The invocation was offered by Mr. Maurice Meredith, Pastor of the Arcadia Church of Christ. Mayor Phillips led in the Pledge of Allegiance. PRESENT: ABSENT: Councilmen Balser, Butterworth, Turner and Mayor Phillips Councilman Reibold Approval of the Minutes of the Regular Meeting of September 3, 1963 was postponed until the return of Councilman Reibold. Mayor Phillips announced that this is the time and place for hearing protests or objections against the assessment for the improvement of Altura Road and other streets by the installation of street lights. Mayor Phillips inquired of the City Clerk if she had the following affidavits: Affidavit of publication, Affidavit of Posting, Affidavit of Mailing. The City Clerk replied in the affirmative. MOTION by Councilman Butterworth, seconded by Councilman Turner and carried unanimously that the affidavits be received and filed. Mayor Phillips then inquired of the City Clerk if she had received any written protests, to which she replied in the negative. Mayor Phillips then inquired if anyone in the audience desired to address Council to the matter. Mr. James T. Rostron, 422 Monte Vista Road, expressed appreciation on behalf of the unlighted portion of the Rancho Santa Anita District and himself for the full support and cooperation of the City Staff for said installation. No one else desiring to be heard, MOTION by Councilman Butterworth, seconded by Councilman Balser and carried on roll call vote as follows that the hearing be closed: AYES: NOES: ABSENT: Councilman Balser, Butterworth, Turner and Phillips None Councilman Reibold The City Attorney then presented, explained the content and read the title of Resolution No. 3617, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF ALTURA ROAD AND OTHER STREEtS (JOB NO. 277)". MOTION by Councilman Turner, seconded by Councilman Balser and carried on roll call vote as follows that the reading of the full body of Resolution No. 3617 be waived: AYES: NOES: ABSENT: Councilman Balser, Butterworth, Turner and Phillips None Councilman Reibold 1. 9-17-63 VARIANCE (Vallone) (F:991) VARIANCE (Heiss) (F:7D3) 15:6095 MOTION by Councilman Turner, seconded by Councilman Balser and carried on roll call vote a.s follows that Resolution No. 3617 be adopted. AYES: NOES ABSENT: Councilmen Balser, Butterworth, Turner and Phillips None Councilman Reibold Mayor Phillips declared open the hearing and inquired if anyone desired to speak on the ~one variance application filed with the Planning Commission by Mike Vallone for permission to construct an eight story apartment building at 614 - 642 West Huntington Drive. Said application was recommended for denial by the Planning Commission Resolution No. 436 and such denial subsequently appealed by applicant. 1 No one desiring to be heard Mayor Phillips stated in part that in view of the forthcoming review, study and recommendations to be made by the Planning Commission pertaining to possible special height district ~ones and regulations, it would appear to be appropLiate to continue this hearing to a future date. The applicant concurred and it was then MOVED by Councilman Balser, seconded by Councilman Butterworth and unanimously carried that the Hearing be continued until NOVEMBER 19, 1963 at 3:00 P.M. Planning Commission Resolution No. 494 recommending APPROVAL of ~one variance application filed by Edward A. and Lillian C. Heiss to permit the construction of an eight story office building on the southwest corner of First Avenue and Wheeler Street. Recommendations and conditions contained in said resolution meeting with the approval of the City Council with the exception of the parking phase, the City Manager read and recommended for approval an amendment to said resolution: Paragraph H Section 4, pertaining to required off street parking. The applicant, Mr. Heiss, having read the amendment, indicated agreement to the wording. Discussion held on parking districts, control by the Parking Place Commission on said districts, in lieu payments, and the fact that the specific plans are yet to be approved by the City Council. Council agreed that the amendment as prepared and recommended by staff is specific in wording, that this appeared to be the best solution, and that the conditions of the variance as contained in the resolution fulfill the City's portion of the agreement on the sale of the old library site. MOTION was then made by Councilman Turner, seconded by Councilman Balser and carried unanimously that Planning Commission Resolution No. 494 be approved with the amendment of Paragraph H Section 4 read by the City Manager, that the variance be granted subject to conditions contained therein. Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 3616 entitled: "A RESOLUTION OF THE CITY 1 COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE FOR THE CONSTRUCTION OF AN EIGHT STORY OFFICE BUILDING ON THE SOUTHWEST CORNER OF FIRST AVENUE AND WHEELER STREET IN THE CITY OF ARCADIA." MOTION by Councilman Butterworth, seconded by Councilman Turner and carried on roll call vote as follows that the reading of the full body of Resolution No. 3616 be waived: AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Turner and Phillips None Councilman Reibold MOTION by Councilman Butterworth, seconded by Councilman TU1'ner and carried on roll call vote as follows that Resolution No. 3616 be adopted: 2. 9-17-63 ZONE CHANGE 1 TRACT NO. 23623 (Final) (F:992) 1 15:6096 AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Turner and Phillips None Councilman Reibold. MOTION by Councilman Balser, seconded by Councilman Butterworth and unanimously carried, that the Hearing on Planning Commission Resolution No. 495 recommending a zone change to create "Zone H" providing for special height district zones and regulations, be scheduled for October 1, 1963 at 3:00 P.M. MOTION by Councilman Balser, seconded by Councilman Butterworth and unanimously carried that the final map of Tract No. 23623 (property located south of Palm Drive west of Santa Anita Avenue) be approved subject to the following conditions: 1. A covenant, in form approved by the City Attorney, shall be recorded agreeing that for purposes of Article IX of the Arcadia Municipal Code the exterior boundary line of said tract shall constitute the rear lot lines of Lot 7. 2. Prior to recordation of the final map a plan showing the size, shape and location of the houses on these newly created lots shall be submitted for approval by the Planning Department. 3. Houses on Lots 1, 12 and 13 shall front on Santa Anita Avenue. The setback shall be not less than 25 feet. 4. House on Lot 9 shall front on Palm Drive and have minimum setback of 25 feet. 5. Install all standard street improvements required by the subdivision ordinance. Improvements, grades and drainage shall be to the satisfaction of the Director of Public Works. No additional median openings will be allowed in Santa Anita Avenue. 6. Provide all easements required for rear line utilities and delineate On a copy of final map prior to final approval. 7. Remove all trees and structures from the street right-of-way. 3. Remove all structures and buildings within or across the tract boundary. These removals or relocations shall comply to all City Ordinances, codes and regulations, and be done to the satisfaction of the Department of Public Works. 9. Dedication of street 60 feet wide or 5 foot planting and sidewalk easements and corner radius of 20 feet at Santa Anita. 10. Arcadia (A: PR) UNINHABITED ANNEXATION (F: 1007) 15:6097 MOTION by Councilman Butterworth, seconded by Councilman Balser, and carried on roll call vote as follows, that the recommendation of the City Manager be.approved and that the sum of $1,000.00 be transferred .from Capital Improvement Pioject No. 509 to Capital Improvement Project Account No. 504 - Library furnishings, equipment and improvements. Said transfer to provide for the installation of two refrigerated drinking fountains in the older portion of the Library and the completion of the tiling of the rest room walls. AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Turner and Phillips None Councilman Reibold MOTION by Councilman Turner, seconded by Councilman Balser, and carried 1 on roll call vote as follows that the recommendation of the City Manager be accepted.and that the agreement between the County of Los Angeles and the City be approved for the improvement of Peck Road from Sawpit Wash to San Bernardino Road, and that same be executed by the Mayor and City Clerk. AYES: NOES: ABSENT: Councilmen Balser, ~utterworth, Turner and Phillips None Councilman Reibold It was noted that the City's share in said improvement amounts to $61,600 which will be paid out of gas tax revenue. The following bids were received for the purchase of four vehicles in the Water Department: Watkins G.M.C. Orrin W. Fox Kent Chevrolet Hutchings Ford 3/4 ton pickup $4,139.46 4,179.99 4,308.22 4,642.19 $3,072.05 compact pickup No Bid " " " " On recommendation of the Water Superintendent and the City Manager, Councilman Balser MOVED that the contract be awarded to Watkins G.M.C. for two 3/4 ton pickup trucks in the amount of $4,139.46 and that a contract be awarded to Hutchings Motors for two compact type pickup trucks in the amount of $3,072.05. Motion seconded by Councilman Butterworth and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Turner and Phillips None Councilman Reibold MOTION by Councilman Butterworth, seconded by Councilman Balser and carried unanimously that the request of the West Arcadia Business