HomeMy WebLinkAboutSEPTEMBER 18,1962 15:5783 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA SEPTEMBER 18, 1962 I The City Council of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 P,M., September 18, 1962, INVOC,ttION The Invocation was offered by Mr, Maurice ~eredith of the Arcadia Christian Church, PLEDGE OF ALLEGIANCE Mayor Pro Tempore Phillips led in the pledge of allegiance to the flag. ROLL CALL PRESENT: ABSENT : Councilmen Balser, Reibold, Turner, Phillips Mayor Butterworth APPROVAL OF MINUTES (8-2l~62 & 9-4-62) HEARING (Greene & Becker) MOTION by Councilman Reibold, seconded by Councilman Turner and carried unanimously that the minutes of the Regular Meeting of August 21, 1962 and" September 4, 1962 as submitted in writing be approved, Mayor Pro Te~pore Phillips declared the hearing open on the application of Paul A. Greene and William W, Becker for a zone variance on property located at 225 Colorado Place to permit the construction and operation of a 122 unit motel, (F:935) The Planning Director explained that the subject property is located in a triangle formed by Colorado Boulevard on the north, Colorado Place on the west and the Flood Control Channel on the east, That the.propertie~ within the triangle, including the subject property, are in Zone'R-3; that the subject property has approximately 315 feet of frontage on Colorado Place and backs onto the Flood Control Channel for a distance of approximately 476 feet, The Planning Director continued, that after a public hearing before the Planning pommission, the matter was referred to the Zoning Committee which recommended approval of the application, That on July 24, 1962, at the request of the Chamber of Commerce, the Planning Commission deferred rction to permit the Chamber of Commerce to evaluate the impact this proppsal might have on Arcadia; that on August 15, 1962 the matter was again before the Planning ~ommission, at which time reports from the Chamber of Commerce and staff were presented, the staff report dated July 5,1962 containing' certain conditions compiled to insure compatibility of the site development with that of the surrounding area; also that the County Flood Control District would have to be contacted to determine all standards affecting the subject property as well as any restrictions as to its use, That there being only five members of the Planning Commission present at said time, a decision recommending approval or disapproval of the application was not obtained and the time having elapsed for action by the Planning Commission the zone variance is presented to the Council without a specific recommendation, I The Planning Technician then explained the artist's rendering and the two plot plans of the proposed motel displayed, and read a report submitted by the Planning Department dated September 17, 1962, which in substance outlined the subject property and general area, the back- ground of the matter, the conditions compiled to insure compatibility, that portion of the report containing an analysis of the evaluation of Plan B (a revised plot plan and landscape architectural plan submitted on September 14,1962 to the Planning Department by the applicants) and 1, 9-18-62 15:5784 its conclusion and recommendations, which in substance stated that from a planning viewpoint the development represents a use appropriate to the property and compatible with developed properties in the surrounding area and recommends that the variance application be approved subject to the original conditions listed in the staff report of July 5,1962. Upon Mayor Pro Tempore Phillips' statement that the council would now hear from those in favor of the granting of the requested variance, the follow- ing persons addressed the Council, stating in part: Mr. Arthur Henzel, Santa Barbara, Attorney for the applicants: That his clients concur with all the recommendations contained in the Planning Department report and that any problems existing can and will be resolved I to the satisfaction of the City, He outlined the past experience of the applicants in construction work and described their operation in Santa Barbara and proposed operations in Monterey and' Palm Springs. He added that it is his clients' theory that because there seems to be a trend towa more elaborate motels and higher rates there is need for good motels at reasonable rates for the traveling public, their plan being to offer no services such as restaurant or cocktail lounge and the like. He mentioned that Planning Commissioners Norton and Forman had viewed the applicants' motel in Santa Barbara and had reported favorably; that Mr, Norton, in his oral report to the Planning