The Invocation was offered by the Rt. Rev. Mons. Gerald M. O'Keefe, Pastor of the Holy Angels Church. Mayor Phillips led in the Pledge of Allegiance to the Flag. PRESENT : ABSENT : Councilmen Balser, Butterworth, Reibold, Turner, Phillips None MOTION by Councilman Reibold, seconded by Councilman Turner and carried unanimously that the minutes of the Regular Council Meeting of May 7, 1963, the Adjourned Regular Meeting of May 14, 1963 and the Adjourned Regular Meeting of May 20, 1963, be approved as submitted in writing. Mayor Phillips declared the hearing open on Planning Commission Resolution No. 476 recommending change of zone from R-l to M-l and D (Architectural Overlay) of property within Annexation No. 30, Southeast Arcadia Uninhabited, and inquired if anyone desired to speak to the matter. No one desiring to be heard, Councilman Butterworth MOVED that the hear- ing be closed. Councilman Balser seconded tqe motion wpich was carried unanimously. Councilman Reibold MOVED that the Council accept the recommendation of the Planning Commission and authorize reclassification from Zone R-l to Zone M-l and D (Architectural Overlay) of property within Annexation No. 30, Southeast Arcadia Uninhabited, as contained in Planning Commission Resolution No. 476. Councilman Butterworth seconded the motion which w~s carried unanimously. Mayor Phillips declared the hearing open on the appeal from Planning Commission denial of Lot Split No. L-63-11 (property located at 1510 South Sixth Avenue) and inquired if anyone desired to speak to the matter. The appellant, Mr. A. R. Coke, residing at 1050 Singingwood Drive, addressed the Cpuncil and stated IN PART: That the subject parcel of land became a problem lot when the subdivision ,north of the s~bject parcel was allowed, as it completely blocks the property in question. That at no time was the subject property owner given the privilege of becoming a part of tha7 subdivision. That it had been stated at the Planning Commission meeting that some relief should be given the subject property owner. That the denial by the Planning Commission of the requested lot split was based primarily on Section 9122.5 of the Arcadia Municipal Code and that in his opinion there is no legal basis for the denial of the request based upon said section as the provisions therein do not apply in this instance. 1. 5-21-63 15:5998 That at the suggestion of the Planning Commission two alternate maps had been prepared and submitted. Said maps were thereupon projected on the visual screen showing the location of the proposed additional two dwellings, one indicating a 40 foot dedicated street and one a 24 foot private street. Mr. Coke also mentioned that it would be economically unfeasible to move the dwelling presently located on the property; that said dwelling is worth approximately $30,000. He also mentioned that there was no likelihood of the subject property becoming part of a subdivision in the near future inasmuch as the surrounding area residences were only six or seven years old. There was no one else desiring to be heard in favor of the requested lot split, and upon Mayor Phillips' inquiring if anyone desired to be heard in opposition thereto, I Mr. Peer Clausen, 925 South Eighth Avenue, addressed the Council and stated in part that he was opposed to substandard zoning as not being desirable for the City and its inhabitants; that in his opinion this lot split should not be permitted in view of the fact that the City is endeavoring to maintain an above average status in home development. No one else desiring to be heard Councilman Butterworth MOVED that the hearing be closed. Councilman Balser seconded the motion which was carried unanimously. Discussion ensued. The Planning Director suggested that should the Council determine to grant the requested lot split the following conditions apply: 1. A buffer strip on that road which is proposed to protect those properties which would have double frontage, said buffer strip to be planted and maintained; 2. Permit a division into two rather than three lots; 3. Prior to the lot split becoming final all house plans, size and location of the proposed dwellings, be submitted and approved by the Planning Commission. Councilman Balser stated in part that although he would not dispute Mr. Coke's statement that the property owner was not contacted regarding the subdivision to the north, that his past experience indicated that occasionally every effort is exhausted to obtain additional badly needed land for a subdivision but that some owners refuse to sell or cooperate. He cited several such cases. He added that in his opinion the subject requested lot split is an unsatisfactory layout of lots; that it is merely a three dwelling development on an R-l lot and would not be in keeping I with the standard the City is endeavoring to maintain. Councilman Reibold stated in part that his primary concern is the precede such a lot split would set as there are many such lots in the City; that he agreed with Councilman Balser that this would be essentially building three houses on an R-l lot. That he did not think a lot 72 feet deep and 100 feet wide is a desirable lot; that he did not favor a lot which has a rear yard on two sides and a side yard on two sides and no front yard except the street. That he would rather see one house built on the same lot. He also mentioned the fact that although he did not doubt Mr. Coke's statement, that for reasons best known to themselves some owners do not elect to cOrne into a subdivision, which is their privilege, and that situations similar to the subject case result. Mayor Phillips expressed doubt as to the advantages of a 72 foot deep lot. 2. 