NOVEMBER 3, 1964
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the Arcadia City Hall on November 3,
1964 at 8 P.M.

The minutes of the regular meeting of October 20, 1964 were approved
as submitted in writing on MOTION by Councilman Considine, seconded
by Councilman Reibold and carried unanimously.
Mayor Turner declared the hearing open on the proposed annexation to
the City of Arcadia of certain territory adjacent and contiguous to
the present City limits, said territory being situated south of
W. Duarte Road and east of Golden West Avenue and designated as
Annexation No. 33, West Arcadia Uninhabited, adding that this is also
the time and place to consider the recommendation of the Planning
Commission with respect to the zoning that is to be placed on said
property concurrent with its annexation; that the recommended zoning
is the same zoning and conditions as was recommended and previously
approved by the City Council for the property immediately north of
the property to be annexed, namely C-l and D with a series of
regulations.
No one spoke in opposition to the proposed zoning and the hearing on
the zoning was closed on MOTION by Councilman Forman, seconded by
Councilman Reibold and carried unanimously.
MOTION was then made by Councilman Reibold, seconded by Councilman
Forman and carried on roll call vote as follows that the zoning on
property contained in the proposed Annexation No. 33 be the same as
approved for the property immediately to the north of which the
subject territory will, if annexed, become an integral part.

It being then in order to consider any protests to the proposed
annexation as fixed by Resolution No. 3711, the City Clerk advised
that she had on file the affidavits of publication and mailing as

Councilman Forman, seconded by Councilman Considine and carried

The City Attorney presented for the first time, explained the content

ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY

Mayor Turner commented on the above recorded vote and stated in part
that the two*'No' votes indicate opposition to the creation of any
additional commercial property; that he feels there is sufficient
C-l and C-2 zoned property which is not developed to its fullest
extent; that he is in favor of upgrading any area and voted in favor
of rezoning that which was already in the City and zoned C-2.
The application for business permit which had been filed by ~tark &
Sons, to install and operate amusement games at Ralph's Market, Live
Oak and Santa Anita, was DENIED WITHOUT PREJUDICE on MOTION by
Councilman Forman, seconded by Councilman Considine and carried
unanimously. The applicant had verbally requested withdrawal of the
application.
The subdivider of Tract No. 22838 (Los Altos Avenue extension) had
requested the City staff to review the status of this tract inasmuch
as he had understood the City was to start condemnation action in
order to acquire the necessary right of way for the opening of Los
Altos Avenue which was not included in the proposed dedication.
The City Manager gave a chronological report which brought out that
in 1962 Council had approved the tract map subject to specified
conditions, one of which was Condition 6 lIthat the City Council
initiate appropriate proceedings to acquire and improve the portion
of the property at 505 Los Altos Avenue". The owner of the one
parcel needed had not been approachable as far as the dedication of

property was concerned; that after considerable negotiations by the
staff he had agreed to dedicate without cost the property necessary
for the subdivision street upon condition that the owner not be
assessed any of the improvement costs; that this was reported to the
subdivider and was considered by the staff to be an appropriate
completion of Condition 6; that the developer had been granted two
extensions (s~x months each) for the filing of the final map, the
last of which would expire November 7, 1964. The minutes of the City
Council meeting of November 7, 1962 set forth the conditions upon
which the Planning Commission had recommended approval of the
tentative map. The Manager asked for clarification of Council's
intent at that time.

