The City Council of the City of Arcadia met in regular session in
the Council Chamber of the City Hall at 8:00 P.M., December 1,
1964.

The Minutes of the regular meeting of November 17, 1964 were APPROVED
on MOTION by Councilman Reibold, seconded by Councilman Forman and
carried unanimously.
Mayor Turner declared the hearing open on the adoption by reference
of the fotlowing Code for the City, to wit: the Uniform Traffic
Ordinance, 1964 Edition, adopted and published by the League of
California Cities and all of the provisions of said Uniform Traffic
Ordinance, 1964 Edition, adopted and published by the League of
California Cities, except Sections 1.11, 2.7, 2.8, 11.1, 11.8, 13,
13.1, 13.2, 13.4, all of Article XIV comprising Sections 14 to
14.12 and Sections 16, 16.1 and 16.2. The City Clerk advised that
notice of the hearing had been given and three copies of the Uniform
Traffic Ordinance kept on file in her office for public inspection,
all as required by law. No one desiring to be heard on the matter
Councilman Reibold MOVED that the hearing be closed. Councilman
Forman seconded the motion which was carried unanimously.
The City Attorney then presented for the second time, explained the
contents, and read the title of Ordinance No. 1270, entitled: "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF:ARCADIA, CALIFORNIA,
AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTIONS 3213.3.5,
3213.4 AND 3214 THEREOF, AND BY AMENDING SECTIONS 3211, 3212, 3213,
3213.1, 3213.2 AND 3213.3 THEREOF, ADOPTING AND AMENDING THE UNIFORM
TRAFFIC ORDINANCE, 1964 EDITION."

Planning Commission Resolution No. 536 recommending granting a zone
variance to permit the remodeling and enlargement of a non-conforming
building at 1415, 1417 and 1421 S. Sixth Avenue subject to the
following conditions:
1. That the existing garage with a dwelling unit above and
in a shed in back of the front structure shall be removed
and a carport shall be constructed for the front dwelling
unit.
2. That complete working drawings for all such construction
and alteration shall be submitted to the Division of
Building and Safety for approval.

After reviewing projecturals which indicated the location of
existing buildings on subject lot, MOTION was made by Councilman
Reibold, seconded by Councilman Forman and carried unanimously that
the Planning Commission recommendation be accepted and that a zone
variance be approved for Vincent and Josephine Gallina to permit
remodeling and enlarging of a non-conforming structure at 1415, 1417
and 1421 S. Sixth Avenue subject to the conditions above specified.
It was MOVED by Councilman Balser, seconded by Councilman Forman and
carried unanimously that Planning Commission's recommendation be
accepted and that the final map of Tract No. 27803 (16 lots north of
the Foothill Junior High School) be APPROVED subject to continuing
compliance with all applicable conditions and requirements previously
imposed.
It was MOVED by Councilman Reibold, seconded by Councilman Forman
and carried unanimously that the Planning Commission's recommendation
be accepted and that the final map of Tract No. 23146 (Second Avenue
and La Sierra Drive) be APPROVED subject to continuing compliance
with all applicable conditions and requirements previously imposed.
Further MOTION was made by Councilman Reibold, seconded by Councilman
Balser and carried unanimously that in deference to the request made
by Robert Price, 5327 Camellia Avenue, Temple City, the house
locations be APPROVED. Mr. Price explained the need for such
approval to enable the subdivision to qualify for financing. The
house location plan is in effect a modification of rear yard
requirements.
It was MOVED by Councilman Considine, seconded by Councilman Forman
and carried unanimously that the final map of Tract No. 30013 (Live
Oak between Greenfield and Louise Avenues) be APPROVED subject to
continuing compliance with all applicable conditions and requirements
previously imposed. Alfred Allen, the subdivider, appealed to the
City Council for deletion of the requirement that utilities be
installed underground in this particular Tract, inasmuch as other
developments have been permitted aboveground utilities. The City
Council, however, felt that it is a step in the right direction and
adherence to the Commission's recommendation should prevail.

The tentative map of Tract No. 30231 extends Los Altos Avenue to
Florence Avenue with 7 single lots. The Planning .Commission recom-
mended approval subject to the following conditions with the

exception of Condition 8. The Commission was of the op1n1on that
the develope: and the property owner involved could work this out.
1. The excess land at 2434 Florence Avenue shall be disposed
of to the adjacent property owners so as not to become
separate parcels.

2. The balance of the street right-of-way opposite parcels 1
and 2 shall be dedicated and improved with the development
of this tract.
3. All structures and buildings within or across the tract
boundary shall be removed or relocated, complying with all
City Ordinances, Codes and regulations and to the satis-
faction of the Department of Public Works.
4. Remove all trees from the street right-of-way.
5. Install all utilities underground.
6. Install all standard street improvements required by the
subdivision ordinance. Improvements, grades, and drainage
shall be to the satisfaction of the Department of Public
Works.
7. Authorize the subdivider to establisp a trust in accordance
with resolution No. 2512 on property located at 518 West
Palm Drive.
* B. Authorize the City to negotiate between the developer and
the property owner at 505 Los Altos Avenue a settlement
which will permit the prop.er development of the area.
9. Provide 60 ft. right-of-way for street purposes, or 50 ft.
right-of~way with 5 ft. wide sidewalk and planting easements.

