Arcadia Uninhabited) j-g-~& INDEXED 14: 5516 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING NOVEMBER 7, 1961 The City Council of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 o'clock P.M., November 7, 1961. The Invocation was offered by Rev. H, Warren Anderson, Pastor of the Arcadia Community Church of God. PRESENT : ABSENT: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser None MOTION by Councilman Butterworth, seconded by Councilman Reibold and carried unanimously that the minutes of the Regular Meeting of October 17, 1961 as submitted in writing be approved. Mayor Balser declared the hearing open on the proposed annexation to the City of Arcadia of certain territory adjacent and contiguous to the present City limits, said territory being situated near the southeasterly portion of the City and designated as "Annexation No, 28, Southeast Arcadia Uninhabited" and that this is the time set when the Council will hear protests made by any person owning real property within the said territory. Mr. H. B. Winslow, 1418 Oaklawn Road, Arcadia, addressed the Council, stating that he represented the Arcadia Friends Church whose property is under consideration. He advised in part that said property was omitted when the annexation along Live Oak Avenue was completed; that the parcel to the north, belonging to Mr. E. G, Harris was cut in half and the parking lot of the church was omitted from the annexation at that time; that they would like to have the zoning uniform throughout the property and that inasmuch as the matter of zoning has not been settled, that the Council either give the proposed annexation the requested zoning concurrent with its annexation or postpone the hearing until the matter of zoning is resolved. The City Attorney advised that the Arcadia Municipal Code provides that property annexed to the City comes in as R-l property unless it is other- wise zoned concurrent with the annexation; that ordinarily matters of this kind do go before the Planning Commission for its recommendation, which recommendation is then considered by the Council with its protest hearing; that this was not done in this instance, That the Government Code provides for the adoption of an emergency measure freezing zoning at a certain level without the matter necessarily going before the Planning Commission, but that inasmuch as a meeting is to be held with Mr. Harris shortly to explore a related problem involving zoning in that area, it would be his suggestion that under the circumstances the protest hearing be continued to the next regular meeting. Whereupon Councilman Butterworth MOVED that the matter be continued to the next regular Council meeting (November 21, 1961), Councilman Phillips seconded the motion which was carried unanimously. Councilman Reibold then MOVED that the minutes reflect action requesting the Planning Commission to consider this matter and report to the . Council at its earliest possible date, Councilman Butterworth seconded the motIon whIch was carried unanimously. 1. 11-7-61 HEARING (Girl Scouts) J . ~tl u INDEXED 14:5517 Planning Commission Resolution No. 424 recommending approval of request of Santa Anita Girl Scout Council for a zone variance to allow the construction of a coyered patio on property at 590 South Third Avenue and to allow the,use of said property as a meeting place for Girl Scouts, The City Clerk read a letter from Mrs, Kenneth Kay appealing the recommen- dation of the Planning Commission and a letter from Mrs, Pauline Fletcher, 322 Eldorado Avenue, requesting permission to be heard on the matter, Mayor Balser declared the hearing open on the appeal from the recommen- dation of the Planning Commission and stated that the Council would hear first from the appellants in the matter. Mr. Alvin W. Hahn, Attorney, 126 East Colorado Boulevard, Monrovia, I addressed the Council, advising that he represented Mrs, Pauline Fletche and others, and stated in substance that some of the appellants he represented had been in accord with the granting of the zone variance several years ago for the property to be used as headquarters for the Arcadia Local Council of Girl Scouts; however, since that time increased activities at the subject location have led them to change their minds. That when the original variance was granted for a new building the removal of the old building left a concrete slab on which it is now proposed to erect a covered patio where certain out-of-door activities of the various groups of Girl Scouts will be held; that among the activities presently held at said location is the burning of open fires, resulting in smoke infiltrating adjacent residences, and that when apprised of this fact, nothing was done to rectify the situation. That in his opinion the limit- ing of the requested variance to ten years indicates that the Planning Commission did not feel the use should be permanent, Mr. Hahn read and presented a petition with 34 signatures of property owners adjacent to the