CITY COUNCIL OF THE CITY OF ARCADIA
JANUARY 7, 1964
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8 P.M. on January 7, 1964
The Invocation was offered by Rev. Walter F. Dannaman, Pastor of the
American Lutheran Church.
Mayor Phillips led in the Pledge of Allegiance to the flag.
PRESENT: Councilmen Balser, Butterworth, Reibold, Turner and
Mayor Phillips
ABSENT: None
The Minutes of the regular meeting of December 17, 1963 were approved
on MOTION of Councilman Reibold, seconded by Councilman Turner and
carried unanimou~ly.
Mayor Phillips declared the hearing open on the proposed amendment to
the Arcadia Municipal Code relating to rules and regulations of County
Parks. The City Attorney advised of the contents of a letter from
Norman Johnson, Director of Parks and Recreation for Los Angeles. Said
communication was received and ordered filed with the City Clerk. The
Mayor inquired if anyone desired to address Council to the matter. No
one so desiring the hearing was closed on MOTION by Councilman Reibold,
seconded by Councilman Turner and carried unanimously.

Whereupon the City Attorney presented for the second time, explained
the content and read the title of Ordinance No. 1231, entitled:
"AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
AMENDING ARTICLE IV OF THE ARCADIA MUNICIPAL CODE BY ADDING THERETO
A NEW CHAPTER 5 ENTITLED "COUNTY PARK REGULATIONS" ADOPTING BY REFER-
ENCE ARTICLES 1 THROUGH 4 OF ORDINANCE NO. 8354 OF THE COUNTY OF LOS
ANGELES ENTITLED" AN ORDINANCE AMENDING ORDINANCE NO. 2301,- RELATING
TO RULES AND REGULATIONS FOR, COUNTY' PARKS, BEACHES, RECREATION CAMPS,
RIDING, AND HIKING TRAILS" AND OTHER RECREATION, AREAS", PRESCRIBING

Mayor Phillips declared the hearing open on Planning Commission Res.
No. 502 recommending the classification of specified properties into
Zone 'H' Special Height District in addition to the basic zone appli-
cable thereto.

The City Clerk read into the record a communication from the West
Arcadia Homeowners Association President, W. Harold Sumner, in which
it was urged that Council maintain the requirement of two thousand
square feet of land area for each R-3 unit and also in opposition to
high rise construction.
The Planning Director presented an oral report together with pictorial
slides outlining the area recommended for high rise classification
(property fronting on Baldwin Avenue between Fairview and Naomi
Avenues) .
Mayor Phillips asked if anyone in the audience desired to speak to the
matter and the following persons addressed Council:

No one else desiring to speak to the matter, it was MOVED by
Councilman Reibol~ seconded by Councilman Balser and carried unani-
mously that the hearing be closed.
Upon inquiry the Planning Director advised that the Zoning Committee
had recommended to the Planning Commission the 'H' classification and
that the Planning staff concurs therein; that the Commission had voted
6 to 1 in favor of the 'H' classification.

Councilman Balser stated in part: that he favored stopping the
boundary at 'the north side of Naomi Avenue; that 8-story construction
was not compatible with R-l construction on Camino Real; that better
control could be had with a buffer; that perhaps Naomi Avenue could be
closed and made into a parking area; that he felt commercial might be
extended farther south on Baldwin Avenue to which he was opposed.
Councilman Reibold stated in part: that according to the Planning
Director there had not been any complaints from the residents in that
area; that the residents had been endeavoring to put together a satis-
factory arrangement on Naomi Avenue; that he favored the rezoning.
Councilman Butterworth stated in part: that he had had occasion to
vote against business zone in West Arcadia; that he was not unmindful
of Ordinance No. 1071; that issues in this matter were different; that
the present discussion is on the development of an existing business
area; that it would in his opinion, have no effect on the school
enrollment; that it would increase the tax base; that he would support
the proposal.
Councilman Butterworth then~MOVED that Planning Commission Resolution
No. 502 recommending the classification of specific property into
Zone 'H' Special 'Height Zone in addition to the basic zone applicable
thereto be APPROVED. Motion seconded by Councilman Turner and carried
on roll call vote as follows:

Mayor Phillips declared open the continued hearing on the APPEAL from
the Planning Commission Res. No: 486 recommending denial of the
variance application of Mike Vallone for permission to construct an
eight-story apartment building at 614-642 W. Huntington Drive.
This matter had been continued at the request of the applicant.
The City Clerk read into the record communications from:

All of the above were in favor of the variance. Opposing the granting
of the variance was Everett L. Regal who submitted his written ob-
jection.
The Planning Director presented a report, including the depth of the
lots, construction proposed, setbacks, driveways, subterranean garage
and the square footage proposed for each of the 200 units. Projecturals
also were displayed depicting the finished aspect of the proposed
apartment.

The following persons addressed Council:
IN FAVOR OF GRANTING THE VARIANCE
Robert Stevens, attorney for Mr. Vallone, urged favorable action based
on the merit of the variance application itself; the type of structure
which would house units costing $24,000 each to build; the attraction
to persons in the higher income bracket which would economically
benefit the City and the business sections; that the location is ideal
for such development being across the street from the race track,
close to the hospital, and Baldwin,Avenue and Huntington Drive pro-
viding excellent accessibility. He could foresee no increase in the
school enrollment due to the construction of such an apartment and
called particular attention to the possibility of using the subter-
ranean garage in the event of an emergency, as it could hold 10,000
persons. In answer to Councilman Butterworth's query regarding the
effect on the apartment development currently being constructed behind
this particular location, ,Mr. Stevens stated in part that this had been
taken into consideration and that the view would not be obstructed due
to the unique design. He urged Council to reverse the Planning Com-
mission recommendation.

Both Mr. Ar~h and Mr. Johnston favored placing the matter before the
electorate.
No one else desiring to address Council, it was MOVED by Councilman
Butterworth, seconded by Councilman Balser and carried unanimously
that the hearing be closed.
Councilman Butterworth stated in part that he acknowledged there was
merit in the case presented by the appellants; that in his opinion
when a variance is requested, the law is being asked to be applied
uniformly to the community but not to the applicant; that the Planning
Commission had recommended strongly against the granting of the
variance, and that he would support the Commission.

Whereupon he MOVED that the recommendation of the Planning Commission be
sustained and that the variance application be denied.

Councilman Balser seconded the motion and commented that he supported the
Planning Commission's unanimous recommendation for denial of the variance;
that the Commission endeavors to keep the City one of distinctive single
family residences; that any high rise apartments could change the
character of the City and in his opinion it is not the will of the people.
Councilman Turner stated in part that the City only has a 4.38 per cent
school enrollment from the apartment units; that slightly less than 25 per
cent of the residential units are apartment units; that the increased tax
base for the City and schools with no increase in school enrollment,
indicates to him the approval of the variance.
Mayor Phillips stated in part that he favored the requested variance, but
would not if it were in any other location; that it appears to him to be
inevitable that in the future Huntington Drive between Holly and Baldwin
Avenues will be rezoned; that the height of a building is not paramount;
that it is the application of economics of the land to the usage; that in
his opinion this is a project which the City cannot afford to by pass.
A roll call vote was then taken on the MOTION for denial previously made
by Councilman Butterworth and seconded by Councilman Balser:

Conditions to be applicable were discussed and the following were
presented:
1., The variance not be operative until complete working drawings
prepared by a Registered Architect and in substantial compliance
with the approved preliminary plot plan and elevations and in-
cluding landscaping and irrigation plans prepared by a landscape
architect have been submitted to and approved by the Planning
Commission which shall be within one year from the date of City
Council approval of this variance.
2. Construct a six ft. high wall on the south, west and east
property lines. Such wall to be measured from the contiguous
properties. In no case shall such wall be less than 5 ft. in
height, measured from subject site.

