REGULAR MEETING
OCTOBER 19, 1965
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8 P.M., October 19, 1965.

On MOTION by Councilman Turner, seconded by Councilman Forman and
carried on roll call vote as follows the Minutes of the regular
meeting of October 5, 1965 were APPROVED.
The Hearing rema~n~ng open on Planning Commission Resolution No. 555
recommending DENIAL of a requested zone change of property located at
the northwest corner of Santa Anita Avenue and Las Tunas Drive from
Zone R-l, R-2 and R-3 to C-3, the Planning Director explained that
the Republic Capital Corporation had made application for the zone
change which was considered by the Commission in public hearings.
The property consists of 9~ acres of vacant land with approximately
950' frontage on Santa Anita Avenue; that based on a study made by
the Planning Department and approved by the Commission it was the
recommendation to the City Council that the property not be placed in
a zone which would permit retail businesses. It was the recommen-
dation that the westerly half of the subject property be placed in
Zone R-l and the easterly half in Zone C-l. He further stated in
part that no facts were developed in the hearings that were not fully
considered in previous proceedings in determining the proper zoning
for the subject area.
No one desiring to be heard on the matter it was MOVED by Councilman
Forman seconded ,by Councilman Balser" and car,ried unanimously that
the hearing be CLOSED.
MOTION was made by Councilman Balser, seconded by Councilman Forman
and carried on the following roll call vote that the City Council
sustain the,recommendation of the Planning Commission (Res. No. 555)
and that the application of Republic Capital Corporation for a change
of zone on subject property be DENIED:

Planning Commission Resolution No. 560 recommending repeal and
amendment of certain sections of, th", Arcadia Municipal Code concerning
uses permitted in Zone R-O, first one:fa~ily zone and regulations

The Planning Director explored the contents of the resolution and a

report dated September 21, 1965, wherein specific areas were
recommended for said R-O zone to require 25,000 sq. ft., 15,000
sq. ft: and 12,500 sq. ft. Projecturals were reviewed as the
existing and proposed uses and regulations were discussed.
Mayor Reibold declared the hearing open.
Bryant Burton, 759 Hampton Road, President of the Rancho Santa Anita
Property Owner's Association (comprising the area south of Orange
Grove Avenue, north of the Santa Fe tracks, west of Baldwin Avenue
and east of Michillinda) asked that an original request be approved
and that the zoning regulations for said area be made to require that 1
every lot hereafter created, established or altered be 30,000 sq. ft.
instead of the recommended 25,000 sq. ft. He further stated in part
that in some instances the deed restrictions on property in the area
would expire at the end of the current year and that with the
possibility of division of property thereafter the majority
(80 percent) of the homeowners in the area desired a degree of
protection which the increased requirement would offer.
Edward Butterworth, 1145 Singing Wood Drive, addressed the City
Council stating in part that most of the existing lots in the area
referred to by Mr. Burton were in excess of 40,000 sq. ft., and
asked that the regulation be made 30,000 sq. ft. instead of 25,000
sq. ft., as recommended. He stated further in part that the City is
a community offering a diversified selection of homes and sites and
offers a choice as to the desires and needs of the individual
families. He concluded with the expression that he is in favor of
the recommendation with this one exception.
Speaking in opposition to the increased requirement as recommended
for R-O Zone was William Hovanitz, 1160 W. Orange Grove Avenue, who
explored the various lot sizes in the subject area, observing in part
that in his opinion there are factors other than size to be
considered, such as diversity. He spoke at length concerning a
proposed subdivision which he is developing at the southeast corner
of Michillinda and Orange Grove Avenues and which has already been
approved at 15,000 sq. ft. He asked that the lot size not be
increased in R-O Zone but that if the City Council approves the
recommendation, that the 15,000 sq. ft. requirement, originally
approved, remain on his property.
No one else desiring to be heard, it was MOVED by Councilman Turner,
seconded by Councilman Forman and carried unanimously that the hearing
be CLOSED.
After considerable discussion it was the consensus of the City
Council that the request for an increase in the square footage
requirement in the specific area as outlined would not be significant
in future development and being in accord with all other contents of
the resolution, it was MOVED by Councilman Forman, seconded by
Councilman Balser and carried on roll call vote as follows that all
recommendations as set forth in Resolution No. 560 be APPROVED; that
Section 9112.1 be changed to require 30,000 sq. ft., instead of
25,000 sq. ft., within the area north of Foothill Boulevard westerly
of Santa Anita except north of Orange Grove Avenue west of Santa
Anita Avenue which will be 15,000 sq. ft. as reflected in Section
9112.2 of said resolution.

