Turner ROLL CALL PRESENT : ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner I None MINUTE APPROVAL The Minutes of the Adjourned Regular Meeting of December 10, 1964 and the Minutes of the Regular Meeting of December 15, 1964 were APPROVED on MOTION by Councilman Forman, seconded by Councilman Reibold and carried unanimously. .!JJO Application of Joseph W. Wilson for a business permit to operate the Arcadia Bowling Alley, billiard tables, restaurant and bar at 71 Morlan Place. . Mayor Turner declared the hearing open and inquired if anyone desired to address Council. Mr. Wilson advised that he has acquired all interests in the Bowling Alley and is desirous of operating same and all related activities. No one else desiring to be heard the hearing was closed on MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously. HEARING (Wils on) MOTION was then made by Councilman Reibold, seconded by Councilman Considine and carried unanimously that the application be APPROVED and that a business permit be issued Mr. Joseph W. Wilson. EQUIPl-!ENT PURCHASE (Police) The recommendation of the City Manager and the Purchasing Officer was APPROVED on MOTION by Councilman Considire, seconded by Councilman Forman and carried on roll call vote as follows that the low bid of S. E. Chubbuck Sales Company in the amount of $5,010.03 be accepted for the purchase of two police ~olo motorcycles and one }O: ~ police servicycle with trade-in of used similar equipment; that all r ~other bids be rejected and that all irregularities or informalities . The current budget reflects funds for said purchase. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None I The recommendation of the City Manager and the Director of Public Works was APPROVED on MOTION by Councilman Considine, seconded by Councilman Reibold and carried on roll call vote as follows that the low bid of Sully Miller Contracting Company in the amount of $10,425.865 for the improvement of Second Avenue from Foothill Boulevard to Laurel Avenue and street resurfacing of Laurel Avenue from Wigwam to Second Avenue and Wigwam Avenue from Foothill Boulevard to Laurel Avenue be ACCEPTED; that all other bids be rejected; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk be and they are hereby authorized to execute a contract in form approved by the City Attorney. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None The recommendation of the City Manager and the Director of Public Works was APPROVED on MOTION by Councilman Reibold, seconded by Councilman Forman and carried on roll call vote as follows that the work as performed by the Paul Sanker Company in the beautification of the Huntington Drive Median Strip from Santa Anita Avenue to Second Avenue be accepted and that final payment in accordance with the contract be authorized: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None The City Manager and the Director of Public Works advised that the improvement of the Railroad Crossing at Santa Anita Avenue, by the installation of four new flashing light signals supplemented with :our crossing gates and appurtenances, has been completed pursuant I to an agreement between the Company and the City dated June 1, 1964; that the actual cost was $23,219.31 of which the Railroad Company will pay 50 per cent. The City will pay the remaining 50 per cent and will be reimbursed from the State Grade Crossing Fund in an amount equal to 50 per cent of the City's cost which will result in the City paying 25 per cent of the-total cost; that said reimbursement 'will be made subsequent to the City paying its obligation to the Railroad Company for which a statement has been received by the City. AYES: NOES: ABSENT: Councilmen None None Balser, Considine, Forman, Reibold, Turner , Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 3754 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING AND DIRECTING THE MAYOR OF SAID CITY TO FILE A REQUEST WITH THE PUBLIC UTILITIES COMMISSION OF SAID STATE FOR ALLOCATION OF FUNDS FROM THE . CROSSING PROTECTION FUND." MOTION by Councilman Forman, seconded by Councilman Reibold and carried on roll call vote as follows that the reading of the full body of Resolution No. 3754 be waived: AYES: NOES: ABSENT: Councilmen Balser, Considine, Form~n, Reibold, Turner None None Councilman Forman further MOVED that Resolution No. 3754 be ADOPTED. Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None The City Manager read in its entirety a report on the recommendation of the Land Disposal and Acquisition Committee and the City Manager for the sale to the Elrovia Company for $200,000 the City-owned land at 82 - 118 W. Duarte Road. The property had been previously advertised and invitations mailed for the sale of the property pur- suant to the conditions set forth in Resolution No. 3714 wherein the property could be developed into R-3 residential type apartments; that to date no offers had been received for that type of improvement. That originally it was contemplated that the subject land would be used for public or semi-public purposes and that the offer made by the Elrovia Company was for the construction of a Church, a semi- public use. The option as submitted provides: 1. For the payment of $500 as part payment on the property which would be retained by the City if the option is not exercised. 2. An escrow is to be opened on or before March 28, 1965. 3. Purchase price to be $200,000. 4. Buyer's approval of preliminary title report and CC&R's of record within 15 days after receipt thereof. 5. Approval of a zone variance to permit the property to be used for church purposes. 3. 1-5-65 TRAINING FILM (Fire) 16:6448 6. City of Arcadia's approval of buyer's building plans and specifications. 7. Subject to satisfactory soil test report. 8. Subject to buyer completing his existing sale escrow. 