subject property, opposing the requested zone variance, said petition stating in part that the granting of such variance would be detrimental to the property values of the residential neighborhood. He also asked those appellants in the audience to stand. (Approximately five persons responded). The Planning Director advised that there were protests at the Planning Commission meeting to the granting of the variance and also those who spoke in favor of it. He displayed a map of the subject area and indicated the location of adjacent properties, stating in part that some of the adjacent property owners who favored the original zone variance have since changed their minds. He continued, stating in part that the Planning Commission took into consideration all the things found objectionable but still felt the request should be granted; however, that they recommended certain restrictions, such as 1) all outside activities being terminated by 10:00 P.M.; 2) regulations of the Air Pollution District and the Arcadia Fire Department as they pertain to the emission of smoke and open fires be strictly obeyed; 3) activities carried on either in the building or I on subject property be limited to only Girl Scout activities; 4) paved areas indicated on the plot plan be lined and reserved for off-street parking and parking not permitted in the driveway; and 5) that the varian be granted for a ten year period and at the end of said ten year period this activity be relocated where it will be more compatible with surround- ing properties. The Planning Director added in part that in his opinion the Planning Commission had in mind that basically the subject area is residential, and that although Girl Scout activities are desirable they do not blend well with the rest of the area; that they recognized that both the City Council and the Planning Commission in 1954 approved the use of the particular building on this lot for Girl Scout activities and also approved another variance in 1958 which enabled the Girl Scouts to construct a new building specifically for Girl Scout activities, and 2. 11-7-61 14:5518 could not at this time, in view of the investment made, recommend the vacation of the premises immediately; however, that eventually an activity such as this should be relocated. Mr, I, Guarda1abene, 517~ South Third Avenue, addressed the Council and stated in part that he had originally approved of the zone variance but had since changed his mind due to the fact that the petition was misrepresented in that he had been under the impression that the request was just for a patio and not for greater activities; also that he is against the outdoor stoves and outdoor fires as being fire hazards inasmuch as they are too close to the property line. I In answer to various questions, including that of the time limit on the prior zone variances and their conditions, the City Attorney advised that the resolutions of the City Council approving the two prior variances do not specify a time limit but that they make reference to the files in order to spell out the precise uses permitted, He also explained in detail the usual procedure of a hearing on appeal and suggested that it might enable the Council to more fully interpret the facts as they are presently presented if a staff report were submitted to them at the next Council meeting which would sunmtarize the entire background and pertinent features of the subject matter, Mr. Hahn again spoke, stating in part that if the original application requested a ten year period that the present ten year variance would in effect be extending the original application and that in his opinion it should in no event go beyond the time requested in the original application, Councilman Camphouse agreed that a staff report covering background material was a good suggestion but that he did not think this hearing should be continued for that purpose; that he was familiar with the' background of the matter, having been on the Council at the time the original variances were granted, and had also attended the Planning Commission meeting at the time the hearing on the matter was held, and that perhaps the feeling of lack of background is that so far the Council has heard from only two persons, one being Mr. Hahn who did not represent the appellants at the Planning Commission hearing. To Councilman Reibo1d's comment that it was his recollection that the original variances were for an indeterminate length of time, Councilman Camphouse replied that he too recalled that this was so. The Planning Director advised that before matters such as this are taken to the Planning Commission there is a complete staff review and information is passed on to the Planning Commission; that if the Council so desired he would read such sunmtarization at this time. It being the consensus of the Council that the hearing proceed, Mayor Balser inquired if any other appellants desired to address the Council. I The following appellants spoke, their opposition being