Turner PRESENT: ABSENT: Councilmen Considine, Forman, Reibold, Turner Councilman Balser The Minutes of the Regular Meeting of February 16, 1965 were APPROVED as submitted in writing on MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously. Pursuant to Resolution No. 3759 Mayor Turner declared the hearing open on the proposed annexation to the City of certain contiguous territory designated as Annexation No. 34 Northwest Arcadia Uninhabited. Property is currently within the limits of the City of Sierra Madre, which City has consented to the detachment thereof, and consists solely of a portion of a public street. The City Clerk advised that she had on file the affidavit of publi- cation and the affidavit of mailing as required by the Government Code and that no written protests had been received. No one desiring to speak or make oral protest to said annexation, MOTION was made by Councilman Reibold, seconded by Councilman Forman and carried on roll call vote as follows that the hearing be CLOSED: AYES: NOES: ABSENT: Councilmen Forman, Considine, Reibold, Turner None Councilman Balser The City Attorney then presented, explained the content and read the title of Resolution No. 3769 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA FINDING AND DECLARING THAT A MAJORITY PROTEST HAS NOT BEEN MADE WITH RESPECT TO 'ANNEXATION NO. 34, NORTHWEST ARCADIA UNINHABITED' . AYES: NOES: ABSENT: Councilmen Considine, Forman, Reibold, Turner None Councilman Balser The City Attorney then presented for the first time, explained the content and read the title of Ordinance No. 1281, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY DESCRIBED IN RESOLUTION NO. 3759 ADOPTED BY SAID CITY COUNCIL ON JANUARY 19, 1965, AND DESIGNATED I THEREIN AS "ANNEXATION NO. 34, NORTHWEST ARCADIA UNINHABITED". Motion seconded by Councilman Considine and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Considine, Forman, Reibold, Turner None Councilman Balser On MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously a public hearing was scheduled for April 6, 1965 at 8 P.M. on the recommendation of the Planning Commission as contained in its Resolution No. 541 (property abutting Live Oak Avenue and Lynrose Street, between Tyler and Lenore Avenues - Zone D architectural overlay). Planning Commission recommendation for approval, subject to speci- fied conditions, the tentative map of Tract No. 22377, property located on the south side of Estrella Avenue, west of Baldwin Avenue. One of the conditions altered the map by reducing the number of lots to eight with a width of 69' each instead of nine lots with lesser width. Projecturals were displayed and reviewed. The Planning Director advised that the tentative map complies basically with standard City requirements for R-l zoning. 1 Councilman Considine MOVED that the City Council APPROVE the tentative map suoject to conditions imposed by the Commission and that in conformance therewith Condition No. 1 stipulate eight lots of 69' width. Councilman Forman seconded the motion. Jack B. Weber, subdivider, 2145 Highland Vista Drive, Arcadia asked for reconsideration of Condition No. 1 and the reinstatement of nine lots as originally requested; that it would create an economic hardship. Discussion ensued with Councilman Reibold to be little to be gained esthetically in that surrounding areas are not up to City practical standpoint the extra width of a significant difference. observing that there appears the increased lot width; standards and that from a few feet would not make a ',' Upon inquiry by Councilman Considine, Mr. Weber stated that a provision to provide for the approval of the Planning Commission on house locations would not be a hindrance. Councilman Forman stated in substance that in his op~n~on it would be a disservice to those who have worked to upgrade the City standards if lot sizes in this subdivision were reduced below those acceptable to the Planning Commission; that the primary motion should not be changed. Councilman Reibold stated in part that in this instance the square footage of each lot is more than the City requirement of 7500 sq. ft; that the subdivision would ultimately increase the value of sur- rounding properties beyond the square footage cost. Mayor Turner concurred that an increase in the lot size would not materially increase the market value over and above what has been established in the subject area. Councilman Reibold then MOVED that the primary motion be AMENDED to delete the part referring to Condition 1 providing for 69' lot width instead of as originally submitted. (This Motion was later withdrawn and restated by Councilman Reibold). The City Manager advised that the corner lot would be 64' in width and the remaining lots 60~' after dedication of 20' for street widening purposes. MOTION was then made by Councilman