HomeMy WebLinkAboutOCTOBER 3,1961 I '''00'''0' ROLL CALL APPROVAL OF MINUTES (9-19-61 and 9-21-61) 14:5483 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING OCTOBER 3, 1961 The City Council of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 o'clock P,M" October 3, 1961, The Invocation was offered by Mons. Gerald M. O'Keefe, Pastor of the Church of the Holy Angels. PRESENT: ABSENT : Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser None Councilman Butterworth exp~essed a desire to comment on the minutes of September 19, 1961 prior to Council taking action. He stated in part that he took exception to certain remarks made by Councilman Camphouse with reference to the manner in which the minutes of August 1, 1961 were approved and his use of the words "adulterated" and "tampered"; that the recording of these remarks, in his opinion, could suggest some misconduct on the part of the three Councilmen who were present at the September 5, 1961 meeting, at which meeting the minutes of August I, 1961 were approved; that had Councilman Camphouse been present at said September 5,1961 meeting he would have heard extensive discussion on the matter; and that in his opinion the remarks had no foundation in fact. ~councilman Phillips stated in part that some eight years ago the minutes of Council meetings reflected only subject matter, action and roll call vote; that the minutes since then have contained condensed versions of discussions held at Council meetings; that in his opinion the minutes as ~NDEXED presented by the City Clerk should be left alone except where an error has been made; that he would hope the matter could be resolved without further dissension, otherwise perhaps the minutes should reflect only action and anyone desiring to delve into a particular matter could listen to the tape recording of the proceedings. A'. ,~ I ZONE VARIANCE Councilman Reibold stated in part that he personally liked the minutes the way they are presented; that in his opinion the heart of the question is Councilman Camphouse's statement that "the minutes had been adulterated or tampered with" and that perhaps the usage of those particular words could be explained by Councilman Camphouse, inasmuch as words occasionally do have different interpretations to different persons. Councilman Camphouse stated in part that he agreed that the recordation of the minutes as they are presented to the Councilmen is proper; that he would accept the blame for perhaps an incorrect choice of words; that he did not believe it is the privilege of anyone to change the minutes as recorded; that he feels that he has the right to disagree with members of the Council; that in his opinion his request for a delay in the approval of the August 1, 1961 minutes for another two week period did not appear to him to be significant inasmuch as a delay had already taken place. Councilman Butterworth then MOVED that the minutes of the regular meeting of September 19, 1961 and the adjourned regular meeting of September 21, 1961 be approved as submitted in writing. Councilman Reibold seconded the motion which was carried unanimously, Planning Commission Resolution No. 421, recommending DENIAL of zone variance application to permit additional dwelling at 5l7-5l9~ South Third Avenue. Guardalabene, owners). 1. 10-3-61 MODIFICATION YARD REQUIREMENTS FOOTHILL FREEWAY (Interchange Design) F 1-7/ INDEXED 14:5484 An appeal from said decision of the Planning Commission having been duly filed by applicant and said matter requiring a public hearing, Councilman Camphouse MOVED that the hearing be scheduled for October 17, 1961. Motion seconded by Councilman Reibold and carried unanimously. Modification Committee Resolution No. 420, recommending APPROVAL of modification of front yard setback line and side yard requirements to permit the placing of two duplexes 43'6" from the present curb instead of 46' on property located at 920 South Second Avenue. An appeal from said decision of the Modification Committee having been duly filed and said matter requiring a public hearing, Councilman Camphouse MOVED that the hearing be scheduled for October 17, 1961. seconded by Councilman Reibold and carried unanimously. Motio, Planning Commission approval of the geometric design of the interchanges 0 the proposed Foothill Freeway from Baldwin Avenue to Santa Anita Avenue an recommendation that appropriate action be taken to assure the freeway being depressed from the west City boundary to approximately Rancho Road. Also communications from ~ancho Santa Anita Property Owners Association, Inc., dated October 2, 1961; Rancho Santa Anita Residents' Association, dated September 15, 1961, and the Arcadia Chamber of Commerce, dated October 2, 1961, regarding said subject freeway and the proposed elevations. It was stated that at this time the matter of the interchange design was the phase to be considered; that the elevations and/or depression of the freeway would be considered later. Interchange