based in part on the increased activities, the fire hazard and smoke, the noise, increased traffic and non-resident participation; Mr. and Mrs, A. R. Fletcher, 600 South Third Avenue Mrs. F. C. Bishop, 511 South Third Avenue, No one else desiring to speak in opposition, Mayor Balser inquired if anyone desired to speak in favor of the requested zone variance. Mrs. Robert Solomon, 1428 Santa Margarita Drive, addressed the Council, and explained at length the purpose and functions of Girl Scouts; and answered questions relative to the time period on the prior zone variances. She also answered questions of the Council as to the number of Girl Scouts and adults frequenting the premises, their responsibilities, etc. She thereafter read a prepared statement (on file in office of the City Clerk) which also covered the primary functions of the Girl Scout program and the assurance of the Girl Scout Council that their use of the 3, 11-7-61 14:5519 premises will be kept within reasonable bounds, and any misuse of the property (excessive noise or smoke or disturbance) will be prevented. The statement also included that in deference to the objections of their neighbors to the use of the headquarters for overnight ?ctivities, they withdrew their request for permission so to do and requested the Council to so stipulate in their approval of the variance application that over- night use is prohibited. No one else desiring to be heard Councilman Reibo1d ~ that the hearing be closed, Councilman Phillips seconded the motion which was carried unanimously, Councilman Butterworth stated in part that he could see no reason to reach a conclusion at this meeting; that pe'rhapsc:other..factsccou1d"be before the Council, ,,"I Discussion ensued. Councilman Camphouse stated in part' that in his opinion to continue the matter would be an unnecessary delay; that the City originally invited the Girl Scouts to locate in the subject area; that sufficient facts have been presented at this hearing to enable the Council to arrive at a decision, and that he ~ that the Council approve the recommendation of the Planning Commission as contained in its Resolution No. 424 and grant the requested zone variance, Councilman Phillips seconded the motion, Councilman Butterworth MOVED that the above motion be tabled for two weeks, Councilman Reibo1d seconded the motion. Councilman Butterworth stated in part that he was not familiar with all of the facts in the matter, not having been present at the Planning Commission meeting, and that although not necessarily opposed to the requested variance, he desired additional time to think about it and that he felt his motion to table should be supported. Councilman Phillips stated in part that there should be some definition of the considerations before the Council at this time, to wit: the use of the area. That in his opinion this is not the issue inasmuch as the Girl Scouts have had and still have the right to use the land in accordance with the laws of the community; that in his opinion they could have a fire ring if it were not an open fire. That the placing of a roof over the concrete slab falls within the requirements of a variance and that this appears to be the sole problem. That the applicants have conceded a number of points, such as foregoing overnight usage. He suggested .that they might explore using a gas fire ring in cinder blocks. That although there might not be an emergency to resolve this matter at this meeting, still, in his opinion, the issue is clear and there is no reason.for delay. Councilman Reibo1d stated in part that inasmuch as the application was filed August 25, 1961, and there have been several continuances prior to this meeting that another two weeks delay for reconsideration would not be materially detrimental. I Mayor Balser stated in part that although the neighbors had valid objections, sufficient time has been spent on that phase, and that in his opinion the Girl Scouts want to be and will be good neighbors. That he has studied the minutes and resolutions of the Planning Commission on this matter and is familiar with the situation and cannot see what purpose could be served in delaying decision for two weeks. Councilman Butterworth then asked Mrs, Solomon if any emergency existed with which a two weeks delay would interfere and Hrs, SololllOn replied in substance that she had appeared on this matter many times and a1th~ugh there;.\o1as no..immediate .\lrgency, that she would like the matter settled, 4, 11-7-61 J. ?5~~' --- INDEXED I RECESS 14:5520 Whereupon the following roll call vote was taken on the motion to table: AYES: NOES: Councilmen Butterworth, Reibold Councilmen Camphouse, Phillips, Balser Upon the request of Councilman Reiboid, Councilman Camphouse amended his motion to include the further restriction that overnight sleeping, not included in Planning Commission Resolution No, 424, be prohibited, to which Councilman Phillips agreed as the seconding member. Said MOTION as AMENDED was carried on the following roll call: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ABSENT: None Mayor Balser declared a recess at 9:30 P.M. The meeting reconvened at 9:36 P.M. MATTERS FROM THE PLANNING COMMISSION: ZONE VARIANCE (Lutheran Church) P:~ , r/1'VV, INDEXED ZONE VARIANCE (Foothill Jewish Community Center) /"t ~'--i!