Reibold ROLL CALL PRESENT: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None APPROVAL OF MINUTES (12-7-65) On MOTION by Councilman Forman, seconded by Councilman Considine and carried unanimously the Minutes of the regular meeting of December 7, 1965 were APPROVED. p: Planning Commission Resolution No. 571 recommending the amendment of the Municipal Code concerning uses permitted and regulations applicable under C-M zone (commercial-manufacturing). Following an oral report by the Planning Director as to the contents of said resolution the hearing was declared open by Mayor Reibold. No one desired to speak either in favor or opposed to the recommendation ;1l9Y~and the hearing was CLOSED on MOTION by Councilman Forman, seconded '(j Uby Councilman Considine and carried unanimously. HEARING (C-M zone uses) The recommended amendments deal with height, yard, parking, sign and landscaping regulations to be applicable in Zone C-M. It was then MOVED by Councilman Balser, seconded by Councilman Forman and carried unanimously that the recommendation of the Planning Commission as contained in its Resolution No. 571 be APPROVED. HEARING (West Arcadia rezoning) Reclassification of certain property between Duarte Road and Camino Real, west of Baldwin Avenue and Golden West Avenue from R-2 and R-3 to Zones C-2 and D, and on the recommendation of the Planning Commission as contained in its Resolution No. 572. I j-'J/3h The Planning Director summarized the contents of said resolution, exploring the regulations recommended to be imposed concurrent with said reclassification. Projecturals were reviewed depicting existing zoning of the approximate 45 acres, structures and conditions thereof. Mayor Reibold then declared the hearing open and the following persons addressed the City Council: George S. Glassoff, 834 W. Duarte Road, stated in part that he stands to lose a major part of his life's savings which have been invested in a 25 unit apartment facility at 834 W. Duarte Road if the recommended rezoning is approved; that the vacancy factor has increased 25 percent since the commencement of the commercial 1. 12-21-65 16:6700 development to the west of his property. He stated further that he is interested in selling, but that buyers are looking for vacant land; he stated his objection to the rezoning and asked for Council consideration of his position. John Duncan, attorney representing Elizabeth Douglas, 758 W. Naomi Avenue, and Henry Cordelius, 747 W. Camino Real, asked for C-2 zoning for the two subject properties which is not included in the Commission1s recommendation. He referred to a warehouse operated on a variance by Hinshaw's Department Store and noted the lack of opposition to the rezoning. I E. J. Brockman, stated in part that the trend for commercial zoning in the area of Camino Real was, in his opinion, established when the variance was granted for the service station now operating on the southwest corner of Camino Real and Baldwin Avenue and asked for commercial zoning to the west of that facility. Herbert Piken, who sometime ago had been denied a request for rezoning of the property west of the said service station on the south side of Camino Real, informed the City Council that he had altered his plans from a large neighborhood shopping center to a small specialty shop type of enterprise and asked for commercial zoning of that area. R. D. Sweeney, attorney for the Elrovia Company, submitted three letters supporting the recommendation of the Planning Commission: Richard Shiershke, 805 W. Naomi Avenue Arcadia Parking, Inc., 741 - 759 W. Naomi Avenue Nicholas J. Battjes, Jr., 815-819 W. Naomi Avenue He continued in substance that the Elrovia Company still has an option on the property owned by the First Church of Christ Scientist, Arcadia, and that if rezoned it will be developed to benefit the City as a whole, and asked for a decision one way or the other. William T. King, representing the First Church of Christ Scientist, Los Angeles, asked for favorable consideration of the rezoning and noted that only one person had opposed the recommendation. Henry Hege, representing the West Arcadia Business & Professional Association, asked that the recommendation of the Commission be adopted. No one else desiring to be heard the hearing was closed on MOTION by Councilman Forman, seconded by Councilman Balser and carried unanimously. I Discussion held at length: Mayor Reibold observed that his question would be whether or not the area to be rezoned should be extended to Camino Real. Councilman Considine stated for the record that he is opposed to expanding commercial zoning, particularly as long as there is much commercial property encountering difficulty within the City at the present time. He stated that he would resist commercial zoning extending beyond Naomi Avenue and that in his opinion the proper approach would be to confine the recommendation of the Commission to that parcel between Naomi, Golden West, Duarte and Baldwin, and as a second consideration the expanded area between Naomi, Camino Real, Golden West and Duarte Road; that the two areas would have to be separated for him to be able to vote in keeping with his precepts. 2. 12-21-65 I R'I'iJ P CONDITIONAL USE PERMIT (Richfield) I HEARING SCHEDULED (convalescent facilities) CONDITIONAL USE PERMIT (Shell) (J',(;~f 16:6701 Councilman Balser stated in part that in his opinion the time has come when the suggested changes would appear to be reasonable and good zoning practice based on the development which has already taken place in the area and that the property surrounding and adjacent to the warehouse should also be included in commercial zoning; that he would prefer restricting the rezoning to 198 feet east of the city boundary line on Camino Real due to the attractive residential development to the west and south thereof. Councilman Forman stated in part that he would agree with Councilman Balser and observed that sometime ago the City Council had attempted to draw zone changes at the rear property line rather than in the middle of a street. He was of the opinion that the R-2 property on the south side of Naomi Avenue would henceforth be undesirable as residential property inasmuch as it would be facing directly into commercial property and favored cutting it off at the south line of Naomi Avenue which would have the effect of backing up to rather than facing