9. Payment of a commission of 6% of the selling price to Beach & Flaaten, or one-half of amounts paid by buyer in the event same is forfeited. MOTION was made by Councilman Balser, seconded by Councilman Forman 1 that the recommendation be APPROVED and that the City Manager be authorized to execute an option for the sale of the City owned property at 82 - 118 W. Duarte Road for $200,000 on behalf of the City. Arthur C. Bauman, 49 El Dorado Avenue, Arcadia, who had previously evinced interest in the property, stated in part that as a property owner and taxpayer he requested a continuance of the matter in order that public notice may be given; that in his opinion there has not been sufficient publicity on the matter of the disposal of this City owned property. Extensive discussion ensued and in answer to inquiries made by Mr. Bauman it was brought out that the subject property is presently zoned R-l and subject to a variance for a residential park multiple family development; that it and properties to the west may be developed into either single family or park-like apartments in accordance with the variance now applicable; that the option as proposed provides that the City grant a variance for the construction of a church, however, if the property is purchased under the con- ditions of the option, the purchaser would have three alternatives: 1) build single family dwellings, 2) build a church, 3) build resi- dential park-type apartments; however, if in the granting of a new variance the Planning Commission were to recommend and the City Council were to rescind the present variance the purchaser would then only have two options: 1) build single family dwellings, or 2) build a church. The zone variance providing for a residential park is valid for a period of two years from the date of adoption of Resolution No. 3714 (October 6, 1964) and that it may be extended without the necessity of a public hearing for an additional two year period by the Planning Commission or the City Council. Mr. Bauman was further advised that when an application is filed for a zone variance to permit the property to be used for church purposes public hearings will be held before the Planning Commission and the City Council and that they will be properly noticed to all interested persons and the public in general. (amendment to County Ordinance) AGREEMENT (Fire Protection & Rescue ser~ices) ~:'OSl COMMUNITY REDEVELOPMENT AGENCY (Proposed) -!J /0 71 -A 1 16:6449 Section 6220.33 of the Arcadia Municipal Code be waived for the Alfred Higgens Production Company in the preparation of a training film featuring in operation the Arcadia Fire Department snorkel apparatus. MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously that the request of the Barber's Union, Local 1000, for the adoption of an ordinance prohibiting the operation of barber shops on Sunday be FILED. Barber Shops in Arcadia are not open on Sunday. MOTION by Councilman Balser, seconded by Councilman Forman and carried unanimously that the request for detachment from the City of certain property contained in tentative Tract No. 30271 which has been filed with the Los Angeles County Regional Planning CommisSion was APPROVED conditioned on the.subject property owners paying all costs involved in the detachment proceedings. MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously that the proposed amendment to Los Angeles County Ordinance No. 5582 be APPROVED in principle. The amendment would provide for the establishment of a County Operational Area desig- nating the County Sheriff as Director in a state of extreme emergency. This matter will be an agenda item before the L. A. County Division of the League of California Cities on January 7, 1965. MOTION by Councilman Considine, seconded by Councilman Reibold and carried unanimously that the revised Uniform County-City Joint Mutual Assistance Agreement be APPROVED and that the Mayor and City Clerk be authorized to execute same. The Agreement provides for fire pro- tection and rescue services and would be advantageous to the City in the event of a major fire or other local emergency. Explored at length was the recommendation of the City Manager on the creation of a Community Redevelopment Agency with the City Council to act as the Agency. A report was submitted on its proposed for- mation and method of financing. The purpose of the Agency would be to collect parcels of property for sale to commercial and industrial concerns which are interested in locating in the City. Development of new housing would not be involved. The report set forth that industrially zoned portions of the City contain many 25', 50' and 60' lots, whereas industrial sites must be at least 3 acres; that attempts have been made in many instances to assemble parcels sufficient to meet the needs of an industry but they have been unsuccessful due to the small parcels involved and because some owners have been unwilling to sell for one reason or another. It was felt by staff that land properly assembled can be readily sold contingent on its use consistent with the development of the City; that the scarce industrial and commercial land should be properly used; that only in this way can the City meet the future economic base needed to maintain or reduce the tax burden on the individual property owner. 5. 1-5-65 ORDINANCE NO. 1276 (Adopted) -d/06'-1 ORDINANCE NO. 1277 (Introduced) ) 16:6450 It was recommended that the project be financed by a $5 million bond issue for the acquisition of property; this would be placed before the electorate, and if successful, not all of the bonds be sold initially since it might not be necessary to sell the total amount if the acquisition and subsequent land sales were productive. There would be no involvement of state or federal funds according to the recommendation. Considerable discussion was held On the proposal with Councilman Balser stating in part that $5 million might be more than needed and Councilman Considine desiring a study for methods of financing other than a bond issue. The City Council expressed tentative approval of the proposal and as 1 the procedure for such formation would be time consuming it was MOVED by Councilman Balser, seconded by Councilman Considine and carried unanimously that staff proceed with the study, prepare an ordinance for introduction creating the Agency; then pursue other methods of financing to be presented to the City Council for its consideration at a later date. The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1276, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF FOURTH AVENUE AND OF THE FIRST ALLEY SOUTH OF HUNTINGTON DRIVE IN SAID CITY." Colorado Boulevard, spoke at length on the proposed formation of a Community Redevelopment Agency stressing the human side of the proposal and stating in part that property owners should be given every consideration and opportunity to dispose of their land as they desire and for the best prices. George Gaffney, 935 W. Duarte Road, expressed interest in the formation and stated in part that in essence he was in favor of such an Agency providing property owners were protected in the acquisition of their land. 1 Mayor Turner observed that there was no reaso~ to think that the citizens of Arcadia would not show the same confidence in its elected officials as it had in the past; that property owners would certainly be given every consideration. Councilman Forman commended the newly formed Arcadia Tournament of Roses Association Committee and the Chamber of Commerce on the award winning float entered in the Rose Parade in Pasadena on New Year's Day. (Mayor's Trophy was presented to the City).