It was pointed out that the inability of the parties involved to get
together was of SOme duration and other ways in which the Tract could
proceed were explored. After discussion Councilman Reibold MOVED
that tentative map of Tract No. 30231 be APPROVED subject to
conditions as set forth by the Planning Commission and including
Condition 8. Councilman Balser seconded the motion.
George Mason, 505 Los Altos Avenue, addressed Council at length
enumerating conditions under which he would be willing to dedicate
the necessary land for the proper extension of the street in front of
his property. The conditions included the granting by the City of a
lot split (his property has 130 feet frontage), no street improvement
expense to him, no trust deed, driveways to be installed on the two
lots, all utilities installed.
The subdivider, Arthur Bauman, stated in part that the conditions

stipulated by Mr. Mason were unreasonable to him and that an
agreement could not be reached. The City Council, however, felt
that an opportunity should be given the parties involved and the
City staff to come to some understanding.
Thereupon the MOTION made by Councilman Reibold and seconded by
Councilman Balser was withdrawn, and Councilman Reibold MOVED,
seconded by Councilman Balser and carried unanimously, that the
matter be referred to staff with instructions to present to the City
Council at the next regular meeting, December 15, 1964, a recom-
mendation which would permit the subdivision to go through one way
or another.

At the City Council meeting of November 17, 1964 the salary increase
for the Librarian was referred to the Library Board of Trustees for
study. The Library Board submitted its recommendation for an
increase from $950 to $975 per month retroactive to the pay period
beginning November 21, 1964.
It was moved by Councilman Reibold, seconded by Councilman Forman
that the following minute resolution be adopted:
RESOLVED, that effective with the pay period commencing
November 21, 1964, the salary of the Librarian be increased
from $950 to $975 per month, and that Resolution No. 3733 be
amended accordingly.
The Motion was carried on the following roll call vote:

Communication was read from the Arcadia Unified School District
requesting the City Council to take steps to initiate a Charter
Amendment at the earliest possible date in order to strengthen the
position of the Board of Education and the School District under the
City Charter, and to make certain that the School District will be
excluded from becoming part of an overall large unified district as
proposed in the State Assembly during the 1964 Special Session.

The matter requiring a vote of the people on motion by Councilman
Considine, seconded by Councilman Forman and unanimously carried,
a determination was made by the City Council to place the matter on
the ballot by partially consolidating with 'the Special School
Election on February 2, 1965 at which time the voters will be
deciding a bond issue for an auditorium.
Whereupon the City Attorney presented, explained the content and read
the title of Ordinance No. 1275, entitled: "AN ORDINANCE OF THE CITY
OF ARCADIA, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING
NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF ARCADIA ON THE
2ND DAY OF FEBRUARY, 1965, FOR THE PURPOSE OF SUBMITTING TO THE
QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO AMEND ARTICLE XII OF
THE ARCADIA CITY CHARTER, AND PARTIALLY CONSOLIDATING SAID ELECTION

In line ~ith the formation on January 1st of each year of lighting
maintenance districts for street lights installed within subdivisions
and other projects during the past twelve months, MOTION was made by
Councilman Reibold, seconded by Councilman Forman and carried
unanimously that the City Engineer file a report in accordance with
the provisions of the Municipal Lighting Maintenance District Act of
1927, Division 14, Part 3 of the Streets and Highways Code. The
report to be filed on December 15, 1964 (the next regular City
Council meeting).

COMMITTEE
REPORT
The recommendation of the Technical Study Committee embodied in a
report dated November 17, 1964 was read by the City Manager. The
report recommended additions to the Municipal Code; 1) a section re-
quiring contractors to be licensed by the State of California when
applying for a permit to build apartment structures with four or
more units and fOl. all commercial and industrial buildings and
2) a section requiring a licensed landscape architect when
landscaping is required either by ordinance 9r condition of approval.