and Professional Association for permission to hold its annual Sidewalk Sale on September 21, 1963 be granted. The City Manager advised of the receipt of a request from property owners 1 on Doolittle Avenue north of Boley Street in southeast Arcadia - outside of City limits. The proposal would be consummated as an uninhabited annexation. The area was reviewed and discussion held on lot sizes, the fact that six lots were partially in the City at the present time and the resultant confused situation. The staff recommended approval of the request inasmuch as the City would benefit by the straightening out of split parcels of land in the area. MOTION by Councilman Butterworth, seconded by Councilman Turner and unanimously carried that the institution of proceedings for annexation of the described area be approved. 4. 9-17-63 STUDY OF OTHER AREAS DRIVEWAY MODIFICATION (P:Driveway) 1 REPORT ALL NIGHT PARKING 1 15:6093 It was then further MOVED by Councilman Butterworth, seconded by Councilman Balser and unanimously carried that the Planning Commission and Planning Department prepare a report on 'logical areas which should become a part of the City and in some instances where deannexation is indicated; said report to be accomplished as time permits. MOTION by Councilman Balser, seconded by Councilman Turner and unanimously carried that approval be given the request of Jack Newburn of 1426 Orlando Drive ror a modification of the driveway requirements to permit the use of asphalt instead of concrete for a driveway at said address. The City Manager advised that in compliance with Council's instructions, the City Attorney had prepared a proposed ordinance to prohibit all night parking and that he had prepared a suggested criteria for an all night parking .permit system. Said report and ordinance having been submitted to Council for study included basis for prohibition, considera- tions in the development of a permit system including a proper fee and the procedure recommended to facilitate enforcement. It was the conSensus of the Council, that the proposed prohibition would eliminate the hazard to moving traffic, that property owners might assume the responsibility of providing additional parking where space available on the property and that the rapid apartment construction had undoubtedly brought about the present situation. Discussion held on the method of permit issuance, permits to be purchased for a fee of $12.00 per year and pro rated for less than a year. The advisability of establishing an adequate warning system was also perused with the Council being strongly of the opinion that every opportunity should be afforded persons to become aware of the new regulation prior to the actual enforcement date. It was then MOVED by Councilman Turner, seconded by Councilman Balser and carried on roll call vote as follows that Council approve the (1) Criteria and (2) the application form. Councilman Butterworth, referring to an effective date for enforcement, MOVED that the proposed ordinance include the provision that it shall be unlawful to indulge in all night parking after January 1, 1964. Mayor Phillips seconded the motion which was carried unanimously. Roll Call vote was then taken on Councilman Turner's Motion: AYES: NOES: ABSENT: Councilmen Balser, Butterworth, Turner and Phillips None Councilman Reibold The City Attorney then presented, explained the content and read the title of Ordinance No. 1222 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY AMENDING SECTION 3214.1 THEREOF AND ADDING THERETO NEW SECTIONS 3214.2 THROUGH 3214.13, AMENDING AND AUGMENTING THE UNIFORM TRAFFIC ORDINANCE BY PROHIBITING ALL NIGHT STREET PARKING AND PROVIDING FOR THE ISSUANCE OF TEMPORARY AND ANNUAL ALL NIGHT STREET PARKING PERMITS." Phillips ordered received and filed the communication advising of the withdrawalof the application of the Santa Anita Coffee'Shop (located on the Los Angeles County Golf Course property) for a license permitting the sale of beer on the premises. ~ayor Phillips ordered received and filed the communication recommending that the City Council postpone the construction of the median strip in Huntington Drive from Santa Anita Avenue to Second Avenue until after the 1963-64 racing season. I Request of the A & A Building Supply Material Company for reconsider- ation of application for construction of a 50' x 107' storage building. Said application had previously been denied inasmuch as the property proposed for construction is in the Central Moratorium Area. Mr. Cliff Lance, 166 East Pamela Road, Arcadia, President of the Company, addressed Council, stating in part that it is essential to the operation of the Company that storage facilities be obtained before the weather prohibits outdoor storage; that he