Reibold PRESENT: ABSENT: Councilmen Balser, Considine, Turner, Reibold Councilman Forman The Minutes of the regular meeting of August 3, 1965 were APPROVED on MOTION by Councilman Turner, seconded by Councilman Considine and carried unanimously. Mayor Reibold declared the hearing open on Planning Commission Resolution No. 555 recommending denial of an application filed by the Republic Capital Corporation on property at the northwest corner of Santa Anita Avenue and Las Tunas Drive from Zone R-l, R-2 and R-3 to Zone C-3. It was noted that, due to illness, the applicant had requested a continuation of the matter and no one desiring to be heard, it was MOVED by Councilman Turner, seconded by Councilman Considine and carried unanimously that the public hearing be continued until the regular meeting of September 21, 1965. The recommendation of the Planning Commission for denial of an application filed by Mr. and Mrs. C. Robert Barrett requesting per- mission to divide their property at 205 W. Walnut Avenue was appealed by the applicants. The Planning Director advised that the Commission had determined that the proposed lot deviated sufficiently from the Zone R-O requirements to warrant the denial. Projecturals were displayed and reviewed in detail showing the location of the improvements thereon. The proposed lot would be 118.97' x 110' which deviates 6' from the requirements. The applicants addressed the City Council requesting favorable_ consideration and s ta te d that the subject property is diffrz-ult to maintain and is unsightly; that it would enhance the area inasmuch as it is located on a corner with the new lot to front on El Monte Avenu~ It was the consensus of the City Council that the advantages of an improved lot at this location would outweigh the slight deviation from the code requirements and the following minute resolution was unanimousLy adopted on MOTION by Councilman Turner, seconded by 1. 8-17-65 PUBLIC HEARING SCHEDULED AWARD OF CONTRACT (Landscaping) (F: 1059) CONSULTING ENGINEER AUTHORIZED (IR) WORK ACCEPTANCE (D & W Paving Co.) (F:ll13) 16:6615 Councilman Balser: BE IT RESOLVED: That the City Council indicate its intention to approve a lot split at 205 W. Walnut Avenue, upon the conditions outlined in the Planning Department report dated July 27, 1965. MOTION by Councilman Turner, seconded by Councilman Considine, and carried unanimously that a public hearing be scheduled for SEPTEMBER 7, 1965 on the appeal filed by the appellant, Marion E. Smith, from the 1 decision of the Planning Commission in its approval of a request for a modification of applicable yard requirements so as to permit the construction of ten garages at R-3 property located at 826 La Cadena Avenue. . The City Manager reported that the following bids had been received and reviewed for the landscaping of Santa Anita Avenue from Colorado Boulevard to Huntington Drive. He recommended the award of the contract to the low bidder, Paul Sanker. Paul Sanker Shawn Co. Moulder Bros. Aka - Tani Landscape Co. Valley Crest Landscape, Inc. $10,933.00 12,712.00 12,926.00 15,200.00 22,010.00 MOTION was made by Councilman Balser, seconded by Councilman Turner and carried on roll call vote as follows that the City Council accept the recommendation of the City Manager and award the contract to Paul Sanker in the amount of $10,933.00; that all other bids be rejected; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk be authorized to execute the contract in form approved by the City Attorney' AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reibold None Councilman Forman On MOTION by Councilman Turner, seconded by Councilman Considine and carried unanimously the City Manager was authorized to employ a con- sulting engineer for the Water Department to prepare plans and specifications for the necessary changes in the water system as a result of the Foothill Freeway construction. The Agreement to be presented to the City Council for review prior to execution. It was noted that $100,000 will be appropriated for the work during 1 the current fiscal year and $60,000 in the ensuing year. The State will reimburse the City for a portion of the design for which it is liable. On MOTION by Councilman Balser, seconded by Councilman Turner and carried on roll call vote as follows, the City Council accepted work as performed by the D & W Paving Company in the improvement of Campus Drive, Huntington Drive and Holly Avenue, and authorized final payment in accordance with the terms of the contract: AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reibold None Councilmen Forman 2. 