plans of the proposed Foothill Freeway from Baldwin to Santa Anita Avenues, as suggested by the State Highway Department, were displayed to the Council, including the interchanges, on and off ramps, their locations and secondary roads. Lengthy discussion was held, during which Mr. H. Saunders, 841 San Simeon Road, and Vice President of the Rancho Santa Anita Property Owners Association, Inc., addressed the Council, stating in part that his Association had no objection to the Council approving the form of the interchanges, but that final approval be made subject to the City's approval as to elevation. Mr. Saunders was advised that the Director of Public Works is scheduled to speak before his Association on October 9, 1961 at which time profiles would be displayed showing proposed elevations from the east to the west City limits and an opportunity presented to ,propound questions. It was further stated that the execution by the City of the freeway agree- ment is the official approval of the final plan, which includes elevations, off and on ramp locations, etc. That the action necessary at this time is Council's approval of the progress to date to present to the State. That the location of the on and off ramps and secondary roads will not per se prohibit the elevation or depression of portions of the freeway under discussion. That additional engineering study is necessary prior to Council making its complete decision as to elevations inasmuch as a depression at Baldwin Avenue might require the abandonment of plans for the extension of Baldwin Avenue going under Colorado Boulevard, the railroad tracks and the freeway. I Councilman Butterworth then MOVED that Council approve the plan as submitted by the Department of Public Works in principle, it being the understanding of the Council, however, that it is not a commitment of the Council in any way as to elevation, nor is it the basis for any implied acceptance of any offer by the Highway Commission, and that it should now be referred back to the Engineering Staff of this City for further study" Councilman Reibold seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ABSENT: None 2. 10-3-61 14:5485 CIVIL DEFENSE Pursuant to the request of Council, the City Manager presented the estimate of cost of mailing to Arcadia residents a pamphlet entitled "Facts About Fallout Protection" issued by the Office of Civil and Defense Mobilization dated April 1958 (available to the City November I, 1961) and insertion material by the City, at $498.00; also that inquiry has been made as to the City's right to use franking privileges for civil defense material. MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that Mr. Clifford C. Pollock contact the Arcadia Red Cross regarding distribution of a brochure similar to one distributed by the Pasadena Red Cross covering measures to be taken for survival in the event of disaster. I Councilman Butterworth further MOVED that Mr. Pollock also contact the Stanford Research Institute in Pasadena regarding their availability for making a civil defense survey in Arcadia. Councilman Reibold seconded the motion which was carried unanimously. Councilman Butterworth added that it was his thought that the City might wish to employ them for this purpose perhaps concurrently with Sierra Madre and Monrovia. iINDEXED Councilman Reibold MOVED that the pamphlet entitled "Facts About Fallout Protection" as set forth in the City Manager's cotmllunication dated September 27, 1961 (on file in the office of the City Clerk) be distributed to the citizens of Arcadia as discussed and that the estimated cost of $498.00 as set forth in said communication be p~id from Council Contingency Account. Councilman Butterworth seconded the motion which was carried on roll call vote as follows: J- 8' J :!J AYES: Councilmen Butterworth, Camphouse, Reibold,Phillips, Balser NOES: None ABSENT: None Councilman Butterworth also ~ that Mr. Pollock contact the Arcadia schools, including parochial, to explore a liaison between the City and the schools regarding plans for the protection of the children in the event of an alert or an atomic blast. Also that Mr. Pollock or some other staff member establish a liaison with the Water Department regarding the establishment of an underground reservoir in Arcadia with a sufficient water s~pply to be available in the event of fallout. It was stated that as soon as the City adopts its civil defense master plan the School District will revise its outdated plan to coincide with the City's plan. That with regard to the underground reservoir, three men from the Water Department are presently attending a radiological school on the effect of fallout on the water system. That the City's wells are underground and will not be affected by fallout; that the City's present reservoirs with the exception of one, on the basie of the latest information, will be completely free from fallout contamination, I At the suggestion of Mayor Balser that