CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR-MEETING
AUGUST 20, 1963
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8:00 P.M., August 20, 1963.
The Invocation was offered by Rev; Walter F. Danneman, Pastor of the
American Lutheran Church.

MOTION by Councilman Reibold, seconded by Councilman Balser and carried
that the Minutes of August 6, 1963 be approved as submitted in writing.
Councilman Turner abstained because of his absence at said meeting.
The minutes of the meeting of June 18, 1963, at which Councilmen Balser,
Reibold and Turner were present were approved on MOTION of Councilman
Turner, seconded by Councilman Reibold, and carried, with Councilman
Butterworth and Mayor Phillips abstaining due to their absence from
said meeting.
Communication was received and recorded from Robert R. Stevens, Attorney
for Mike T. Vallone, requesting continuance of the hearing scheduled for
this date on his appeal from the Planning Commission recommendation for
denial for a zone variance permitting construction of an eight story
apartment building on property located at 614-642 West Huntington Drive.
The applicant desired continuation until September 17, 1963.
Inasmuch as the public hearing was scheduled for this date, Mayor Phillips
inquired if anyone in the audience desired to address Council on the
matter. No one desiring so to do, Councilman Balser MOVED that the public
hearing be continued until September 17, 1963 at 8:00 P.M. Councilman
Turner seconded the motion which was carried unanimously.
Mayor Phillips declared the hearing open on Planning Commission Resolution
No. 488 recommending the amendment of the Municipal Code by prohibiting
the construction of more than one dwelling on lots in Zone R-l and called
for any communications pertinent to the matter.
A communication was read into the record by the City Clerk from Lillian
W. Brown, 431 W. Walnut Avenue, requesting consideration for owners of
property such as she owns. Said property being surrounded by multiple
development, and meeting the present requirements for such improvement.
Planning Director, Mr. Phelps, summarized steps leading to the recommenda-
tion of the Planning Commission, including statistics of areas which have
more than one house. Concentration of such improvement being primarily
in the southeast section of the City. Photographs were reviewed on the
visual screen and discussion was held on the various areas.

Mayor Phillips then inquired if anyone in the audience desired to speak
to the matter.
Mrs. Vincent A. Wirth, 2001 Bella Vista Avenue, stated in part that her
property is entirely landlocked as far as development by subdividing is
concerned. That the only improvement available for her would be by the
construction of a second house. Her property being 80' x 300' deep. She
was not in favor of the proposed regulation.
Mr. Herbert Miller, 1025 El Sur Avenue, stated in part that his property
was in an area where a second dwelling is presently permitted and that lh
the new regulation this privilege would be denied him. He opposed any
legislation to preclude such privilege. Planning Director presented Mr
Miller with a diagram.
It was brought out that the proposed regulation would provide for oppor-
tunities through variance requests for consideration of hardship cases.
Mrs. Edith Dunn, 101 W. Palm Drive, stated in part that a subdivision is
in the process of development adjacent to her property which would create
one of the conditions necessary to obtain permit for construction of a
second dwelling; that it would result in qualifying her property for a
second dwelling under the present regulation; that the proposed change
would preclude her from this privilege. She opposed the amendment to the
Code as recommended by the Planning Commission.
No one else desiring to be heard, Councilman Butterworth MOVED that the
hearing be closed. Councilman Reibold seconded the motion-;hich was
carried \nanimously.
The enactment of legislation under Ordinance No. 990 was reviewed. This
Ordinance was later repealed and Ordinance No. 1060 was adopted.
It was brought out that conditions within the City have changed materially
since such adoption. It was also stated that there were on the average
about four second dwellings constructed annually since 1957; that the trend
of combining deep lots and developing them into 7500 square foot lots with
residences in the $35,000 bracket had seemed to prevail during this time;
that in the opinion of the Planning Commission this latter type of develop-
ment was more to be desired than the placing of a second structure on the
rear of a property already developed.
Councilman Reibold then MOVED that the Council sustain the Planning
Commission recommendation and that the Municipal Code be amended to prohibit
the construction of second dwellings on lots in R-l zone and that the City
Attorney be instructed to prepare the necessary ordinance to effect such
change. Councilman Turner seconded the motion, which was carried on roll
call vote as follows:

Mayor Phillips declared the hearing open on the weed abatement program
for 1963-64 and stated that this is the time and place to hear and consider
all objections to the proposed removal of weeds, rubbish and refuse from
lots in the City in accordance with provisions of Resolution No, 3608.

Mrs. Vincent A. Wirth, 2001 Bella Vista Avenue, stated in part that she had
received notice and asked for clarification of fees specified therein; that
she would welcome the contractor doing ~he work for the price indicated;
that she had a deep lot which was impossible to enter with a tractor; that
it was waste land as far as use is concerned.

