CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETIN~
SEPTEMBER 3, 1963
The City Council of the City of Arcadia met,in regular session in the
Council Chamber of the City Hall at 8:00 P.M., September 3, 1963.
The Invocation was offered by the Rev. John Toews, Pastor of the
Arcadia Christian Church.
The pledge of allegiance to the flag was let by Mayor Phillips.

MOTION by Councilman Reibold, seconded by Councilman Turner and carried
unanimously that the Minutes of August 20, 1963 as submitted in writing
be approved.

Mayor Phillips declared the hearing open on the application for business
permit filed by Edmond G. Ducommun, dba Graydon Industries, to allow the
installation and operation of amusement games at the Arcadia Bowl, 21
Morlan Place.
The applicant, Mr. Ducommun, addressed Council, stating in part that
five games of skill would be installed and operated at said location.
No one else desiring to 'address Council, MOTION was made by Councilman
Reibold, seconded by Co'~cilman Turner and unanimously carried that the
hearing be closed.
MOTION was then made by Councilman Reibold, seconded by Councilman Turner
and carried on roll call vote as follows that the application be approved
and that the requested business permit be granted.

Planning Commission Resolution No. 493 recommending approval of zone
variance application to permit the construction of a Masonic Temple on
the south side of Duarte Road west of Santa Anita Avenue. Mayor Phillips
summarized events leading to the present stage and contents of the
resolution discussed'at length.
MOTION by Councilman Turner, seconded by Councilman Reibold and unanimously
carried, that the recommendation of the Planning Commission be approved and
that the City Attorney present the appropriate resolution.
Whereupon the City Attorney presented, explained the content and read the
title of Resolution No. 3615, entitled: "A RESOLUTION OF THE CITY COUNCI~
OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE FOR THE
CONSTRUCTION AND MAINTENANCE OF A MASONIC TEMPLE ON PORTIONS OF LOTS 9
AND 10 OF TRACT NO. 6074 ON THE SOUTH SIDE OF DUARTE ROAD WEST OF SANTA
ANITA AVENUE IN SAID CITY."
Discussion held on the various sections contained therein, particularly
section 'j' referring to the requirement that the south 30 feet be offered
to the City for alley purposes accompanied by tender of deed for such
purposes but with no obligation on the part of the City to improve or

Planning Commission Resolution No. 494 recommending APPROVAL of zone
variance application to permit the construction of an eight story office
building on the southwest corner of First Avenue and Wheeler Street.
Conditions set forth in said resolution summarized by Assistant Planning
Director, Ernest Nayor.
Mr. Edward A. Heiss, residing at 2464 Canyon Road, and owner of said
property, addressed Council. Sufficient parking area possibilities
were discussed with Nr. Heiss stating in part that he would like to
join the City Parking District. Discussion held on in lieu payment,
provisions for same and the desirability of a.precise figure.
Although time is of the essence, the Councilmen and Nr. Heiss agreed
that the final determination of all factors could be delayed until the
return of the City Manager at which time it would be an agenda item
(September 17, 1963).
NOTION by Councilman Reibold, seconded by Councilman Turner and
unanimously carried that the zone variance application filed by
Edward A. and Lillian C. Heiss and recommended for approval by the
Planning Commission be continued until the Council meeting of September
17, 1963.
~lOTION by Councilman Turner, seconded by Councilman Reibo-ld and carried
unanimously that the request of the Les Burns Sales Company for a
business license at l44-D Santa Clara Street be granted.
NOTION by Councilman Reibold, seconded by Councilman Turner and carried
unanimously that the request of Jose O. Gonzales, dba Jose Drive-In,
433 N. First Avenue, be denied. The denial based on the recommendation
of the City Manager as a result of inspection by the Superintendent of
Building and Safety.

The said quotations include sales tax and a trade-in allowance for a
piston-type, portable compressor purchased by the City in 1950.
MOTION by Councilman Reibold, seconded by Councilman Turner, and carried
on roll call vote as follows that the purchase be made from the low bidder,

Councilman Reibold MOVED that the City Council award the Contract for said
work to the low bidder~ D & W Paving Company, in the amount of $54,916.82;
that all other bids be rejected and that any irregularities or informalities
in the bids or bidding process be waived and that the Mayor and City Clerk
be authorized to execute such contract on behalf of the City for the
performance of the contract and in the amount specified in form approved by
the City Attorney. Said project to be financed from State and County Gas Tax
Funds with the exception of an eight foot sidewalk adjacent to the Holly ;
Avenue School. Said sidewalk to be financed from City Capital Projects Fund

