Reibold PRESENT: ABSENT: Councilmen Balser, Forman, Turner, Reibold Councilman Considine The Minutes of the regular meeting of November 2, 1965 were APPROVED on MOTION by Councilman Forman, seconded by Councilman Balser and carried unanimously. Captain Barnes of the Arcadia Mounted Police the organization had won in recent parades. in City Hall. presented trophies which They will be on display On MOTION by Councilman Turner, seconded by Councilman Forman and carried unanimously, the recommendation of the Planning Commission (Resolution No. 570) concerning regulations applicable to Zones C-2 and C-3 (Commercial Zones) was scheduled for public hearing on DECEMBER 7, 1965 at 8 P.M. The final map of this Tract (156-160 W. Duarte Road) was recommended for disapproval by the Planning Commission on the basis that Same was not in substantial compliance with the conditions of approval of the tentative map, which indicated the creation of one lot whereas the final map indicated the creation of SeVen lots. The Planning Director explained the areas in non-compliance with the Subdivision Land and Map Act and local regulations. Allyn Barber, attorney for the subdivider, Arthur Bauman, stated in substance that the tentative map was prepared in accordance with the suggestions of the Planning Department; that it reflected one lot on which it was proposed to construct six units. He referred specifically to the condie ions on which a variance was granted for property on Duarte Road including the subject property (Resolution No. 3714). Areas of agreement were explained and the City Attorney stated that the only disagreement was because of the creation on the final map of six lots under six separate ownerships with common ownership of the seventh, ::o~e of which comply with the Subdivision Ordinance. 1. 11-16-65 lR '. The recommendation of the Personnel Board concerning amendments to the resolution on the educational incentive increment for police officers was APPROVED on MOTION by Councilman Turner, seconded by Councilman Forman and carried unanimously. I The State Division of Highways proposes to install traffic signals at the intersection of Huntington Drive and Fifth Avenue at an expendi- ture of approximately $14,000. The State to pay one-half the cost and the balance to be shared equally between Monrovia and Arcadia. In order to become eligible for the use of Matching Fund Credit it will be necessary for the two subject cities to enter into a Cooperative Agreement. It was MOVED by Councilman Forman, seconded by Councilman Balser and carried on roll call vote as follows that such an Agreement be entered into; that the Mayor and City Clerk be author- ized to execute the agreement in form approved by the City Attorney, and that the sum of $3500 be transferred from Reserve for Capital Improvement Projects Account No. 285 in the General Fund to Capital Projects Account No. 243, Traffic Signals, Huntington Drive and Fifth Avenue. AYES: NOES: ABSENT: Councilmen Balser, Forman, Turner, Reibold None Councilman Considine In furtherance of the reconstruction of Duarte Road at Fifth Avenue, the City has been requested to share equally with the City of Monrovia the cost of the installation of traffic signals at this location. The estimated cost is $15,000 with the final cost to be determined by bids received by the City of Monrovia. The City to make application to either the State and/or County for the use of gas tax funds to pay for the cost of the installation. It was MOVED by Councilman Balser, seconded by Councilman Turner and carried on roll call vote as follows that a Cooperative Agreement be entered into with the City of Monrovia; that the Mayor and City Clerk be authorized to execute same in form approved by the City Attorney. Huntington Drive (vacant lot in C-O Zone) was AUTHORIZED. On MOTION by Councilman Turner, seconded by Councilman Fotman carried on roll call vote as follows, the audit of the City's as contained in a financial statement prepared by the firm of Lusich was ACCEPTED and final payment AUTHORIZED. and books Black & AYES: NOES: ABSENT: Councilmen Balser, Forman, Turner, Reibold None Councilman Considine Property owners at 2237, 2247, 2303 and 2313 S. Mayflower Avenue asked the City Council to consider annexing their properties. It was noted that the subject property abuts Tract No. 26114, a substandard development which was refused annexation in 1960. Subsequently, the portion of that tract which was located within the City was deannexed in 1960 to permit the entire tract to be within County boundaries. Concern was expressed by Councilman Balser in that 50 percent of the property desiring annexation is contiguous to the deannexed Tract No. 26114. Councilman Turner was of the opinion that the boundary line at that location would be improved by the annexation and MOVED that the request be APPROVED. Mayor Reibold seconded the motion (MOTION LATER WITHDRAWN). Further discussion ensued with Councilman Balser referring to the size of the lots within the subject subdivision (all under the 75' x 100' minimum requirement by the City in R-l zones). Upon the statement of the City Attorney that the Local Formation Agency would probably ask about the plans of the City as to the eventual annexation of Tract No. 26114, Councilman Turner, with the consent of his second, WITHDREW the primary motion. Whereupon it was MOVED by Councilman Balser, seconded by Councilman Forman and carried unanimously that the request for annexation be DENIED for reasons stated above. The City Manager explored his report dated November 10, 1965, concerning the request of property owners on North Santa Anita Avenue between El Vista Circle and Andrea Lane for deletion of said area from the sidewalk program. He pointed out that even though the specific area has only a very few children walking to school at the present time, the situation could change and that to continue the deletion of areas from the overall program could seriously hamper the adopted program. The findings set forth in the report were made during heavy rains. Councilman Balser stated in part that in his op1n10n it is time to place value on the safety of school children; that he favored the program as adopted. Mrs. Charles Sherman, 1741 N. Santa Anita Avenue, and Joseph Gallo, 1771 N. Santa Anita Avenue, both addressed the City Council asking for deletion of the subject area. 3. 