The Invocation was offered by Councilman Bals~r. Mayor Butterworth led in the pledge of allegiance to the flag. PRESENT : ABSENT : Councilmen Balser, Phillips, Reibold, Turner, Butterworth None MOTION by Councilman Phillips, seconded by Councilman Turner and carried unanimo~sly that the Minutes of the Regular Meeting of December 18, 1962 be approved as submitted in writing. Mayor Butterworth declared the hearing open on the proposed annexation to the City of Arcadia of certain territory adjacent and contiguous to the present City limits, said territory being situated near the southeasterly portion of the City, more 'particularly described in Resolution No. 3531, and designated as Annexation No. 30; Southeast Arcadia (Uninhabited), adding that this is th~ time and place fixed by the Council to consider any protests in writing. The City Clerk advised that no written protests were received from any person owning real property within the territory proposed to be annexed and that she had on file Affidavits of Publication of Resolution No. 3531 and of Mailing of Notice of Public Hearing. Mayor Butterworth then inquired if anyone in the audience wished to be heard regarding the proposed annexation. No one desiring to be heard Mayor Butterwo~tr declared the hearing close~. The City Attorney thereupon presented, explained the content and read the title of Resolution No. 3547-A, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FINDING AND DECLARING THAT A MAJORITY PROTEST HAS NOT BEEN MADE WITH RESPECT TO ANNEXATION NO. 30 SOUTHEAST ARCADIA (UNINHABITED)." MOTION by Councilman Phillips, seconded by Councilman Reibold and carried on roll call vote as follows that the reading of the full body of Resolution No. 3547-A be waived: AYES: Councilmen Balser, Phillips, Reibold, Turner, Butterworth NOES: None ABSENT: None Councilman Phillips further MOVED that Resolution No. 3547-A be adopted. Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Reibold, Turner, Butterworth NOES: None ABSENT: None The City Attorney then presented for the first time, explained the content and read the title of Ordinance No. 1194, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, 1. 1-2-63 RETIREMENT FUND (Quadrennial Actuarial Revaluation) (F:193) FIRE ZONES (Report - Continued to 1-15-63) (S) 11-6-62 ELECTION EXPENSE (F:928) 15:5862 APPROVING THE ANNEXATION TO SAID CITY OF THAT CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY DESCRIBED IN RESOLUTION NO. 3531 ADOPTED BY SAID CITY COUNCIL ON NOVEMBER 20, 1962 AND DESIGNATED THEREIN AS 'ANNEXATION NO. 30, SOUTHEAST ARCADIA (UNINHABITED)'." MOTION by Councilman Reibold, seconded by Councilman Turner and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1194 be waived: AYES: Councilmen Balser, Phillips, Reibold, Turner, Butterworth NOES: . None ABSENT: None Councilman Reibold further ~ that Ordinance No. 1194 be introduced. I Motion seconded by Councilman Phillips and carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Reibold, Turner, Butterworth NOES: None ABSENT: None The City Manager advised that the State Employees' Retirement Law (SERS) requires that an actuarial investigation and revaluation of the assets and liabilities of the system be made at least once every four years in order to determine whether any change should be made in the contribution of the State and contracting agencies; that the last quadrennial revaluation was made as of June 30, 1958; that the cost to the City for such revaluation is $325.00, funds for such purpose being available in the Retirement Fund. MOTION by Councilman Balser, seconded by Councilman Phillips and carried on roll call vote as follows that the Council accept the recommendation of the City Manager and authorize him to execute, on behalf of the City, a contract with the firm of Coates, Herfurth and England, consulting actuaries, for a revaluation as required by the State Employees' Retire- ment Law: AYES: Councilmen Balser, Phillips, Reibold, Turner, Butterworth NOES: None ABSENT: None The matter of the City's present policy regarding Fire Zones and their affect on variances, a report on same dated December 28, 1962 having been submitted to the Councilmen by the City Manager, was briefly discussed. Upon Councilman Turner commenting that he had not had time to attentively peruse the report, and at his request, Mayor Butterworth ordered the matter placed on agenda for the Council meeting of January 15, 1963. MOTION by Councilman Phillips, seconded by Councilman Balser and carried I on roll call vote as follows that the Council authorize final payments in connection with the special election on Proposition "w" held November 6, 1962, a) to Harold Ostley, Los Angeles County Treasurer, $61.20 and b) to the Los Angeles County Registrar of Voters $75.89, total $137.09, to be appropriated from Council Contingency Account: AYES: Councilmen Balser, Phillips, Reibold, Turner, Butterworth NOES: None ABSENT: None 2. 