The City Attorney advised that the Contractor could be contacted directly
and that if the adjacent property owners were so inclined an arrangement
could be made to clear several lots and perhaps a special price could be
obtained; that Mrs. Wirth could follow this suggestion if she so desired.
It was brought out that if the work could be done by machine mowing the
cost would be adjusted accordingly. "
Raymond C. Spoelstra, 220 W. Lemon Avenue, stated in part that his property
contained many fine plants, camellias, orchids, etc., and that he had sold
the rear of his property to a subdivider and that this section was the
property needing' to be cleared; that he would like the matter to be checked
so that he would not be charged for such work. He was advised that this
would be done.
Mrs. Edith Dunn, 101 W. Palm Drive, inquired as to the responsibility of
maintaining the one foot strip and the parkway on the new subdivision cre-
ated west and north of her property on 20 West Palm Drive. She was advised
that the subdivider would be responsible for 'the one foot strip.
No one else desiring to be heard, Councilman Balser ~ that the public
hearing be closed; Councilman Turner seconded the motion which was carried
unanimously. ' ,
Councilman Balser further MOVED that the Superintendent so designated by
Resolution No. 3608, proceed with the work pursuant to the Weed Abatement
Act and in accordance with Resolution of Int~ntion No. 3608. Councilman
Butterworth !econqed the motion which was carried unanimously.
Property located west of Tenth Avenue, north of Camino Real, consisting of
14 lots to become known as Linda Way.
Planning Commission recommendation for APPROVAL of the final map, subject
to the following conditions:
1. Install all standard street improvements required by the
subdivision ordinance. Improvements, grades and drainage shall
be to tqe satisfaction of the Director of Public Works.
2. Provide all easements required for rear line utilities.

3. Remove all trees and structures from the street-right-of-way. No
driveway shall be in curb returns.
4. Remove all structures and buildings within or across the tract
boundary. These removals or relocations shall comply to all City
Ordinances, Codes and regulations, and be done to the satisfaction
of the Department of Public Works. The house will be removed from
1323 Sotith Tenth Avenue. :
5. Dedication of street 60 feet wide, or 5 foot planting and, sidewalk

The final map being in conformance with the approved tentative map,
was ~ by Councilman Balser, seconded by Councilman Turner, that
final map of Tract No. 27992 be approved, subject to the specified
conditions.
That the City Clerk be and she is hereby authorized and directed to se
in due form such approval and acceptance on said map and to affix ther 0
the Corporate Seal of the City of Arcadia and to certify to the adoption
and passage of a Minute Order at such time as there shall be deposited
with the City of Arcadia a good and sufficient Surety Bond guaranteeing
,certain improvements in said Tract No. 27992, pursuant to Section 9114
. of the Arcadia Municipal Code,
Further discussion was held on the house plans and locations which had
been submitted directly to the Planning Commission. It was noted that
several plans encroached within the 25 foot rear yard requirement. The
City Attorney advised that the proper procedure would have been to submit
said plans and locations to the Modification Committee and not to the
Planning Commission, and particularly that notice to adjoining property
owners must be given or waivers of notice obtained from them before such
modifications can properly be granted. It being the consensus of the
Council that City requirements must be adhered to and that plans and
locations must be submitted to the Modification Committee, it was MOVED
by Councilman Balser, seconded by Councilman Turner and unanimously
carried that the house plans and locations which encroached into rear
yards within the Tract be disapproved.
Mayor Phillips declared that since no action can be taken on these two
matters until time for appeal elapses, the zone variance applications
filed for the construction of the Masonic Temple on the south side of
Duarte Road west of Santa Anita Avenue (in accordance with Planning
Commission Resolution No. 493) and for the construction of an eight story
office building on the southwest corner of First Avenue and Wheeler
Street in accordance with Planning Commission Resolution No. 494 will be
held over until the Council meeting of September 3, 1963 and the matters
will appear on said agenda.
MOTION by Councilman Reibold, seconded by Councilman Turner, and carried
unanimously, that permission be granted to the American Association of
University Women, Arcadia Branch, to hold its Fifth Annual Festive Far
at the Los Angeles Turf Club on November 7, 1963 from 10 A.M., until
9 P.M.
MOTION by Councilman Turner, seconded by Councilman Reibold and carri
unanimously that boulevard stop signs be authorized for installation a
1) First Avenue at Tindalo Road; and 2) Floral Avenue at Tindalo Road.
The City Manager explained traffic patterns in said area in answer to
inquiry by Councilman Turner.
Upon recommendation of the City Manager, MOTION by Councilman Balser,
seconded by Councilman Reibold and carried on roll call vote as follows,
by Resolution the City Council approve the City's contribution to Job
No. 277 to be $8,363.00 and that the sum of $5,700.00 be transferred

(JOB NO. 277)."

