" FEBRUARY 16, 1965 The City Council of the City m Arcadia met in regular session in the Council Chamber of the Arcadia City Hall on February 16, 1965 at 8 P.M. Rev. Turner PRESENT: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None The Minutes of the Regular Meeting of February 2, 1965 and the Adjourned Regular Meeting of February 9, 1965 were APPROVED as submitted in writing on MOTION by Councilman Balser, seconded by . Councilman Considine and carried unanimously. Planning Commission Resolution No. 537 recommending changing the basic zone of properties on the north side of Huntington Drive between Baldwin Avenue and Old Ranch Road from C-2 to C-O and D (architectural overlay) and the regulations to be imposed in said Zone D. The Planning Director explained the purpose for the recommended re- zoning; that a greater degree of zoning guidance was appropriate in order to insure that the properties redevelop in a manner compatible with the neighboring residential uses. Projecturals were displayed depecting the size of the subject lots which in the opinion of the Commission are of insufficient size to constitute an independent commercial center; that the recommended C-Q and D zoning would permit professional office buildings to be constructed thereon and would be more in keeping with the adjacent area. Mayor Turner declared, the hearing open. No one responding,- to his inquiry if anyone desired to speak to the matter, Councilman Reibold MOVED that the hearing be closed. Motion seconded by Councilman Forman and carried unanimously. MOTION was then made by, Councilman Reibold, seconded by Councilman Forman and carried unanimously that the recommendation of the Planning Commission (Resolution No. 537) be APPROVED. Mayor Turner declared the hearing open on the proposed 1965 Weed Abatement program and stated that this is the time and place to hear and consider any and all objections to the proposed removal of rubbish, refuse and weeds in accordance with Resolution No. 3758 wherein the locations for such clearance are set forth. The City Attorney explained that the clearing of the property may be 1. 2-16-65 PROPOSED COMMUNITY REDEVELOPMENT AGENCY 8/o1f-A ORDINANCE NO. 1278 Introduced -!f /011 16: 6471 performed individually by the owner of the property so noticed and in such event the work will not be done by the City and the cost thereof will not be assessed against the property. The City Clerk advised that she had on file the Affidavit of Posting. No one desiring to be heard with respect to the proposed weed clearance, Councilman Balser MOVED that the hearing be closed. Councilman Forman seconded the motion which was carried unanimously. Councilman Balser then MOVED that the Fire Prevention Inspector and I Superintendent of Weed Abatement be authorized and directed to pro- ceed with the work pursuant to the Weed Abatement Act and in accordance with the provisions of Resolution No. 3758. Councilman Reihold seconded the motion which was carried unanimously. The City Manager presented his report on the creation of a Community Redevelopment Agency with the City Council to act as the Agency, the Mayor as the Chairman and the City Manager as Director. The basic purpose of the Agency would be to assemble parcels of commercial and industrial lands either on a voluntary or condemnation basis for resale for redevelopme~ according to an adopted plan. The report set forth that scarce commercial and industrial lands must be properly used; that by building a strong economic tax base by the proper use of the lands is one way to meet continuing high costs of government and at the same time relieve the property owner of as much of the tax burden as possible. It stressed the provision for owner participation and explained that a project area cannot be less than a total block bounded by four streets of subdivided land; that if un- subdivided it cannot contain less than 90,000 sq. ft. Following considerable discussion on the feasibility of creating such an Agency, MOTION was made by Councilman Balser, seconded by Council- man Forman and carried unanimously that the City Council proceed with the establishment of a Community Redevelopment Agency; that at a forthcoming Study Session the City Manager present for study precise data and figures on financing, after which the City Council would make final determination. Whereupon the City Attorney presented for the first time, explained the content, and read the title of Ordinance No. 1278, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING NEED FOR A REDEVELOPMENT AGENCY TO FUNCTION IN SAID CITY, DECLARING THE CITY COUNCIL OF SAID CITY TO BE SUCH AGENCY, AND DESIGNATING THE MAYOR OF SAID CITY AS THE CHAIRMAN OF THE AGENCY." MOTION by Councilman Balser, seconded by Councilman Considine and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1278 be WAIVED: I AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None MOTION was further made by Councilman Balser, seconded by Councilman Reibold and carried on roll call vote as follows that Ordinance 2. 