/ ;b INDEXED MASTER PLAN OF HIGHWAYS ~: J;;t;G I INDEXEll SAN GABRIEL' FREEWAY Jr<5'/ ~~~L Planning Commission Resolution No. 423 recommending denial of zone variance request of the American Lutheran Church (130 West Duarte Road), Inasmuch as the applicant requested withdrawal of its requested zone variance, the City Attorney stated that a resolution covering same would be presented at the next Council meeting. Planning Commission Resolution No. 425 recommending denial of zone variance request of the Foothill Jewish Community Center to allow temple and religious school at 160 East Sycamore Avenue. Councilman Phillips MOVED that Council approve the recommendation of the Planning Commission as embodied in its Resolution No. 425, and that the petition of the Foothill Jewish Community Center for a zone variance to allow a temple and religious school at 160 E. Sycamore Avenue, be denied, and that the City Attorney be instructed to prepare a resolution accordingly. Councilman Camphouse seconded the motion which was carried on r~ll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ABSENT: None The Director of Planning advised that with regard to the notice received last April from the Regional Planning Commission of the proposed amend- ment No. 451 to the Master Plan of Highways that Sixth Avenue, between Duarte Road and Camino Real, and Fifth Avenue, between Duarte Road and Foothill Boulevard, be designated as 80 foot highways, that subsequent notice has been received that both Fifth and Sixth Avenues have been removed from the proposed amendment. After viewing and discussing the various routes 'of the proposed San Gabriel River Freeway between the San Bernardino Freeway and the Foothill Freeway as depicted on a wall map and being advised by the City Manager and the Director of Planning that the Planning Commission recommends for approval the route depicted as the orange-brown line terminating in Duarte near Bradbourne Avenue, such recommendation being based on difference in construction costs; the number of families to be removed and the number of parcels of land to be acquired as well as the benefit ratio being consistent with that of the other routes studied, Council- man Reibold ~ that the Council accept the recommendation of the Planning Commission as stated above. Councilman Camphouse seconded the motion which was carried unanimously. 5. 11-7-61 ZONE VARIANCE (Harding's Gardenland) 'I 14:5521 Mayor Balser declared that since no action can be taken until time for appeal elapses (11-9-61) the zone variance request of Harding's Garden- land, Inc. to use the 20 foot strip of land lying west of Second Avenue for storage of materials used in connection with their nursery (Planning Commission Resolution No. 427 recommending approval) will be held over until the appeal period has passed. ",' ::rr d tl:NDEXED MOTION by Councilman Butterworth, seconded by Councilman Reibold and carried unanimously that in compliance with the recommendation of the City Manager consideration of the commencement of negotiations for the I transfer or sale of certain excess Pacific Electric Railway Company property be tabled pending further staff study. Upon the advice of the City Manager that the Pacific Electric Railway Company has delivered to the Title Company a deed to the property purchased by the City, said deed to be delivered to the City upon certain conditions of payment (Total purchase price $375,000 plus other incidental charges of $1781), Councilman Phillips MOVED that Council accept the recommendation of the City Manager and authorize the appropriation for this purpose of $377,000, said appropriation to be transferred and appropriated as follows: 1. Transfer and appropriate $200,000 from the Water Fund Earned Surplus Account No. 291 to Capital Improvement Projects Account No. 205, Property Purchase, Huntington Drive Extension; 2. Transfer and appropriate $67,572.66 from Reserve for Capital Projects Account No. 285 in the General Fund to Capital Improvement Project Account No. 205; 3. Appropriate $48,427.34 from Capital Improvement Project Surplus Account No. 290 to Account No. 205; 4. Transfer and appropriate $61,000 from General Fund Unappropriated Surplus Account No. 290 to Capital Improvement Projects Account No. 205. That the $200,000 appropriated from the Water Fund be repaid to said fund upon subsequent sales of the excess property involved, Motion seconded by Councilman Camphouse and carried on roll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ABSENT: None Councilman Reibold then ~ that the City Manager be authorized to I enter into escrow for the acquisition of said property. Councilman Camphouse seconded the motion which was carried unanimously. MOTION by Councilman Camphouse, seconded by Councilman. Reibold and carried on roll call vote as follows that Council accept the recommen- dation of the City Manager and the Library Board and authorize the transfer of $879 ($809 installation, plus 7 months maintenance $70) from Unappropri- ated Surplus Library Fund No, 290 to the Library Building and Maintenance Account No. 460-38 in the Library General Fund, for the purpose of installing a sprinkler alarm system by Tele-Fire of California, Inc. at 6. 