REGULAR MEETING
OCTOBER 5, 1965
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the City Hall on October 5, 1965
at 8 P.M.

On MOTION by Councilman Turner, seconded by Councilman Forman and
carried unanimously the Minutes of the regular meeting of
September 21, 1965 were APPROVED. Councilman Balser abstained from
voting due to his absence from said meeting.
Mayor Reibold declared the hearing open on the application of John
Bellitti, dba Johnny Tempo Motors, for a business permit to allow the
operation of a used car lot at 419 E. Huntington Drive. No one
desiring to be heard, it was MOVED by Councilman Considine, seconded
by Councilman Balser and carried unanimously that the hearing be
CLOSED. It was further MOVED by Councilman Considine, seconded by
Councilman Balser and carried unanimously that a business permit be
approved to said applicant.
The Planning Director explored the zone variance application of
Fran~ Marchese, owner of property located at 343 W. Colorado Boulevard,
to permit the construction of 21 garden type apartments as reflected
on projecturals which depicted the subject site as being surrounded
and currently in R-l zone. The property is triangular in shape
bounded by Renoak Way, the railroad and the proposed Foothill Freeway
and Colorado Boulevard. The Planning Commission had reviewed the
matter in public hearings but had not reached a determination, hence
it was forwarded to the City Council without recommendation.
Whereupon Mayor Reibold declared the hearing open.
Richard Weimer, architect for the subject project, reviewed the
characteristics as shown on several renderings. He explored the
efforts which had been made to improve the property with single
family residences developed according to standards for subdivisions
in the City, but the land being situated between railroad, future
freeway and a major street would not lend itself to the type of homes
in the area. He then explained the proposed development which would
present an R-l appearance in that the apartments would be split
level, in clusters around an open air landscaped area, with closed
garages; that the proposed project is in keeping with the general
plan of placing this use between busy traffic arteries and single
family use; that his client has an inherent right to place an

improvement on his property to realize a return for his investment
providing it is not detrimental to the adjoining property. He stated
in conclusion that the property is almost undevelopable for single
family dwellings from the standpoint of economics in connection with
egress and ingress from Colorado Boulevard and urged approval of the
~one variance application.
Mrs. Monica Roach, 301 Harvard Drive, spoke in protest to-the
construction of additional apartments within the City and to any
rezoning of R-l property.

Robert Arth, 1017 Catalpa Road, representing the Rancho Santa Anita
Resident's Association, referred to a letter to the Planning Com-
mission dated June 18, 1965 in protest to this development and stated
in part that there is a high vacancy factor in R-3 units at the
present time and that a variance should only be granted where a hazard
exists. He urged denial of the application.
No one else desiring to be heard it was MOVED by Councilman Considine,
seconded by Councilman Forman and carried unanimously that the hearing
be CLOSED.
Councilman Considine referred to the possibility of developing
perhaps seven single family lots in the subject area; that with the
railroad, the freeway and a major street, the location would be just
as objectionable to apartment dwellers as single homeowners, whereas
an R-l development would be more in keeping with the surrounding area
and would offer a reasonable profit to the developer.
Discussion held on the way this might be achieved.
Councilman Forman was of the opinion that there is ample R-3 property
yet to be developed, and that he could not see improving a relatively
small triangular area with something other than the surrounding
improvements.
Councilman Balser stated in part that he could not conceive of
rezoning the subject area which is co~pletely surrounded by R-l
development.
Councilman Turner observed that he was also opposed to too much R-3
~oning but that the subject property is difficult to develop; that
the proposed apartments would appear residential and if they could be
rented in an area facing both a railroad and a freeway it would be a
fair investment for the owner; that he is torn between two concepts
in this instance.
Mayor Reibold stated in part that to him it is far more important I
than the approval or disapproval of this application that the City
Council recognize what is taking place; that'he could not accept the
implication that people who live in apartments are second rate
citizens; that a home is a home whether it is an apartment or a house-
that both are select places in which to live.
Councilman Considine, with the expression that areas should be
developed according to a plan that achieves the proper location for
apartment growth and one that preserves R-l zoning - that persons
have the right of preference - MOVED that the zone variance
application be DENIED. Motion seconded by Councilman Forman and
carried on roll call vote as follows:

MOTION by Councilman Forman, seconded by Councilman Balser and
carri,ed unanimously that the tentative map of Tract No. 24286
consisting of portions of three single-family lots (9, 10 and 11 of
Santa Anita Tract) ,be .APPROVED ,subject 'to conditions as recommended
by the Planning Commission in its report of September 28, 1965 with
one' additional condition: that a tWo-car garage be provided for the
property located at 815 North Second Avenue. Although the length of
the street exceeds 500 feet the Commission waived this requirement.
The Subdivision complies with Zone R-l standards and the cul-de-sac
standards.
MOTION by Councilman Balser, seconded by Councilman Forman and
carried unanimously that Council accept and approve final map of
Tract No. 23972 subject to the conditions of the approved tentative
map; that the City Clerk be and she is hereby authorized and directed
to endorse in due form such approval and acceptance on said map and
to affix thereto the Corporate Seal of the City of Arcadia and to
certify to the adoption and passage of a Minute Order at such time as
there shall be deposited with the City of Arcadia a good and
sufficient Surety Bond guaranteeing certain improvements in said
Tract No. 23972, pursuant to Section 9114.2.of the Arcadia Municipal
Code. '
The following Miflute Resolution was adopted on MOTION by Councilman
Forman, seconded by Councilman Balser and carried unanimously:
RESOLVED, that pursuant to the recommendation of the City Planning
Commission contained in its Resolution No. 563 adopted September 28,
1965, Sections 9275.4.9, 9275.4.12, and Paragraphs 1 and 4 of Section
9275.4.11 of the Arcadia Municipal Code be waived with respect to the
Conditional Use Permit to allow the expansion of an existing Service
Station at 171 East Live Oak Avenue in the City of Arcadia, such
waiver to become operative upon the effective date of the Conditional
Use Permit as granted by said Planning Commission Resolution No. 563.
Mrs. Richard Trevor, President of the League of Women Voters of
Arcadia, presented t~ the City Council copies of an intensive
Community Pilot Study: The work involved therein was accomplished by
the members and Mrs. Arthur W. Reiter spoke to the survey as did
Roge~ Johnson, Vice President of Marketing and Research with the firm
of Hixon and Jorgenson. The City Council expressed appreciation to
the League for its interest 'in the opinion of citizenry concerning
city government.
The following bids were received on September 20, 1965 for cleaning
and cement mortar lining water mains in place, the lowest bid being
made by Pipe Linings, Inc. in the amount of $33,448:

and carried on roll call vote as follows that the Council accept the
recommendation of the City Manager; that a contract for furnishing
the Water Department with 195 cast iron fittings in the amount of
$5,208.22 be awarded to Park-Son, Inc.; that all other bids be
rejected; that any irregularities or informalities in the bids or
bidding process be waived, and the Mayor and City Clerk be authorized
to execute such contract on behalf of the City for the performance of

in accordance with the contract.

On MOTION by Councilman Turner, seconded by Councilman Forman and
carried unanimously the City Council approved a Grant of Easement to
the Southern California Edison Company as delineated by the Director
of Public Works on a plot plan of the Corporation Yard site and
authorized the Mayor and City Clerk to execute same in form approved
by the City Attorney.

line of the property owned by the City and on which the Corporation
Yard will be constructed.

MOTION by ,Councilman Turner, seconded by Councilman Forman and
carried unanimously that the City Council grant permission to the
Parent-Teachers Association of Hugo Reid School to hold its annual
carnival on October 23, 1965 from 11 A.M. and 6 P.M., and the
provisions of Section 6220.12 of the Arcadia Municipal Code be
waived.
MOTION by Councilman Forman, seconded by Councilman Balser and
carried unanimously that the City Council grant permission to the
Parent Teacher's Association of Santa Anita School to hold its
annual carnival on Saturday, October 23, 1965 from 12:00 noon until
6:00 P,M.
SIDEWALKS The City Manager explored the seven concepts upon which the con-
struction of the sidewalk program was based in a report dated
September 7, 1965. This report with modification was approved by
-11/,:;\./ the City Council. He continued that during the interim considerable
concern had been evinced regarding an item in the proposed program
which would require property owners whose driveways were constructed
of other than 'concrete to reconstruct their driveway entrance aprons
'at the time the 'sidewalk was constructed. (It, had been contended
that if the program did not take place, existing driveway aprons
would be adequate for the residential property owners). It was also
noted that initially two sections would be concentrated upon; i. e.,

Anita Avenue from Foothill Boulevard to the north City limits.