2-16-65 16:6472 No. 1278 be INTRODUCED. Colorado Boulevard, Arcadia, upon inquiry was advised that the City Council would hear anyone desiring to speak at the time specified on the agenda; that no final action on the above matter had been taken; that Ordinance No. 1278 could not be adopted at this meeting and would not be adopted until at least the next regular meeting of the City Council. Mayor Turner welcomed and explained Councilmanic procedure to the visiting students. SWIMMING POOL (CITY-SCHOOL) Proposed agreements for the swimming pool and use were received by the City Council for review. They will be placed on the agenda for the regular meeting of March 2 for City Council consideration. PARADE (Masonic Lodge) pR.~ MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously that the Arcadia Masonic Lodge No. 547 be granted permission to hold a parade as requested on March 6, 1965 in con- ~nection with its cornerstone ceremonies for the new Temple at 50 W. Duarte Road. ,. LAND PURCHASE (rejected) The communication advising that the City's bid of $25,500 for the proposed purchase of property at 225 S. Second Avenue was not accepted was received and ordered filed. It was explained that a higher bid was offered and accepted by the property owner. PERSONNEL MOTION by Councilman Balser, seconded by Councilman Reibold and (new position) carried unanimously APPROVED the recommendation of the City Manager ~4 that a position be created in the Water Department of Assistant Civil I~; ~~J~.Engineer and eliminate the existing position of Senior Engineer r Draftsman. g lOS'S The City Manager read a report on the acquisition of property at 1410, 1416, 1422 and 1432 S. Sixth Avenue as a possible park site. The land is adjacent to the Camino Grove School and would be developed similar to the park-school sites at the Bonita and Hugo Reid schools. LAND ACQUISITION (Park site) I The report set forth that a City-owned park adjacent to school property decreases the cost and increases the utility value of such a park site and school playground for both agencies; that the School District would become responsible for the maintenance of the park; supervisory costs would not be increased inasmuch as the City Re- creation Department budget provides for two supervisors at the School playground during after school hours and vacations; that during school hours supervision would become the responsibility of the School District personnel. The school playground would not be visible from Sixth Avenue or Camino Grove Avenue if homes were built on vacant lots on the east side of Sixth Avenue - this would facilitate the policing of the area. I MOTION was made by Councilman Reibold, seconded by Councilman Forman and carried unanimously that permission be granted to use a house trailer at 1114 El Norte Avenue for a period or-Sixty (60) days. the communication from Mrs. Charles Blackbu.'n regarding Tract No. 27903 was removed from the agenda at the request of the writer. 4. 2-16-65 AUDIENCE PARTICIPATION RE: COMMUNITY REDEVELOPMENT AGENCY I J/071 I 16:6474 George Copans, 122 E. Colorado Boulevard, addressed the City Council at length, stating in part that in his opinion the purpose for which the Agency, is being created would be an invasion of privacy by a governmental agency; that it could become a political issue and the present City officials, although well intentioned, have no control over its successors and their desires; that there is no guarantee that the land could be sold for a planned usage. He stated further that an individual 'property owner could not participate inasmuch as a project area must be at least 90,000 sq. ft. He concluded his remarks by asking that the Agency not be formed, that in his opinion it would be a mistake. Mayor Turner observed at this point that the proposal is for the inclusion of commercial and industrial property only, not residential unless it is not properly improved or is in an improper zone; that an individual property owner does not have to participate in the total or in any part of the investment of the property which he does not already own; that he may develop his own portion into what is compati- ble with an adopted plan. Paul Hackstedde, 333 W. Camino Real, addressed the City Council stating in part that he was in substantial agreement with Mr. Copans and suggested that the City Council move slowly because of the principles involved; that in his opinion it is not the primary function of local government. Robert E. Moser, 62 W. Woodruff Avenue, owner of industrial property at 18, 20 and 22 N. Fourth