11-7-61 I LIBRARY (Construction of Parking Lot) :J f17~ ,fr(? 'INDEXED 14:5522 the Library connected directly with Fire Headquarters, such installation to help prevent excessive fire and water damage in the Library in the event the alarm is not heard or reported: AYBS: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOBS: None ABSBNT: None Discussion was held on the cost estimate submitted by the City Manager of $18,687 for the construction of a parking lot westerly of the Library; said estimate contemplating the cost of improving the 195' x 405"parcel immediately west of the Library site by the installation of two driveway entrances, grading, installation of 2-1/2" asphaltic concrete pavement, etc., and to install a curb and gutter at the southerly end of the subject improvement to take care of part of the drainage, and in addition the construction of approximately 200 feet of storm drain pipe to take care of the balance of the proposed improved parking lot and drainage pipe to eliminate existing ditch in rear of the library. The City Manager advised that should Council desire to consider improving only a portion of the area at this time that it is estimated this would cost approximately $12,000, and that in such event he recommended the front half of the total area be improved. Whereupon Councilman Camphouse MOVBD that the Council instruct the Director of Public Works to proceed with the preparation of plans and specifications for the improvement of the subject area and that as soon as such plans and specifications are completed the City Clerk be authorized to call for bids for such work in conformance with said specifications on the entire parcel and also for alternates for the improvement of the front portion only of such area. Councilman Phillips seconded the motion which was carried unanimously, GASOLINE Upon recommendation o!)the City Manager, Mayor Balser ordered the report (Central regarding proposed central purchasing of gasoline through Los Angeles Purchase County referred back to staff pending an analysis and report on all through existing contracts and agreements between the City of Arcadia and the Los Angeles County of Los Angeles. County) rt~~~ The matter of whether to enforce universally Section 11.8 of the Uniform ~UNIFORM~NDEXEITraffic Ordinance, which reads as follows, after a suitable educational TRAFFIC . program or to resci~aid section, was discussed at length: ORDINANCB ' , (Section 11.8) "Section 11,8, All Night Parking Prohibited. No person shall stop, stand or park a vehicle on any street for a period of time longer than thirty (30) minutes between the hours of 2:00 A.M. and 4:00 A.M. of any day, provided that this section shall not apply to a vehicle of any regularly licensed physician when actually engaged in making professional calls .11 I 5!~ (f~ tII'/DEK.tD It was stated that this section has not been enforced since the adoption of the ordinance based on the fact that there appeared to be no great problems involved and could be handled on a complaint basis; however, a check by the police department a year ago disclosed 700 violations of said section whereas a check in October, 1961 disclosed 1154 violations, indicating a growing problem in this regard; that complaints are received about cars in violation and explanation is difficult as to why no action is taken, and that it is necessary to decide whether the said section should be enforced or rescinded. The Chief of Police entered into the discussion and described the problems that would be encountered in the enforcement of the ordinance; however, that in his opinion proper respect for the law required either its enforcement or rescission; that if Council desires the ordinance enforced, an educational program be instigated, warning citations given 7, 11-7-61 BURGLARY PREVENTION (Commercial) ,/ STOP SIGNS d',~ . ~~ INDEXED 14:5523 at the commencement of the program and thereafter traffic citations with no exceptions, The subject of temporary permits of approximately a week's duration for visitors of permanent residents was discussed, as well as permission for residents to park on the street permanently in such cases where no off-street parking was available within a reason- able distance and that such permit be granted only for proven good cause and a sizeable fee charged for same, It was also stated that enforce- ment of the ordinance would result in an improvement in the aesthetic appearance of the