REGULAR MEETING
MARCH 16, 1965
The City Council of the City of Arcadia met in regular session in
the Council Chamber of the City Hall at 8:00 P.M., March 16, 1965,
Rev. Walter F. Dannaman, ALcadia American Lutheran Church
Mayor Dale E. Turner
The Minutes of the Regular Meeting of March 2, 1965 were APPROVED as
submitted in writing on MOTION by Councilman Reibold, seconded by
Councilman Considine and carried unanimously. Councilman Balser
abstained from voting due to his absence from said meeting.
A Resolution for Heroism Beyond the Call of
Duty was presented to Ray E. Burke, who risked
his life in the rescue of the pilot, co-pilot
and engineer from their burning aircraft which
crashed in December 1963, (Mr. Burke had
earlier been awarded the Carnegie Medal for
Heroism. )
Mayor Turner declared the hearing open on the application of
Donald p, McCormac for a business permit to pick up refuse from
commercial enterprises, The City Clerk advised that she had on file
the affidavit of publication and that there were no communications
other than the staff report.
The City Manager enumerated the five concerns currently licensed for
commerciol rubbish pick up, which he stated are in addition to the
contract agreement with the City Refuse Company,
Gene Gregg, attorney for the applicant, addressed the City Council
stating in part that a preliminary investigation on behalf of his
client' indicates that some of the licensees are serving only one
business and are therefore not engaged in open competition; that
the City should consider broadening its license ordinance to permit
such competition; that there appears to be a differential in rates
with which his client feels he can compete and that the commercial
business owner is entitled to that benefit. That his client has the
most modern equipment in contrast to that of some of the licensees.
Discussion ensued wherein it was stated by the City Manager that the
number of commercial rubbish licensees to be permitted was five but
the number of locations to be serviced by each was not'incorporated
in the ordinance as the City Council felt that this should be left
up to,the individual. (AMC Section 6434,2 - Limitations).
The consensus of the City Council being that the need for criteria
was apparent, MOTION was made by Councilman Reibold, seconded by
Councilman Forman and 'carried unanimously that the matter be
continued for sixty days (May 18, 1965); that during the interim the
staff in~estigate the number of locations being served by each licen-
see and report back to the City Council for action on the subject
application.

Mayor Turner declared the hearing open on the application of
Mildred E, Carr for a business permit to allow her to conduct a
private detective agency.
The City Clerk advised that she had on file the affidavit of
publication and that there were no communications other than the
staff report,
No one desiring to address the City Council, MOTION was made by
Councilman Balser, seconded by Councilman Considine and carried
unanimously that the hearing be CLOSED,

MOTION was then made by Councilman Balser, seconded by Councilman
Reibold and carried unanimously that the application be APPROVED and
that a business permit be issued to Mildred E, Carr for said
business.
MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that the public hearing on Planning Commission
Resolution No. 542 recommending the denial of the application for a
zone change from Zones R-l and R-2 to Zones C-l and D (architectural
overlay) on property at 710, 716, 720 and 728 Camino Real and 1505
and 1529 S. Baldwin Avenue, be set for TUESDAY APRIL 20, 1965 at
8 P.M., and that the City Clerk direct notices to the appropriate
property owners.
The Planning Director explained the contents of Planning Commission
Resolution No. 540 recommending the amendment of Resolution No, 3727
by augmenting the Zone 'D' regulations thereby imposed on property
classified in Zone C-l and C-2 in the Central Area, The Commission
recommended revisions to correct minor discrepancies.
The City Council concurred in the recommendations with the exception
of Section 2. I. Plan Review, which was al,tered to read: "Prior to
the filing of an application for a building permit to construct, or
reconstruct any structures, preliminary plans shall be submittedl.to
and approved by the Planning Department , , .".
MOTION was made by Councilman Forman, seconded by Councilman Reibold
and carried unanimously that Planning Commission Resolution No. 540
be APPROVED as THUS AMENDED.
The City Council reviewed at length the recommendation of the
Technical Study Committee that building permits be issued only for
plans which comply with the ordinances in effect at the time permits
are issued.

