777 S. Rarbor Blvd., La Rabre, stated in part that
governmental jurisdictions require that loading and unloading
activities not exceed the ambient noise level; that produce is
usually delivered once daily between 5 A,M. and 7 A.M. in the San
Gabriel Val1ey area; that foods are delivered during the regular
working hours of the day. Re stated further that the familiar Alpha
Beta sign has been used for 7 years.
Jack Stokey, 265 W, Lemon Avenue, Arcadia, owner of the southwest
corner of Duarte Road and Second Avenue, asked that the requested
zoning be approved; that he had dedicated property with the prospect
of being able to negotiate a lease for a service station.
For the enlightenment of Mrs. George Kileen, 143 Greenfield Place,
the loading zones and the location of the sign were delineated on a
map. Conditions and modifications were explored by the City Manager
as contained in his report.
Bill Murfell, 135 Greenfield Place, was informed that the conditions
require all trash, etc., to be maintained in a 6' concrete block wall
enclosure. Re stated that the wall at his rear property line is 6'
and he would not like to be able to see the rubbish from his
property. Re also expressed concern about the location of the
loading dock, that he has only a 25' rear ykrd, which would abut the
market property.
David Cohn, 925 N. Garfield Avenue, Alhambra, owner of property at
925 and 1001 S, Second Avenue, spoke in protest to the proceedings;
that he was most concerned about the provision for rubbish mainte-
nance and the noise which would be noticeable from his property. Re
also felt that a 6' wall would be inadequate.

Jerry Melanie, 141 Greenfield Place, spoke in protest - that the
advent of the market would result in two markets within one block
which, in his opinion, could devaluate property.
Mrs. Jean Potter, 921 S. Second Avenue, stated in part that the
disapproval of the zone change would allow the older homes to remain
and the owners would undoubtedly have to resort to the renting of
same.

No one else desiring to be heard, Councilman Balser MOVED that the
hearing be CLOSED. Councilman Reibold seconded the motion which was
unanimously carried.
Extensive discussion ensued. The report of the City Manager setting
forth the conflicting requirements of the Planning Commission and the
amendments proposed by Lands and Buildings, Inc., was explored at
length. The report was the result of a meeting with the developers
and the City Manager and represented compromises worked out therein,
Particular emphasis was placed on the sign and its location, the
possibility and value of increasing the rear wall to a height of 8'
instead of the 6'. Rowever, it was felt that the higher wall would
interfere with circulation and ventilation for the property owners
whose property had only 25' at the rear. Some of the wording in the
resolution ~as explored.
It was the consensus of the City Council that the zoning portion of
the recommendation could be introduced in ordinance form at this
meeting and the 'D' regulations to be incorporated in a resolution
for a future meeting at which time the wording could be reviewed.
Whereupon the City Attorney presented for the first time, explained
the content and read the title of Ordinance No. 1265 entitled: "AN
ORDINANCE OF TRE CITY COUNCIL OF TRE CITY OF ARCADIA, CALIFORNIA,
AMENDING SECTION 9233.14 OF THE ARCADIA MUNICIPAL CODE BY RECLASSI-
FYING TO ZONES C-1 AND C-2 AND ALSO TO ZONE D (ARCRITECTURAL OVERLAY)
THE PROPERTY LOCATED AT TRE SOUTHWEST CORNER OF SECOND AVENUE AND
DUARTE ROAD IN SAID CITY."

It was Councilman Balser's observation that the Planning Commission
and the staff is to be commended in resolving the matter thus far;
that in his opinion the changes appear to be of an inconsequential
nature. Whereupon he MOVED that the conditions recommended by the
Planning Commission be approved as modified by the report from the
City Manager, except that Item 19 pertaining to sign remain as
recommended by the Planning Commission. Councilman Forman seconded

Mayor Turner advised that he and Mrs. Turner have accepted an
invitation from the Pan-American Federation of America to visit
Arcadia's Sister City, Tripo1is, Greece, in July 1965 at the expense
of the Federation; that the 34th National Annual Federation
Convention will be held in Tripolis at that time, Re commented that
the gesture evidences a deep feeling on the part of the people whose
lineal history is Greek; that they view the affiliation much more
than just a material exchange.
Mayor Turner declared the hearing open on the County Realth Code by
reference. No one desired to address the City Council and Councilman
Reibold MOVED, seconded by Councilman Considine and carried unani-
mously that the hearing be CLOSED.

