CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
MARCH 3, 1964
The City Council of the City of Arcadia, California, met in regular
session in the Council Chamber of the City Hall on March ,3" 1964
at 8 P.M.
The Invocation was offered by Rev. H. Warren Anderson, Arcadia
Community Church,
The pledge of allegiance to the flag was led by Mayor Phillips

MOTiON by Councilman Reibold,'~econded by Councilman Balser and
carried unanimously that the Minutes of the City Council meeting of
February 18, 1964 be APPROVED.
Planning Commission Res. No. 504 recommending the amendment to the
Arcadia Municipal Code by amending and augmenting the regulations con-
trolling signs, billboards and advertising structures in Zone C-l,
amending off-street parking requirements for Zone C-l and altering
the uses permitted in and the regulations applicable to Zone C-l, On
recommendation of the City Manager the matter was continued until
March 17, 1964. (Hearing remains open),
The City Council reviewed the recommendation of the Planning
Commission for denial of a lot split request of Don C. Russell on
property at 2835 Winthrop Avenue. Mr, Russell had appealed the
recommendation which matter was now being considered by the City
Council.
The Planning Director displayed projecturals and explained the basis
on which the Commission had recommended for denial; that the locs
would be substandard and not consistent with the existing requirement
for 7500 sq. ft, to each lot; that the granting of such request could
result in other property owners in the area making similar application
for lot splits and that it could set a precedent.
Mrs. Russell addressed Council stating in part that permitting the lot
split would allow the construction of a residence which would improve
the appearance of the neighborhood; that it is now waste space.
Discussion was held on the possibility of the applicants' securing
additional land from adjacent property in order to meet the re-
quirement. Mrs. Russell stated that it would not be possible due to
the existence of a chain link fence covered with ivy which the proper-
ty owners to the west on Live Oak Avenue would not want to remove and
that the property owners to the north on Winthrop Avenue were not

Mr. Butterworth stated that he recognized that the matter is one of
some hardship on the property owners but that the disadvantages out-
weigh the advantages, and on the basis of the unanimity of the
Planning Commission in recommending denial, he MOVED that the recom-
mendation of the Planning Commission for denial be sustained.
Councilman Balser seconded the motion which was carried unanimously.
MOTION by Councilman Turner, seconded by Councilman Balser and
carried unanimously that a public hearing be scheduled for March 17,
1964 at 8,P.M. on, Planning Commission Resolution No. 506 recommending,
upon specified conditions, reclassification from Zone R-l to Zones
CoO, D and H of property located at 604, 612 and 620 W. Duarte Road.

MOTION by Councilman Turner, seconded by Councilman Balser and
carried unanimously that a public hearing be scheduled for April 7,
1964 at 8 P.M. on Planning Commission Resolution No. 507 recommending
'denial of a zone variance to allow construction of a 20 unit apartment
on property located at 241 W. Colorado Boulevard. (In compliance
with the provisions of the Arcadia Municipal Code, the applicant had
appealed said action and filed the required $100 fee).
Recommendation that improvement of Longden Ball Park backstop and
fencing be instituted. Discussion held on the present hazardous con-
dition and the need for the improvement. Appreciation was expressed
on behalf of the Arcadia National Little League which had pledged the
sum of $500 to be paid on or before July 1, 1964 and deposited to the
Parks and Recreation Facilities Fund.
MOTION by Councilman Balser, seconded by Councilman Turner, and
carried on roll call vote as follows that the sum of $2500 be ap-
propriated from the Parks and Recreation Facilities Fund for the
improvement of the Longden Ball Park backstop and fencing.

The City Manager advised that plans are being completed for the im-
provement of Santa Anita Avenue from Grand Avenue to Live Oak Avenue;
that it will be a joint project between the Los Angeles County Road
Department, the City of Temple City and the City of Arcadia and that
the City's portion is estimated to be $52,000.

MOTION by Councilman Butterworth, seconded by Councilman Reibold and
carried on roll call vote as follows that the project plans be
approved; that the City Attorney prepare the appropriate resolution
to finance the City's portion from County Gas Tax funds and that the
Mayor and City Clerk be authorized to execute an agreement with the
County in form approved by the City Attorney.

MOTION by Councilman Butterworth, seconded by Councilman Turner and
carried on roll call vote as follows that Council approve an
agreement between the Santa Fe Railroad and the City for the instal-
lation of grade crossing signals, the crossing gates, along with
other appurtenances as required in the plan and that the City Manager
be authorized to execute such an agreement on behalf of the City in
form approved by the City Attorney.