commercial improvements. Discussion continued on boundary lines with Councilman Turner expressing concern with the possibility that anything more than the recommendation of the Commission was being considered. He referred to his former opposition to the rezoning of the property at Golden West and Duarte as it was and still is his opinion that there is an over abundance of commercially zoned property which is not completely or properly developed; that he would not vote for any change over or above that recommended by the Commission. Following extensive discussion on just what property should be rezoned at this time, it was MOVED by Councilman Balser, seconded by Councilman Forman and carried on a 3 to 2 vote as follows, that property bounded by Duarte Road on the north, Baldwin Avenue on the east, Golden West Avenue on the west and Camino Real on the south presently zoned either R-2 or R-3 or PR-2 except that property known as 807, 809, 811, 817 and 819 West Camino Real, be placed in Zone C-2 and D. AYES: NOES: ABSENT: Councilmen Balser, Forman, Reibold Councilmen Considine, Turner None Councilman Considine commented that in his opinion it is a mistake. On MOTION by Councilman Forman, seconded by Councilman Balser and carried unanimously a Conditional Use Permit was APPROVED to allow the Richfield Service Station Corporation to replace its present station at the southeast corner of Duarte Road and Santa Anita Avenue with a new ranch style station, upon compliance with all regulations and additional conditions as set forth in its Resolution No. 574. A public hearing was scheduled on Planning Commission Resolution No. 573 - recommending standards to govern future convalescent facilities - for TUESDAY JANUARY 18, 1966 at 8 P.M. On MOTION by Councilman Forman, seconded by Councilman Turner and carried unanimously a Conditional Use Permit was APPROVED to allow the Shell Service Station at 171 E. (See Planning Commission Res. No. 563-A). On MOTION by Councilman Balser, seconded by Councilman Forman and carried unanimously the tentative map of Tract No. 24900 (236-240 W. Foothill Boulevard) was APPROVED subject to conditions as stipulated in the Planning Commission report dated December 14, 1965. I On MOTION by Councilman Forman, seconded by Councilman Turner and carried unanimously the annual financial report (1964-65) was received and ordered FILED. It was MOVED by Councilman Forman, seconded by Councilman Balser and carried unanimously that the pedestrian traffic count taken on December 14, 1965 by the Department of Public Works on Santa Anita Avenue north of Foothill Boulevard be received for the record. (Sidewalk construction in the subject area to go forward according to plan). On MOTION by Councilman Considine, seconded by Mayor Reibold and carried unanimously the streets in Tract No. 16769 (Wistaria Avenue) were accepted for maintenance as the requirements and conditions have been completed. On MOTION by Councilman Balser, seconded by Councilman Turner and carried unanimously the installation of a stop sign for eastbound traffic on Wistaria Avenue at El Monte Avenue was AUTHORIZED: Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 3845 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DESIGNATING THE INTERSECTION OF WISTARIA AVENUE WITH EL MONTE AVENUE AS A STOP INTERSECTION FOR EAST BOUND TRAFFIC, AND DIRECTING THE PLACING AND MAINTAINING OF A STOP SIGN THEREAT." MOTION by Councilman Balser, seconded by Councilman Forman and carried on roll call vote as follows that the reading of the full body of Resolution No. 3845 be waived: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None I Councilman Balser further MOVED that Resolution No. .3845 be adopted. Ludwig and Ludwig Engineering Science, and to execute and deliver quitclaim deed or other appropriate document releasing and quitclaiming the City's right to enforce said Agreement as contained in the deed from the City dated May 15, 1964, all of said documents to be in form approved by the City Attorney. It was noted that the request for transfer of funds for said construction will be made at the time the results of the bids are tabulated and submitted for award of contract. None None On MOTION by Councilman Forman, seconded by Councilman Turner and carried on roll call vote as follows the contract for the purchase of cast iron pipe was awarded to the low bidder, Pacific States Cast Iron Pipe Company in the amount of $6,324.32; that all other bids be rejected; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk be and they are hereby authorized to execute the contract in form approv~~ by the City Attorney. Sixth Avenue and owned by the Arcadia Unified School District in the amount of $15,000. Said property to become part of the proposed park site. The sum of $15,000 was authorized for transfer from Capital Projects Account No. 285 in the General Fund to Capital Improvements Account No. 632 - Park Site Acquisition. (Legal description of subject property: north 92~' of the south 185' of the west 220.92' of Lot 6 Tract 808.) Hoke for permission to continue using the existing office trailer at 154 E. Huntington Drive was APPROVED on MOTION by Councilman Balser, seconded by Councilman Turner and carried unanimously. Permission was granted for a period of ONE YEAR. The City Attorney presented for the first time, explained the content and read the title of Ordinance No. 1314, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTIONS 9263.2.7, 9284.1.2 AND 9284.1.7 THEREOF AND AMENDING DIVISIONS 3 AND 4 OF PART 6 OF CHAPTER 2 OF ARTICLE IX THEREOF (C-2 AND C-3 REGULATIONS)." Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None It was further MOVED by Councilman Forman, seconded by Councilman Considine and carried unanimously that staff prepare a report for Council consideration on off-street parking in connection with the regulations in the ordinance just introduced pertaining to Zones C-2 and C-3. It was MOVED by Councilman Balser, seconded by Councilman Turner and carried unanimously that the City Manager submit cost estimates for the purchase of a new table in the Conference Room a~d on new carpeting for the office of the Mayor and City Manager's offices. Councilman Considine was informed that he may be assured of some type of traffic control at the intersection of Naomi and Baldwin Avenues; that ttl€ use of a portable signal is not recommended.