Commission, had stated that there was good material used throughout the motel, Mr, Henzel then presented Mr, Jack Haydon, a Planning Consultant and Landscape Architect, employed by the applicants, Mr, Haydon displayed drawings showing the effect landscaping and tree planting would have in screening out light and noise problems and maintained that the construction would be an attractive addition to the neighborhood, He commented, in answer to a question, that the trees proposed to be planted would be mimosa and liquid amber, among others, Mr, Henzel spoke again, stating that with regard to the Los Angeles County Flood Control District having to be contacted, that he had spoke with Mr. King of said District that day and had been assured that there were no problems that could not be resolved, Mr. R. E. Langdon, Jr" 1350 LaLoma Road, Pasadena, an architect and one of the owners of the subject property: That he felt this would be a development consistent with the land use in the area; that his associate had checked the applicants' operation in Santa Barbara and thought it was good; that a variance for motel use had been granted three years ago to the previous owner of the subject property but that the time limit had expired and the variance was not used, He requested that the variance be granted, No one else desiring to speak in favor of the matter, Mayor Pro Tempore Phillips then stated ~hat the Council would now hear those in opposition to the requested zone variance, and the following persons addressed the Council, stating in part: Mr, Walter C. Muller, owner of the Westerner Hotel: That in his opinion I the proposed landscaping of the subject motel is not in accordance with that of the other motels presently in the area; that the problem of densit has not been thoroughly explored, the area of the rooms being about half the size of the average motel room in the City and could, after a period of time, attract undesirable clientele, That the "No Service" feature stressed by the applicants, in his opinion is regressive rather than progressive, dating back to the time of the auto courts, He read an excerpt from a Santa Barbara newspaper dated July 13,1962 which set forth in part that the applicants proposed to manage their motels from their central location in Santa Barbara and contemplated leasing them in the future. He contended that this was a speculative venture not compatible with the type of ventures in Arcadia, Also that the proposed rates could be lower because the construction of the building was inferior, He felt that the matter should be referred to the consulting firm recently e~loyed by the City to study the downtown area, for their comments. 2, 9-18-62 15:5785 Mr. Hal, Wentworth. Manager of 'the Arcadia Chamber of Commerce. read a report dated August 9. 1962 addressed to the Council and the Planning Co~ission from the Chamber's ~oard of Director~. said report containing rec~mmendations. in substance: that, the application as presented be denied; that any hotel or motel constructed on the subject property be of the garden type with ample plantings and garden areas; that any plan favorably considered include a ratio of number of units to,squaie footage of land involved comparable with other motels or hotels in the area and that a ratio of landscaped area to the total land area involved also be comparable with these same existing installations, I Mr, Gerald J, Murphy. owner o~ the Santa Anita Frontier Hotel: That except for the winter months he did not feel there was need for even one third the rooms presently in the area, That he has plans for approximately 16 more units for his hotel but has not constructed them for this reason; that he did not believe the proposed construction would enhance the area, Mr, Henzel spoke the third time. repudiating_the statement that the rooms were too small anq cited Planning Commissioners Norton's and Forman's statements that the rooms were adequate. He pointed out that the Planning Commission has recommended approval and stated that the landscaping can be changed to meet the conditions imposed so as to compare favorably with the landscaping of the other hotels and motels in the area, In answer to Councilman,Reibold. he advised that the rooms were proposed to be ll'x 18' including the dressing area and bathroom; that the furniture is planned for installation in the rooms and that there w~uld be adequate space, Mr. Paul A, Greene. one of the applicants: That he is a builder of long experience in the construction of residential and motel units, He elaborated on the type of material proposed to ,be used 'in the subject motel. stressing the fact that the material will