11-16-65 16:6682 Councilman Turner MOVED that the area on Santa Anita Avenue between El Vista Circle and Andrea Lane'be deleted from the program and that a study be made on the number of children coming out of El Vista Circle as compared to those out of Sierra Madre Boulevard. It was hoped that better weather conditions would prevail when this is undertaken. Motion seconded by Councilman Forman. Councilman Balser stated in part that the safety of the school children should be primary; that situations change; that sidewalks should be provided on main thoroughfares and he considered Santa Anita Avenue as such; that 89 percent of the residents favor sidewalks and that he was opposed to any further changes in the program. 1 Councilman Turner stated in part that he believed in spending the City's money where it would do the most good fat the most people; that when need arises sidewalks could be provided. Mayor Reibold observed that there is a fluid population, but that if a situation requires sidewalks they could then be provided; that in his opinion if the residents do not want them the City should not tell them how to run their lives. ,. Roll call was then taken on the primary motion: AYES: NOES: ABSENT: Councilmen Forman, Turner, Reibold Councilman Balser Councilman Considine R-O ZONE Lot size revisions William Hovanitz, 1160 W. Orange Grove, on November 2, 1965 asked the City Council to exclude from the proposed ordinance calling for 30,000 sq. ft. lots in the area of Michillinda and Orange Grove Avenues. He referred specifically to property not included in his Tract No. 30284. At that time staff was instructed to report back and clarify the matter prior to the adoption or amendment of said ordinance, (No. 1311). The City Manager's report dated November 10, 1965 set forth complexities in the situation. It was stated in part that the trend has been to increase the required size of lots in the area rather than to decrease it as submitted by Mr. Hovanitz. Attached to said report were maps depicting actual lot sizes from Michillinda east to Baldwin Avenue, north of Foothill Boulevard, indicating that 75.38% of the lots in the specific area have upwards of 30,000 sq. ft; 21.46% have from 25,000 to 30,000 sq. ft. and 3.15% less than 25,000 sq. ft. Reference was made to Arcadia Municipal Code Section 9111.6 which gives authority for subdivision approval of lots with less than the r.equired size where justified; that a lesser size could be approved at some future date on the Michillinda Avenue frontage property if appropriate. It was noted that any additional developments on the pending Tract (No. 30284) could be considered, after the adoption of the proposed ordinance, on its own merits and given discretionary treatment if needed. It being the consensus of the City Council that said ordinance be given its second reading at this meeting, 1 ORDINANCE NO. 1311 The City Attorney then presented for the second time, explained the content, and read the title of Ordinance No. 1311 entit led: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REPEALING SECTIONS 9251.1.5 AND 9251.1.12, AMENDING SECTIONS 9251.2, 9251.2.2, 9251.2.4 AND 9251.2.5 OF THE ARCADIA MUNICIPAL CODE (R-O ZONE REGULATIONS) AND AMENDING DEVISION 2 OF PART 1 OF CHAPTER I of Adopted 4. 11-16- 65 /~ 1 .f COMMUNICATION (Chamber building) 16:6683 ARTICLE IX OF THE ARCADIA MUNICIPAL CODE (SUBDIVISION LOT AREA REQUIREMENTS) . AUDIENCE PARTICIPATION: (R-O Zone) (Sidewalks) &l)d-.I 1 (R-O Zone) Hovanitz Mrs. Manuel Munoz, 268 W. Las Flores Avenue, referred to the possibility of all R-O zoned lots requiring the same amount of square footage. Councilman Balser explored reasons for the variables. Mrs. Munoz observed that she is in favor of sidewalks. The following persons spoke concerning the removal of trees to make way for the proposed sidewalk construction (specifically on Holly and Lemon Avenues). Included in the remarks was the suggestion that'a Citizen's Committee be formed on such projects: Mrs. Mel Wysock, 509 W. Lemon Avenue Mrs. C. Sharp, 437 W. Lemon William McGregor, 1751 Holly Avenue War.ren Paetz, 506 Columbia Drive, spoke to the matter of apron construction and will confer with the Director of Public Works. In answer to a request from a press representative, the City Manager read in its entitety his report dated November 16, 1965 concerning the scope of the proposed sidewalk program, tree removal, sidewalk location, utility pole location. It was submitted that the program as approved by the City Council was sound; that there will be intermittent resistance to the program and that in these cases the City Council would be the only body which could make the final determination fot the best interests of the program and the property owners involved. The City Council was in full accord with the report. William Hovanitz, 1160 W. Orange Grove, stated in part that remarks made by him on November 2, 1965 were true and factual; that they could be checked for veracity (pertaining to the R-O zoning in the Michillinda and Orange Grove area). 5. 11-16.65 16:6684 The City Clerk read a communication from Earle A. McDonnel regarding uses proposed for c-o zoned properties at 55 and 67 E. Live Oak Avenue. He asked that supplementary vehicular parking be provided for in the ordinance as an additional use permissible in Zone C-O. ORDINANCE NO. 1310 Adopted It being the consensus that parking lots for commercial businesses not permitted in Zone c-o would not be desirable and that the ordinance be adopted as introduced, the City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1310, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING PORTIONS OF TITLES 1 AND 2 OF DIVISION I OF PART 6 OF CHAPTER 2 OF ARTICLE IX OF THE ARCADIA MUNICIPAL CODE." 1 MOTION by Councilman Turner, seconded by Councilman Forman and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1310 be WAIVED. The City Attorney explained the effect of the District Court of Appeal decision against the City of Bakersfield involving the adoption and application of the Uniform Building Code, and on MOTION by Councilman Turner, seconded by Councilman Balser and carried unanimously, authorization was given for the City's participation in an amicus curiae brief before the Supreme Court in the case of Miller vs. the City of Bakersfield.