It was the consensus of the City Council that the present procedure
effects the purpose desired in that there is a 3D-day interim between
the time an Ordinance is adopted and becomes effective.
MOTION was then made by Councilman Reibold, seconded by Councilman
Considine and carried unanimously that the communication be filed.
The City Manager reported on bids received for the construction of an
office building to be built by the City and leased to the Chamber of
Commerce and recommended that the contract be awarded to the
E, T, Short Company in the amount of $60,508 including alternate
Nos. 1 and 3, rejecting alternate Nos. 2 and 4, He also recommended

the amendment of the lease agreement to provide for $400 monthly
rental instead of the original amount of $310. This was brought about
by the increase in construction costs. The architect's estimate was
$47,040 in September of 1964, but in the final plan preparation other
needs were discovered and the rise in certain labor costs resulted in
the increased cost.
Discussion held on the action taken by the Chamber of Commerce at its
Board of Director's meeting on March 11, 1965, asking the City
Council to consider establishing the monthly lease on the basis of
amortizing the construction cost and interest over a 33 1/3 year
period which would make the monthly rental $375.
Frank Regan, President, Chamber of Commerce, stated that the longer
term lease agreement would be appreciated, The consensus of the City
Council was that the difference would be insignificant - only $25.00
per month under the present 25-year lease agreement.
MOTION was then made by Councilman Reibold, seconded by Councilman
Forman and carried on roll call vote as follows that the recommen-
dation of the City Manager be accepted and that a contract be entered
into with the E, T. Short Company in the total amount of $60,508
including alternate Nos, 1 and 3, rejecting alternate Nos. 2 and 4;
that all other bids be rejected; that any irregularities or
informalities in the bids or bidding process be waived and that the
Mayor and City Clerk be and they are hereby authorized to execute the
contract in form approved by the City Attorney; that the sum of
$63,000 be appropriated from the Unappropriated Reserve for Capital
Projects Account No. 285 in the General Fund to Capital Projects
Account No. 102 - Holly Avenue Office Building - and that the rental
under the Chamber of Commerce lease be established at $400 per month.

waived and that the Mayor and City Clerk be authorized to execute a

bid of the D & W Paving Company in the amount of $54,748,60 for
the improvement of Santa Anita Avenue between Colorado Boulevard
and Huntington Drive; that all other bids be rejected; that any

It was the consensus of the City Council that when cars are again
purchased smog control devices be included as an alternate in the
bids.

MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously that the Chamber of Commerce be granted
permission to erect three street banners (Baldwin Avenue and Duarte
Road, Huntington Drive and Morlan Place and Live Oak near Santa
Anita Avenue) to publicize its First Annual Spring Flower Festival
at the Arboretum on April 2, 3, 4, 1965. Banners to be displayed
from March 18 through April 5.
The City Council explored the request of the Boys' Christian League
for permission to erect two banners to publicize its circus to be
held. June 4 and 5, 1965. It was stated in part by Councilman Reibold

that the City has heretofore limited banner displays to local
organizations such as the Chamber of Commerce, Community Chest, ete;
that although Arcadians will undoubtedly attend the circus where
does the City stop in approving banners,

Councilman Balser stated in part that the matter warrants study, but
the League is a worthwhile non-profit organization and that until the
problem becomes acute the request in his opinion should be granted,
MOTION was then made by Councilman Balser that permission be granted
the Boys' Christian League to install banners at Duarte Road and
Baldwin Avenue and Huntington Drive opposite Bekins Van & Storage
Company for the period May 28 through June 7.
It was stated in part by Councilman Forman that he has been told
that the organization is competing with local merchants by the sale
of merchandise such as sporting goods during fund raising activities;
that it has not been entirely beneficial to the local merchandising
establishments; that the circus is not totally an Arcadia project.

The City Manager advised for the record that it was found to be
incorrect that a member of the firm of Perl iter and Ingalsbe was a
resident of Arcadia, although C. S. Northrop, owner of NoreD
Engineering Corporation and an Arcadia resident, will be performing
the field work in connection with the engineering of' the 1964 Storm
Drain Bond Issue Project. The statement had been made at the March 2
meeting,

Discussion held on the request of Mr. and Mrs. Edward L, Heiss for a
60-day extension in the lease clause covering construction com-
mencement. The City Council acknowledged the communication from
William H. Marmion requesting the City Council to make the subject
property available to other development in conjunction with his
property located to the north of the site in question.
Mr. Heiss addressed the City Council and in part stated that although
financing has not been completed he is confident at this point that
with the extension of 60 days the project can get under way,
The consensus of the City Council being that a 60-day extension is
not unreasonable in light of all the diligent work which has gone
into the project, MOTION was made by Councilman Considine, seconded
by Councilman Balser that the request be granted,
In further discussion it was placed on record that if this extension
does not prove sufficient to permit financing acceptable to both the
lessee and the City, that the City Council, in pursuing its
responsibility, would at the expiration of the 60 days feel free to
seek other recourse in the development of the property,