City's streets, as well as improving traffic safety, an easier street sweeping program and the ability of the police to notice unfamiliar cars in a neighborhood, 1961 that in the interim warning notices be placed upon cars and as much publicity as possible be obtained to give notice of the enforcement; and that the staff proceed with some kind of a temporary permit in extreme cases, Councilman Butterworth seconded the motion which was carried on roll call vote as follows: Councilman Phillips then MOVED that the Manager and the Police Chief to enforce Traffic Ordinance; that the enforcement Council instruct the City Section 11,8 of the Uniform become effective January 2, AYES: Councilmen Butterworth, Camphouse, Reibo1d, Phillips, Balser NOES: None ABSENT: None The City Manager distributed to the Council pamphlets regarding burglary prevention, and stated that said pamphlet will be distributed to the Chamber of Commerce and all commercial establishments within the community, The Chief of Police added that the Arcadia police force will offer its services to the merchants if they wish in a program of instructions on security. In answer to a query as to information regarding residential burglary prevention, the Chief of Police advised that the Los Angeles County Sheriff's Department has such information, MOTION by Councilman Reibo1d, seconded by Councilman Camphouse and carried unanimously that Council accept the recommendation of the City Manager, the Director of Public Works and the Police Department and authorize the installation of boulevard stop signs at the following locations: On Catalpa Road at A1tura Road Stop sign for westbound traffic On Volante Drive at A1tura Road Stop signs for eastbound and westbound traffic On La Rosa Road at A1tura Road Stop sign for eastbound traffic On Encanto Drive at A1tura Road Stop signs for eastbound and westbound traffic I On Panorama Drive at A1tura Road Stop signs for eastbound and westbound traffic On Corto Road at A1tura Road Stop sign for westbound traffic On De Anza Place at A1tura Road Stop sign for eastbound traffic On Columbia Road at A1tura Road Stop sign for eastbound traffic 8. 11-7-61 CURB &; GUTTER ' CONSTRUCTION (Live Oak) J 701 ..':\ ' I ,/ "N])EXEn I CIVIL DEFENSE ~ -' r.,."""~ t- .. :INDEXED PECK ROAD SPREADING BASIN (Santa Wash - .. ., 14:5524 The City Manager reported that in accordance with the City Council decision of March 21, 1961, after "Notice to Construct Curb" was duly mailed and posted, one owner having failed to construct the required curb and gutter within the 60 day period provided by Section 5880 Streets and Highways Code, the Superintendent of Streets caused the curb and gutter to be constructed adjacent to the parcel at a cost of $416.58, said cost to be assessed to one parcel of property located at the corner " of Live Oak Avenue and Las Tunas Drive described as follows: United California Bank, executor for estate of Herbert Kalliwoda; A portion of Lot 69, Santa Anita Colony Tract, MR 42-87; 0.30 more or less acres being (except of streets) that part lying southwest of Las Tunas Drive and easterly of a line parallel with and distance easterly measured at right angles 351 feet from westerly line of said lot, MOTION by Councilman Phillips, seconded by Councilman Reibold and carried unanimously that Council acknowledge receipt of the report of the Superintendent of Streets; that the matter be set for public hearing at 8:00 P.M., November 21, 1961, and the staff instructed to give appropriate notice. Mayor Balser ordered filed the communication from the Stanford Research Institute (reply to City's inquiry as to their availability for making a civil defense survey in Arcadia) wherein they indicate that they could serve no useful purpose at this time in view of the background of information pertaining to various requirements for survival following nuclear attack already developed by the City. Mayor Balser added that as recommended by the City Manager, the City will continue its efforts on a local level through its existing facilities, with the guidance of the newly formed Arcadia Civil Defense Board and assistance of established area, County, State and Federal agencies. The City Manager advised that the Los Angeles County Flood Control District proposes to construct fencing along the Santa Anita Wash from Peck Road Spreading Basin northerly to Sierra Madre Wash; and, in addition, to Anita modify the existing levies along the northerly side of the Peck Road Fencing)Spreading Basin in the vicinity of the Par 3 Golf Course. That plans have been submitted to the Department of Public Works for the proposed fencing and levy reconstruction along the Peck Road Spreading Basin and Santa Anita Wash, northerly to Live Oak Avenue. 