1-2-63 UPPER SAN GABRIEL VALLEY, . MUNICIPAL ' WA:rER 'pISTRICT (F:48S) I COUNTY BOUNDARY COMMISSION .',' , 15:5863 Extensive discussion was held on the Statement dated December 17, 1962 and letter dated December 19, 1962 from Mr. David S. Wood, President of the Board of Directors of.the San Gabriel Valley Municipal Water District, concerning ~upport.for its recommendation that a contract be entered into directly with the State of California for importation of Feather River water after the year 1972. (Both statement ~nd letter on file in office of the City ,Clerk). ' Mayor Butterworth welcomed to the meeting and to the discussion members of the Board of Directors of the Upper San Gabriel Valley Municipal Water District. Mr. Carl Fossette, Secretary of said Board of Directors, addressed the Council in opposition to the communication and statement. Mr. J. Erce1 Cleminson, President of said Board, expressed appreciation on behalf of said Board for the support rendered by the City. Councilman Reibo1d stated in part that in his opinion the City Council has already made its determination to go along with the Upper San Gabriel Valley Municipal Water District; that he could see no reason for another joint meeting as requested ,in letter received from Mr. Wood; that the Council concurred with the Water Report of Stetson, Strauss & ~resselhaus and had so advised the District. .He added that time is of the essence. The City Manager stated in part that the Upper San Gabriel Valley Municipal Water District Board of Directors was aware ~f the itemization in the . letter at the time the Council made its final decision, although water rates ~ere not taken into consideration because .they were not known. ,f .." .:" Councilman Phillips expressed reliance in Councilman Reibo1d's City Manager's conclusions and felt they should be sustained. and the '.. Mayor'Butterworth then suggested that the City.Manager reply to Mr. Wood'." letter'to:the effect .that the Council (s satisfied with its position; .that although it welcomes the District's thoughts, it has no occasion to change its course .of action at th~s time unless there is further information, Councilman Reibold adding that there be included in such reply the fact that the Council appreciates their questions but'.that they. were studied before a conclusion was reached. Mayor Butterworth ordered filed notice of .proposed Annexation No. 39 Inhabited to the City of Monrovia, inasmuch as it has no effect on Arcadia. AUDIENCE PARTICIPATION AMERICAN LUTHERAN CHURCH I (F: 885) Mr. Galbraith, architect for. the American Lutheran Church, proposed to be constructed at 110 and 118 West Duarte Road, addressed the Council, stating that he wished to speak to the matter of a modified plan of such church and related facilities; however, since the Planning Director planned to bring the matter up before the Council, he would defer speaking until that time. Director displayed a modified plan.of a church and related facilities proposed to,.be constructed by the American Lutheran Church at 110 and 118 West Duarte Road, ,adding that said plan differs from that originally submitted with the application for a zone variance to permit such construction and approved by the Council February 20, 1962; that in his opinion the new plan is substantially better. He related the primary differences, in part alterations in. parking spaces and landscap- ing. He commented that the architect's elevation plans are compatible with the City's new library adjacent thereto and that he recommended that the Council modify the one condition of approval that the plans be submitted to and approved by the Planning Commission prior to the 3. 1-2-63 TRACT NO. 24140 (Final) (F :727) 15:5864 issuance of a building permit and.;shall be substantially in compliance with plans and elevations submitted with the application. Mr. Galbraith commented that the matter was being brought to the attention of the Council so that a time extension on the variance could be obtained. The City Attorney suggested that 1) prior to the present deadline for the expiration of the existing variance the applicant apply in writing for an additional extension of the variance; 2) that the advisability of renoticing a hearing for the purpose of considering and acting upon the revised plot plan be considered; or 3) that the Planning Commission on its own option reopen the original proceedings to consider and act on the revised plans. I After lengthy discussion, it being the consensus of the Council that an extension of the variance need be granted, Councilman Reibold MOVED that the applicant make written application in that regard and that the Planning Commission take appropriate action for a review of the matter and to make recommendations concerning the revised plans submitted by the applicant. Councilman Phillips seconded the motion which was carried unanimously. Due to hearings held establishing the amount of improvement cost to be placed in trust to be paid if outside properties were to use the improvements it was not possible to have a signed Title Sheet, which is normally required prior to Council action (final map approved by the Council September 4,1962) because it could not be determined which properties would or would not be included within the final tract. The Title Sheet of this final map having been submitted with the final tract map, Councilman Turner MOVED that the Council accept and approve final map of Tract No. 24140 subject to the following,conditions: . 