5-21-63 I TRACT NO. 28438 (Tenta~ive) ;, (F:979) I ':'1;"1.; -: ll~!;;~ , ~;. 'I - \' ~ " . ." 15:5999 Councilman Balser then MOVED that the Council sustain the Planning Commission and deny Lot Split No. L-63-ll (located at 1510 South Sixth Avenue). Councilman Reibold seconded the motion. Mr. Coke again addressed the Council, stating in part that he wished to refute Councilman Balser's inference tqat the owner of the subject property was contacted; that his statement that .he had not been contacted was a , statement of fact. He also mentioned that some of the lots in the subdivision on Pamela Road are only approximately 80 feet deep. Upon Councilman Balser stating that he had been speaking in generalities and had not referred to the subject owner; Mayor Phillips commented that the record would pear him out. The above motion was then carried unanimously. Six lots on a cuI de sac street located west of Holly Avenue, between Longden and Walnut Avenues, on the rear portions of properties known as 416 and 426 West Longden Avenue and 415 and 425 West Walnut Avenue. Planning Commission recommendation of approval subject to the following conditions: ' : . 1. The south lot line of lot No.4 shall be in line with the south lot line of Lot No.3. 2. A 6 inch water connection into this tract reducing to a 4 inch water main beyond a fire hydrant required by the Fire Department. A flushout will be required at the end of the proposed water main. " 3. Install all standard street improvements required by the subdivision ordinance. Improvements, grades and drainage shall be to the satisfaction of the Director of Public Works. 4. Provide all easements required for rear line utilities. Delineate easement on copy of final map and secure approval of utility companies. S. Remove all trees and structures from the street right of way. 6. Remove all structures and buildings witqin or across the tract boundary. These removals or relocations shall comply to all City ordinances, codes and regulations and be 'done to the satisfaction of the Department of Public Works. 7. Dedication of street 60 feet wide or 5 foot planting and sidewalk easements. 8. Provide garages for 416 and 426 West Longden Avenue and 415 and 423 West Walnut Avenue. 9. Easement for drainage and sewer shall be of size and type approved by Director of Public Works. 10. Fees and deposits required: Street light installation Street sign installation Street tree installation Recreation fee (6 @ 25.00) $345. 70. 119. 150. $684. 11, A covenant in form approved by the City Attorney shall be recorded agreeing that for the purposes of Article'rx of the Arcadia Municipal Code the exterior boundary of said tract shall constitute the rear lot lines or Lots 3 and 4. 3. 5-21-63 AGREEMENT (Engineering Service) (F :951) 15:6000 12. Prior to the issuance of a permit to build the guest house shown at 416 West Longden Avenue a covenant enforceable by the City shall be prepared in form approved by the City Attorney stating that the guesthouse shall not be used for rental purposes. The Planning Director advised that one of the conditions of approval was that the street must be either 60 feet wide or 50 feet with a five foot planting easement around it; that this is not possible on the two lots on Longden Avenue' at the present time as there has not been sufficient property purchased to provide the additional five feet for planting and sidewalk purposes. The Planning Director also mentioned that the Planning Commission I approved the construction of a guest house onthe property at 416 West Longden Avenue but that since such approval the size, shape and location of the guest house has been changed; that the subdivider submitted a revised map showing the changes. Mr. Arthur Bauman, the subdivider. addressed the Council and explained the owner's reasons for desiring the revised proposed location of the guest house, adding that a block wall would be constructed shielding the guest house from the street and that there would be no street entrance to the guest house. . After considerable discussion, and it being the consensus of the Council that it did not favor the new proposed location of the guest house (it being three feet from the property line) but preferred the original location of 9 feet 7 inches from the property line, Councilman Balser ~. seconded by Councilman Butterworth, that the matter be held over until the question of the setback line for the proposed guest house could be resolved. Upon Mr. Bauman stipulating that the guest house would be set back nine feet seven inches, as suggested by the Council. Councilman Balser withdrew his motion and Councilman Butterworth withdrew his second. Councilman Balser then ~ that the Council accept the recommendation of the Planning Commission and that Tentative Tract No. 28438 be approved subject to the conditions set forth above and the changes recommended by the Planning Department, and subject further to the condition that the proposed guest house on the property at 416 West Longden Avenue be set back nine feet seven inches from the property line. Councilman Reibold seconded the motion, which was carried unanimously. MOTION by Councilman Reibold that the Council accept the recommendation of the City Manager and the Director of Public Works and approve the agreement between the City and Engineering Science, Inc. for engineering service for the Orange Grove Reservoir. Councilman Balser seconded the motion. Discussion ensued upon Councilman Butterworth's statement that he '. wished to amend the motion and refer the matter back to staff in that in his opinion the agreement is ambiguous and substantially deficient. Tha although he had been informed that the firm in question was of high repu and would probably construe any doubt in favor of the City, that inasmuch as the agreement is a form contract used for engineering purposes, ,there should be some improvements. That it should contain a "hold harmless" clause and that items 1 and 2 should contain provision for control by the City on expenses to be incurred. Councilman Butterworth then MOVED that the above motion be tabled and the contract referred back to staff for changes as to form. Councilman Turner seconded the motion. 