SEPTEMBER 21, 1965
The City Council of the City of Arcadia met in regular session in
the Council Chamber of the City Hall at 8:00 P,M., September 21, 1965.

On MOTION by Councilman Forman, seconded Ly Councilman Turner and
carried unanimously the Minutes of the Regular meeting of September
7, 1965 were APPROVED as submitted in writing.
MOTION by Councilman Forman, seconded by Councilman Turner and
carried unanimously that the request of the applicant be APPROVED and
that the public hearing on the zone variance application to permit
the construction of a 21 unit apartment development at 343 W.
Colorado Boulevard be continued until the regular meeting of October
5, 1965.
MOTION by Councilman Forman, seconded by Councilman Turner and
carried unanimously that the request of the applicant be APPROVED and
that the public hearing on the zone change application on property
located on the northwest corner of Santa Anita Avenue and Las Tunas
Drive be continued until the regular meeti~of October 19, 1965.
Mayor Reibold declared the hearing open on the application of Mr, and
Mrs, Darrell Clingman for a business permit to allow the operation
of a Montessori School for children from 2~ to 5 years of age at
1406 S, Santa Anita Avenue, Petitions and communications in protest
and communications in favor were made part of the record.
The applicant, Mrs. Clingman, in answer to a question propounded by
Councilman "Turner, stated that the enterprise will be a private one;
that they will be under no obligation to another school; that the
teacher is affiliated with the Montessori International Association
by membership and that the special equipment could be purchased by
anyone.
In answer to a request by John Searfoss, 27 E, Pamela Road, the City
Attorney read provisions from the Municipal Code concerning conditional
use permits which are part of the zoning ordinance dealing primarily
with the appropriate locations for specific uses, and from the
provisions concerning business permit applications which are peculiar
to the applicants who will operate and the manner in which they
propose to conduct a business.
Mr. Searfoss continued in part that he was spokesman for the property
owners residing within a 300' radius of the subject property; that in

his op1n10n there were some questionable procedural methods; that
notification of the hearing before the Planning Commission was to go
to all 26 property owners, including the School District which is
neutral in the matter; that to date there is a record of 83 percent
in protest or 20 out of a possible 24; that two owners did noc receive
any notice.
Reference was made by Mr, Searfoss to the possibility of bankruptcy
in the subject instance and to the filing of bankruptcy by other
schools of the same nature; that the applicants are not experienced
in the operation of a school. He stated further in part that to
grant the business permit would only downgrade the area and by
visiting a similar school which is successful in Pasadena he dis-
covered that it is situated in a zone R-3 with a predominance of
apartments. He referred to a press article in which the applicant
stated that if the school were successful she would expand next year.

Mr, Searfoss asked what would prevent the City Council from granting
a business permit on adjacent properties should an application be
made therefor, and referred specifically to the owner of 1412 S.
Santa Anita Avenue who is in favor of the school; that it is possible
an extended option could be placed on this property. He referred to
alterations which would be necessary as indicated by the Fire
Department, which conversions would make the property undesirable if
it ever reverted to residential use.
He then stated in part that it was the understanding of the protesting
property owners that an appeal would be scheduled to be heard before
the City Council; that instead the proprietors of the proposed
business had checkreined the City Council; that there are better
locations for the school which should have been recommended by the
Planning Department, He mentioned East Duarte Road between Second
and Fifth Avenues in particular, which area is currently being
studied for rezoning. He stated that a formal appeal had not been
filed due to the time element and the money necessary in such
procedure; that an appeal is being made at this time and that they
had not been informed of the procedure. He urged denial of ,the
application.
Mrs, Ray Fortner, 1331 S. Santa Anita Avenue, asked for denial of the
business permit as did Basil Johnson, 20 E. Pamela Road, who stated
in part that it was ,commercial intrusion in a residential area; that
others could follow which would result in property devaluation. Mrs.
Fredda Whippo, 1411 S, Santa Anita Avenue, also asked for denial of
the permit.
No one else desiring to be heard, it was MOVED by Councilman Turner,
seconded by Councilman Forman and carried unanimously that the hearing
be CLOSED.
It was noted by Councilman Considine that the hearing before the City
Council is on the application for a business permit, not on zoning;'
that there had been no formal appeal filed; that the arguments
presented should have been related to the moral standards of the
applicants or to the conduct of the proposed business and whether or
not it would be harmful to the community; that as far as bankruptcy
is concerned any business either s~cceeds or fails; that should the
applicant fail the property owners would be protected, as another
person could not continue the school; that the subject property
returns to Zone R-l in five years and that he was at a loss to see
how a conditional use permit may be granted and at the same time a
denial of a business permit without just cause.