Planning Commission Resolution No. 561 recommending the amendment of
the Arcadia Municipal Code, concerning uses permitted in Zone C-O,
Professional Office Zone, and regulations applicable thereto.
The Planning Director explored the contents of said resolution and a
report dated September 21, 1965 wherein the existing and proposed
uses and regulations were set forth.
Mayor Reibold then declared the hearing open,
Henry Hege, 651 W. Duarte Road, spoke on behalf of two owners of
property on the south side of Huntington Drive east of Baldwin Avenue,
one of whom has a zone variance for the construction of R-3 usage and
the other currently completing an apartment building on said property.
He spoke in opposition to a portion of the recommendation contained
in said resolution which would result in the deletion of Zone R-3 on
properties on the south side of Huntington Drive, and submitted that
the most logical use of this property and the maximum utilization
would be for the existing purpose allowed under R-3 zoning. He then
explored the improvements on the south side of Huntington Drive east
of Baldwin Avenue and referred to the extensive professional office
development in the West Arcadia area and expressed the belief that
future professional offices will locate in that area and not along
Huntington Drive.
Mr. Hege asked that R-3 uses not be eliminated from the proposed text
change of zone or that proceedings be instituted to change the zoning
on the south side of Huntington Drive from Zone C-O to Zone R-3; that
if this should materialize, that the elimination of the R-~ USes in
Zone c-o be postponed until such time as the rezoning would become
effective.
Dr. Charles Shore, 654 Sharon Road, part owner of property on the
south side of Huntington Drive near La Cadena Avenue, related his
experience of five years ago as a physician with offices,in that
area; that the location was not acceptable to patients due to traffic
congestion especially during the racing season; that many physicians
have moved from Huntington Drive to the professional offices in the
immediate West Arcadia area. He concluded stating in part that the
subject area is not a practical location ~or professional usage.
No one else desiring to be heard, it was MOVED by Councilman Forman,
seconded by Councilman Turner and carried unanimously that the hearing
be CLOSED.
Discussion ensued on the lack of CoO development on the south side of
Huntington Drive and in order to protect a property owner desiring to
build under R-3 zoning it was the consensus of the City Council that
a time certain should be announced indicating when the c-o zoning
would go into effect at this particular location.
The City Council concurred in the recommended regulations with the
exception of Item 16 under Section 9261.1.2 Professional Offices. It
was agreed that the word 'Laboratories' should be' changed to 'Medical
and Clinical Laboratories' which distinguishes the use from
engineering testing laboratories for instance. It was brought out
during discussion that the Modification Committee could modify the
sideyard requirements if warranted, and that where there is a joint
development it could be handled by the recordation of a covenant for
the common development of property.

It was then MOVED by Councilman Forman, seconded by Councilman Turner
and carried unanimously that the recommendation of the Planning
Commission as contained in its Resolution No. 561 be amenqed by
changing the word 'Laboratories' to 'Medical and Clinical 'Laboratories'
and that as thus amended the recommendations be accepted; 1that the
City Attorney be instructed to prepare the necessary ordinance to put
into effect at this, time all of the recommendations except the
deletion of the R-3 uses from the c-o zone; that the City Council at
this time announce its intention to make such deletion from the uses
pe~mitted in Zone C-O, without the necessity of further hearings on
the subject, upon final determination by the Council of all
proceedings for the reclassification of property presently zoned c-o
and instituted within forty-five (45) days from date hereof.

It was then MOVED by Councilman Considine, seconded by Councilman
TU~ner and carried unanimously that the City Council request the
Planning Commission to institute proceedings on its own initiative to
consider the proper rezoning for the south side of Huntington Drive
between Holly and Baldwin Avenues.
On MOTION by Councilman Balser, seconded by Councilman Turner and
ca~ried unanimously a public hearing was scheduled for November 2,
1965 on Planning Commission Resolution No. 567 concerning the uses
pe~mitted in Zone C-l, Limited Commercial Zone, and regulations
applicable thereto.
On MOTION by Councilman Balser, seconded by Councilman Turner and
ca~ried unanimously a public hearing was scheduled for November 2,
1965 on Planning Commission Resolution No. 566 recommending the
denial of a zone variance to permit the development of two twelve
story and penthouse residential structures on property located at
515-603 West Duarte Road.
MOTION by Councilman Turner, seconded by Councilman Forman and
carried unanimously that the City Council grant permission for the
Pa~ent Teacher's Association of Camino Grove School to hold its
annual carnival on Friday, October 22, 1965 from 4 P.M. to 9 P.M. on
the Camino Grove school grounds.
MOTION by Councilman Balser, seconded by Councilman Turner and
carried unanimously the request of the Better Gardens Nursery for U M
pe~mission to erect a fire proof tent iR-Ei&-E~2RWRSR~~ihgp~~a~ ~ '\
Ge~~e~ for the purpose of storing Christmas trees from November 25
to December 25, 1965 was APPROVED. Off-street parking is to be
provided.

the Water Department with water meters of various sizes for a period
of one year be awarded to Rockwell Manufacturing Company, in the
amount of $33,385.82; that all other bids be rejected; that any
irregularities or informalities in the bids or bidding process be
waived, and that the Mayor and City Clerk be authorized to execute
such contract and in the amount specified, in form approved by the
City Attorney. Funds are provided in Account No. 470.71.3.