1. Provide all necessary rear line utility easements. 2. No structure shall remain on any land within the tract boundary except with the approval of the Director of Public Works and Planning Director. 3. A map showing the location of those structures proposed to remain shall be submitted to the Department of Public Works prior to the signing of the final map. 4. Install all street improvements, including drainage facilities required by the Public Works Department in accordance with grades satisfactory to the Director of Public Works. 5. Pay the following fees and deposits: I 15 steel street light posts 84 street tree installation 3 street sign installation 38 lots recreation fee $2,025.00 714.00 105.00 950.00 Total $3,794.00 6. Authorize the subdivider to establish a Trust in accordance with City Council Resolution No. 2512, on lot No. 42, in the amount of $2,450.60, plus the cost of maintaining this Trust. That the City Clerk be and she is hereby authorized and directed to endorse in due form such approval and acceptance on said map and to affix thereto the Corporate Seal of the City of Arcadia and to certify 4. 1-2-63 TECRNI<;AL STUDY . COMMITTEE I (nsp) VISUAL AID EQUIPMENT JOINT MEETING COUNCIL AND BOARDS AND COMMISSIONS I RESOLUTION NO. 3548 15:5865 to the.adoption and passage of a Minute Order at such time as there ....J shall be deposited with th~ City of Arcadia a good and sufficient Surety Bon~ guaranteeing certain improvements in said Tract..No. 24140, pursuant to ~ection 9114 of the Arcadia Municipal Code. Councilman Balser seconded the motion' which was carried unanimously. , , The Planning Director auvised that the Technical' Study Committee, appointed to review the quality of construction of apartments in Arcadia, had at its last meeting made several recommendations involving the trans- mission of sound between apartments, between apartments and outside areas, etc., adding that the Committee recommends tha~' the Council instruct him to work closely with the City Attorney regarding amending the Building Code in that regard. Discussion ensued and suggestions were made as to possible elimination of sound. Councilman Turner was particularly concerned with the practice of placing medicine cabinets back to back in bathrooms. Councilman Phillips stated in part that he did not approve of amendments to the building or~inance by, degrees; that it had been his thought that the Committee was to make its recommendations.a~ to the possible upgrading of quality of construction and increase of space. That Zone R-3-R had been established for such purpose but has never been used, and should be the criterea of what should be~attempted in R~3. That in his opinion. there should be a public hearing on the entir~ matter of upgrading R-3. construction. The Planning pirector commented that it was the thought of the Committee to handle each phase separately. Mayor Butterworth commended the Technical Study Committee on its many hours of ~ork and ~ndeavor and, requested that Counci1's thinking on the matter be conveyed.to it, in substance that Council is interested in the upgrading of the quality of construction of apartment buildings together with density and that it should think along spc~ lines; also that perha.ps it would be better .to think the entire matter through first before con- .sidering the enactment of a comprehensive ordiqance covering the subject matters. The City Manager briefly explained the operation of the new visual aid equipment installed in the Council Chamber. At the suggestion of Mayor Butterworth, February 14,1963 was set as the time for a joint dinner meeting of the Council with. all the City's Boards and Commissions, the City. Manager to notify the individual members and to make all necessary arrangements. The City Attorney presented, explained the content and read the title of Resolution No. 3548, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 'ARCADIA, CALIFORNIA, 'AMENDING SUBSECTION 'f' OF SECTION 5 OF RESOLUTION NO. 3524." Councilman Turner MOVED that the reading of the full body of Resolution No. 3548 be waived. Motion seconded by Councilman Balser and carried on roll call vote as follows:.