It was ,MOVED by Councilman Considine, seconded by Councilman Balser
that the City Manager be authorized to proceed with the program as
outlined, except that where non-conforming driveways exist in the
areas where sidewalks are to be constructed, that the driveway aprons
be reconstructed as part of the sidewalk program, total cost of same
to be borne by the Capital Projects Fund.
Warren Paetz, 501 Columbia Road, spoke in favor of the sidewalks, but,
stated in part that consideration should be given property owners-who.
have been required to pay for their sidewalk aprons pursuant to the' ..
City ordi'nance.
It was agreed that Mr. Paetz had a good point and it was noted that a
master plan of the sidewalk program will be available prior to the
start of construction; that it could be used as a guide to not only
an individual property owner but to staff as well as it will indicate
the proposed sidewalk areas.

Pursuant to Section 2122.4.1 of the Procedural Ordinance it was MOVED
by Councilman Forman, seconded by Councilman Balser and carried
unanimously that the request of the Arcadia Rotary Club concerning

the construction of a plaza be considered at this time.
The proposed Rotary Plaza would be constructed as a landscaped
terrace around the grade level on the circular perimeter at the
corner of Holly Avenue and Huntington Drive, the site of the new
Chamber of Commerce Office Building. The report dated September 29,
1965 outlined the design, material, etc. The project would cost
approximately $3000 to be borne in its entirety by the Arcadia
Rotary Club.
The City Council expressed appreciation and on MOTION by Counci~man I
Turner, seconded by Councilman Balser and carried unanimously the
project was APPROVED subject to the concurrence of the Board of
Directors of the Chamber of Commerce. A communication to this effect
will be directed to the Club.
AUDIENCE PARTICIPATION:
Mrs. Betty M. Fester, 834 Hugo Reid Drive, protested the construction
of a sidewalk in her particular block; that from her observance there
are not sufficient children walking to and from school to warrant the
installation; that she desires to maintain the quiet suburban
atmosphere of the area and that the yards and homes were not planned
for sidewalks, that in her case her home would become too close to
the walkway infringing on the privacy of her home. She urged the
City Council to reconsider and suggested more intensive police patrol
for traffic violations in the subject area.
E. C. Dunson, 820 Hugo Reid Drive also protested the proposal; that
children uSe bicycles or take the bus to school; that the sidewalks
could be used for skating purposes.
Jack B. Mallon, 814 Hugo Reid Drive, stated in part that he observed
few children walking in the block but had noticed large carrier
trucks and other vehicles using Hugo Reid Drive. He was advised that
this was illegal to trucks other than those making actual deliveries
in the area, and will be investigated by the City staff.
It was noted that the construction of sidewalks for Hugo Reid Drive
is not contemplated for at least four years and that during the
interim the situation will be carefully studied. The possibility of
installing speed limit signs on Michillinda at Hugo Reid Drive and of
a sign to slow the traffic for school children will also be
investigated.

and read the title of Ordinance No. 1308, entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION

In order to correctly reflect the intent of the City Council and of
the Motion originally made by Councilman Considine at the meeting of
July 20, 1965, it was MOVED by Councilman Considine that Page 5 of the
City Council minutes of July 20, 1965 (Book 16, Page 6599) official
minutes of the City Clerk be amended by substituting for the paragraph:
"The recommendation of the Planning Commission as contained in its
Resolution No. 548 pertaining to the south side of Live Oak Avenue
from Santa Anita Avenue to Second Avenue was approved on Motion by
Councilman Considine, seconded by Councilman Forman and carried on
roll call vote as follows. Staff to submit Zone 'D' regulations to
be applicable thereto.", the following:
"Councilman Considine moved, 'Inasmuch as Planning Area 'B' is
presently C-2, and inasmuch as the City Council is considering C-2
for portions of Part 'E', that the City Cou~cil make Area 'B' also
cc2 with a 'D' Overlay inasmuch as it would then become compatible
with the area just determined.' This motion was seconded by
Councilman Forman and unanimously carried."

The City Attorney was excused from attending this meeting due to a
conflict with other prior commitments.
Councilman Turner advised of his appointment by Judge Evelle Younger
on a Citizens Advisory Committee to prepare a program for the
prevention and control of crime.
Mayor Reibold called attention to the forthcoming tribute to Patricia
Pratt to be held at the City Library on Sunday October 10, 1965 at
2 P.M. In memory of Miss Pratt a Bosendorfer concert grand piano will
be presented to the City.
The meeting adjourned at 10 P.M.