3. Water services shall meet with the standards set forth in the
Uniform Plumbing Code and shall be approved by the Water Superin-
tendent.
4. Grading and drainage plans shall be submitted to and approved by
the Department of Public Works.
5. All building, landscaping and service area illumination shall be
directed away from the adjacent properties and in no case shall
any lighting fixtures be installed above a height of six ft.
6. Close all existing unused curb cuts and install sidewalks and
street lights in accordance with Department of Public Works
standards.

7. The working drawings shall meet with the requirements of the
Building' Code.
8. Site fire protection shall be provided in a manner satisfactory
to the Fire Chief.
9. Driveway approaches shall be 35 ft. wide.
10.
No parking except for loading and unloading shall be permitted in
driveway areas.

11.
Buildings shall be of Class A oonstruction.
12. All driveway and parking areas shall be paved with concrete and
approved by the Department of Public Works.
13. Subject development shall meet with R-3 requirements in addition
to those listed above.
14. The City Planning Commission shall reserve the right without
necessity of further notice or hearing to make minor modifications
of any of the foregoing conditions, if such modification will
achieve substantially the same results and will in no way be detri-
mental to adjacent properties or imp rovements a s will the
strict compliance with said conditions.

Abutting owners having waived notice and consenting thereto, the request
of the First Church of Christ Sci~ntist for a variance from the Uniform
Building Code to allow the construction of a shake roof at 812 W. Duarte

Turner and carried unanimously.

MOTION by Councilman Butterworth, seconded by Councilman Balser and
carried unanimously that an amendment to the Lease Agreement and
Purchase Option be APPROVED and that the Mayor and City Clerk be
authorized to execute same in form approved by the City Attorney. (The
amendment would permit the lessee-purchaser, with City's approval of
tenancy, to use the Department Store space for other permitted com-
mercial use if they are unable to obtain suitable Junior Department
Store tenants within six months of the date hereof).
MOTION by Councilman Reibold, seconded by, Councilman Turner and carried
unanimously that the City Attorney be instructed.to prepare a Lease '
Agreement for city owned property located at Holly Avenue and
Huntington Drive (known as the 'Point' for consideration by the City
Council at its next regular meeting.
Discussion was held on the contents of the proposed lease agreement and
Mayor Phillips appointed a Committee to work with the Chamber of
Commerce consisting of Councilmen Butterworth and Turner. Henry Hege
represented the Chamber of Commerce.
MOTION by Councilman Butterworth, seconded by Councilman Reibold and
carried on roll call vote as follows that the Mayor and City Clerk be
authorized to execute a deed to the Arcadia Industries, Inc., for the
purchase of City owned land on Peck Road (Lot 15 Tract No. 26345).

It was pointed out that the matter of the Planning Commission
Resolution No. 498 recommending limiting the height of all future
buildings to two stories or 35 feet in all zones except Zone 'H'
would be carried on the pending Agenda.
Councilman Butterworth expressed appreciation of a Resolution passed by
the City Council of our Sister City, Tripolis, Greece, in memory of
former President Kennedy.
He also recommended the formation of a 7-man City Board or Commission
for the Sister City Program. The suggestion was concurred in by the
Council members and the City Attorney was instructed to prepare the
appropriate ordinance.
Mayor Phillips reminded Council of the forthcoming dinner meeting of
the League of California Cities in Arcadia, January 16, 1964.
Mayor Phillips appointed Councilmen Butterworth and Balser as a
Committee to recommend independent auditors for the fiscal year ending
June 30, 1964.
Mayor Phillips requested Councilmen Butterworth and Turner attend the
Chamber of Commerce meeting to be held at the Flamingo Restaurant
Friday January 17, 1964 at 7:30 A.M. Purpose of the meeting is to dis-
cuss the possibility of an auditorium.
Mayor Phillips declared the meeting adjourned at 11:20 P.M.