Reibold, seconded by Mayor Turner and carried on roll call vote as follows that THE MAIN MOTION BE AMENDED BY THE DELETION OF REFERENCE TO THE ELIMINATION OF ONE LOT AND BY ADDING THERETO A REQUIREMENT THAT ALL HOUSE LOCATION PLANS BE SUBMITTED TO THE PLANNING COMMISSION FOR APPROVAL PRIOR TO PROCEEDING WITH ANY CONSTRUCTION. AYES: NOES: ABSENT: Councilmen Considine, Reibold, Turner Councilman Forman Councilman Balser THE PRIMARY MOTION WAS THEN CARRIED UNANIMOUSLY. The final map of Tract No. 30142 (Bella Vista Drive between Wistaria and Longden Avenues) was APPROVED, subject to conditions as specified by the Planning Commission in its report dated February 23, 1965, on MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously. The recommendation of the Personnel Board for revised job description to cover the position of Assistant Civil Engineer was APPROVED on MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously. 3. 3-2-65 PROPERTY ACQUISITION $j:: RE.(l ~. ;;:.t.vt 3fetil WAIVE VARIANCE FEE (dePont) :p. REDUCE SPEED LIMIT ORDINANCE NO. 1282 Introduced WORK COMPLETION J I01;J- 16:6481 On January 19, 1965 the City Manager was authorized to have an appraisal made of property at the southeast corner of Naomi and Baldwin Avenues and to notify the owner of the property of the City's desire to purchase the property for street realignment purposes in view of the traffic and right-of-way problems involved at the location. The City Manager advised that an appraisal has been secured and that he has not heard from the owner in response to his communication of January 20, 1965. MOTION was made by Councilman Forman, seconded by Councilman Reibold and carried unanimously that the City Manager be authorized to 1 negotiate for the acquisition of the property within the appraisal figure and if unable to so do that the City Attorney proceed with the . necessary steps for condemnation proceedings for submission to the City Council at its next regular meeting (March 16, 1965). The request of Dorothy dePont for waiver of variance fee of $125 in connection with the filing of a variance application to determine the status of a second structure on her property at 1430 S. Tenth Avenue was DENIED on MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously. It was the consensus of the City Council that some relief should be available, however, there is no provision in the Municipal Code for waiving a filing fee for a variance; that to so do could result in future requests for similar consideration; that historically fees have only been waived for public service agencies. The recommendation of the City Manager, Police Chief and the Director of Public Works based on traffic engineering studies that the prima facie speed limit be decreased to 35 miles per hour on Santa Clara Street, between Huntington Drive and Santa Anita Avenue, was APPROVED on MOTION by Councilman Considine, seconded by Councilman Forman and carried unanimously. Whereupon the City Attorney presented for the first time, explained the content and read the title of Ordinance No. 1282, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADDING TO DIVISION 2 OF PART 2 OF CHAPTER 2 OF ARTICLE III OF THE ARCADIA MUNICIPAL CODE A NEW SECTION 3222.2." MOTION by Councilman Forman, seconded by Councilman Reibold and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1282 be waived: AYES: NOES: ABSENT: Councilmen Considine, Forman, Reibold, Turner None Councilman Balser 1 Councilman Forman further MOVED that Ordinance No. 1282 be introduced. AYES: NOES: ABSENT: Councilmen Considine, Forman, Reibold, Turner None Councilman Balser The recommendation of the City'Manager and the Director of Public Works for the immediate replacement of the Ashlund Chipper (brush chipper) and that the sum of $4500 be transferred from Account No. 433-E-l to Account No. 433-F-54 was APPROVED on MOTION by Councilman Forman, seconded by Councilman Considine and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Considine, ,Forman, Reibold, Turner None Councilman Balser The Agreement between the City and the Los Angeles County Flood Control District for the design and construction of the 1964 Storm Drain Bond Issue project Nos. 602, 1401 and 1402 within the City was explored. It provides for the reimbursement to the City of expenses involved in preparing plans and specifications for the projects subject to maximum limit on each of the three projects proposed in the County, Chief Engineer's preliminary report. On MOTION by . Councilman Reibold, seconded by Councilman Forman and carried on roll call vote as follows the Mayor and. City Clerk were authorized to execute the Agreement in form approved by the City Attorney encompassing two additional conditions proposed by the City Attorney. AYES: NOES: ABSENT: Councilmen Considine, Forman, Re~bold, Turner