The Motion for granting a 60-day extension was shen carried
unanimously.
Inasmuch as the City is soon to go to bid on gasoline needs the City
Manager presented-for consideration data on a cooperative purchasing
program conducted by the County Purchasing Agent; that 33 cities,
71 school districts and 3 special districts are participating; that
the City uses approximately 120,000 gallons per year and that it
would mean a small savings to the City if the Council desired to
purchase through this source.

Discussion ensued with Mayor Turner of the opinion that it would be
worthwhile ,to enter into a master purchase agreement as autonomy is
not lost; that it is a way of purchasing for less money.
It was the consensus of the majority of the City Council that
~urchasing County-wide could lead to favoring one gasoline firm, and
that the practice could extend to other types of purchasing,
Thomas C, Sullillan, Jr" 160 White Oak Drille, commented from the
audience that the'matter is one for serious con~ideration; that such
a practice could extend to other types of purchasing.
Councilman Forman MOVED that the City continue its present practice
of gasoline purchasing; that it not be obligated to the County for
this type of serllice, Councilman Reibold seconded the motion which

carried unanimously, that the communication from William'H. Marmion
regarding the proposed Arcadia Tower Building construction be filed

It was MOVED by Councilman Reibold, seconded by Councilman Forman and
carried unanimously that the communications from the Arcadia Chamber ..
of Commerce, Mrs. Irvin I. Livingston, Jr., and the petition signed
by 13 residents supporting the Agency be received and filed.
Upon inquiry by Councilman Forman the City Manager adllised that
pertinent data will be ready for study at the session to be held on
March 25,
George Gaffney was advised in response to his inquiry that it is not
the intent of the City to extend sand and gravel operations on South
Peck Road; that it is zoned for industrial uses only.
Mayor Turner received and ordered filed the communication from the
California Roadside Council expressing support'i~ the' recent adoption
of Ordinance No. 1283 relating to billboards, underground utilities
and service stations.

It was MOVED by Councilman Reibold, seconded by Councilman Balser and
carried on a 4 to 1 lIote (Councilman Forman lIoting 'no') that the
City Council grant the request of Fred Howser for' a year's extension
of the lIariance granted by Resolution No. 3665 on April 21, 1964 for
property at Colorado Boulevard and Colorado Place.
Councilman Forman explained that in his opinion the matter should be
referred to the Planning Commission; that in compliance with the Code
.the Commission has the right to extend variances providing certain
conditions are established.
Edith Dunn, 29 Palm Drille, spoke to a matter of a subdillision trust
which had been acted upon by the City Council two years ago, She was
adllised to submit a letter of explanation and the City Council would
see what assistance it could render although the City Attorney advised
that the matter is closed as far as the City is concerned since the

trust agreement is already executed and the trust deeds and the sub-
division map have been recorded.
Banners
Kermit Hartzler, President of the Arcadia Business Association,
expressed concern on the type of banners approved by the City and
referred to the effort being made to control signs. It was the
consensus of the City Council that it is a matter for study,

The City Manager submitted copies of a proposed script
connection with the new film strip on city functions.

Councilman Reibold and Considine referred to a traffic condition at
Camino Grove and Eighth Avenue and asked the staff to investigate,
Councilman Forman was joined in by the Council members in commending
Wesley McDaniel and others in their work resulting in a successful
Student Government Day. (March 16, 1965),

Councilman Considine referred to a traffic situation at Harvard and
Colorado Boulevard where numerous accidents have occurred. It was
brought out that anything the City may wish to do would have to be
approved by the State as Colorado Boulevard is a State Highway,
Mayor Turner suggested that some legislative bills be discussed at the
Study Session on March 25,
The City Attorney referred to the availability of copies of the
legislative bills, He further stated that he had been appointed by
the President of the' City Attorn~y's section of the League of
California Cities to a State-wide Committee of City Attorneys to
analyze and submit recommendations concerning various bills on Home
Rule and S~ate preemption; that the members from the south were to
meet in Los'Angeles on Friday March 19 and the entire Committee would
meet ,in the League office in Sacramento on March 26; that he planned
to attend 'both such ~eetings,
