Dr, Stanley S. McKee, Pastor of the Church of the Good Shepherd - Methodist Mayor Conrad T. Reibold PRESENT : ABSENt: Councilmen Balser, Considine, Forman, Turner, Reibold None Due to the desire of members of the City Council for clarification of a technicality the Minutes of the regular meeting of April 20, 1965 were not approved. Same will appear on agenda for the next regular meeting. Mayor Reibold, on behalf of the City Council, presented Councilman Turne~ with a plaque honoring him for his tenure of Mayor (1964-65). Planning Commission Resolution No. 543 recommending upon specified conditions the reclassification of the property located at 653 Fairview Avenue from Zone R-3 to Zone PR-3 and to Zone C-2 and D (architectural overlay). The applicants, Kent Chevrolet, propose to use the property for off-street parking, access to Fairview Avenue and fer construction of an additional service building. The Planning Director explained that the subject property is now in Zone R-3 and improved with an older single-family house; that property to th~ north is in a combination of zones consisting of PR-2, R-3 and C-O and D and is improved with a number of dwelling units; that prope~ty to the east is in Zone R-3 and is improved with an apartment building; that property to the south across Fairview Avenue is in Zone R-3 but is utilized for public parking; that property to the west is in Zones C-2 and PR-3 and utilized for public and private automobile parking purposes. He continued that the site would be clear~d of a non-conforming use and the property would be improved with paving and landscaping which would provide a greater space buffer between the existing apartment house to the east and the comme~cial activities to the west; that based on these reasons the Planning Commission recommend that the northerly 100' be reclassified to ZOne C-2 and to Zone D, and that the southerly 170' be rezoned to PR-3 with applicable conditions as specified in Resolution No. 543. After reviewing projecturals of the subject site Mayor Reibold decla~ed the hearing open and no one responding to his inquiry if anyon~ desired to speak in favor or in opposition to the proposed 1. 5-4-65 PROTEST HEARING ANNEXATION NO. 35 -:3-/033 RESOLUTION NO. 3786 Adopted j- /033 ORDINAL~CE NO. 1285 Introduced -8-/633 16:6526 zone change, it was MOVED by Councilman Forman, seconded by Councilman Turner and carried unanimously that the hearing be CLOSED. In answer to inquiry the Planning Director explored conditions as specified by the Planning Commission, in particular No. 1 wherein it is stipulated that a 6' minimum to 81 maximum decorative masonry wall along the entire east 310' shall be constructed (such wall to decrease to 3' in height in the front setback area of Fairview Avenue). He also referred to Condition No. 2 requiring a 36" high decorative masonry wall 5' back of the south property line along Faioview Avenue with a 25' wide wall opening for egress and ingress to be constructed. I It was then MOVED by Councilman Turner, seconded by Councilman Forman and carried unanimously that the recommendation of the Planning Commission be approved and that property at 653 Fairview Avenue be reclassified from R-3 to PR-3 and C-2 and D subject to conditions as set forth in Resolution No. 543. Pursuant to Resolution No. 3771, Mayor Reibold declared the hearing open on the proposed annexation to the City of Arcadia certain uninhabited contiguous territory designated as "Annexation No. 35 West Arcadia Uninhabited". (Property south side of Naomi Avenue, east of Golden West Avenue). The City Clerk advised that she had on file the affidavit of publi- cation and the affidavit of mailing as required by the Government Code and that no written protests had been received, No one desiring to speak or make oral protest to said annexation, MOTION was made by Councilman Forman, seconded by. Councilman Balser and carried on roll call vote as follows that the hearing be CLOSED. On MOTION by Councilman Forman, seconded by Councilman Turner and carried unanimously a public hearing was scheduled for June 1, 1965 on Planning Commission Resolution No. 548 recommending the reclassi- . fication of portions of property bounded on the west by El Monte Avenue, on the south by the southerly boundary of the City of Arcadia, on the east by Second Avenue and on the north by a line parallel to and distant 600 feet northerly of Las Tunas. Drive and Live Oak, easterly of its intersection with Las Tunas- Drive. The final map of Tract No. 27195 (consisting of 19 lots on property north of the Foothill Junior High School) was APPROVED, subject to specified conditions, on MOTION by Councilman Considine, seconded by Councilman Forman and carried unanimously. The communication expressing appreciation for re~ent recognition of its efforts by the presentation of plaques was ordered FILED. The request of Dr. H, C, Field, former owner of the Arcadia Small Animal Hospital (311 N. Santa Anita Avenue) for a partial refund of the unused portion of the 1965 business license fee was APPROVED, pursuant to Section 6214.5.3 of the Arcadia Municipal Code, on MOTION by Councilman Forman, seconded by Councilman Balser and carried on roll call vote as follows that the sum of $11.25 be. authorized for refund to Dr. H. C. Field. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None In response to a communication received from Mrs. J. R. Jones, 523 Leda Lane, requesting assistance in solving dust problems emanating from an adjacent unpaved driveway (1233 S. Sixth Avenue), the City Council discussed the possibility of legislation which would require all driveways to be paved. . I Mrs. Jones addressed the City Council stating in part that she was under the impression that the City could aid in the situation. She was advised that the City has taken all the steps it can under existing regulations and that perhaps civil action was her remedy at the present time. Councilman Considine stated in part that in his op1n1on it would be well for the City Council to request the Planning Commission and staff to review the problem of unpaved driveways for ultimate elimination of the dirt and dust situation. It was Councilman Balser's observation that the Zoning Ordinance should include such a provision and suggested a two year deadline for the paving of driveways, It was the consensus of the City Council that the Planning Commission include driveway paving in its current study and endeavor to update the Zoning Ordinance, The communication from Mrs. Jones was ordered filed on MOTION by Councilman Turner, seconded by Councilman Forman and carried unanimously. The City Council in accord with the recommendation of the City Manager that the City oppose the election-at-large provision of Senate Bill No, 6, ADOPTED the following minute motion as made by Councilman Turner, seconded by Councilman Considine and carried unanimously: "RESOLVED that regardless of the ultimate number of Senators who will represent Los Angeles County, whether it be 15, 12 or some other number, the economies of the situation make it most impractical if not impossible for the average candidate to campaign in a general election in the County at large; that this would eventually lead to candidates soliciting campaign contributions from 'major commercial interests thereby tending to eliminate the grass roots approach which the District philosophy embodies, therefore, this City Council opposes that portion of S en ate Bill No. 6 that would have Senators elected at large from Los Angeles County and directs copies of this minute resolution to Senator Rees, Assemblyman Flournoy and Assemblyman Collier," I 4, 5-4-65 REPORT (Police) ! 4-; P,..e,~u....- I 16:6529 The City Council received the 1964 calendar year report of the Police Department as submitted by the Police Chief. It encompassed index crimes, traffic accidents and violations, training programs, current strength of the department as to personnel and changes therein, complaints, commendations and miscellaneous items. Councilman Considine stated for the record that "I have received several nice compliments on our Police Department, where they have gone out of their way to help motorists; taking persons to and from service stations for fuel when they have run out of gas; things of this nature which are generally over and beyond the requirements of their normal duties. I think they should be commended for their efforts and this is a compliment to the City forces, I would like them to know we appreciate their efforts in this regard.lI The report was acknowledged and ordered FILED. ART On MOTION by Councilman Considine, seconded by Councilman Forman and FESTIVAL carried unanimously the request of the West Arcadia Business and (WAB&PA) Professional Association for permission to hold its 12th Annual Mid- {i~ lJJp' f:;;.1, r(~ Valley Art Festival on May 6, 7 and 8, 1965 was APPROVED including . the prohibition of parking on both sides of Baldwin Avenue between Duarte Road and Naomi Avenue and extra police patrol service during the night. LAND SALE (City-owned) ~ :,t 3?)oy 1965-66 BUDGET (Preliminary) In order to transfer title of property to complete negotiations for the sale of city-owned property, MOTION was made by Councilman Turner, seconded by Councilman Forman and carried on roll call vote as follows that the Mayor and City Clerk be authorized to execute deeds in form approved by the City Attorney for Lot Nos, 2 through 13 and Lot Nos. 22 through 25 of Tract No, 26345 as shown in Map Book 670, Pages 65, 66 and 67 of the Los Angeles Recorder to E. O. Rodeffer and D. R, Butler. There is an unpaid balance due the City of $65,400, plus 10 per cent interest of $6,540 and interest to May 1, 1965 of $5,984,31 making a total of $77,924,31 to be paid the City. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None Pursuant to the prOV1Slon of the City Charter, the City Manager submitted the preliminary budget for the fiscal year beginning July 1, 1965 to June 30, 1966. He explained that the expenditures contemplated under said budget total $3,145,644 as compared with $3,023,503 in 1964-65, He drew attention to the fact that the new ~. ~",-~t.- budget provides for a tax rate of $1.10 per $100 assessed valuation, :JI 0 whereas the current tax rate is $1.05 - as compared with the preceding 12 year tax rate of $1,10, I CONTRACT AWARD (Water main> J I/O.$" Mayor Reibold commented that although it is too early to say prior to detailed study of the budget by the City Council, he would hope that the tax rate could be held at $1.05. The City Council scheduled budget study sessions at the conclusion of this meeting. TAX FUNDS Sidewalks ~ 16:6530 the low bid and award the contract for the water main replacement in Norman Avenue from Holly Avenue to Baldwin Avenue and in Fifth Avenue from Duarte Road to Huntington Drive to the Royal Pipeline Con- struction Company in the amount of $31,526.00; that all other bids be rejected; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk be and they are hereby authorized to execute the contract in form approved by the City Attorney. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reihold None None I On MOTION by Councilman Turner, seconded by Councilman Forman and carried on roll call vote as follows, the plans and specifications for the improvement of Campus Drive between Huntington Drive and Holly Avenue from the Arcadia Wash to Huntington Drive and approxi- mately 380' south of Huntington Drive on Holly Avenue were approved; the transfer of $40,000 from the General Fund Unappropriated Surplus Account No. 290 to Capital Improvement Projects Account No. 239 was authorized and the City Clerk was authorized to advertise for bids upon receipt of approval from the State Division of Highways, AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman"Turner, Reibold None None City funds expended in this improvement will be qualified for matching credits under Section 186.1 of the Streets and Highways Code. The Director of Public Works submitted a report of projects presently budgeted, Gas Tax funds available and the preliminary 1965-66 Gas Tax Budget. He advised that the City. will have accumulated an estimated $277,000 by June 30, 1965; that the City has accumulated matching credits of approximately $120,450, the exact amount depending upon final resolution of matching credits reported to the State Division of Highways. He further recommended that the additional money made available for maintenance purposes be budgeted for maintenance and a maximum of $90,000 be approved in this manner: $50,000 for street resurfacing by contract and $40,000 maintenance of streets by city forces. Discussion ensued with Councilman Considine suggesting that sidewalks along Duarte Road and Baldwin Avenue be constructed concurrent with the widening of the same streets which is reflected in the work projects under the State Gas Tax Program for 1965-66; that in this manner sidewalks could be constructed in the subject areas at a minimum of cost to the City although the cost for same must come from Capital Projects Account. The City Manager explained that State Gas Tax Funds may be used for intersection sidewalks only which is a minor part of the total construction of sidewalks. I Expressing a desire for an estimate of the cost for the construction of sidewalks at the same time the above mentioned streets are widened, MOTION was made by Councilman Turner, seconded by Councilman Forman' and carried unanimously that staff be instructed to provide the Capital Projects Committee with projective figures for the con- struction of sidewalks in the two areas mentioned. 6. 5-4-65 RESOLUTION NO. 3787 Adopted I RESOLUTION NO. 3788 Adopted I REPORT (Lighting District No. 20) :1 :!J 96 / 16:6531 The City Attorney then presented, explained the content and read the title of Resolution No. 3787 entitled: "A RESO~UTION OF THE CITY COPNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADOfTING AND SUBMITTING A BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM THE STATE HIGHWAY FUND TO' CITIES." . Motion seconded by Councilman Forman and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None In accordance with the provisions of the Streets and Highways Code concerning levying and collecting assessments for municipal street lighting, Act of 1919, under which Lighting Maintenance District No. 20 was formed, the Director of Public Works submitted the Engineer's Annual Expense Estimate for the 1965-66 fiscal year. He explained that the period covered therein is the second year of the .2 year period established by Resolution No, 3625 wherein cost of installation of the system would be repaid to the City Account established for that purpose. Maintenance costs for the same period were also included - total assessment to District for 1965-66 $1,545.09. The cost to be borne by the District shall be paid by special assessment taxes levied on all land exclusive of improvements within said District No. 20. (Area located in the Santa Anita Village) . This is in connection with proposed Tract No. 30231 - extension of Los Altos. Kermit Hartzler, President of the Arcadia Business Association, presented a petition requesting and urging the City Council to take steps to create a Community Redevelopment Agency as soon as possible; that no involvement be permitted in any Federal Redevelopment program nor any involvement be permitted in any residential area; that it be restricted to 1) industrial property located east of Peck Road and south of Live Oak Avenue in the City of Arcadia and 2) commercial property as outlined in the Central Area Plan. A reply was requested. Tom C, Sullivan, 160 White Oak Drive, spoke in support of the petition presented by Mr, Hartzler and commented on the opposition to the creation of the Agency. James S. Bartlett, 855 Hugo Reid Drive, spoke in opposition to the creation of the Agency with the power of eminent domain, Troop No. 116 was recognized.. The City Manager advised that in connection with the bids received for the main replacement in Fifth Avenue it will be necessary to obtain a pipe line license from the Atchison, Topeka and Santa Fe Railroad Company, in order to replace the main under the railroad tracks at Fifth Avenue. It was MOVED by Councilman Forman, seconded by Councilman Turner and carried unanimously that the Mayor and City Clerk be authorized to execute the pipe line license on behalf of the City in the form submitted by the railroad company. The City Council concurred in the steps taken by the City Manager in submitting a communication to the President of the Los Angeles County Division of the League of California Cities asking that the matter of night racing be placed on its agenda for consideration and urging that the Division oppose this legislation, (Assembly Bill No. 320 would permit night racing and Senate Bill No. 1237 would restrict night racing to tracks receiving individual approval of the Racing Board, Reference was also made to Assembly Bill No, 1386 which provides for off-trac~ betting on horse races). The City of Arcadia has opposed all these Bills. The League of California Cities' meeting to be held in Beverly Hills May 20 was noted, 9, 5-4-65 (TURNER) (FORMAN) (BALSER) A ,WATERSHED , COMMISSION Adjournment 16:6534 Councilman Turner expressed appreciation for the plaque presented him earlier in the meeting. Councilman Forman commented on the expeditious manner in which a street condition was recently eliminated by City forces. Camphouse to another two year term on the Los Angeles County Watershed Commission.