In part, it was Councilman Reibold's opinion that the requirement for
landscape architects would be an unwarranted interference with the
rights of individuals except in the areas of public health and safety;
that such is not the case with landscaping which is a matter of
aesthetics and how far a person desires to go.
Councilman Considine observed in part that a four unit dwelling might
be too small to require a licensed landscape architect but that on
larger projects he would like to see the requirement for a licensed
person or someone of recognized capability; that perhaps a definition
of magnitude of a development is indicated.
Councilman Forman concurred with Councilman Considine and made
reference to an apartment building where a professional individual
could have made impressive improvements over the present landscaping;
that standards are being raised through construction requirements
and that, in in his opinion, professionals are needed providing it
does not become prohibitive to a developer. He favored securing
additional information as to a practical breaking point.
Mayor Turner stated in part that he was not in accord with the
requirement for such buildings as one store or for one service
station; that he did concur with the suggestion that a professional
be required for major projects such as the proposed garden type
apartment considered for the south side of Duarte Road; that he would
favor referring the matter back to the Committee for a refinement of
'major projects' - and that the new recommendation should include
only such developments.
Councilman Balser stated in part that he is a firm believer in the
requirement; that from observation when licensed landscape architects
were employed on even small projects the aesthetic value improved to
the point where it reduced rental problems; that he favored returning
the matter back to the Committee; that they are on the right track
but perhaps a little too restrictive; that in his opinion the City
Council should strongly consider the requirement.

Discussion then continued on the requirement that all contractors be
licensed by the State of California prior to the issuance of a permit
for the construction of apartment buildings with four or more units
and for all commercial and industrial buildings.
Mayor Turner stated in part that he was in favor of the requirement;
that the construction of a building involves public health and safety
and that he would like to refer this back to the Committee for a
more inclusive recommendation as to the general contractor as far as
carpentry is concerned.
Considerable discussion ensued on the procedure now being followed
by the City in the issuance of permits for all phases of construction
when done either by an owner-builder or a private builder. The City
Council expressed the need for definite information which the staff
will supply.

Further refinement of this recommendation was desired and it was
MOVED by Councilman Forman, seconded by Councilman Reibold and
carried unanimously that the matter be referred back to the Technical
Study Committee and that the comments made by the City Council be
made available to it.
MUNICIPAL On MOTION by Councilman Balser, seconded by Councilman Forman and
COURT carried unanimously the City Council approved the proposed legis-
REORGANIZATION lation for Municipal Court reorganization as submitted by the

the word 'convenient' in Section 3 of the report as recommended by
the City Attorney.
BALDWIN
AVENUE
WIDENING
At the request of the City Manager the Director of Public Works
prepared a comprehensive report on the widening and improvement of
Baldwin Avenue which was submitted to the City Council. It set forth
the proposed method of acquiring the necessary properties and the time
element involved in order to have it completed by the time the con-
struction of the Foothill Freeway and the Baldwin Avenue extension
from Colorado to Foothill is concluded. The report recommended
acquisition of property through negotiation rather than condemnation.
The need for sidewalks was acknowledged and discussion was held on
the source of funds.

The following recommendations were then APPROVED on MOTION by
Councilman Balser, seconded by Councilman Forman and carried
unanimously:
(As set forth in Report of November 24, 1964)
1. The staff was authorized to budget funds each year for
property acquisition and improvement purposes from Gas
Tax allocations and budget funds each year from the
General Funds for the purpose of matching funds as
needed and required for expenditure of 186.1 money.
2. The staff was authorized to hire outside property acqui-
sition negotiators to acquire the requisite property and
file lis pendens condemnation so as to freeze property
prices at an early date, and further to approve the acqui-
sition to ultimately provide the full 84 foot right of
way.
3. The staff was authorized to proceed with plan preparation
as rapidly as staff work load permits, and the acquisition
of outside assistance if determined necessary to meet dead-
lines for plan completion. I
BOUNDARY The City Manager submitted a report which was forwarded to the City
STUDY Managers and Administrators of surrounding cities suggesting that
discussions be held on a plan of action which might lead to the

, eventually become a part of the cities involved. The data is being
compiled for eventual submission to the City Councils for consider-
ation.
The consensus of the City Council was that such a study is necessary
at this time and MOTION was made by Councilman Forman, seconded by
Councilman Reibold and carried unanimously that the staff be author-
ized to pursue the matter in cooperation with adjacent communities
and to report back to the City Council prior to any commitments for
expenditUl.e of funds.

November 23, 1964 amounting to $3,547 be maqe to.the City owned
property on Live Oak Avenue partially occupied by the Arcadia

The request of the Siamese Cat Society of California for permission
to hold a cat show on March 27 and 28, 1965 at the Arcadia National
Guard Armory was APPROVED on MOTION by Councilman Considine, seconded
by Councilman Reibold and carried unanimously.
Lybrand, Ross Bros. and Montgomery, having completed the annual audit
of the final books and accounting records for the fiscal year ending
June 30, 1964, MOTION was made by Councilman Balser, seconded by
Councilman Considine and carried on roll call vote as follows that
$3500 be paid to said Company for services rendered:

body of Resolution No. 3740 be waived:

A Study Session will be held on Thursday December 10 at 7:30 P.M. for
the purpose of discussing data processing and its applicability to
the City's needs.
The City Attorney commented on the recent decision by the Supreme
Court in the Long Beach Panguingui gambling case, the effect being
to uphold the Long Beach City Ordinance.
Mayor Turner ordered the meeting adjourned at 10:40 P.M. until
December 10, 7:30 P.M.
