Reibo1d PRESENT: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None The Minutes of the regular meeting of July 6, 1965 were APPROVED on MOTION by Councilman Turner, seconded by Councilman Forman and carried unanimously. Due to his. absence from said meeting, Councilman Balser abstained from voting. to conduct an Mayor Reibold spoke to the HEARING Application of Mario Piatelli for a business permit (Auction) auction of three homes and one lot on Sharon Road. I.J. declared the hearing open and the following persons !J-f' ~JA. ,.L:iitatter: ~~~r_~ - Robert A. Zoller, 339 Sharon Road, opposed an auction in the resi- dential area and referred to the unfinished appearance of the subject homes and lot, and stated that in his opinion there are other and better ways to dispose of property. 1 HEARING , (Zone change Piken) 9--11 ;W No one else desiring to be heard Councilman Turner MOVED that the hearing be CLOSED. Motion seconded by Councilman Balser and carried unanimously. Discussion ensued and reference was made to the prior policy of the City in disallowing auctions due to the business activity they would bring to residential areas. Based on this and the opposition expressed by nearby residents it was MOVED by Councilman Considine, seconded by Councilman Balser and carried unanimously that the application be DISAPPROVED. Planning Commission Resolution No. 553 recommending upon specified conditions the reclassification of property at the northwest corner of Foothill Boulevard and Second Avenue to Zones C-1 and D (architectural overlay). It was brought out by the Planning Director that the subject property is presently zoned C-2 to a depth of 135 ft. and PR-l to a depth of 75 ft.; that the remaining property is in Zone R-1; that the R-1 properties on Sycamore Av~nue from the wash easterly to the west boundary of the former Foothill Jewish Center property are 375 ft. deep and the remaining lpts to the east are 170 ft. in depth; that the subject property is located on an arterial highway and the Planning Commission recommended the reclassification as the proposed development will be more compatible if present zoning is expanded. He also explained conditions upon which the Commission recommended the rezoning and projecturals were displayed, 1. 7-20-65 16:6596 Mayor Reibo1d then declared the hearing open. Speaking in favor of the recommendation: Herbert M. Piken, one of the developers, stated in part that a dignified shopping center is proposed and that he has met with about 75 per cent of the adjacent property owners. He reiterated statements made before the Planning Commission which are a matter of record. Ha~ris A. Dolan, representing the Security First National Bank, stated that the Bank had chosen the subject location after surveying other areas and urged approval of the requested zoning. 1 No one else desiring to be heard it was MOVED by Councilman Balser, seconded by Councilman Forman and carried unanimously that the hearing be CLOSED. Councilman Balser then MOVED that the recommendation for C-1 and D Zone contained in Planning Commission Resolution No. 553 be APPROVED. Motion seconded by Councilman Forman and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None HEARING (APPEAL) ~;~1 Mayor Reibold declared the hearing open on the Appeal from Planning Commission decision as contained in its Resolution No. 550 denying the granting of a conditional use permit to allow the construction of an addition to an existing convalescent hospital located at 414 W. Huntington Drive. The appeal was filed in compliance with Arcadia Municipal Code Section 9275.2.9 by John A. Williams, owner of the Hospital. Elmer R. Slavik, 760 W. Huntington Drive, Arcadia, stated in part that the situation is quite different in the convalescent hospital field today than it was in 1962 when the subject facility was established; that to prevent its going into a non-profit type of organization an endeavor is being made to enlarge and improve it to benefit the community and the operation itself; that in order to comply with the requirements made by the Planning Commission the number of new beds being requested has been reduced from 24 to 18; that the only requirement not met is the one setting forth 1000 sq. ft, of land per bed which figure is unrealistic in his opinion. John Williams, President of the subject hospital, stated in part that the request is based entirely on economic need and requirements; that 1 it operates under the free enterprise system and desirffito be able to compete in one of the most competitive businesses in the country. He noted the 25 per cent reduction in the number of beds and urged favorable consideration of the request. HEARING CLOSED No one desiring to speak in opposition it was MOVED by Councilman Fo~man, seconded by Councilman Considine and carried unanimously that the hearing be CLOSED. Councilman Forman stated in part that in his op1n10n the additional beds would overburden the density considering the two similar hO$pitals in the city; that vacancies could occur which would tend to downgrade all of the hospitals. 