Avenue, stated in part that he would be affected inasmuch as his small parcel of land is now developed close to its peak but not in accordance with the new Towne Centre Plan; that he would be agreeable to the redevelopment of his land on a cooperative basis but not on a bargaining basis such as under condem- nation proceedings; that although the present City officials are sincere it may not be true oc succeeding bodies. He cited a personal experience in land negotiation and asked that a redevelopment method without condemnation be explored. Mayor Turner then advised that there are defined areas essential to the beginning of a project after criteria have been met; that public hearings with proper notices would be required giving all persons an opportunity to be heard on any proposal being considered by the Agency. Harold Sumner, 375 W. Camino Real, asked that the City Council proceed with caution and stated in part that property owners select a City for a home through respect, pride and assurance that it is a City of homes. Mayor Turner advised that copies of the ordinance just introduced would be available to the public at the office of the City Clerk. Councilman Reibold stated in part that fundamental questions have been raised by those addressing the City Council. He explained that the Gity Council has been thinking basically about the small parcels of industrially zoned land on Peck Road and the industrial portion of the Towne Centre area. He observed that the City Council has seen to it that the proposal was covered in the press and that the City Manager has presented the matter to many groups; that it would be helpful in matters such as this if the public would communicate with the City Council if it is not in agreement with a proposal. He stated also that future leg!slative bodies could go beyond the limit set down by this City Council and that if it is the final determi- nation to proceed it might be a matter to place before the electorate. 5. 2-16-65 16:6475 Mayor Turner stated that in :::~e eSsence of time the introduction of the ordinance was a necessary preliminary step should the City Council decide to proceed after a study is made of all phases of the proposal; that the City Council would proceed slowly keeping in mind what has transpired at this meeting. '}l.SffJ Siebert Weisman, Pasadena realtor with property interests in the City, commended the City Council on its proposal and suggested that those opposing the formation of the Agency study the merits of re- development along the lines proposed by the City Council. Tom Simovich, 1105 Rodeo Road, addressed the City Council regarding I juvenile problems he has encountered in his area, cited instances and asked for relief from the situation through local and/or higher governmental agencies; that he had contacted the Police Chief and the Mayor toward that end. He was advised that his communication had just been received and appointments were to be made on the morrow; that there had not been sufficient time to review the matter. JUVENILE PROBLEMS Mayor Turner called to Mr. Simovich's attention an agenda item which will come before the City Council at this meeting pertaini~~ to the juvenile problem and urging the Los Angeles County Board of Supervisors to divulge names of juveniles identified with major crimes of violence. RESOLUTION NO. 3764 The City Attorney presented, explained the content and read the title of Resolution No. 3764, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, SUPPORTING IN PRINCIPLE THE RECOMMENDATION OF THE LOS ANGELES COUNTY BOARD OF SUPERVISORS TO DIVULGE NAMES OF JUVENILES IDENTIFIED WITH MAJOR CRIMES OF VIOLENCE." I AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None Councilman Balser MOVED that the following Minute Resolution be and it is hereby adopted: "RESOLVED, THAT THERE IS HEREBY CREATED IN THE WATER DEPARTMENT THE POSITION OF ASSISTANT CIVIL ENGINEER AND THAT THE SALARY SCHEDULE NO. 440 IS ASSIGNED THERETO; THAT THE POSITION OF SENIOR ENGINEERING DRAFTSMAN BE ELIMINATED FROM THE WATER DEPARTMENT; AND THAT ALL FORMER RESOLUTIONS ON THE SUBJECT BE AMENDED TO CONFORM HEREWITH." The recommendation of the Committee to appoint an independent auditor to examine the City's financial position at the end of the 1964-65 fiscal year was accepted and MOTION was made by Councilman Reibold, seconded by Councilman Considine and carried unanimously that the firm of BLACK & LUSICH be retained for such examination at a fee of $4000. A communication from said firm sets forth figures at which additional work may be performed if the City so desires. Councilman Reibold referred to a pedestrian hazard existing on Campus Drive opposite the High School and suggested that the City Manager confer with the Superintendent of Schools in an effort to alleviate the situation.