After a complete interpretation and clarification of the municipal
code as it applies to the subject instance by the City Attorney, it
was MOVED by Councilman Considine, seconded by Councilman Forman and
carried on roll call vote as follows that the City Council grant a
business permit for the operation of a Montessori School at 1406 S.
Santa Anita Avenue in strict accordance with all applicable regu-
lations including the conditional use permit. It was noted that all
business permits are renewed annually.

On MOTION by Councilman Forman, seconded by Councilman Considine and
carried unanimously a public hearing was scheduled for October 19,
1965 on Planning Commission recommendation concerning amendments to
the R-O zone regulations (Resolution No. 560).
On MOTION by Councilman Forman, seconded by Councilman Turner and
carried unanimously a public hearing was scheduled for October 19,
1965 on Planning Commission recommendation concerning Zone CoO
regulations (Res. No. 561).
On MOTION by Councilman Turner, seconded by Councilman Considine and
carried unanimously the final map of Tract No. 29178 (12 single
family lots - 250 W, Foothill Boulevard) was approved subject to
continuing compliance with all applicable conditions imposed at the
time the tentative map was approved.
On MOTION by Councilman Considine, seconded by Councilman Forman and
carried unanimously the final map of Tract No. 23567 (8 single family
lots - 639-655 W, Norman Avenue) was APPROVED subject to continuing
compliance with all applicable conditions imposed at the time the
tentative map was approved.
The Planning Director explained in detail the location of the subject
property (between Las Flores and Lemon Avenues, and Holly and El Monte
Avenues) and indicated on visual maps the properties proposed to be
placed in trust, said properties not participating in the subdivision
which is also before the City Council for consideration of its final
map approval. It was stated that good and usable lots could be
developed of the subject properties under lot split procedures,
Verne Mishler, 263 W, Las Flores Avenue, one of the three property
owners not desiring to sell a portion of their property in order to
become part of the new tract stated in part that in line with a
communication, which is a matter of record, he felt that the amount
of the proposed trust ($5,204.39) is exorbitant; that there will be
a drastic change in living and environment; the view will be marred;
an increase in taxes; the inconvenience of dirt, dust and noise of
the workmen; and referred to the fact that they use the north portion
of their land for the keeping of saddle horses. He then asked for a
25 percent reduction in said amount.
Discussion held among the Councilmen concerning the basis on which
trust amounts are figured and Councilman Forman commented on remarks
made by Planning Commissicner Hanson which could be studied by the City

The City Attorney referred to a policy resolution which was adopted
some time ago; the purpose of same was for the orderly development of
properties and not to allow property owners to remain out of a
subdivision and then when expenses were paid come in, thereby taking
advantage of improvements paid for by someone else, He pointed out
that the placing of a trust is not an assessment against land of
anyone else; that it merely gives them a right at the time of their
own choosing to make use of the facilities installed by someone else.