Inasmuch as the Subdivision Map Act precludes the extension of a
tract map for more than one year and also inasmuch as the developer
would not be precluded from filing a new map on the same property or
any portion thereof, Councilman Considine MOVED, seconded by
Councilman Reibold, that the staff not pursue the matter further;
that should the subdivider so desire he could file another tract map.
Considerable discussion ensued with Councilman Balser of the opinion
that the developer should be given consideration; that he had made
every effort to develop the property; that the City has a moral if
not a legal obligation to pursue Condition 6. He stated further in
part that he recalled that the owner of the 505 Los Altos Avenue
property was not approachable to any type of settlement.
The subdivider, Arthur Bauman, addressed Council stating in part that
it would be costly to prepare a new set of plans to be reviewed by a
new City Council; that it is unfair to the other property owners
involved in the proposed tract to have denied to them the opportunity
of developing their property because of one owner; that he has
expended a lot of money and asked that a trust against Mr. Mason's
property be established for the pro rata share of the street costs at
a time when Mr. Mason would use the new street.
The City Attorney advised that the property owner agreed to dedicate
land for the new street if the subdivider would pay the costs of the
street. All avenues of street construction were explored, as was the
manner in which a subdivision trust can be placed on property.
Discussion continued on the hazard which would be created by the City
if it should permit the construction of a substandard street; that
the City would be liable for damage from any hazardous condition of
a public street accepted by it.
The possibility of creating a cuI de sac street was dismissed due to
the existing drainage problem.
The City Council then determined to adhere to its original motion to I
deny the request for another extension but advised Mr. Bauman to give
consideration to the filing of another tentative tract map for the
Los Altos Avenue extension by-passing the Mason property or by
compromising with Mr. Mason on street costs.

Request for relief from the moratorium to permit the erection of a
sign at 25 N. Santa Anita Avenue for identification purposes of the
Santa Anita Pharmacy was approved on MOTION by Councilman Forman,
seconded by Councilman Considine and carried unanimously, upon
condition that no sign overhang the sidewalk area.
MOTION by Councilman Reibold, seconded by Councilman Balser and
carried unanimously that the recommendation of the City Manager and
Director of Public Works be accepted and that a stop sign be
installed at the northeast corner of St. Joseph Street and Rolyn
Place.
The City Attorney then presented, explained the content and read the
title of Resolution No. 3728, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DESIGNATING THE
INTERSECTION OF ST. JOSEPH STREET AT ROLYN PLACE AS A STOP INTER-
SECTION AND DIRECTING THE PLACING AND MAINTAINING OF A STOP SIGN

Request of the Alpha Beta Market for modification of one of the
conditions (No. 20) in the approval by the City Council of the
proposed Shopping Center at Duarte Road and Second Avenue. The
Market requested permission to construct its identification sign at
32 ft. instead of the approved 25 ft. within an area of 120 sq. ft.,
instead of the approved 100 sq. ft.
ConSiderable discussion held on,the effect of the requested modifi-
cation, with the City Council not objecting to the request for an
increased area, but n~agreeing on the 32 ft. in height for the sign.
Speaking for a group of residents on Greenfield Avenue, Richard A.
Nash stated in part that they, are satisfied with the 25 ft. high sign
and have no objection to the alteration in tre square footage of the
sign, but asked that the Council deny the request for a 32 ft. sign.
A letter from Mr. Nash was made a matter of record.
For the benefit of the property owners in attendance projecturals
were shown which displayed the visibility of the subject sign from
various distances.
Councilman Balser then MOVED that the City Council not allo~ a change
in the height of the sign; that it remain at 25 ft. Motion seconded
by Councilman Reibold.

Robert Huntley, Alpha Beta Markets, advised that the market would be
happy with the 25 ft. free standing sign - or a 32 ft. sign on the
building; that it wanted the sign to be so situated that it would not
be visible to the residents.

No. 372; that the City also accept the bid of Mackaig & Sons in the
amount of $2,094.23 for the purchase of one Plymouth Belvedere with
the trade-in of Arcadia vehicle No. 371; that any irregularities or
informalities in the bids or bidding process be waived and that all
other bids be rejected. The funds for such purchase reflected in the
current budget.