the City's ordinance providing for a Civil Defense and Disaster Committee, and the Arcadia Municipal Code establishing an Action Cotmllittee on Civil Defense and Disaster be changed to cover a citizens board of civil defense of seven or eight persons to act in an advisory capacity to the Council similar to the City's other boards and commissions, Councilman Phillips ~ that the City Attorney be authorized to prepare an ordinance for presentation at the next Council meeting with an emergency clause affixed thereto changing the constitution of the City's present disaster council to a board. Councilman Butterworth seconded the motion which was carried unanimously. Councilman Butterworth MOVED that the Council accept the recommendation of the City Manager and approve the City of Arcadia Civil Defense & Disaster Plan, with the exception that where appropriate the reference to Civil Defense Council be changed to Civil Defense Board. Councilman Reibold seconded the motion which was carried unanimously. Councilman Reibold ~ that the Council accept the recommendation of the 3. 10-3-61 COMPLETION OF WORK (Osborn - 1961-62 Resurfacing) -" ....,:.t-- i",J..3 BID IwNfNEn (Tree Removal Valencia Way to Hillcrest) 14: 5486 City Manager and instruct the Planning Department and the Planning Commission to study the City's Zoning Ordinance with regard to the desirability of either retaining its status quo or making some changes to permit the construction of fallout shelters in front yards. Councilman Butterworth seconded the motion which was carried unanimously. MOTION by Councilman Phillips, seconded by Councilman Camphouse and carried on roll call vote as follows that the City Council approve the recommen- dation of the City Manager and the Director of Public Works and accept the work of Osborn Constructors, contractors for the 1961-62 resurfacing program and authorize payment to be made in accordance with the contract with said firm for the above specified work, and the bond released after the expiration of the required 35 days. Remove large Oak tree 350.00 345.00 460.00 BID AWARD (Street Sweeper) '9i- " '// <' , C- ?fOOL- INDEXED Mr. Phillip E. Newmyer, 1139 Valencia Way, addressed the Council and requested that the two Oak trees on Valencia Way not be removed, expecially the larger one on the west side of Valencia Way. The Director of Public Works advised that although the larger Oak tree is in the way of vehicular traffic the majority of the residents on that street do not desire its removal; that it extends from the curb line approximately 18 inches. Mr. Harold A. Hyde, 1235 Valencia Way, addressed the Council and stated that he thought the Oak tree that extended into the street was a hazard to vehicular traffic and should be removed. Miss Janet Newmyer, 1139 Valencia Way, also addressed the Council, stating that she represented the young people on her street and pleaded that the Oak trees be saved for their sheer beauty; that Arcadia is noted for its beautiful old Oak trees. She mentioned one street in Arcadia where an Oak tree was growing in the middle of the street and that the City had built an island around that tree. After discussion the Director of Public Works was requested to have a curb designed that would take care of the drainage and to put markers on the tree to promote vehicular traffic safety. The Director of Public Works requested and received permission to reanalyze the above bids, inasmuch as the removal of the subject Oak tree was a separate item on the bids, and to submit his recommendation later in the meeting. The City Manager advised that the Dearth Machinery Company, 16327 East Arrow Highway, Azusa, was the only company that .responded to a call for bids for the purchase of a three yard capacity street sweeper with dual gutter brooms; that said company submitted a bid of $10,400.00 for a Wayne street sweeper, Model 460, with additional features as set forth in the City's specifications, f.o.b. Arcadia, including sales tax. I Councilman Phillips ~ that Council accept the recommendation of the City Manager and the Purchasing Officer and that the Dearth Machinery Company be awarded a contract for furnishing the City with a street sweeper according to the City's specifications and the company's bid proposal. Councilman Reibold seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ABSENT: None 4. 