8-17-65 1965/66 ASSESSED VALUATIONS 16:6616 The City Manager advised that the Los Angeles County Auditor- Controller had submitted the certified assessed valuations for 1965/66; that the total valuations are $2,902,760 over the previous year, representing an increase of 2.5 per cent. The City Attorney presented, explained the content and read the title of Ordinance No. 1299, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION FOR THE FISCAL YEAR BEGINNING JULY 1, 1965." Motion seconded by Councilman Turner and carried on roll call vote as follows: AYES: NOES: ABSENT: 1 Councilmen Balser, Considine, "Turner, Reibold None Councilman Forman The sufficiency of the present 5 cent tax rate on vehicle parking districts to provide even the minimal maintenance of the City parking lots was brought up by Councilman Turner, who recommended that the City Council look ahead with a view toward increasing the tax rate in order to provide adequate maintenance. The City Manager explained that the limit is now 10 cents which would be insufficient; that the only solution would be increased assessed valuation. Mayor Reibold commented that he had asked the City Attorney to look into the possibility of starting another parking district on the north side of Wheeler Avenue. 3. 8-17-65 SWIMMING POOL (City-School) (F:1098) EQUIPMENT PURCHASE (Water Dept.) (P:Eqt. Pur.) METROPOLITAN WATER DISTRICT (F:485A) RESOLUTION NO. 3811 Adopted RESOLUTION NO. 3812 Adopted (F:1122) 16:6617 The City Manager advised that the School District had received and reviewed the bids on the proposed swimming pool facility, in accordance with plans approved by the City and the State Division of Architecture; that the low bid of $90,000 was within the established limits and that construction will begin within 15 days after the award of contract and that completion is required within 75 days thereafter; that with this schedule the pool will be available during the forthcoming school year. The communication from the School District was ordered received and FILED, on MOTION by Councilman Turner, seconded by Councilman Balser and carried unanimously. 1 It was MOVED by Councilman Considine, seconded by Councilman Turner and carried on roll call vote as follows that the contract for the furnishing of gate valves be awarded to the low bidder, M & H Valve & Fittings Company, a Division of Dresser Industries, Inc., in the amount of $10,128.82 with 30 - 45 days delivery. AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reibold None Councilman Forman The representative of the contract recipient stated that he would endeavor to improve the delivery dates. The City Council accepted the recommendation of the City Manager that the meeting adjourn to a time certain for the purpose of adopting a Resolution of Intention to pay all or part of the Metropolitan Water District tax in cash in lieu of assessments on real property. This meeting will be adjourned accordingly. The City Attorney presented, explained the content and read the title of Resolution No. 3811 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, COMMENDING THE PRESIDENTIAL APPOINTMENT OF JOHN D. PARKHURST AS A MEMBER OF THE WATER POLLUTION CONTROL ADVISORY BOARD IN THE DEPARTMENT OF HEALTH, EDUCATION, AND WELFARE OF THESE UNITED STATES, FOR A TERM EXPIRING JUNE 30, 1968." The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1298, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 9233.5 OF THE ARCADIA MUNICIPAL CODE BY RECLASSI- FYING TO ZONES C-l (LIMITED COMMERCIAL) AND ZONE D (ARCHITECTURAL OVERLAY) THE PROPERTY AT THE NORTHWEST CORNER OF FOOTHILL BOULEVARD AND SECOND AVENUE IN SAID CITY." Motion seconded by Councilman Considine and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Turner, Reibold None Councilman Forman PROCEDURAL 1 POLICY (Property) The City Council concurred in the suggestion of Councilman Turner that the City Council take steps to adopt a procedural policy to be followed in the purchasing and/or selling of property and the payment of commissions. The Land Committee and the City Manager will study the matter and present its recommendation to the City Council. Councilman Considine inquired about the progress being made on the study for possible rezoning of property in West Arcadia including both sides of Camino Real west of Baldwin Avenue. He was informed by the Planning Director that his Department expects to have the matter before the Planning Commission during October 1965. CONSIDINE 5. 8-17-65 ADJOURNMENT ~ 16:6619 Councilman Considine also inquired about the study on regulations for the prevention of private property deterioration. The City Attorney stated in part that he is gathering material for the City Council possibly at the next St~dy Session, and suggested the review of existing regulations. He referred to state regulations which are before the Legislature, including a bill permitting cities to set up procedures which may be adaptable to the case in point; that all available data should be considered.