None Councilman Balser The recommendation of the City Manager and the Director of Public Works was APPROVED on MOTION by, Councilman Reibold, seconded by Councilman Forman and carried on roll call vote as follows that the firm of Perliter & Ingalsbe be retained for the designing of plans for the construction of the 1964 storm drain bond issue project Nos. 602, 1401 and 1402. Discussion held on adequate insurance protection for the City. Mr.' Perliter advised that his firm carries maximum errors and omiSSions' insurance. This point is to be covered in the contract as prepared by the City Attorney. MOTION by Councilman Reibold, seconded by Councilman Forman and carried on roll call vote as follows that the firm of Perliter & Ingalsbe be retained for the design plan in the construction of the 1964 storm drain Bond Issue Project Nos. 602, 1401 and 1402; that the Mayor & City Clerk be authorized to execute said contract in form approved by the City. AYES: NOES: ABSENT: Councilmen Considine, Forman, Reibold, Turner None Councilman Balser 5. 3-2-65 WEED ABATEMENT d-/o&f CITY-SCHOOL SWIMMING POOL AGREEMENT a,' ~<-~ SHOPPING CENTER (Pantry Market) J /o$fJ 16:6483 In answer to inquiry by Councilman Considine, the City Manager explained that a number of proposals had been received from engi- neering firms; that a review of the work of the subject firm was made; that no difficulties had been encountered in the work performed by the firm in the 195G storm drain bond issue projects; that it is capable of performing the work within the allotted time; that it ~sn't totally an outside firm as one of the principals resides in the City. The recommendation of the City Manager and the Superintendent of Weed 1 Abatement was APPROVED on MOTION by Councilman Forman, seconded by Councilman Reibold and carried on roll call vote as follows that the low bid of Harold Watts in the amount of $1,706 be accepted for the . removal of rubbish, refuse and weeds upon parkways, streets and private property in the City; that all other bids be rejected and that any irregularities or informalities in the bids or bidding process be waived; that the Mayor and City Clerk be authorized to execute the contract in form approved by the City Attorney. AYES: NOES: ABSENT: Councilmen Considine, Forman, Reibold, Turner None Councilman Balser On MOTION by Councilman Reibold, seconded by Councilman Forman and carried unanimously the proposed City-School Swimming.Pool construction and use agreement was approved in pr~nciple but the matter was continued until the regular meeting of March 16 to enable the staff to meet with the school officials to clarify certain aspects of the wording of the agreement. The owner and the proposed lessee of property' recently zoned C-l &D for a shopping center at Golden West Avenue and Duarte Road appealed the decision of the Planning Commission in its disapproval of the revised plans as not being in substantial compliance with the plans previously approved under the Zone 'D' regulations. , The Planning Director displayed project urals of the proposed site development, explaining that the Commission had not approved the revised plans as it was of the opinion that if changes are to be allowed that they be made only after additional public hearings before the Commission; that the new set of plans are different from the original ones. Mayor Turner stated in part that although he was opposed to the ahopping center in the beginning as he felt there were adequate facilities already in the City, that the proposed changes are to the 1 betterment of the development. He cited improved access to parking areas, arrangement of the buildings insofar as setbacks are concerned and enhanced parking facilities. Councilman Forman stated in part that the revised plans, in his opinion, are an advantage over the original ones; that a more open apace appearance would now be gained. In answer to a query by Councilman Considine as to whether or not the City is obligated to hold additional'public hearings on revised plans, the City Attorney advised in' part that the question involves largely 6. 3-2-65 1 MOTION 1 COMMUNICATION (O'Keefe) ~/o7f 16:6484 a matter of judgment as to whether or not the changes are minor or substantive ones, if they accomplish substantially the same results as those originally approved or if they would cause more detriment than would the adherence to the original plans; that if it is determined by the City Council that they are not substantive or major changes and do accomplish substantially the same results, then the changes may be approved without noticing the matter for public hearing. If that is not the case, then public hearings would have to be held as it is a portion of the zoning process. -Discussion then ensued on the significance of the changes. Provision is made on the new plans for