4. 5-21-63 15:6001 I Upon Councilman Reibold ~tating that he di4 not think a motion can be amended that completely changes the meaning which is the intent of the motion; that it would seem more proper to vote on the motion as made and then move to refer it back to staff or to table it, Councilman Butterworth stated that he would yield to Councilman Reibold's wish, and that the first motion he would make is'to table the motion, adding that he did not want his motion to be construed as dissatisfaction with either the firm or with the substance of the contract. That he would then MOVE that it be referred back to staff, and change his motion to one of tabling if the second would agree to the change. Councilman Turner stated that he agreed and would second the motion. The City Manager advised, in answer to Mayor, Phillips, that the delay would not materially affect the subject matter. Mayor Phillips inquired of the City Attorney if he construed the remarks made by Councilman Butterworth prior to the motion to table to mean minor or substantial changes in the agreement and the City Attorney replied that he thought he meant wording rather than detail. Councilman Butterworth added that he thought the rorm was deficient, particularly so if it is to be used as a model form for other engineering firms with whom the City deals; that he meant the matters agreed upon between the contracting parties. He also explained the meaning of a "hold harmless" clause as one wherein one person agrees to indemnify and hold harmless another from any claim that arises out of injury to a third party; that although he understood this was an architectural agreement he thought the hold harmless clause was valuable where somebody else is doing the work. In answer to the City Attorney's request for further clarification of Council's intent regarding items 1 and 2, whether specifics are to be inserted or to be negotiated with the prospective engineering firm before the contract is redrafted, Councilman Butterworth replied that his thinking would be that the drafting should be done after consultation with the City Manager and the Director of Public Works; that under items 1 and 2 there should be some control by the City as to expenses to be incurred and some kind of an estimate asked for and submitted to the City for approval. The motion to table was then carried unanimously. Councilman Butterworth then MOVED that the contract be resubmitted to staff and in particular to the City Attorney with the request that it be changed as to form along the lines of discussion at this meeting, plus any other changes the City Attorney daemed to be in the best interests of the City. Councilman Turner seconded the motion which was carried unanimously. BUILDING PERMIT I (A & A Building Material Co.) (F:899) Considerable discussion ensued regarding the request of A & A Building Material Company to enlarge their storage space by construction of a 5350 square foot building at the intersection of St. Joseph and Front Streets. It was stated that this property is in the moratorium section and the area envisioned by the Planning Consultants for quality merchandise retail shops, a cultural center and selected office build- ings; that the proposed building and its use would not be compatible with the development proposed by the Consultants and could serve as a deterent to such development; that the Planning Department recommends the denial of the application. Councilman Turner pointed out that the company has a ten year lease on the property and that their plans would not delay the total aspect; that if the application is not approved the present building and use may remain for ten years. That he did not believe the proposed improve- ment would deteriorate the plan in that this is not a critical area; that he would request the Consultants to submit a staging of overall development. 5. 5-21-63 BUILDING PERMIT (Ass is tance League) (F:899) BUILDING PERMIT (Nicholson) (F:899) 1963-64 GAS TAX ENGINEERING FUND RESOLUTION NO. 3593 15:6002 The City Attorney commented that any deviation from the Plan will delay accomplishment of the overall plan and that in his opinion more will be gained by the Council fixing its criteria and then strictly adhering thereto. MOTION by Councilman Balser, seconded by Councilman Butterworth and carried unanimously, with the exception of Councilman Turner who voted "No", that the application of the' A and A Building Material Company for a building permit to build a concrete block building at the inter- section of St. Joseph and Front Streets, parallel to the Santa Fe track, be denied. Recommendation of Planning Department that request to allow construction of new addition to the Assistance League building at 100 South Santa I Anita Avenue be granted subject to the condition that ,complete working drawings in substantial compliance with the submitted plot plan and rendering be submitted and approved by the Planning Department, the use of the property for the purpose of