Following bids were received for the installation of traffic signals
at Duarte Road and Holly Avenue, Santa Anita Avenue and Diamond Street
and at Las Tunas Drive and El Monte Avenue. Said installation to be

MOTION by Councilman Reibold, seconded by Councilman Turner and carried
on roll call vpte as follows that the contract for the work be awarded to
the low bidder, Steiny and Mitchel, Inc., in the amount of $24,931.00
such award to be subject to written approval from the State Division of
Highways because of the excess of the bid over the approved estimate;
that all other bids be rejected and that any irregularities or informalities
in the bid or bidding process be waived and that the Mayor and City Clerk be
authorized to execute such contract on behalf of the City for the performance
of the contract and in the amount specified in form approved by the City
Attorney.

MOTION by Councilman Turner, seconded by Councilman Reibold and unanimously
carried, that the recommendation of the City Manager, City Controller and
Personnel Officer be accepted and that a 10% rate increase on renewal of the
Group Health and Accident Insurance for 1963-64 be approved. It was noted
that the increase will be necessary for the fiscal year commencing September
15, 1963 due to the number of sizeable claims paid during the past year.
The report reflecting results of the Department of Public Works' investigation
into the possibility of creating a tree planting program was reviewed. Said
report recommends that the program be inaugurated on a request basis, perform-
ing such work in locations from which the request emanates and continuing as
requests, work load and financing permits. The Director of Public Works
stated in part that for safety reasons, bricked-in tree wells would be used.
MOTION by Councilman Turner, seconded by Councilman Reibold and unanimously
carried that the program be instituted as set forth in said report.
Submission of preliminary report - Street Lighting- Santa Anita Village -
Street Lighting Act of 1919. Said installation was requested by petition
some time ago.
Report containing plans, cost estimates and diagrams necessary for the
institution of proceedings for the project. In accordance with City policy I
that street lighting systems be maintained and electrical energy be furnishe
for such systems, it was recommended that Lighting Maintenance District No.
20 be formed and that the owners of land within the area be assessed for a
portion of the costs of said system. Maintenance and Operation shall be
furnished for such system for a period from the date of formation to and
including January 31, 1966.
Upon MOTION by Councilman Turner, seconded by Councilman Reibold and carried
on roll call vote as follows, the report was accepted and the Director of
Public Works was instructed to proceed with the formation of Lighting
Maintenance District No. 20 and that the City pay for the installation of
four lights adjacent to the school property as well as 50% of the cost of
six intersection lights in accordance with City policy. Said installation
costs of $3,198.00 for the entire system to be charged to the Abatements
Receivable Account established for such purpose.

The City Manager advised that with the construction of the Santa Clara
Street extension from Santa Anita Avenue to Huntington Drive, certain ~,
excess lands remain south of the new street right of way; that the new ~
owners of the Arcadia Bowl, 21 Morlan Place, desire to purchase same in ~
the amount of $15,556.00 payable over a three year period at 6% interest,
the purchaser to have the right to pay any remaining balance at any time.
Terms of the agreement were discussed with Councilman Reibold stating in
part that the terms were satisfactory to the Land Committee.
MOTION BY Councilman Reibold, seconded by Councilman Turner and carried
on roll call vote as follows that the property be sold per terms as set
forth in the suggested agreement and that the Mayor and City Clerk be
authorized to execute such agreement, in form approved by ,~~ City Attorney.

Pursuant to Council direction, the Director of Public Works and the City
Manager advised that plans and specifications have been prepared for the
improvement of Huntington Drive by a center median strip from Santa Anita
Avenue to Second Avenue; that preliminary consent had been obtained from
the State Division of Highways to the effect that they will participate in
the costs of constructing a portion of said improvement. In addition, the
State will pay the cost'of installing curbs and breaking pavement and there
is a possibility that the State will also participate in the safety lighting
at the intersections of Santa Anita Avenue First Avenue and Second Avenue.
Estimate time for construction being 45 days excluding beautification.
MOTION was made by Councilman Turner, seconded by Councilman Reibold and
unanimously carried that the City Council authorize the City Clerk to
advertise for bids for said construction at such time as the necessary,
approval is received from the State Division of Highways.
Mayor Phillips reviewed the report submitted by the City Manager recommending
an increase in the water rate; he summarized events leading to the present
need for legislation, commenting that the City Council and the Water Board
had thoroughly reviewed all reports prior to the time the matter of annexing
the Upper San Gabriel Valley Water District to the Metropolitan Water District
was placed before the electorate on March 12, 1963. At that time the voters
of Arcadia, by a 7 to 1 majority, voted favorably on the question. One of
the considerations being the method of payment to the Metropolitan Water
District of the charges. The City Council, prior to said election declared
its intention to pay all or part of its obligation by increasing the water
rate rather than levying a tax on property.
Said report contained schedule of dates for making payments, projected
Metropolitan Water District tax rates and payments, water rate increase
computations together with an addendum to the report containing
recommendations for the proposed rate increase for lands within the City
not served by the Water Department and also lands outside the City and
served by the Water Department.