2. 7-20-65 d 16:6597 Councilman Turner stated in part that when private enterprise feels it can do better by expanding facilities it should be so allowed providing all requirements are met. I.."" The Planning Director ,explained that there are no standards re- stricting the amount of area per bed as yet; that the only standards to be used as a guide are those of the hospitals in existence; that the Planning Commission will consider this requirement; that the Department is suggesting that the maximum density be one bed for every 1000 sq. ft. of gross lot area; and that in the subject request the figure would be about 600 sq. ft. per bed. Councilman TU1'ner then MOJED that the request for a conditional use permit be granted. The motion was seconded by Mayor Reibold. Councilman Balser agreed with the recommendation of the Planning Commission and the staff; that the high standards in Arcadia are set on the density of apartments and by the same token standards must be set on convalescent hospitals. Councilman Considine stated in part that convalescent hospitals are a special use as it gets into areas more residential than the standard hospital; that it is a matter of how much commercial density is desired in an area almost all residential. Councilman Turner stated in part that the new appearance would be a greater improvement than the offsetting factor of the size; that in his opinion a person in a convalescent hospital would not need 1000 sq. ft. of lot area; that as long as the 'appearance is pleasing to the community the density factor should be secondary. Roll call was then taken on Councilman Turner's motion. HEARING SCHEDULED (zone change) It was MOVED by Councilman Balser, seconded by Councilman Considine and carried unanimously that a public hearing be scheduled for August 17, 1965 at 8 P.M. on Planning Commission Resolution No. 555 recom- mending the denial of a requested zone change of property located at the northwest corner of Santa Anita Avenue and Las Tunas Drive, The City Clerk to notice the hearing as required by law. 1 PERSONNEL BOARD It was MOVED by Councilman Considine, seconded by Councilman Forman and carried unanimously that the recommendation of the Personnel Board be APPROVED and that the Personnel Rules be amended as follows: le. : ~C~~Rule XIII. Probationary employees shall not have the right of appeal. Rule IV. Section 3, Subsection (b). A reclassified position shall be filled by promotional examination, except in the case where the number of qualified applicants is equal to or less than two plus the number of positions to be filled, the department head may request that the Personnel Board waive the requirements of the competitive examination. The eli- gible list established by waiver of examination shall be automatically canceled when the reclassified positions are fi lled. 1 Following discussion on the recommendation of the Personnel Board coccerning incentive pay for raising the professional competence of police officers, it was MOVED by Councilman Balser, seconded by Councilman Forman and carried on roll call vote as follows that members of the Police Department holding the rank of policeman or policewoman be paid an 'educational incentive increment' equal to one salary schedule (5%) above their current salary step when conditions as outlined in the communication dated July 15, 1965 are met; that payment of the increment commence with the first pay period after the member submits evidence of having complied with the requirements: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None It was MOVED by Councilman Considine, seconded by Councilman Turner and cartied on roll call vote as follows that the recommendation of the Personnel Board be approved and that the salary schedule for the senior building inspector be established at 10% above the salary schedule for the Building Inspector, (The 1965-66 salary for building inspector having been established at Schedule No. 434 - $607-737; the 1965-66 salary for senior building inspector to be established at Schedule No. 438 - $669-813.) AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None The City Manager explored in detail the status of the recommendation 1 contained in Planning Commission Resolution No. 548 which was continued from June 1, 1965. The portion of the resolution which was not acted upon included zoning to be placed on property on the north side of Las Tunas Drive from Santa Anita Avenue to El Monte Avenue. The recommendation had placed about half of this property in Zone R-l with which the City Council had not concurred. It was continued in order to enable staff to submit further reports and diagrams. Property located on the south side of Live Oak Avenue between Santa Anita Avenue and Second Avenue and recommended for Zone C-2 had also been continued pending a decision on the area referred to above. Included in the new staff report were three alternate diagramatic plans for the area at the northwest corner of Santa Anita Avenue and Las Tunas Drive. 