be standard and not sub- standard as mentioned by one of the opponents; that there would be sound- proofing throughout the building and that the development would be managed by the applicants contrary to, the contention of the opposition, Mr, Muller submitted pictures showing the size and content of one of the rooms in the Santa Barbara motel owned and operated by the applicants , The City Manager pointed out that attached to the aforementioned report is a breakdown showing various motels in the City. setting forth the number of units. acreage and average units per acre. said breakdown including the subject motel; the average of total units per acre of all the other motels being 17,22 as compared to 49 per acre of the ~ubject motel. No one else desiring to be heard Councilman Reibold MOVED that the hearing be closed, Councilman Turner seconded the motion which was carried unanimously. I Discussion then ensued. the Councilmen expressing their opinions in part as follows: Councilman Reibold: That basically the only question before the Council for its decision is whether or not this is the type of development compatible to the City, That the matter of price per room. who will operate the motel,' whether or not. it is needed. is not the concern of the'Council. That a use compatible to the subject area would be a motel. but the subject operation would. in his opinion. create a density not compatible. That'were the applicants to submit a rendering of a higher grade and with a 'lower density he probably would look upon it with favor. but that he could not do so in the subject instance. Councilman Reibold thereupon MOVED that the application of Paul A, Greene and William W, Becker for a zone variance on property located at 225 Colorado Place. to permit the construction and operation of a 122 unit motel. be denied, 3, 9-18-62 TRACT NO. 27186 (Final) (F:897) 15:5786 Councilman Turner: That he felt there is a need for this type of motel in various areas of the country but not in Arcadia, He expressed concern with regard to the reputability of the transients who might occupy the motel due to its low rates, adding that this could result in a factor of safety for the youth of the City, That construction and location wise, he felt, the applicants have done commendably in securing the maximum usage of the property but that he personally would not care to see the development in Arcadia, Councilman Turner seconded the above motion, Councilman Balser: That in his opinion the subject location being a compatible area for a motel, the Plan B as submitted by the I applicants would result in a satisfactory development in such area and that he favored the variance being granted. He commented that speculatio as to the reputability of the occupants of such a motel could be favorabl instead of unfavorable as suggested, Mayor Pro Tempore Phillips: That Council's decision, in his opinion, should be whether or not this is a proper use o~ the land, That the matter of density could occur in the adjacent motels in a C zone without need for permission from the Council. That the applicants could build the same development on the same acreage on Huntington Drive without a variance, That he favored granting the variance, The following roll call was then taken on the motion to deny the variance: AYES: Councilmen Reibold, Turner NOES: Councilmen Balser, Phillips ABSENT: Mayor Butterworth Due to the tie vote, Mayor Pro Tempore Phillips announced that the subject matter would appear on the agenda for the Council meeting of October 2,1962, at which time it is hoped there will be a full compliment of councilmen, Located east of El Monte Avenue and south of Las Flores Avenue, MOTION by Councilman Balser, seconded by Councilman Turner and carried unanimously that the Council accept and approve final map of Tract No. 27186 subject to the following conditions, as set forth in letter from the Planning Commission dated September 11, 1962; that the City Clerk be and she is hereby authorized and directed to endorse in due form such approval and acceptance on said map and to affix the!eto the Corporate Seal of the City of Arcadia and to certify to the adoption and passage of a Minute Order at such time as there shall be deposited with the City of Arcadia a good and sufficient Surety Bond guaranteeing certain improvements in said Tract No, 27186 pursuant to Section 9114 of the Arcadia Municipal Code: 1, The deed restrictions of Tract 13113 shall be released or so modified that residences on lots 1, 2 and 3 will not be in violation, I 2, The subdivider shall make every effort to secure 10 feet dedication for street purposes, including the corner cutoff, from