additional parking area but withifewer, parking spaces, the setbacks are greater and the site size has been reduced by dedication of property for street purposes. Councilman Considine agreed that the changes would all be beneficial, but that in his opinion a substantial change is being requested and he would agree with the Commission that action could not be taken on the modifications without another public hearing before that body. He expressed objection to Council approving one set of plans only to have another set presented to it at a later date; that he objected to it in principle because it is constantly reoccurring; that he would be more sympathetic to requests of this nature if, when there is real reason for change, normal procedures are followed. . Discussion ensued on the maximum use of the property and the consensus of the City Council was that this should be resolved between the staff and the architect. , 1;1 '.' :-'.' . Councilman Reibold recognized the position taken by Councilman Considine but felt that in this particular instance the revised plans are, in his opinion, much better than the original; that the requested changes are not of sufficient nature as to warrant further public hearings. . Councilman Forman concurred in this observation and MOVED that the revised plans be APPROVED as submitted, that any further implementation providing for additional parking spaces where possible without disturbing the flow pattern be referred to the staff and the architect. Motion seconded by Councilman Reibold and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Forman, Reibold, Turner Councilman Considine Councilman Balser The City Attorney stated for the record that he concurred in .Councilman Considine's criticism of any practice of submitting one thing for the purpose of ~getting your head in the tent' and then later coming back with something else. He pointed out however that if this ~ere a variance where the person makes an application and is required by the ordinance to submit plot plans, elevations, details, et~., there is a little less latitude as to making changes without no~ice than in the case of plans submitted under a tn' zone regulation imposed on a piece of property where the plans are submitted with a certain amount of direction from the City under regulations intended to protect other properties, and that there is some basis for more leeway allowed to the City Council in authorizing changes under such a procedure than there would be under a variance set-up. Mayor Turner acknowledged and ordered filed the communication of John O'Keefe, 1431 S. First Avenue, expressing opposition to the proposed formation of a Community Redevelopment Agency. 7. 3-2-65 PUBLIC SCHOOLS WEEK A : PR. OUTDOOR ADVERTISING :J/o 1s' PROPOSED COMMUNITY REDEVELOPMENT AGENCY ~/(j1f-A 16: 6485 The request of the Masonic Lodge for permission to install posters on light standards to publicize Public School Week (April 26 to 30) was APPROVED on MOTION by Councilman Considine, seconded by'Mayor Turner and carried unanimously. The installation to be made after approval of the Southern California Edison Company. Jay Kingry, representative of the Pacific Outdoor Advertising Company, asked that outdoor signs be reinstated in the conditional use ordinance; that the signs are not offensive and that the City Council has the right to approve or disapprove a location; that 1 presently his Company has only six locations. He felt that an opportunity should have been made for presenting the position of the Outdoor Advertising Companies. Don Davis, representative of the Foster & Kleiser Outdoor Advertising Company, concurred in the remarks made by Mr. Kingry and urged that billboards be retained under conditional use permits; that possible future locations appear to be minimal, but he would like to be in a position to apply should a location present itself. Prior to hearing from those desiring to speak to this matter, Mayor Turner stated in part that the City Council would not take any final action on the proposal at this meeting; that the staff had been instructed to develop preliminary plans and procedures for the benefit of those having misgivings about the practicability and feasibility of the program; that a plan will be formulated for 1) an industrial area and 2) for a commercial area; that a procedural ordinance will also be developed setting forth the method and criteria under which the City. Council and the Redevelopment Agency would operate, thus giving local auto"omy to anything which may be done under the purview of the Community Redevelopment Law. George Copans, 122 E. Colorado Boulevard, addressed the City. Council, propounding questions pertaining to the use of a State Law which was designed primarily for the elimination of substandard areas and urged the City Council to study all aspects of such a program. Robert E. Moser, 62 W. Woodruff Avenue, referred to procedure and asked whether or not the public would have an opportunity to be heard. The City Attorney explained the procedure and the time involved in the introduction and adoption of an ordinance; that every meeting is, in a o:oad sense, a public hearing at which anyone may be heard. He advised that he had prepared a resume' of the Community Redevelopment Law and a time table, which upon perusal should allay anyones fears that the matter could be determined without adequate public notice. 