Mayor Reibold qualified his 'yes' vote by stating in part that it is
his hope that some work can be done in this area in the future,
The final map of Tract No. 27903 was then APPROVED on MOTION by
Councilman Forman, seconded by Councilman Turner and carried unani-
mously.
The Planning Director advised that the Commission had reviewed the
new plans' as submitted in connection with the proposed construction
of an office building at 534 W, Duarte Road and approved same with
modifications outlined in its report dated September 21, 1965, That
the new plans are now before the City Council. It was MOVED by
Councilman Forman, seconded by Councilman Turner that the matter be
reconsidered at this time. The motion carried unanimously.
Upon advice from Henry Hege', attorney for the applicants, that the
situation with the Church to the east of the subject property had
apparently been resolved, it was MOVED by Councilman Turner, seconded
by Councilman Forman and carried on roll call vote as follows that
the recommendation of the Planning Commission, as contained in its
Resolution No, 549 and as modified by its communication of September
21, 1965, be APPROVED.

Departments had recommended the approval and use of the subject Park,

low bid of Hardings Gardenland in the amount of $9,821 for the
landscaping of the grounds of the Chamber of Commerce office building
being constructed at the corner of Holly and Huntington Drive; all
other bids were rejected, any irregularities or informalities in the
bids or bidding process were waived and the Mayor and City Clerk were
authorized to execute the contract in form approved by the City

Counci lman Considine was advised by the City Manager prO tempore that
there would be no additional fees to the City in connection with the
Chamber building construction.
Frank Regan, current President of the Chamber of Commerce, expressed
appreciation to the City Council and advised that dedicatory
ceremonies will be conducted on November 6, 1965.
Councilman Considine spoke briefly to the excellent attendance at the
Arcadia Night-Lawrence Welk Television program on Saturday September
18, 1965. This event was sponsored by the local chamber of Commerce,

Upon recommendation of the City Manager it was MOVED by Councilman
Turner, seconded by Councilman Considine and carried on roll call
vote as follows that the City retain the services of the firm of
Perliter and Ingalsbe as consulting engineers to design in con-
junction with the State Division of Highways the facilities of the
Water Department to be relocated as a result of the construction of
the Foothill Freeway, and also for improvement of facilities
heretofore programmed for replacement. The fee to be charged to be
based upon the engineering curve utilized by all consulting engineers.

Councilman Turner spoke to a resolution to be considered providing
for the acquisition of properties for the proposed rapid
transportation route and the freeways; that in many instances the
routes coincide and that by acquiring properties at one time an
economy would be effected; that the resolution would bring pressure
on legislature to this end.

Basil Johnson, 20 E. Pamela Road addressed the City Council with
reference to the procedure in hearing objections to the Montessori
School; that those present were of the opinion that the appeal on the
conditional use permit would be heard but that only the evidence
concerning the business permit was allowed; that the general public
is not familiar with protocol in these instances and that perhaps in
the future the City Council could be more lenient in the methods of
conducting City business. Mayor Reibold thanked Mr, Johnson for the
comment.

It was noted that colpred maps will go forward to the City Council
indicating the areas by zones.
Projecturals were displayed by the Planning Department of numerous
apartment developments depicting 'before and after' the imposing of
new regulations and requirements on driveways, landscaping, etc.

For the record it was noted that property proposed to be acquired by
the City (Minutes of September 7, 1965) for delinquent taxes has been
retained by the property owner through the payment of unpaid taxes,
It was also noted that the guard rail barrier recently installed at
the Y curve on Colorado Boulevard has already protected persons at
the intersection.
The City Manager pro tempore reported on his attendance at the recent I
conference of the Independent Cities held at Palm Springs. He
advised that he had attended along with the City Attorney and a
representative of the Arcadia Tribune; that he did not feel it was
very valuable; that he may have engendered some support for the
position of the City Council relating to the future of the
organization.
Councilman Turner spoke to the City Selection Committee of the Rapid
Transit District; that the Board is beginning to function properly
now and that he would sanction returning to office the present Board
members.
The City Attorney commented that he attended the conference at the
expense of the City of El Monte; that the conference was productive
in that it furthered the possibility of a joint seminar about which
he had spoken at the last business session, and as recommended by the
Committee of the Los Angeles 'County Division of the League of
California Cities.
Study Session was scheduled for"Wednesday September 29, 1965,
Mayor Reibold adjourned the meeting at 10:25 P.M.