the property at 2112 El Monte Avenue south of "A" Street, If the dedication is not received the subdivider shall remove that portion of the unused private driveway within the dedicated street and shall install an appropriate radius curb return to the satisfaction of the Director of Public Works, If, in the future, the property at 2112 El Monte Avenue is divided, the necessary dedication shall be required and the short radius curb return shall be removed and a standard curb return shall be constructed at the expense of the applicant for the division of the lot, 4, 9-18-62 I ZONE CHANGE (Live Oak & Lenore) (F:936) ZONE VARIANCE (Nursery School - 716 West Huntington) (F :937) 1958 STORM DRAIN BOND ISSUE PROJECT NO. 521 (F :938) I COMPLETION OF WORK (Allen Engineering - Tennis Court Lighting) (F :761) 15:5787 3. Dedicate all necessary rear line utility easements, 4, The front setback line on lots 1, 2 and 3 should be 25 feet, The side setback for lot 1 should be 20 feet, 5. Remove all buildings from the tract, Remove all'. trees from the street right of way, 6, Install all street improvements, including drainage facilities, required by the subdivision' ordinance and Public Works Department in accordance with plans and to grades satisfactory to the Director of Public Works, 7. . Councilman Turner seconded the motion which was carried unanimously, Mayor Pro Tempore Phillips declared that since no action can be taken until time for appeal elapses the zone variance request of Emilie and Luben Balabanoff to permit the use as a nursery school and day camp of the property at 716 West Huntington Drive (Planning Commission . Resolution No, 460) will be held over until the appeal period has passed and will be placed on agenda for the Regular Council Meeting of October 2,1962, MOTION by Councilman Turner, seconded by Councilman Reibold and carried unanimously that the Council accept the recommendation of the City Manager and the Director of Public Works; approve the plans and specifications submitted by the Los Angeles County Flood Control District, prepared by the Los Angeles County E~gineer and reviewed by the Department of Public Works, for Storm Drain Project No. 521, South Arcadia under the provisions of the 1958 Storm Drain Bond Issue, portions of said project in the City of Arcadia including the intersections of Live Oak and Santa Anita Avenues, Live Oak and Second Avenues and in Tyler Avenue southerly of Live Oak Avenue; authorize the District to proceed with the construction described therein and grant said District permission to occupy and use public streets within the City to repair and.maintain said installation upon its completion, MOTION by Councilman Balser, seconded by Councilman Reibold and carried on roll call vote as follows that the Council approve the recommendation of the City Manager and the Director of Public Works and accept the work of the Allen Engineering Company, contractor for the tennis court lighting (Job No, 268) as satisfactorily completed, and authorize payment to be made in accordance with the contract with said firm for the above specified work; and the bond released after the expiration of the required 35 days: AYES: Councilmen Balser, Reibold, Turner, Phillips NOES: None ABSENT: Mayor Butterworth 5, 9-18-62 COMPLETION OF WORK (Santa Anita Avenue Improvement Job No, 47-3) (F:901) SANTA ANITA AVENUE SPEED LIMIT (S :Traffic) CALL FOR BIDS (Water Main Replacement) (F:939) REFUND (Sewer - 1216 10th (F:Refunds) 15:5788 MOTION by Councilman Reibo1d, seconded by Councilman Turner and carried on roll call vote as follows that the Council approve the recommendation of the City Manager and the Director of Public Works and accept the work of D & W Paving, contractor for the improvement of Santa Anita Avenue (Job No. 47-3) as satisfactorily completed, and authorize payment to be made in accordance with the contract with said firm for the above specified work; and the bond released after the expiration of the required 35 days: AYES: Councilmen Balser, Reibo1d, Turner, Phillips NOES: None ABSENT: Mayor Butterworth I Discussion was held on the report of the Police Chief and the Director of Public Works regarding the proposed increase in the speed limit from 25 miles per hour to 35 miles per hour on Santa Anita Avenue from Huntington Drive to Live Oak Avenue, and their recommendation, concurred in by the City Manager, The City Manager commented that a communication on the subject, dated September 17, 1962, had been received from Mrs. David B, Harriman, 77 West Las Flores Avenue, said letter being on file in the office of the City Clerk, The Police Chief addressed the Council and explained that the