4, 7-20-65 MOTION (withdrawn) , 1 NEW MOTION 9-1/1/ WORK ACCEPTANCE 1 1-/0'9 L. CURBS, GUTTERS EL SERENO DRIVE p: f..$ ~ 16:6599 In consideration of the residential portion of the northwest corner of Las Tunas Drive between Santa Anita Avenue and E1 Monte Avenue specifically, it was MOVED by Councilman Turner, seconded by Councilman Forman, that this portion be placed in Zone c-o and that provision be made to require all new construction;:that it become unlawful to remodel an existing house to make it conforming. Dis- cussion ensued on the latter part of the motion, as a result of which Councilman Turner withdrew his motion for restatement. Councilman Forman also withdrew his second. Councilman Turner then MOVED that said property be placed in Zone c-o and D, and that staff be instructed to submit Zone 'D' regulations to be applicable thereto. Motion seconded by Councilman Forman and carried on roll call vote as follows: ' AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None The alternate plans were then considered at length and it was MOVED by Councilman Forman, seconded by Councilman Turner and carried on' roll call vote as follows that Alternate Plan No. 1 be approved and that staff be instructed to submit Zone 'D' regulations to be applicable thereto. (This plan extends Sandra Avenue, creates R-1 lots backing on Woodruff Avenue and with the c-o zoning on Las Tunas Drive and Santa Anita Avenue places the balance of the subject area in Zone C-2 and D). Staff to submit Zone 'D' regulations to be applicable thereto. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None The work as completed by the Westates Electrical Construction Company in the furnishing and installing of traffic signal systems, highway lighting and other appurtenant work at Santa Anita and Colorado, First and Colorado and Santa Anita and Huntington Drive was ACCEPTED and final payment AUTHORIZED on MOTION by Councilman Forman seconded by Councilman Turner and carried on roll call vote as follows: AYES: NOES: . The City Attorney attempted to explain ~he procedure that had been followed. . . - In accordance with the provisions of the Streets and Highways Code, the Director of Public Works submitted his annual report on the Municipal Lighting Maintenance District Acts of 1919 and 1927 for the purpose of making tax levies for the fiscal year 1965-66. The City Manager advised that the current budget provides $2600 for the purchase of a new six passenger station wagon to replace a 1959 station wagon; that the Fire Chief now requests that the new equipment be purchased to replace a 1954 Ford Vanette Rescue unit. Councilman Balser MOVED that the request be granted, Motion seconded by Councilman Turner and carried unanimously. The request of the Los Angeles County Fair Association for permission to hang banners to publicize its annual Fair (September 17 through October 3, 1965) was APPROVED on MOTION by Councilman Forman, seconded by Councilman Balser and carried unanimously. The communication from the Los Angeles County Assessor setting forth the unofficial assessment figures for the fiscal year 1965-66 was noted and received. The report reflected a preliminary grand total of both secured and unsecured valuations of $117,345,230. 1 The City Council on July 6, 1965 approved the acquisition of three, properties, however, funds were not appropriated for two of the parcels nor for the escrow costs c,n a third. The Planning Director advised that William Kuyper is the new Chairman and James Parker the new Vice Chairman of the Planning Commission. " ". The Planning Director will arrange a time certain for the City Council to view slides depicting 'before and after' the new R-3 regulations became effective. ,0 11. 7-20-65 BALSER (sidewalks) g-/IJI ADJOURNMENT 16:6606 Councilman Balser inaugurated discussion on the need for sidewalks adjacent to schools, a subject about which he has felt strongly for $ome time; that in his opinion the Capital Projects Program has reached a stage where the City Council should consider the con- struction of sidewalks at least on one side of heavily travelled thoroughfares in school areas. He cited specific dangerous areas adjacent to schools and recommended on MOTION that the City Council instruct the staff to prepare a study with estimated costs for the ~onstruction of sidewalks adjacent to schools. The motion was seconded by Councilman Considine and carried unanimously. Brief discussion held on priority streets and schools. Councilman Turner was advised that the City retains its Independent Cities' membership but that funds were not budgeted for attendance at meetings, etc. Councilman Balser was welcomed back to the Council Table by Councilman Forman who expressed appreciation for the opportunity to Serve as liaison to the Library Board during Mr. Balser's absence. the Study Session scheduled for July 29, 1965 was noted.