proposes an agreement with the City whereby permission be granted to construct the building and the cost be amortized over a 10 year period at $25,000; that should it become necessary for the City to purchase the structure to implement the Central Area Plan the amortization schedule could be used to reduce the cost of the building to the City; that in which case the cost to the City would be $20,000; that the City receives substantial sales tax revenue from the operation. Ext'ensive discussion held on the possibility of the lease being terminated by the Railroad Company; the possibility of a third party entering the picture; the fact that the Building Company cannot place a covenant on railroad property without its consent; the recording of an appropriate document with Mr. Lance stating in part that in his opinion the Railroad Company would be agreeable to such an arrangement between the City and his Company. Council expressed the desire that Mr. Lance secure the concurrence of the railroad company in the proposal. and unanimously carried MOTION was thiri made by Councilman Turner, seconded by Councilman ButterwortlV'that the staff be instructed to work out with Mr. Lance details which would enable the Council to grant permission to construct the building within the framework of the thoughts expressed by the Council, and bring its recommendations to the Council as soon as possible. MOTION by Councilman Balser, seconded by Councilman Butterworth, and carried unanimously that approval be given the request of the Lutheran Church for permission to hang a banner in front of the church building advertising Loyalty Sunday September 22, 1963. 1 MOTION by Councilman Balser, seconded by Councilman Butterworth and carried unanimously that permission be granted the Elks Lodge to hang banners advertisingtheir Annual Charity Ball. Said banner to be displayed from November 15th to November 25, 1963. Request of Robert Lowe for permission to install and use a trailer as an office at his used car lot located at 222 East Huntington Drive. Mr. Lowe, residing at 425 South Baldwin Avenue, Arcadia, addressed Council, stating in part that he was in need of additional office space and that he would endeavor to Secure a trailer to meet City requirements. Discussion held on offices being used by other used car lot owners within the City; that the location is within the moratorium area which the City is proposing to upgrade; whether or not it would be too'~o1ijecti'aualole, arid other factors pertaining thereto. 6. 9-17-63 ORDINANCE NO. 1213 (Water Rat~ increase) (F:435) 1 LIGHTING MAINTENANCE DISTRICT NO. 20 RESOLUTION NO. 3618 1 RESOLUTION NO. 3619 15:6100 MOTION was made by Councilman Butcerworth, 'seconded'by Councilman Balser and carried unanimously that the request of Robert Lowe for permission to use a trailer as an office be denied. The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1218, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,AMENDINGSECTIONS 7531.1.1, 7531.1.3, 7531.2 AND 7531.2.2 OF THE ARCADIA MUNICIPAL CODE WITH RESPECT TO WATER RATES." The City Attorney advised that the Director of Public Works, having filed his report on the proposed Lighting District No. 20 (Santa Anita Village) under the Street Lighting Act of 1919, this is the time and place to inquire if anyone, in the audience or at the Council Table, desire to be heard or to ask any questions aboutit, prior to the Council's approving it and instituting proceedings for a district pursuant thereto. No one desiring to be heard, the City Attorney then presented, explained the content, and read the title of Resolution No. 3618 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN LIGHTING FIXTURES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES IN THE CITY OF ARCADIA, TO BE FURNISHED, INSTALLED AND MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID FIXTURES FOR A PERIOD OF MONTHS ENDING JANUARY 31, 1966." CITY OFFICIALS Councilman Turner stated in part with reference to Planning Commission Resolution No. 495 recommending the creation of a Zone H (which had been scheduled for public hearing earlier in this meeting) that he was of the opinion that Council should consider a 'Zone H' only insofar as height of buildings is concerned; that in his opinion two separa~e sets of specifications should be made applicable 1) for commercial and 2) for apartments. It was the consensus that this will be explored further at the time of the hearing, and that during the interim Councilman Turner and Planning Director Phelps could review the matter. Councilman Balser was welcomed back to the Council table after a vacation. Mayor Phillips reminded the Councilmen of the forthcoming Independent Cities'Seminar to be held on Catalina Island September 22 and 23, 1963.