December 1, 1964 at 8 P.M. was fixed as the t~me for a public hearing
on the adoption by reference of the 1964 edition of the Uniform
Traffic Ordinance as proposed by Ordinance No. 1270 and the Clerk was
instructed to publish proper notice thereof.
Brief discussion held with the City Attorney on the contents of
proposed resolutions and ordinances governing the removal of signs.
The Planning Director expressed concern at the parking situation on
portions of Live Oak Avenue.
Appreciation was expressed by Robert Huntley for the cooperation
received from the City Council and the City staff in resolving this
matter.
The Planning Director reported favorably on the first meeting with
the Planning Commissions of the City and that of Temple City; that
annexations were primarily discussed.
Mayor Turner advised of the same impression held by the Temple City
Mayor.
The City Manager reported on the meeting of the Land Disposal
Committee (with Councilman Considine and Mayor Turner in attendance);
that it had considered the offer of the Westman Development Company
to purchase city-owned property on Duarte Road west of the proposed
American Lutheran Church site and El Monte Avenue; that said offer
was for $1.50 per sq. ft., and a reduction in the land area required

The City Council of.the City of Arcadia, California met in regular
session in the Council Chamber of the Arcadia City Hall on November
17, 1964 at 8 P.M.

The Minutes of the Regular meeting of November 3, 1964 were APPROVED
as submitted in writing on MOTION by Councilman Reibold, seconded by
Councilman Forman and carried unanimously.
Policies and Procedures as recommended by the Sister City Commission,
as well as accounting procedures to be followed in fund raising
activities of the Commission were APPROVED on MOTION by Councilman
Balser, seconded by Councilman Reibold and carried unanimously. The
City Council expressed appreciation for the excellent manner in which
the Commission has organized its activities.
The recommendation of the Planning Commission (Resolution No. 536)
for approval of the zone variance application to permit the
remodeling and enlarging of a non-conforming structure at 1415, 1417
and 1421 S. Sixth Avenue, will appear on the December 1, 1964 agenda
by which time the period in which an appeal may be filed will have
elapsed.
The City Manager recommended approval of the request of Mr. and Mrs.
Edward A. Heiss for an extension of the construction commencement
date from December 1, 1964 to March 31, 1965. The Lease Agreement
and Purchase Option entered into with the Heiss' on April 2, 1963
also provides that a $4000 payment shall be made on January 1, 1965.
The City Manager explained that to date all of the conditions of said
Agreement have been met; that structural plans for the Tower Building
are now being processed by the Planning, Public Works and Building
Departments and that the request is being made by the Heiss' in order
that all negotiations for final loan commitments may be completed.
MOTION was made by Councilman Reibold, seconded by Councilman
Considine and carried unanimously that the request for an extension
in the construction commencement date from December 1, 1964 to March
31, 1965 be APPROVED with the provision that the payment of $4000 due
January 1, 1965 is made.

At the request of the City Council, the City Manager presented a
report on the possible construction of swimming pool facilities for
joint use of the Arcadia Unified School District and the City
Recreation Department. It set forth that the preliminary proposal is
to construct two pools - training pool and diving pool - enclosed by
a block wall with chain link fencing - that the estimated cost is
between $70,000 and $80,000. The School Board asked for a determi-
nation from the City if there is interest in sharing the cost and the
facilities.
Considerable discussion ensued on maintenance responsibilities, terms
of an agreement and to what financial extent the City should
participate. The City Council was advised that a survey of
agreements is being conducted of other areas with similar partici-
pation. MOTION was then made by Councilman Considine, seconded by
Councilman Forman and carried on roll call vote as follows that the
following proposal be submitted to the School Board; that the Board
authorize the School Superintendent to pursue the matter further and
that the City staff be authorized to work with the School staff in
the preparation of an agreement for submission to the Board and the
City Counci 1:
"The City Council has determined that it has a definite
interest in the construction of swimming facilities as outlined
by the School Superintendent and City Manager, which would be
available to both agencies for use.