The City Attorney stated that under the agreement the Railroad Co. is
to maintain the installation until the parties agree otherwise or the
Public Utilities Commission otherwise directs.
MOTION by Councilman Balser, seconded by Councilman Reibold and
carried on roll call vote as follows that the City retain the firm of
Lybrand Ross Bros. and Montgomery to perform the annual audit of the
financial records of the City for the fiscal year 1963-64 at a fee' of
$3500.

Reservoir in conformance with specifications; that the bids be re-
ceived March 16, 1964 at 11 A.M.
MOTION by Councilman Balser, seconded by Councilman Reibold and
carried on roll call vote as follows that $8000 be appropriated from
Unappropriated Surplus Account No. 290 to Police Department Account
No. 421-5 for traffic control during the 1964 racing meet of the
Western Harness Racing Association.

Mayor Phillips ordered received and filed the communication from
the City Manager advising that the City participated in the training
program developed by the Commission on Peace Officer's Standards and
Training; that eleven police officers had availed themselves of the
training program and that as a result the City 'had received $2802.50
frOm the Commission for expenses incurred on the basis of funds
allocated from court fines for this purpose.
MOTION by Councilman Reibold, seconded by Councilman Turner and
carried unanimously that the request of the Industrial Brush Company
114 St. Joseph Street for a building permit to allow structural
alterations on the building to provide additional office space be
approved and that a permit be issued in compliance with all appli-
cable building regulations.

MOTION by Councilman Balser, seconded by Councilman Butterworth and
carried unanimously that the request of the Peerless Linen Rental
Service, 122 N. Santa. Anita Avenue, for a building permit to allow a
plexy glass type fence to be installed be approved and that a permit
be issued in compliance with all applicable building regulations.
Receipt of the petition from various property owners residing west of
. Baldwin Avenue on Camino Real and Naomi Avenue was acknowledged.
Said petition requested consideration of property rezoning from R-2
to R-3. MOTION by Councilman Turner, seconded by Councilman Balser
and carried unanimously that the request be referred to the Planning
Commission for recommendation to the property owners interested
therein.
The City Attorney presented for the first time, explained the content
and read the title of Ordinance No. 1238, entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,. AMENDING CHAPTER
2 OF ARTICLE IX OF THE ARCADIA MUNICIPAL CODE BY REPEALING. SECTION
9282.1 THEREOF AND AMENDING SECTIONS 9251.2.1, 9252.2.1, 9253.2.1,
9254.2.1, 9255.2.1, 9261,2.1, 9262.2.1, 9263.2.1, 9264.2.1, 9265.2.1,

Schools relative to Assembly Bill No. 46. It was the consensus of

resolution.

Mayor Phillips advised of the receipt of a letter and a resolution
from the City of San Gabriel in opposition to the Bill and requesting
the City to take similar action.

MOTION by Councilman Reibold, seconded by Councilman Turner and
carried unanimously that the City Attorney be instructed to prepare a
,resolution incorporating the City's opposition to Assembly Bill No. 46.
CHARTER The City Manager was requested to submit copies of the written
~ opinion of the City Attorney regarding the effect of the Assembly
a. ~ ;1.oGBill and the City Charter to members of the School Board, the Super-
intendent of Schools, members of the Press and also to the eight
candidates seeking election to the City Council. It was the consensus
of the City Council that the material may prove helpful in avoiding
misunderstanding within the community.

Councilman Turner reported on his recent attendence of the Civil
Defense Management course held at Alameda, California; that it was
fruitful and that at a later date he would make a comprehensive
report should someone else desi~e to attend such a course.

Upon advice of the City Attorney that it is now time to proceed with
litigation to recover the penalty due under the agreement for
liquidated damages executed by Nate'Margolin in consideration of a
zone variance extension, and after hearing his explanation of the
circumstances, Councilman Turner MOVED that the City Attorney be
authorized to institute,appropriate litigation unless favorable
action. occurs in the near future and that he be authorized to select
associate counsel of his choosing when he deems it advisable so to do.
Motion seconded by Councilman Balser and carried unanimously.

ADJOURNMENT

Mayor Phillips advised of the receipt of letters from Mrs. James Dale,
Mrs. Peter Pitchess and Mrs. Louis Randall accepting appointment to
the Sister City Commission.
Mayor Phillips also requested the City Manager to arrange for a
dinner meeting with the members of the Sister City Commission and
active members of the,interim'Committee.
The City Manager was requested to submit a copy of the Resolution
forming the Commission to Tripolis, Greece.