1 Councilman Considine then stated for the record: III have had many discussions with people since our last meeting dealing with the Community Redevelopment Agency and there have been two or three basic areas of concern which I think we can put into our program and perhaps the staff could survey as they go along: There is the hope that the Redevelopment Agency would be restrictive in its formation, perhaps be restricted to industrial and commercial property existent as of this present date, so it would never become something that would be extended over into residential specifically. 8. 3-2-65 16:6486 "Also there is a strong feeling that there should be a restriction as to the time of existence. In other words, if the purpose of the Redevelopment Agency is to develop certain plots of ground that there should be provisions for its termination after those plots of ground have been developed. 1 "There is a high degree of concern over the possibility of condem- nation proceedings. The people with whom'I have discussed t;;is feel that perhaps if it were on a request basis - in other words, if the people involved were to petition the Agency for a specific development - then having, say, a two-thirds or a majority or some appropriate number, the condemnation proceeding would be taking place at the request of the people in the immediate tract. "There has also been some concern expressed over the use of the Redevelopment Agency in the handling of raw ground as compared to ground which has been developed, speaking now in precise terms of buildings and structures having deteriorated, we would use this Agency to clear them and replace with something which would be more suitable for the community. "I would think that while the staff is investigating the program we have discussed previously - if perhaps these considerations could be t'aken into account and perhaps incorporated - it would be something the people of Arcadia would find more palatable and probably would allay many of the fears as to the extensive use. I feel specifically that the restriction to application of the Agency to perhaps industrial-commercial and the restriction of its existence in time would be specifically very important." Mayor Turner then observed that some of Councilman Cons~dine's points have been included in his suggestions to the staff. Councilman Forman stated that the welfare of the entire City will be kept in mind at all times and that caution will be exercised in the development. Councilman Reibold deplored information which had reached him that persons were contacting owners of certain properties which had never even been considered for inclusion in the redevelopment program, urging them to sell to them as the City would condemn their properties. Mayor Turner advised that copies of the procedural outline and the time table for its implementation would be available to the public in the office of the City Clerk. He also requested publicity in the press. 1 Introduced The City Attorney presented for the first time, explained the content and read the title of Ordinance No. 1280, entitled: "AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 9233.9 OF THE ARCADIA MUNICIPAL CODE' BY RECLASSIFYING TO ZONE C-O AND ALSO. ZONE D (ARCHITECTURAL OVERLAY) OF ALL THE COMMERCIAL PROPERTIES ON THE NORTH SIDE OF HUNTINGTON DRIVE BETWEEN BALDWIN AVENUE AND GOLDEN WEST AVENUE IN SAID CITY." ORDINANCE NO. 1283 Discussion held on Section 9262.1.3 which deletes billboards as a conditional use in the ordinance as drawn. The Planning Commission had recommended that billboards be removed from the commercial zones as a permissive use but included as a conditional use. Councilman Forman stated in part that he would like to see the ordinance introduced as drawn including the elimination of billboards, and referred to the endeavor made over the past eight years to up- grade the sign ordinance. the City Manager suggested a study be made of the business of 'Used Car Sales' being permitted in C-2 or any less restrictive commercial or industrial zone. Councilman Reibold MOVED that the ordinance be changed and considered again at the next regular meeting. (Motion withdrawn). Councilman Reibold MOVED that the reading of the full body of Ordinance No. 1283 be WAIVED.