Whereupon the City Attorney presented for the second time, explained
the content and read the title of Ordinance No. 1264 entitled: "AN

Planning Commission recommendation that the tentative map of
Tract No, 30142 (located at 1931, 200l and 2009 Bella Vista Drive)
be approved subject to specified conditions, The Planning Director
advised that the Department has been recommending that all utilities
be installed underground, but that in this instance it had failed to
so do; that the Commission in most cases has agreed to this
requirement and he suggested that the City Council consider imposing
this added condition.
Councilman Balser MOVED, seconded by Councilman Forman that the City
Council approve the recommendation of the Planning Commission and
that of the Planning Department (underground utilities).

Mr. McNulty, 245 Carolwood, Arcadia, the developer, addressed Council
stating in part that he was unaware of the possible requirement for
underground utilities until apprised by Mr. Phelps; that he had
obtained estimates of the installation and they were very costly;
that he had made a survey of adjacent subdivisions which revealed
that they are all served by poles; that the existing poles would
serve two of his homes and for the remaining four only two additional
poles would be required. Re asked that the conditions remain as
recommended.

The consensus of the City Council being that underground utilities
are the goal, the fact that there are existing facilities in the area
anq there is need for only two additional poles, Councilman Balser
withdrew his original motion and MOVED that the tentative map of
Tract No. 30142 be APPROVED subject to the specified conditions as
outlined by the Planning Commission. Councilman Forman also withdrew
his second to the original motion and s~coryded the new motion which
was unanimously carried.
Request of the Tidewater Oil Company for relief from the moratorium
to permit the reconstruction of its service station on the northwest
corner of Santa Anita Avenue and Runtington Drive. The Planning
Department recommended granting the request under certain conditions
which included the requirement for planter areas. The applicants
concurred in most of the conditions, asking for minor modifications
in a communication addressed to the City Manager dated October 20,
1964.
Extensive discussion ensued and the conditions were considered in
detail. It was the consensus of the City Council that they could be
worked out at staff 1evel except in the area of planters; that
because of the size of the lot (less than 100' x 100') the placement
of planters on Santa Anita Avenue and on Runtington Drive would
impair ingress and egress to and from the station as well 'as consti-
tuting a safety hazard,
Raymond Kennett, 1669 Wilson Avenue, Arcadia, official with the
Company, and Mr. Aspen, engineer with the Company, explained reasons
for the minor modifications; also asked that the aforementioned
planters be eliminated in the essence of safety.
Edward Dantler, 30 Racienda Drive, Arcadia, stated in part that he
felt it would be difficult to negotiate financing for an eight story
office building for which he is endeavoring to purchase the land on
the northeast corner of Santa Anita Avenue and Runtington Drive
(former Sunfair Market site) as there would then be two corners
improved with service stations; that the area under the Towne Centre
PIan would be pI aced in a 'D' overlay zone; that it was his under-
standing that u1timately service stations would be eliminated in
Zone 'D'.
Renry McNulty, realtor of 11 W. Runtington Drive, questioned what
would happen to the subject property if the reconstruction were not
permitted; that he is the owner of the property immediately west and
for Some time has 100ked to improvement of the corner,
It was brought out that the ground lease is for 25 years with 23
years remaining; that the Company purchased the facilities some three
years ago and is eager to facilitate the rebuilding into an
attractive structure.
Discussion held on service stations being placed in any zone by
special use permit providing the application and improvements have
been approved by the Planning Commission and the City' Council; that
they are being removed from all zones, not just one zone.
Inasmuch as the corner will be much improved by the new station,
whereas if the request were not granted an undesirable occupancy
could remain for an indefinite period of time, it was MOVED by
Councilman Balser, seconded by Councilman Forman and unanimously
carried that relief from the moratorium be granted the Tidewater Oil
Company (5 W. Runtington Drive) subject to conditions as outlined by
the Planning Department with modifications as requested by the
Company with the exception that the requirement for planters on Santa
Anita Avenue and on Runtington Drive be eliminated.

MOTION by Councilman Reibold, seconded by Councilman Considine and
carried unanimously that the request of Douglas R. Cone, dba Arcadia
Motors, for relief from the moratorium be granted and that his
business license be transferred from 400 E. Runtington Drive to
301 E. Runtington Drive. Said approval based on the removal of the
existing service station and full compliance with proposed
regulations of C-2 and D zoning.
MOTION by Councilman Balser, seconded by Councilman Considine and
carried unanimously that the request of George's BBQ for relief from
the moratorium be granted and that the erection of a new sign at
19 W. Runtington be approved subject to a11 sign regulations and the
'01 overlay requirement for this particular area.