"It is also the intent of the City Council that the City would
participate in the original construction cost in an amount equal
to 1/3 of the actual cost, provided the actual cost does not
exceed $90,000. If said cost exceeds $90,000, the participation
by the City shall not exceed $30,000.
"These statements of intent are made with the understanding that
construction plans meet with the approval of both the School

Extensive discussion held on the len~thy report prepared and read
by the City Manager on the proposed formation of Southern California
Association of Governments (SCAG). Reference was made to a 1960
publication of "Hetropolitan California" prepared on State level which
set forth in substance that the State should assume the authority for
planning the needs of metropolitan areas. This possibility became a
matter of concern to the County Supervisors who met and discussed
ways in which State control could be escaped. It was subsequently re-
commended by the County Supervisors that an organization such as SCAG
should be formed comprised of Counties and Cities within said'Counties.
The City Manager commented in part that his office is in complete
accord with the objectives for escaping the taking over of the solution
of area problems by State and Federal agencies, however, it has some
qualms about the solution as submitted.
On Mayor Turner's request the following transcription of discussion
is made a part of the minutes in order for its availability for future
study as an implementation to that which has already been presented to
this Council. (MOTION is incorporated therein).
" how many functions could SCAG perform that are not already performed
by existent groups? I have the feeling that we have everything of a
planning nature set up in individual groups already. Would they replace
these groups or would they simply overlap?
CITY MANAGER: "This is the big question in our minds - that it does provide for the
appointment of an executive director and staff by the SCAG organization
and as you read the aims and objectives that include, in my opinion,
those now carried out by LARTS and by the Transportation En~ineering
Board that are performing work in the field of transportation and in
the field of engineering - primarily rapid transit highways and this
type of thing, the Regional Planning Commission is carrying out planning
functions. It seems to me that we do have existing agencies that, if it
were possible to have a central gathering point of data in the Regional
Planning Commission itself, this could perhaps accomplish the purpose.
On the other hand, the other counties that are involved do not have the
structure that exists in Los Angeles County.
MAYOR TURNER: "My answer to ,what Hr. Considine asked, I think there is a more effective
way of doing this same job. I submitted my thinking verbally to the City
Manager and he has not had an opportunity to reevaluate or encompass it
in his report . . . that is that we have a State Association of Supervisors
which is very strong and it brings together all county functions into an
organization that is quite impressive in its stature in Sacramento insofar
" o.,"~,~._l~gislation is concerned. We also have the League of California :Cities
which is divided up into counties or into sectors . . . every city of the
76 in Los Angeles County belongs to the L. A. Chapter of the League of'
California Cities,

"I suggest as an alternate to this cumbersome organization which is
another step in government that has to be dealt with and which could
become actually quite a political empire second only to the Governorship
of the State in the Chairmanship of this committee, that this committee
be composed of one City representative and one Supervisor from each of
the five Counties making a committee of ten to work as a SCAG Committee.
This committee would then operate, as I see it, in this manner:
A supervisor from each County that is representative on this Committee
then would take this Committee's solution to' a problem to a Supervisor
and he again to his supervisor and then on to the State Association
and make himself heard. The City representative would take it back to
the League Chapter, of ,.hich it is a member and to the League's backing
locally - then assuming that the State then would back it up, I think

that the League of California Cities and the State Association of
Supervisors being the culminating point of any recommendation of the
SCAG Committee would be much more effective and a supplemental
organization made up from the composition of these two organizations.
"This would be my solution to it and I think it would be keeping us
from developing another step in government, that in my opinion, can be
very cumbersome... could get quite logical although they have tried to
dispel any fears on anybody's part that there wou~ ~e any great cost
involved.... the Government doesn't seem to operate over a period of
years in this manner. When you get this organization tunctioning, I am
sure it is going to pyramid and I think we have the organizat~ons through
which we can do this job. It would probably become very cumbersome.. I
it is a very complex organization that they hope to set up and I for
one would not be in favor of the City of Arcadia being a party to the
SCAG organization. _
"Would it be a situation wherein the SCAG group could be just one other
group that would pre-empt certain home rule powers that we now are
sharing on a voluntary basis that are still maintaining final authority
within our 0';0 right?
"I don't believe that this could necessarily be one of the major factors
in that the general assembly is made up of representatives of every
City \V'hich I assume \.JQuld be the same representative as that for the
City in the League of C~lifornia Cities.
"Are they advisory or are they going to wind up <<ith authority to do
something?
"They are advisory only at the present time.
"Essentially it is a pressure group.
"They would still have to come back through the League of California
Cities which is the spokesman for the State associating supervisors
which in each case is the spokesman for the composite or the accumulation
of the city's budget.
"If it was a part of the two organizations, namely, the League and the
Supervisors' organization, would then those other people have the right
to overrule what the interested parties are concerned with? In other
words, the problem arises because Los Angeles County, Orange County,
Ventura County, Riverside' and San Bernardino Counties in the not too
distant future will be one continuous mass of homes, structures, etc.,
and as such creates a problem. Now, the people of -. -,~y,.fi ~