on roll call vote as follows that the reading of the full body of Resolu-

Councilman Balser~, seconded by Councilman Reibold and carried unan-
imously that the recommendation of the City Manager and the Director of
Public Works that the plans and specifications for the following two
projects be approved and that the City Clerk be authorized to advertise
for bids for said'work after receipt of State Division of Highways' appro-
val:
1. Job No. 278 - widening of Duarte Road from Holly to Baldwin
Avenue;
2. Traffic Signals and Safety lighting - Holly Avenue and Duarte
Road, Santa Anita Avenue and Diamond Street and Las Tunas Drive
and El. Monte Avenue.
The recommendation reflected the inclusion of an 8 foot sidewalk to be
constructed alo~g the south side of Duarte Road along the Holly Avenue
School property. Said sidewalk to be financed from City Capital Projects
Fund.
MOTION by Councilman Reibold, seconded by Councilman Balser and carried
unanimously that the request of Melvin Kaiser for an alteration permit
to allow the installation of glass doors in the existing building at
306 South First Avenue be granted.
The City Manager advised that one of the conditions in the granting of
the variance request for Motel 6 at 225 Colorado Place was the relocation
of an existing sewer main and easement; that an executed Grant of Easement
for the relocated sewer had been received. Upon his recommendation MOTION
was made by Councilman Balser, seconded by Councilman Turner and carried
unanimously that the Mayor and City Clerk execute a Quit Claim Deed of
the former sewer easement, in form approved by the City Attorney.

Councilman Reibold MOVED that the recommendation of the City Manager
and the Purchasing Officer be accepted; that a 14 month contract for
uniform rental service be awarded to ATLAS COVERALL AND UNIFORM SUPPLY
COMPANY in the amount of $6,538.00 for the 14 months. The 1963-64 Budget
reflects $5,823.00 for the rental service for 12 months. That all other
bids be rejected. Said contract to be in form approved by the City
Attorney,

Referring to a request received from the West Arcadia Business and
Professional Association for signalization of crosswalk at 1271 South
Baldwin Avenue, the City Manager summarized accidents occurring in thel
subject area, the approximate number of vehicles the area carries dail
the results of a signal study made involving 16 major city street inte
sections. Comparison of cost of types of signalization under consider
ation was also explored.

1. The elimination of an additional parking stall each direction
from the subject crosswalk (midway between Duarte Road and
Naomi Avenue on Baldwin Avenue). This would increase visibility
until the following improvement could be completed.
2. Signalization at the intersection of Naomi and Baldwin Avenues.
Said installation would allow for the control of traffic and the
proper platooning and coordination of signals along Baldwin
Avenue, which would result in breaks in traffic sufficient to
allow the safer movement of pedestrians.
3. Removal of the present mid-block crosswalk at 1271 South Baldwin
Avenue concurrent with the installation of traffic signals as
recommended in Item No.2.
Discussion was held and the following persons addressed Council on the
matter:
James Weiss, representing West Arcadia Business and Professional
Association, favored Item Nos. 1 and 2 but not Item No.3.
Don Eckhart, Assistant Manager of the West Arcadia Branch of the Bank
of America, did not favor the removal of the mid-block crosswalk.
David Barron, Barron's Pharmacy and Drug Store in West Arcadia, was
of the opinion that a cross-walk at the subject area increases accidents
and favored a signal at Naomi Avenue.
Edward Reigle, 631 Fairview Avenue, inquired as to the possibility
of a traffic signal installation at Baldwin and Fairview Avenues. The
Director of Public Works informed Mr.Reigle that it is a scheduled item,
probably in 1965. Mr. Reigle opposed elimination of the crosswalk and
favored signalization at Naomi Avenue.
It being the consensus of the City Council that improvement of the area
was indicated, Councilman Reibold ~ that the recommendations of the
City Manager be approved as contained in Item Nos. 1 and 2 with the
elimination of Item No.3. Motion seconded by Councilman Turner and
carried unanimously.
MOTION by Councilman Balser, seconded by Councilman Turner and carried
on roll call vote as follows, that the recommendation of the City Manager
for the retention of Mr. James E. Carroll for the purpose of conducting
a sales tax study of the records in Sacramento for the City be accepted.
That the sum of $550.00 be appropriated for said review. The study is
estimated to be completed within three weeks at which time a report will
be submitted.