The report recommended an increase in the water rate of 6~ per hundred
cubic feet over the minimum and that the minimum rate be increased 25~
per month for domestic use. The increase to be effective November I, 1963.
Councilman Reibold stated in part that he appreciated the Manager's
recommendation but that he was of the opinion that an increase of 6~ per
hundred cubic feet over the minimum would be sufficient, recognizing that
in the early years the City would have to divert some portion of capital
projects money to make up the difference, however, the City was well on
schedule as far as implementing the Montgomery Report. _He stated further
that a sample check of minimum users indicated that during the summer
months everyone used more than the minimum and during the winter something
in the order of 9% of the people used only the minimum, therefore, in his
opinion to increase the minimum charge was not too significant.

Further discussion ensued between the Council, City Manager pro tempore,
Water Superintendent and the City Controller, after which Councilman
Reibold MOVED that the water rate be increased by 6~ per hundred cubic
feet for that amount over the minimum within the City and 9~ per hundred
cubic feet for that amount over the minimum outside the City.

The City Attorney advised that the Superintendent of Weed Abatement, as
appointed by the City Council, had filed and posted as required by the
Weed abatement Act, his report of the cost of assessments for said
abatement and that the City Council would now consider and take action
thereon. The Mayor declared open the hearing on said report and asked if
anyone wanted to be heard in connection therewith. No one desiring to be
heard on the matter, Councilman Reibold MOVED that the hearing be closed.
Councilman Turner seconded the motion which was unanimously carried.

,At the request of Councilman Turner, Mayor Phillips advised the Masonic
Temple officials who were in the audience of the favorable action taken
earlier in the evening on the Masonic Temple Variance Application.
Councilman Turner referred to a communication from the City Manager dated
June 24, 1963 in which a recommendation was made that all future public
and semi public buildings include a civil defense shelter area; he in-
quired whether or not it would be advisable or proper for the City Council
to recommend the inclusion of such a shelter in the,basement or the proposed
building after being informed by the Planning Department representative that
to his knowledge no such plan had been incl~ded. Additional costs and the
fact that this would not be a public building per se were-discussed with
the consensus being _ that ,the Masonic Temple .repr,esenta_t~v.es:,wo,uld probably
explore the possibility at a later date now that "it, had. been 'brought to
their attention.
Councilman Turner commented that on behalf of a neighbor of Councilman
Butterworth he would inquire as to what steps could be taken to alleviate
the traffic hazard now existing at the westerly end of Singing Wood Drive,
calling attention specifically to the sharp curves and suggesting some
type of notice to drivers of the hazard. Discussion brought out the fact
that the curbs had been painted and advance warning signs had been posted
in the area approximately two years ago; that same had to be removed on
request of the residents; that reflectors had also been tried to no avail.
The Director of Public Works stated in part that his department would once
more endeavor to remedy the situation.
The City Attorney, presented, explained the content and read the title of
Ordinance No. 1218 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ARCADIA, CALIFORNIA, AMENDING SECTIONS 7531.1.1, 7531.1.3, 7531.2 AND
7531. 2. 2 OF THE ARCADIA MUNICIPAL CODE WITH RESPECT TO WATER RATES. "

Mayor Phillips urged attendance at the forthcoming seminar to be held
on Catalina Island September 21 and 22, 1963; that same appeared to be
of vital importance to independent cities.
Mayor Phillips advised of the receipt of a Notice from the Assembly
Judiciary Committee regarding Hearings to be held October 30 and 31.
1963 on court reorganization in Los Angeles County. Same was presented
to the City Attorney to review the notice and advise Council should any
action need to be taken by the City.
At 9:10 P.M. the meeting adjourned.