10-3-61 14:5487 CALL FOR BIDS With regard to the recommendation of the City Manager and the Director of (Widening east Public Works that Council approve plans and specifications for the widen- side Baldwin ing of the east side of Baldwin Avenue between Workman Avenue and Las between WorkmanTunas Drive and request for authorization to advertise for bids, the City & Las Tunas) Manager advised that Mr. George F. Wilson, owper of the property on the southeast corner of Las Tunas Drive and Baldwin Avenue had re~uested that this project be delayed until after the storm drains are installed. I CALL FOR BIDS (Peck No.1 Well) I CALL FOR BIDS (Baldwin Ave. Reservoir) ,The City Manager added that one of the conditions of the zone variance granted on the subject corner (A & P Grocerylocated thereon) was that there would be a dedication of the right of way of 25 feet and that at the time the street was widened the owner would be obligated to install a sidewalk as part of the construction. That when }lr. Wilson submitted the executed deed he had requested permission to blacktop this dedicated area for parking purposes until such time as the City widened the street. . That the City had granted this request, adding that at such time as the City did proceed with the widening of the street he would be required to pay for the removal of the pavement and, in accordance with the requirements of Resolution No. 3173 establishing the regulations of the D Zone, to construct the sidewalk along Baldwin Avenue. The City Manager stated further that inasmuch as the installation of a storm drain in Baldwin Avenue is not contemplated for some time (approximately 1963) and a sufficient number of dedications have now been received, he would recommend that the 'City proceed with the widening of the east side of Baldwin Abenue between Workman Avenue and Las Tunas Drive. It being the consensus of the Council that it would be to the benefit of the City for the subject widening program to proceed, Councilman Phillips MOVED that the Council accept the recommendation of the City Manager and the Director of Public Works; that the plans and specifications for the widening of the east side of Baldwin Avenue, between Workman Avenue and Las Tunas Drive, work to consist of curbs, gutters and pavement and appurtenant work, be approved ~s submitted; that the City Clerk be authorized to call for bids for such work in conformance with said specifications, the project to be financed from Los Angeles County Gas Tax Funds; said bids to be opened at 11:00 A"M., October 16, 1961 and submitted to the Council at the regular meeting of October 17, 1961. Councilman Camphouse seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ABSENT: None MOTION by Councilman Reibold, seconded by Councilman Phillips and carried unanimously that Council accept the recommendation of ' the City Manager and the Water Superintendent; that the plans and specifications for the drill- ing, casing, perforating, developing and testing of a 20-inch water well, to be known as Peck No. 1 Well, be approved as submitted; that the City Clerk be authorized to call for bids for such work in conformance with said specifications, expenditure for same being provided for in the 1960-61 budget, Water Fund, Major Projects, Item 2; said bids to be opened October 16, 1961 at 11:00 A.M. and submitted to the Council at the regular meeting of October 17, 1961. MOTION by Councilman Phillips, seconded by Councilman Reibold and carried unanImously that Council accept the recommendation of the City Manager and the Water Superintendent; that the plans and specifications for the construction of Baldwin Reservoir No.2 be approved as submitted; that the City Clerk be authorized to call for bids for such work in conformance with said specifications, expenditure for same being provided for in the 1960-61 budget, Water Fund, Major Projects, Item 4; said bids to be opened November 10, 1961 at 11:00 A"M" and submitted to the Council at the regular meeting of November 14, 1961. MOTION by Councilman Reibold, seconded by Councilman Phillips and carried unanimously that the Director of Public Works be authorized to represent I the City of Arcadia at meetings of the State Highway Department regarding the routing of the San Gabriel Freeway inasmuch as such routing will affec Arcadia; ~nd also that the matter of such routing be referred to the Planning Commission for study and report to the Council. . The City Manager informed the Council that notification has been received from the Pacific Electric Railway Company that they have accepted the City's offer to purchase approximately 5.716 acres of their property for the sum of $375,000.00 and that they would be in position to open an escrow on the matter in the near future. Foothill) inquiry as to whether the City could prepare legislation to relieve a builder of a bomb shelter of City taxes, he was advised that the Council had adopted a resolution urging the Legislators and the Governor to reconsider a bill that was defeated at the last session of the Legislature; that the State sets the basis for taxation. Mr. Lamb was also advised that the City has specifications for recommended shelters available to Arcadia citizens at no charge and that the building fee for such shelters is only $1.00. Mr. Robert Arth, 1017 Catalpa Road, President of the Rancho Santa Anita Residents' Assn., addressed the Council, stating in part that if Baldwin Avenue is to be extended it would cause the least hardship if it were depressed and a compromise sought regarding lowering the freeway as much as possible.