MOTION by Councilman Balser, seconded by Councilman Turner and carried
unanimously that the request of T. H. Summers and Associates, Realtors,
118 South First Avenue, be granted and that an occupancy permit be
issued to him for the business of real estate.
MOTION by Councilman Reibold, seconded by Councilman Butterworth and
carried unanimously that the recommendation of the City Manager and
Police Chief be accepted and that boulevard stop signs be installed at
Highland Oaks Avenue, at Orange Grove and at Highland Oaks Avenue at
Doshier Avenue.
The City Manager cited violations occurring in said area. Discussion
was held on future installation of stop signs at Santa Anita and Orange
Grove Avenues and at Santa Anita and Sierra Madre Avenues.
Acknowledgment of communication received from Emmett E. Patten attorney
for Joseph Gallal who is seeking reconsideration of the denial of his
application for the operation of a billiard hall at 1025 South Baldwin
Avenue. Said matter was before Council on June 4, 1963 at which time the
request was denied.
Mr. Patten addressed Council reiterating the request as contained in said
communication. He stated in part that it was the desire of his client,
Mr. Gallal, to be permitted to appear before Council again, as he felt he
was not fully prepared to make an adequate presentation of all facts con-
cerning the proposed operation of said business at the Council meeting of
June 4, 1963.

Councilmen Butterworth and Turner were in favor of granting the request
for reconsideration. Mayor Phillips and Councilmen Balser were of the
opinion that nothing would be gained in such event.
Councilman Reibold then MOVED that the request for reconsideration be
denied. MOTION seconded by Councilman Balser and carried on roll call
vote as follows:

of Resolution No. 3611, entitled:"A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA, ACCEPTING THE IMPOSITION OF ADDITIONAL
HIGHWAY USERS TAXES AND FEES PURSUANT TO CHAPTER 1852, STATUTES OF 1963".

The City Attorney presented and explained the content and purpose
of a recommended amendment to the contract entered into with the con-
tractor for weed abatement and recommended its execution. The original
contract made no provision for the machine mowing of weeds on improved
property and parkways and whereas said removal by machine mowing is
advantageous to City and Contractor, as well as to members of the public.
Councilman Reibold ~ that said amendment be approved and that the
Mayor and City:Clerk be authorized to execute same in form approved by
the City Attorney. Motion-seconded by Councilman Balser and carried
unanimously.

The City Attorney presented, explained the content and read the title
of Ordinance No. 1221 entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, AMENDING DIVISION 2 OF PART 5 OF CHAPTER 2
OF ARTICLE 9 OF THE ARCADIA MUNICIPAL CODE BY REPEALING SECTIONS 9252.2.1'
AND 9252.2.17 AND BY AMENDING SECTIONS 9252.2.16 AND 9252.2.18 THEREOF.

on roll call vote as follows that the reading of the full body of
Ordinance No. 1221 be waived:

AUDIENCE PARTICIPATION:
Mr. Ralph Stogsdill, 547 Workman Avenue, addressed Council to the matter
of a three story medical building which he anticipates seeking per-
mission to construct in the future on Las Tunas Drive as it relates to
consideration currently being given high rise construction in the City.
Mr; Stogsdill was advised that a Height District Study is currently before
the Planning Commission with no determination being made to date. Inter-
est was evidenced in the rendering displayed by Mr. Stogsdill; however,
no further discussion of the matter could be held inasmuch as the entire
matter of high rise buildings is in study stage at this time. Suggestion
was made that Mr. Stogsdill keep in touch with the Planning Director.

Councilman Turner was welcomed back to the Council table, after being
absent for vacation.
SWIMMING
MEET
Councilman Reibold stated in part that on Saturday morning, August 24,
1963, a competitive swimming meet would be held in El Monte under the
sponsorship of the California Municipal Pools; that Arcadia would be
represented by its 28 top swimming winners in local contests.
MOTION by Councilman Reibold, seconded by Councilman Turner, and
unanimously carried, that congratulations be directed to the Event
Officials with the wish that it will become an annual event.
LIBRARY
Councilman Reibold, in following up a statement made at previous meeting
relative to the Library controversy, stated in part that he had prepared
two ordinance proposals, 1) either to make the Library Board elective
or, 2) providing in substance for a referendum on the closed shelf as
well as to provide that the decisions of the Library Board be made
subject to review by the City Council. He thereupon handed each counCI
man copies of said proposed ordinances and asked that they be studied
and reviewed at such time as is proper.
Mayor Phillips stated that the public had already been informed that i
and when this matter becomes an agenda item it will be publicly announced
through the press.

Mayor Phillips appointed a committee to work with the West Arcadia
Business and Professional Association in reviewing the regulation
governing door-to-door distribution of advertising materials.
Councilmen Reibold and Turner, the City Manager and the City Attorney were
the appointees. A meeting to be arranged with a report back to the City
Council.
Mayor Phillips urged attendance at the forthcoming meeting of the
Independent Cities as the agenda for said meeting indicated it would
be of interest to the city officials. '.
At 10:25 P.M. the meeting adjourned into an executive session in the
Conference Room with the City Council, the City Manager and the City
Attorney in attendance.
At 11:30 P.M., the meeting reconvened and adjourned sine die.