improvement of Santa Anita Avenue between Huntington Drive and Live Oak Avenue has made an increase in the limit both reasonable and safe, a radar speed study disclosing that the critical speed was 38,6 miles per hour on said street, In answer to Councilman Balser, the Police Chief advised in substance that the speed limit, adjacent to schools facing on said street would continue to be 25 miles per hour and such area would be posted as a school zone; that the California Vehicle Code establishes such speed limit when passing a school building or the grounds thereof contiguous to a highway while children are going to or leaving such school during open or closing hours or during the noon recess period; that such 1imi~ applies when passing any school grounds which are not separated from the highway by a fence, gate or other physical barrier while the grounds are in use, MOTION by Councilman Turner, seconded by Councilman Balser and carried unanimously that the report and recommendations dated September 12,1962 from the Director of Public Works and the Police Chief to the City Manager (on file in office of the City Clerk) be accepted as the findings of the City Council, and that a speed limit of 35 miles per hour be authorized on Santa Anita Avenue between Huntington Drive and Live Oak Avenue, except, when approaching and passing the schools facing on Santa Anita Avenue, said school zones to be so posted. MOTION by Councilman Balser, seconded by 'Councilman Turner and carried I unanimously that the Council accept the recommendation of the City Manage and the Water Superintendent; that the Plans and specifications for a water main replacement in Third Avenue be approved as submitted; that the City Clerk be authorized to call for bids for such work in conformance wit said specifications, expenditure for such purpose being provided in the 1962-63 budget, Water Reserve and Depreciation Fund, Major Projects, Item 1, said bids to be. opened October 1, 1962 at 11:00 A.M. and submitted to the Council at the regular meeting of October 2, 1962, MOTION by Councilman Reibold, seconded by Councilman Turner and carried on roll call vote as follows that the Council accept the recommendation Ave,)of the City Manager and the Director of Public Works and authorize a refund of $51,30 from Council Contingency Fund to Mr, William G. '.' 15:5789 the sewer for Mr. Crouch, was unable to locate the lateral as shown on department records, and it being the past policy of the City in these irisfances to refund the amount paid under the sewer assessment proceedings for'the house connection: AYES: Coun~ilmen Balser, Reibold, Turner, Phillips NOES: None ABSENT: Mayor But terworth " The City Manager advised that in portions of Santa Anita Village which presently are without lights, property owners circulated petitions for the installation of street ,lights under the Street Lighting Act of 1919 and have returned the petition from one area, which contains 617- of the area in favor of lighting, A diagram showing the area was submitted to the Council. The signatures and petition having been reviewed by the Department of Public Works, Councilman Balser MOVED that the Council accept the recommen- dation of the City Manager and the Director of Public Works, accept the petition and authorize the Director of Public Works to proceed with preparation of plans, cost estimates and diagrams for instituting proceed- ings under the Street,Lighting Act of 1919, 'Councilman Reibold seconded the motion which was ~arried unanimously. MOTION by Councilman Reibold, seconded by Councilman Balser and carried unanimously that ~he Council grant permission to the Arcadia Republicans, Inc. to hang two large banners, one at the intersection of Huntington Drive and First Avenue and the other at the intersection of Baldwin Avenue and Duarte Road for the purpose of advertising the Republican Candidates' Rally to be held in the Arcadia County Park on Octoper 14,1962, said banners to be erected September 24,1962 and taken down October 15,1962. " MOTION by Counci'lman Balser, seconded by Councilman Turner and carried unanimously that the Council grant permission to the West Arcadia Business and Professional. Association as per their request.of September 12,1962, to hold a "Sidewalk Sale" September 22, 1962 between the hours of 10:00 A.M. and 5:00 P.M., said sale to take place at ,the West Arcadia Hub Shopping Center on the east and west sides of Baldwin Avenue between Duarte Road and Naomi Avenue, and in Market Square on the north side of Duarte Road just east of Baldwin Avenue, As in the past, the City Attorney questioned the propriety of'using a public right of way for such purposes, The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1186, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ApDING TO ARTICLE III OF THE ARCADIA MUNICIPAL CODE A NEW CHAPTER 6 ENTITLED 'HELICOPTER REGULATIONS' ," . .,' MOTION by Councilman Rei~old, seconded by Councilman Turner and carried on roll call vote'as follows that the reading of the full body of Ordinance No, 1186 be waived: AYES: Councilmen 'Balser, Reibold, Turner, Phillips NOES: None ABSENT: Mayor Butterworth Councilman Reibold further MOVED that Ordinance No. 1186 be adopted. Motion seconded ~y Councilman Turner and carried on roll call vote as follows: AYES: Councilmen Balser, Reibold, Turner, Phillips NOES: None ABSENT: Mayor Butterworth The City Attorney commented that a report on the matter of business license fees pertainingt~ the Heliport use would be forthcoming from the City Manager's office,at the next Council meeting, 7, 9-18-62 ORDINANCE NO. 1191 (Introduced) 15:5790 The City Attorney presented for the first time, explained the content and read the title of Ordinance No, 1191, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADDING TO DIVISION 1 OF PART 2 OF CHAPTER 2 OF ARTICLE III OF THE ARCADIA MUNICIPAL CODE A NEW SECTION 3221.6." , ' MOTION by Councilman Balser, seconded by Councilman Turner and carried on roll call vote as follows that the reading of the full body of Ordinance No, 1191 be waived: AYES: Councilmen Balser, 'Reibold, Turner; Phillips' NOES: 'None ABSENT: Mayor ButterWorth Councilman Balser further MOVED, that Ordinance No. 1191 be introduced. Motion seconded by Councilman Reibold and carried on, roll call vote as follows: I . AYES: Councilmen Balser, Reibold, Turner, Phillips NOES: None ABSENT: Mayor' Butterworth AUDIENCE PARTICIPATION nsp The following persons addressed the Council with regard to Ordinance No, 1190 adopted by the Council on August 21, 1962, said ordinance banning scoring devices in certain establishments, said statements being in substance as follows: Mr. L. Farmer, residing in Covina, and employed by the Ross Music Co, He requested the Council to reconsider said Ordinance No. 1190 or to modify it; that it would work a hardship on tavern operators; that an attorney had been retained to represent the tavern operators of Arcadia but that he had been unavoidably detained, and requested that the effective date of said ordinance be extended in order to give said attorney an opportunity to speak. Mr. Farmer was advised that the Council had no desire to reconsider the matter; that their decision had been unanimous in adopting said ordinance, such deciSion having been reached after lengthy discussion and deliberation. He also was advised that after the adoption of the ordinance letters had been sent to all establishments requiring a permit from the City Council for various types of amusement devices specified in the Arcadia Municipal Code, advising the permittees of the ordinance and reminding them that at the time such permits were issued or renewed for the current year each permit was issued on the basis that the device might be banned before the normal expiration of the permit and business license being authorized; that the Council had adopted Ordinance No. 1190, the effect of which prohibits the possession and use, in the manner set forth in their application, of the devices described and for which permits and business licenses have been issued, and that the ordinance takes effect on Septemb 21, 1962, ' Mr, Murray, representing the 101 Club: That he had not been aware of th ordinance being voted on and that in his opinion it was discriminatory, He was advised that the subject matter was carried in the newspapers and that there had been ample notice. He was also advised of the above mentioned letter. Mr, Nelson, 514 Huntington Drive, speaking for the Tavern Association: That this will close several taverns and work a hardship on residents of Arcadia, He mentioned the attorney who had been retained to represent the Association and inquired as to the procedure necessary to forestall the ~ffective date of the ordinance. He was advised that his only recourse would be a referendum, 8. 9-18-62 15:5791 I Mr, Sopka of the Oaks Club: In answer to numerous questions regarding the meaning of certain sections of the said Ordinance No, 1190, the City Attorney explained at length its effect and for further explanation Mr, Sopka was requested to make a personal appointment with the City Attorney, Mr, James E. Biddle, 326 Alste~ Avenue, Arcadia: He 'asked numerous questions regarding the procedure necessary for a private citizen to institute to enjo~n the race"track f~om.: further operati~~,.