assisting the senior citizen portion of Arcadia's population being appropriate and compatible with those uses contemplated by the Consultants. MOTION by Councilman Reibold, seconded by Councilman Butterworth and carried unanimously with the exception of Councilman Turner who voted "No", that the Council approve the Central Area Plan as to this specific property and approve the proposals as meeting the criteria, use and design set forth in the plan subject to the further condition that the final plans be submitted for the approval of the Planning Department. Request of Ben Nicholson for relief from the moratorium placed on construction in the downtown area and for a building permit for the construction of an eight unit apartment building on the southwest corner of Bonita Street and Second Avenue (166 Bonita Street). It was stated that the development is proposed in the area designated by the Central Area Consultants as Medium Rise Residential and that assuming this designation to mean four stories, that it may be an economic error to construct two ,story apartments; that the developer should be made aware of the property's full potential. Councilman Turner MOVED that the Council approve the Central Area Plan as to this specific piece of property and approve the plan as meeting the criteria and uses specified in the plan for that area. Councilman Balser seconded the motion which was carried unanimously. It being the consensus of the Council that the budget submitted by the Director of Public Works for the 1963-64 fiscal year pursuant to the master agreement for expenditures of Section 2107.5 of the Streets and Highways Code, Gas Tax Fund for Engineering, the City Attorney presented, explained the content and read the title of Resolution No. 3193, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADOPTING BUDGET FOR EXPENDITURE OF GAS TAX ALLOCATION FOR MAJOR CITY STREETS FOR 1963-64." I MOTION by Councilman Balser, seconded by Councilman Reibold and carried on roll call vote as follows that the reading of the full body of Resolution No. 3593 be waived: AYES: Councilmen Balser, Butterworth, Reibold, Turner, Phillips NOES: None ABSENT: None Councilman Balser further ~ that Resolution No. 3593 be adopted. Schien, former owner of an apartment unit located at 1148 West Huntington Drive, this being 757. of the unused portion of the license fee paid by Mrs. Schien and a new license having been issued to the present owner: AYES: Councilmen Balser, Butterworth, Reibold, Turner, Phillips NOES: None ABSENT: None The suggestion of Councilman Balser that routine refunds such as the above be processed through staff rather than the Council, with the right of appeal to the Council, was well take~ by the Council and the City Attorney was requested to prepare the necessary amendment to the business license'ordinance. Brief discussion ensued regarding Councilman Turner's comment that he did not favor a sign indicating a swimming pool on the premises being posted on the gate as this might tend to alert uninvited persons of the existence of a pool on the premises. Councilman Butterworth was excused from further attendance at this Council meeting. 11. 5-21-63 15:6008 AUDIENCE PARTICIPATION Mr. Luben Ba1abanoff, 1625 South Second Avenue addressed the Council and expressed appreciation for Council's aid in the expediting of arrangements for the opening of his nursery school at 716 West Huntington Drive in the near future, adding that he hoped the Council would attend the official opening. Mr. John Delcamp, 2770 Yorkshire Road, addressed the Council and requested its sentiments regarding the installation of a nursery school in areas zoned R-O. Mayor Phillips advised him that such a request should first go through regular channels, such as the Planning Commission for its recommendation and then before the Council; that for the Council to t express any opinion at this time might be construed as prejudging the matter; however, that it was his personal opinion that such a request fo Zone R-O would not be regarded favorably. Councilman Balser stated that he agreed with Mayor Phillips. MATTERS FROM CITY OFFICIALS TECHNICAL COMMITTEE REpORT DUARTE ROAD PROPERTY (1": 820) BUILDING REMOVAL REPORT REQUEST COMMUNITY REDEVELOPMENT BILL COMMUNICATION (nre Dept.) ADJOURNMENT The Planning Director advised that the final report of the Technical Committee on construction of multiple units would be submitted to the Council prior to the next Council meeting. The City Manager had displayed for Council's information a sketch prepared by the Senior Planner showing the City owned property on Duarte Road adjacent to the library, outlining the parking lots, and that portion of the property proposed for the construction of the Masonic Lodge and the Lutheran Church. He indicated that parking facilities were proposed to be constructed so that access may be obtained from the church and the lodge into the parking lot and out on Santa Anita Avenue thus relieving the turning movement on Duarte Road. The Council expressed approval of the general arrangement. Councilmen Balser commented on a matter that he had mentioned some time ago regarding the removal of buildings of such character as to be detrimental to an area and requested a staff report on same. Mayor Phillips requested the City Attorney to submit a resume of the bill before the Legislature on the Community Redevelopment Act and of the pending legislative bill affecting the same. Mayor Phillips read a communication from the State Compensation Insurance Fund to Fire Chief Way commending the Arcadia Fire Department on its perfect safety record. At 10:55 P.M.