"As I see it, the end result whether it is a SCAG organization set up
as they propose or as I propose, it is the same . . . they still have
to come back to somebody to carry the ball. These people are pioneers
and are being set originally as an information gathering group and as
a fact finding group to have to take the action and the only logical
group left to take the action is the League of California Cities and
the Association of Supervisors... It still comes back that the only
elected officials who have the power to act are the Supervisors and the
City Councils.

It reminded me that the State was going to pre-empt our powers.. I
didn't feel very secure in it as they had it outlined .. I don't think
its any good as a home rule concept.
"As I said this would be a political dynasty next to that of the
Governorship of the State in the power of the chairman or president
of the group. I don't believe it is too far off because I don't think
there is any other group who would have the power of the State that they
would have.
"In view of all of the discussions that are going on and in view of
my own feelings of all the things that SCAG has to offer are already
available in other organizations now existent and not being desirous
of further burdening budgets by creating other political empires,
I propose... (He then stated the motion as follows:)
MOTION that we do not at this time join SCAG but rather sit back and
propose if we choose a counter proposal to use'existing agencies
or observe what happens to SCAG in the hands of other cities and I am
sure we can always join hands with them at a later time if it seems

On recommendation of the City Manager MOTION was made by Councilman
Forman, seconded by Councilman Reibold and carried unanimously that
the zoning regulations applicable to Live Oak Avenue and Lynrose
Street between Tyler and Lenore Avenues be referred to the Planning
Commission.for study. It was set forth in a comprehensive report
submitted by the City Manager that new and proposed businesses are
creating traffic and parking problems for the particular area.
Although Lynrose and streets south therefrom are not within the City,
every effort has been made to resolve the situation which is being
generated by the lack of parking area for the employees of the
businesses established and operating within the two block area on
Live Oak Avenue. The formation of a parking district was discussed
as a possible solution.
MOTION by Councilman Balser, seconded by Councilman Considine and
carried unanimously the request of the Better Gardens Nursery for
permission to erect a fire proof tent in the El Rancho Shopping
Ce~ter for the purpose of storing Christmas trees from November 20 to
December 20 was APPROVED.

carried on roll call vote as follows an amendment to the City's
contract with the State Employees' Retirement System was APPROVED.
The amendment would provide for an increase in retirement allowances,
special death benefits and survivor allowances with respect to
retirements and deaths which occurred prior to January 1, 1962.. It-,
was estimated that the t'otal amount of increase in, allowances would'-'-'
be, $2,427,12 per year or $202.26 per month for 24 persons. .The staff

carried unanimously that permission be granted for a teen-age dance
at the Armory on Friday November 27, 1964. It will be sponsored by
the Arcadia Teen-agers. It was felt that an opportunity should be
afforded for this activity.
The Study Session scheduled for November 26 (Thanksgiving Day) was
cancelled. Determination will be made at the December 1st meeting
as to whether or not a December Study Session will be held.
Councilman Forman commended Wesley McDaniel on his Civil Defense
presentation at the Commission meeting on November 16, 1964.
Mayor Turner advised that the City would not be represented at the
forthcoming Independent Cities' meeting as members of the City Council
would not be able to attend.
Mayor Turner reminded the City Clerk of the extensive mailing in
connection with Resolution No. 3736.
Mayor Turner advised of the forthcoming meeting on human needs of the
Community Planning Counsel (November 20, Friday 8:30 A.M.) and
observed that the local situation does not indicate participation at
this time.