Pursuant to Section 5 of the Swimming Pool Construction Agreement
executed between the City and the Arcadia Unified School District
dated April 12, 1965, the School District requested,' an advance
payment in the amount of $28,033.66 (one third of the awarded
contract cost of $84,101). Whereupon it was MOVED'by Councilman
Forman seconded by Councilman Balser and carried on roll call vote as
follows that the sum of $30,000 be appropriated from Reserve for
Capital Projects Account No. 285 in the General Fund to Capital
Improvement Projects Account No. 629, Swimming Pool Construction. It
was noted that final adjustment, including any changes, will be. made.

MOTION by Councilman Balser, seconded by Councilman Turner and
carried unanimously that the recommendation of the City Manager,
Director of Public Works, and the Water Superintendent be approved
and that the City accept the improvements in Tract No. 27803 for
maintenance and the surety bond deposited by the subdivider be
released.
MOTION by Councilman Turner, seconded by Councilman Forman and
carried unanimously that the City Council accept the recommendation
of the City Manager and the Director of Public Works; that the plans
and specifications for the extension of Santa Clara Street be
approved as submitted; that the City Clerk be authorized to call for
bids, upon receipt of approval from the State, for such work in
conformance with said specifications; expenditures for same being
provided for in the City Capital funds, and said funds will in turn
be qualified for Matching Credits pursuant to Section 186 of the
Streets and Highways Code.

In accordance with the prOV1S1ons of the Municipal Lighting
Maintenance District Act of 1927 Division 14 Part 3 of the Streets
and Highways Code, districts are formed annually for street lights
installed within subdivisions and other projects during the year,
incorporating therein districts which would expire in said year.
The City Engineer advised that District No. 26 will include lighting
in any subdivision and residential areas, and District No. 25
commercial lighting along Huntington Drive, First Avenue, Baldwin
Avenue and a portion of Santa Anita Avenue. Whereupon it was MOVED
by Councilman Balser, seconded by Councilman Forman and carried
unanimously that the City Engineer file reports in accordance with
said Act on November 2, 1965.
On MOTION by Councilman Turner, seconded by Councilman Balser and
carried unanimously the City Council on behalf of the Citizens
accepted a Bosendorfer Grand Piano as a gift from Mr. and Mrs. Mel
Pratt in memory of their daughter Miss Patricia Pratt.
On recommendation of the Director of Public Works and the City
Manager, boulevard stop signs were authorized for installation for
east and west bound traffic on Las Flores Avenue at First Avenue.
MOTION by Councilman Considine, seconded by Councilman Turner and
carried unanimously.
Whereupon the City Attorney presented, explained the content and read 1
the title of Resolution No. 3827, entitled: "A RESOLUTION OF THE

The City Manager read his report dated October 14, 1965 concerning
the reclassification of property on Las Tunas and Live Oak between
El Monte and Second, Avenues. It referred specifically to 2626, 2633,
2634 and 2637 Louise Avenue and portions of property abutting Live
Oak and El Capitan Avenues. It was noted that the zone map indicates
this property is zoned c-o and D although the c-o zoning is not yet
operative on these properties. This matter was resolved in the
consideration of Ordinance Nos. 1307 and 1309 later in this meeting.
Following consideration of a communication and petition with 21
signatures opposing the proposed construction of sidewalks on Holly
Avenue between Las Tunas and Live Oak, it was MOVED by Councilman
Balser, seconded by Councilman Forman and carried unanimously that"
the area referred to be deleted from the overall program of side~aik
in$tallation. Edwin Laughren, 2812 Holly Avenue, spoke to the matter,
explaining reasons for requesting the deletion.
The City Attorney presented for the second time, explained the content
and read the title of Ordinance No. 1306, as amended and reintroduced

The City Attorney presented, explained the content and read the title
of Resolution No. 3826 entitled: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA, REQUESTING FROM THE BOARD OF
SUPERVISORS OF THE COUNTY OF LOS ANGELES AID TO CITIES GASOLINE TAX
FUNDS FOR THE IMPROVEMENT OF SANTA ANITA AVENUE, A PUBLIC STREET IN
SAtD CITY OF ARCADIA."

The Planning Director advised that the Commission will hold a Study
Session on Thursday October 21, 1965.
It was noted that the Study Session scheduled for the City Council
for October 28, 1965 will not be held.
Councilman Balser MOVED that MRS. HARRY R. LAUBER, 1111 Magnolia
Lane, be appointed to the Planning Commission for a term to expire
June 30, 1969. Councilman Forman seconded the motion which was
carried on roll call vote as follows:
