CITY COUNCIL OF THE CITY OF ARCADIA
DECEMBER 18, 1962
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8:00 P.M. December 18, 1962.
The Invocation was offered by Rev. Lawrence Peel, Associate Pa~tor of
the Church of the Good Shepherd.
Mayor Butterworth led in the pledge of allegiance to the flag.

MOTION by Councilman Phillips, seconded by Councilman,Reibold and
carried unanimously that the Minutes of the Regular Meeting of December
4, 1962 be approved as submitted in writing.
Mayor Butterworth declared the hearing open on the matter of the
construction of curb, gutter and sidewalk in front of all property
fronting on that portion of the easterly side of Santa Anita Avenue,
between Floral Avenue and Foothill Boulevard in which no curb has here-
tofore been constructed, and inquired if anyone desired to speak to the
matter.
Dr. David F. Buckingham, 51 East Floral Avenue, addressed the Council,
stating in part that the proposed improvement of the street will narrow
the street, making it unsafe for his tenants to park. He requested that
the subject improvements be held in abeyance"until the median strip has
been narrowed as contemplated.
The Director of Public Works advised in part that it is 25 feet from the
median strip to Dr. Buckingham's property, allowing 10 feet for parking
and 15 feet for vehicular traffic; that the proposed improvements are
basically in the interest of pedestrian traffic; that inasmuch as more
than 50% of the easterly side of the subject street is presently improved,
the Street Superintendent has the prerogative, upon consent of the Council,
to improve the remainder of that side of the street. That the curb will
be at a permanent location.
No one else desiring to be heard, and no written protests having
received, Councilman Phillips MOVED that the hearing be closed.

Motion
Discussion ensued. It was stated in part that the narrowing of the
median strip would widen the subject street; that consideration is being
given to removing the median strip entirely in the subject section,
probably during or after the time the freeway is constructed. The City
Attorney explained the applicability of the Abreviated 1911 Act to the
subject matter.
Councilman Turner MOVED that all protests, written or oral, if any there
were or be, be overruled; that the Superintendent of Streets be instructed
to proceed with the work as contemplated in accordance with the provisions
of Chapter 27, Part 3 of Division 7 of the Streets & Highways Code.
Councilman Phillips seconded the motion which was carried unanimously.

Mayor Butterworth declared the hearing open on the matter of the
construction of curb and gutter on all property fronting on that portion
of El Sur Avenue between Mayflower and Tenth Avenue in which no curb has
heretofore been constructed, and inquired if anyone desired to speak to
the matter.
No one desiring to be heard and no written protests having been received,
Councilman Reibold MOVED that the hearing be closed. Councilman Turner
seconded the motion which was carried unanimously.
Councilman Reibold further MOVED that all protests, written or oral, if
any there were or be, be overruled; that the Superintendent of Streets
be instructed to proceed with the work as contemplated in accordance 1
with the provisions of Chapter 27 of Part 3 of Division 7 of the Streets
and Highways Code. Councilman Balser seconded the motion which was
carried unanimously.
MOTION by Councilman Phillips, seconded by Councilman Turner and carried
on roll call vote as follows that the recommendation of the Planning
Commission, as embodied in its Resolution No. 463, be accepted and that
the petition of the Pacific Telephone and Telegraph Company for a zone
variance to permit the addition of a second story to a building heretofore
constructed under a variance, at 15 East Alice Street, and other
construction, as set forth in said Resolution No. 463, be approved upon
the conditions contained in said resolution, and that the City Attorney
be instructed to prepare a resolution accordingly:

MOTION by Councilman Balser, 'seconded by Councilman Turner and carried
unanimously that the Council accept and approve final map of Tract No.
22314, subject to the following conditions, as set forth in letter from
the Planning Commission dated December 12, 1962:
1. Dedicate a 5 foot planting and sidewalk easement along Andrews Road
for its entire length.
2. Dedicate lots 8 and 9 in fee to the City, or execute Trust Agreements
in form approved by the City Attorney.
3. Provide all necessary rear line utility easements.
4. Relocate the garage at 105 Norman Avenue to provide side yard
clearance. No driveway opening will be allowed in the curb return
on Norman Avenue. ~---..,

5. Remove all trees from the street right of way.
6. Install all standard street improvements required by the Subdivision
Ordinance. Improvements, grading, grades and drainage shall be to
the satisfaction of the Director of Public. Works.

8. City shall dedicate lots IS, 16 and 17 in Tract No. 21341 for
street purposes.
That the City Clerk be and she is hereby authorized and directed to
endorse in,due form such approval ~nd acceptance on said map and to
affix thereto the :Corporate Seal of the City of Arcadia, and to '
certify to the adoption and passage of a Minute Order at such time'as
there shall be deposited with the City of Arcadia a good and sufficient
Surety Bond guaranteeing certain improvements iq said Tract No. 22314
pursuant to Section 9114 of the Arcadia Municipal Code.
Upon the Planning Director pointing out that the Planning Commission
recommended the establishment of trusts for lots 8 and 9, Councilman
'Balser further MOVED that the Council authorize the establishment of
a Trust for lot 8 of Tract No. 22314 in the amount of $885.17 and for
lot 9 of $3672.26, this being in accordance with condition No.9 as
set forth in Planning Commission's communication of December 12,1962.
Councilman Reibold seconded the motion which was carried unanimously.

The Planning Director displayed a map of the prGposed tract and explained
that the Planning Commission by unanimous action did not approve the map
due to its many variables, which he in part identified.
Mr. Al Knutsen, 2636 South Baldwin Avenue (the subdivider) addressed the
Council, advising in substance that the proposed subdivision plan is
presently the best development available. He requested that, if the
Council should determine to sustain the Planning Commission, it be on
the basis of returning the matter to the Planning Commission and, that
Council's denial be without prejudice.
Whereupon Councilman Balser MOVED that the Council sustain the recommen-
dation of the Planning Commission and that approval of tentative map of
Tract No. 27619 be denied, without prejudice to future consideration of
the same or any modification thereof. Councilman Phillips seconded the
motion which was carried unanimously.
Located north of Longden Avenue and west of Second Avenue, containing
36 lots.
MOTION by Councilman Balser, seconded by Councilman Phillips and
carried unanimously that the Council accept and approve final map of
Tract No. 27444 subject to the following conditions, as set forth in
communication from the Planning Commission dated November 14, 1962:
1. The City shall accept the offer of "future street" dedication for
First Avenue between Las Flores Avenue and the north line of the
tract. This street to be opened and improved by the subdivider.
2, Dedicate a 5 foot planting and sidewalk easement along each side
of Arthur Avenue and ~ouise Avenue.
3. Dedicate Arthur Avenue 49 feet wide and dedicate one foot in fee
to the City between lots 32 and 33.
4. Rearrange the lines of lots 25 and 26 to clear the swimming pool
on lot 24. The pool shall be covered or otherwise protected until
completion of a new house on the lot.
5; Relocate or remodel1the dwellings at 2113 South Second Avenue and
51 East Longden Averlue and the garage at 2111 South Second Avenue
to conform to new ldt lines.
6. Provide all necessary rear line utility easements.

7. Remove all other buildings and structures within the tract except the
dwellings at 2111 South Second Avenue, 25 East Longden Avenue and 33 East
Longden Avenue.

ordinance. Improvements, grading, grades and drainage shall be to the
satisfaction of the Director of Public Works. The minimum grade shall
b~ 0.47. or a minimum storm drain to Second Avenue will be required.

12. A covenant in form approved by the City Attorney shall be recorded

Councilman Reibold MOVED that the Council accept the recommendation of
the City Manager and the Director of Public Works; that a contract for
the installation of traffic signals at seven intersections in the City
be awarded to C. D. Draucker, Inc. in the amount of $42,705.00; that all

Lengthy discussion was held on the report submitted by the City Manager,
the Director of Public Works, and the Police Chief regarding requests from
local businessmen for special limited curb markings, for the purpose of
securing Council's policy in the matter for the staff.
Police Chief Seares spoke to the matter, stating in part that in his
opinion, if there is any indication that a merchant may be suffering by
not having a short term parking space in front of or near his place of
business, he should be granted his request. However, that enforcement
would require time consuming policing and if not rigidly enforced,
frequent undetected violations would destroy the effectiveness of such a
green zone.
The City Manager stated that one of the strong arguments advancedois::th4t
the City has a responsibility to assist the small businessman rema~n in
business; that he is being deprived of business since his customers tend
,to transact their business with newer establishments having ample parking
and, that many cities do provide green zones when requested by the
merchant.

The Councilmen presented and considered many suggestions, to wit: that if
,it will help the merchants, the line should be drawn at cleaners,
bakeries, candy stores, and the like; that there be only two green zones
,
in a block, one at the end of the block and ,the other near a cross ,walk,
not necessarily immediately in front'of the establishment; that the
installation of a green zone be under the criterea established by the
Chief of Police in his report; that not more than 50% of the street be
established as a green zone; that a green zone not be established
arbitrarily if there is no need for one; that green zones or any other
zones be posted as to time limitation; that a survey be made as to ,the
individual merchant's desires in the matter.
Mr. Mallozzi, 411 Eldorado Street, addressed the Council, stating in
part that he had made two requests for green zones; that he felt each'
business should be treated individually; that the green zone should be
liberalized to aid the merchant.
Mayor Butterworth suggested that the City Manager and the staff give
the matter further study along the lines of Council's suggestions.

A' progress report on the safety program instituted by the City in the
Dana School vicinity was submitted to Mr. John O'Keefe for perusal, to
be discussed later in the evening.
MOTION by Councilman Phillips, seconded by Councilman Reibold and

dation of the City Manager and authorize the sum of $62,932.00 being
appropriated and transferred from the Unappropriated Surplus Account
No. 290 in the General Fund to Police Department Account No. 42l-3A'for

OF THE CITY OF ARCADIA, CALIFORNIA DECLARING THE RESULTS OF A SPECIAL
MUNICIPAL ELECTION HELD IN SAID CITY ON THE 6TH DAY OF NOVEMBER, 1962,
FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A
PROPOSITION TO BAN DOOR-TO-DOOR COMMERCIAL SOLICITATION."
The City Attorney also advised the Council of his conversation over the
telephone with Mr. S6l Hirschhorn, Executive Director of the California

Mr. John O'Keefe, 1431 South First Avenue, addressed the Council with
regard to the safety program instituted by the City in ',the Danlj. School
vicinity, the progress report on s~id matter, dated December 12, 1962,
having been submitted to Mr. O'Keefe earlier in the evening, inasmUch
as said report was mailedfbut not as yet received by Mr; O'Keefe.

Mr. O'Keefe was asked for his comments and stated that he agreed with the
report that sidewalks would seem to be the ultimate solution, and inquired
of the Council as to its decision in this respect. Mayor Butterworth
advised that the Council has not gone forward on the matter of sidewalks;
that the cost would be very substantial and that he has found that many
residents do not want sidewalks. To Mayor Butterworth's inquiry as to
whether Mr. O'Keefe has ever polled his neighbors to determine how they
might feel about sidewalks, Mr. O'Keefe replied that his immediate neighbors
favored sidewalks but did not want to pay for them.
Mayor Butterworth then stated that the safety program instituted at the
Dana Junior High School is a pilot,plan to secure reaction on how much
good can be derived from it. He suggested that Mr. O'Keefe write to the
Council after he had an opportunity to observe the plan in operation'.
Request of applicants (Emilie and Luben Balabanoff) for amendment of Res.
3524'.uSec':~iori 5;' Si1bs-. (d) and (f) of zone variance granted them October
16, 1962 for a nursery school at 716 West Huntington Drive.
Mr. Luben Balabanoff addressed the Council and explained that he proposed
leasing the parking area on adjacent property, which subsection (d) of
Section 5 permits in lieu of a circular driveway to be constructed. 'That
his request for a deferment of two years of the provision that sidewalks
be installed across the front of the property is based primarily on
finances at the present time; also that sidewalks will not contribute,any-
thing esthetically to the area inasmuch as there is presently no sidewalk
in front of adjacent properties,
Discussion ensued, and it being the consensus of the Council that so long
as there is assurance that a sidewalk will be installed in front of the
subject property within two years, or at such time prior thereto as
adjacent properties are so improved, Councilman Turner MOVED that the
Council grant the requested deferment; that the variance be amended
to the extent that the sidewalk be installed at'such time as 50% of
the applicants'" side of the street in that block is so improved, but in
no event beyond a two year period and that if not so performed, the
variance shall lapse. Councilman Phillips seconded the motion which was
carried unanimous ly. i
Lengthy discussion was held regarding the request of the developers of
Tract No. 24311 for acceptance by.the City of the improvements in said
tract, which approval has been held in abeyance for several years.
The City Attorney reviewed the situation, explaining in substance that
approval has been withheld due to several mistakes made in the sub- ,"
division and that legal proceedings are pending involving said tract'
for damages for unlawful diversion of flood water from said tract to
another. That at the time the subdivision was approved the calculations
by the ,builder's engineer did not take into account the flow of water'
that normally would come into the area; that the calc~iations were
accepted by the City; further that construction was not exactly in
accordance with the plans as approved by the City.

The Director of Public Works advised.,that there is 'no problem at the
subject location now nor has there been since the subdivision to the
south was constructed. That the only, concern of the City Manager and
his department has been the legal technicality involved.

It being the consensus of the Council that the problems involved have been
'satisfactorily consummated, Councilman Turner MOVED that although the
improvements in Tract No. 24311 were not properly designed and in
addition were not constructed precisely in accordance with approved plans
and specifications, inasmuch as additional drainage facilities have been
installed at the expense of the City and persons other than the subdividers
of Tract No. 24311, which additional facilities do accomplish the purpose,
contemplated for'Tract No. 24311, the, improvements in Tract No. 24311 be
accepted. Councilman Phillips seconded the motion which was carried
unanimously.
Mayor Butterworth ordered filed the notice of annexation proposals to
City of El Monte Nos. 299, '305 and 306 as they have no effect on Arcadia.

Resolution No. 3541, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, NOTIFYING THE COUNTY OF LOS ANGELES OF SAID

In reply to Mr. Joseph C~ Boggio, 220 West Duarte Road (member of the
Civil Defense and Disaster Board) as to whether Resolution No. 3547 has
the approval of the Federal Government, Mayor Butterworth advised that
it has the approval of the United States Information Service, which is
a representative of the Department of State and also of the American
Municipal Association.
The City Attorney advised that in connection with the desire of many
persons in the area of Anoakia Lane within the County of Los Angeles,
to annex to the City of Arcadia, a boundary description, including all
of the lots on Anoakia Lane and the Anoakia School was submitted" to
and approved by the Los Angeles County Boundary Commission. That the.
Registrar of Voters reported December 18, 1962 that there are ten
registered voters that have been registered to vote in the area for 54
days. That accordingly it is uninhabited territory and proceedings may
be instituted for ,annexation to Arcadia if the Council so desires.
The Council indicating its consent to such annexation,'the City Attorney
thereupon presented, explained the content and read the title of
Resolution No. 3532, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, INSTITUTING PROCEEDINGS FOR, SETTING A
PUBLIC HEARING CONCERNING AND GIVING NOTICE OF THE T~ AND PLACE OF
SUCH PUBLIC HEARING CONCERNING THE PROPOSED ANNEXATION TO THE CITY OF
ARCADIA OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT

The City Manager adviseq that the Personnel Board at its regular meeting
of December 13,1962 discussed the recommendation to combine the

Treasurer aqd Personnel Officer positions and unanimously'moved that
Catherine A. Murphy, City Treasurer, be appointed to the combined
positions of Treasurer and Personnel Officer, t~e starting salary to
be set at the "D" step in Salary Schedule No. 436.
Discussion was held on the fact that the "D" step in said salary schedule
No. 436 is one step lower than was originally contemplated and Councilman
Reibold suggested that consideration be given in six months, rather than
the normal year, to raising the salary to the "E" step.
The City Attorney then presented, explained the content and read the title
of Resolution No. 3533, entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 3 OF RESOLUTION NO.
3498 BY ABOLISHING THE FULL-TIME POSITION OF PERSONNEL OFFICER AND, AS
PROVIDED BY THE ARCADIA CITY CHARTER, BY ASSIGNING THE DUTIES OF SUCH
PERSONNEL OFFICER TO THE POSITION OF CITY TREASURER AND AMENDING THE

The City Manager briefly reviewed the report submitted to the Council
regarding exercises held a week ago by the Civil Defense and Disaster
Board, adding that the medical staff and other participants should be
commended for their realistic efforts.: He also mentioned that Councilman
Balser had been present at said exercises,
Discussion was held on the memorandum submitted by the City Manager
regarding the Governor's proclamation declaring December 31, 1962 a
State Holiday and its applicability to the City of ' Arcadia.
The City Manager quoted from a memorandum opinion of the Attorney
General pertaining to the authority of the Governor to so proclaim a
State Holiday; that regarding City offices the determination of whether
they will be open or closed is vested in the governing body of the City
by reason of provisions of the Government Code.
The City Attorney added that the Government Code specifies the legal
holidays; ,that among them is a holiday proclaimed by the President or
the Governor; that the City's Personnel Rules include ,as' a holiday any
day declared by the Governor to be a holiday; that uriles~ the governing
body adopts an ordinance stating that the City Hall be left open on
December 31 it should be closed; and unless the Council by resolution

amends the Personnel Rules, December 31 is a holiday for City 'employees.
No motion being necessary by the Council, Mayor Butterworth declared
December 31st as a holiday, the City Hall to be closed on that day,
December 24th to be a work day.