The fo110wing bids were received for the replacement of a diesel
tractor with a backhoe and an angle dozer blade for the Water

MOTION was made by Councilman Considine, seconded by Councilman

accept the bid of C. R. Cook Ford Tractors, Inc. in total amount of
$6,080.80 including Alternates A and B; that all irregularities or

Advice that the City Fire Department personnel participated in the
Santa Barbara County Coyote Fire (September 23 to 28, 1964) was
acknowledged with commendation to the Fire Chief and his men.

The City Manager advised that the first financial statement of the
Chamber of Commerce prepared by the firm of Black and Lusich, CPA,
has been filed in his office where the City Council may view same
and all future statements, which wi11 be prepared every 6 months.

Mayor Turner stated that his 'no' vote is consistent with his belief
that the City is not in a position nor should it be in a position of
having to put this street through; that if the residents of the area
desire to have the street they should be willing to deed the
necessary land.
The City Manager advised that he did not receive any bids on the City
owned Duarte Road property; that he had received a communication from
the Westman Development Company (Arthur Bauman) asking for a meeting
relative to the disposition of the land. Councilman Balser MOVED
that the matter be referred to the City Manager, and that an
appointment be made with Mr. Bauman and the Land Committee.
Councilman Forman seconded the motion which was unanimously carried.
Mayor Turner commented that should a Council member of the Committee
be unable to attend the meeting he wil1 substitute.
MOTION by Councilman Considine, seconded by Councilman Forman and
carried unanimously that the request of the Library Board for the
reinstatement of a secretarial classification be granted; that the
tit Ie of "Senior Stenographer Clerk" be changed to "Secretary to the
Librarian" and that the salary schedule be No. 417. The Library
Board had requested salary schedule No, 419.
In order to correct an error in the legal description of property'
which was exchanged with the Rutchings Motors in 1962, MOTION was
made by Councilman Forman, seconded by Councilman Balser and
unanimously carried that the Mayor and City Clerk be authorized to
execute a Quitclaim Deed to Rutchings Motors, Inc., for said land
omission in the legal description of the former deed.

Bil1 Schultz addressed the City Council regarding Tract No, 23146
(located at Second Avenue and La Sierra Drive) and requested
reconsideration of a condition imposed by previous action providing
for 45' radius and a 45' frontage. Re asked for reinstatement of the
original pIan calling for a 40' radius cul-de-sac and the front line
distances as original1y shown on-the tentative map. (These were of
varying widths). /"'----
This matter was before the City Council on July 21, 1964 at which
time it considered the recommendation of the Commission for denial of
the tentative map. Council sustained the decision of the Commission
at this meeting. On August 18 at the request of the property owners
involved in the subdivision the matter was referred to staff for
further study. On September 1, 1964, on the basis of the staff
report, Council approved the tentative tract map subject to the
conditions previously imposed by the Commission. Two of these
conditions being the provision for the 45' radius and the 45' frontage
at the property line of the cul-de-sac,

Extensive discussion ensued with the Planning Director exploring the
entire background of the tract. Projecturals were also shown. Re
stated in part that the 45' frontage requirement is probably more
important than the 45' radius as that would call for the relocation
of the garage which is located too close to the proposed street,
The City Council felt that adherence to its previous action was in
order and it was MOVED by Councilman Forman, seconded by Councilman
Reibold and carried unanimously that the City Council reaffirm its
original action and that aIL conditions imposed at that time be
retained.
The City Council, on October 6, 1964, denied the request of LeRoy
Smith who had applied for relief from the moratorium to permit an auto
parts store at III S. First Avenue. It felt that the usage was not
in keeping with the pIan for the downtown area and also that a
10 year lease as proposed was excessive.
Written request of Dr. I. R, Goulard on behalf of LeRoy Smith, asked
for reconsideration of the request on the basis of a 3 to 5 year lease
instead of the original 10 year lease. Council adhered to its
previous action on MOTION by Councilman Reibo1d, seconded by
Councilman Balser and unanimously carried.
Mayor Turner advised of the forthcoming dedication of the City Rall
at Temple City. Councilman Balser to endeavor to represent the City.
Mayor Turner advised of the forthcoming meeting of the San Gabriel
Valley Mayors' Association. Taxation to be discussed and Supervisor
Bonelli to be present. No member of the City Council being able to
attend, City Attorney Nicklin was requested to attend if possible.
Mayor Turner reminded the City Councilmen and other City officials of
the testimonial dinner to be held on October 23 in honor of former
Councilman Edward Butterworth.