1 ,.1 ~-Il iIlIDExEn I CADWALLADER PROPERTY "L ,:? '" VI :r ~) }i # r:INrrEXEn MOTION by Councilman Reibold, seconded by Councilman Phillips and carried unanimously that Council accept the recommendation of the City Manager and the Director of Public Works and approve the work contemplated on Los Angeles County Flood Control District Plan No, 22l-D89.l through 9.3 both inclusive and plan No, 36-D39.l and ,2 subject to the conditions set forth in the report of the Director of Public Works dated November 2, 1961, The City Manager stated that after reviewing the Council minutes of October 10, 1961, with respect to the proposed acquisition of the Cadwallader property, from which meeting he was absent, he wished to make the following clarifications of statements made at said meeting as to exactly what transpired during the negotiations: "On May 3, 1961, as a result of Council action which authorized the City Manager to begin negotiations for these properties, we had prepared an appraisal of the property by Mr. Richard W. Puffer, who appraised the property at $84,975 which we rounded out to $85,000, I pointed out that the appraiser selected for this work has appraised a full appraisal that could be used by the City for the purpose of condemnation. Under such circumstances we would not reveal the 9. 11-7-61 / 14:5525 actual appraised amount or the details of the appraisal. However, since we do not contemplate condemnation action in the matter we feel free to quote these figures and offer you an opportunity to review the complete contents of the appraisal. We are therefore prepared to carry out the acquisition of the property by recommending to the Council a purchase price of not to exceed $85,000. We invited them to review the appraisal and to reply. They did not reply by written communication but made several trips into the office wanting considerably more than this. As a result of that we had a second appraisal made from a list of appraisers that one of their representatives had recommended to us and, one of these appraisers we did employ, and he came up with a price of $104,000. We then sent him a communication on August 2, 1961 stating that on the basis of the new appraisal that we would recommend to the City Council the acquisition of the property at $100,000. We finally received a written reply August 9, 1961 which stated that they had been dealing with us on the basis of the total price of $125,000. "1 would like to point out that nowhere during discussions have we ever reaChel an agreement as to a fair price for the land. 1 informed Mr. Cadwallader as well as Mr. Pratt, who represented him on a couple of occasions, that if the property was worth the figure that they set, and for which they intimated they had offers, that certainly they should go ahead and sell this land, because the City did not want to stand in the way of a sale, and that we would not proceed on condemnation. They subsequently offered to sell us the property for $110,000. "At your meeting of September 21, 1961, the matter was reviewed, the financial condition of the City was pointed out, and you authorized the City Manager to attempt to secure an 180 day option to purchase the property for a total of $105,000 with $5000 to be paid upon the execution of the option. This was delivered to their office the following morning. We heard nothing from them on the matter at all, except that they were not satisfied with the matter and had appeared before you on October 10, 1961. "Again 1 would like to say that at no time did we make any offers other than the two that we mentioned, nor did we advise them to do anything but sell the property if they had an opportunity to sell it. "At your October 10, 1961 meeting you passed a motion to withdraw the option offer. Subsequently, however, after the passing of the motion, while there was not another motion made, the owners were requested to consult with the Manager. Shortly after my return 1 did sit down with them and discussed the matter in great detail and today received a letter from them as follows: '650 W. Duarte Rd. It was brought out in part that the City has an abatement procedure in its zoning ordinance which has not been used on many occasions, but which would ultimately provide for the elimination of such equipment. That some of the equipment has already been removed or converted to other uses; that the ban on keeping chickens on a commercial basis is less than a year old and doubtless much of the equipment will be removed in the foreseeable future, some by subdivisions being constructed in the area, etc, That some eastern cities have laws based solely on ~esthetics and eventually that might be possible here; that other cities, among them Colton and Beverly Hills, have enacted laws for the removal of unsightly buildings that are inadequately maintained, abandoned and the like, that such law might be feasible here. 11. 11-7-61 14:5527 To Mr. Landvogt's remark regarding the unsanitary condition of such equipment, particularly with .regard to rodents, he was advised that the Health Department, as well as the City's Building and Fire Departments inspects such areas and requires adherence to the City's Health and Fire Codes; that any complaint in this regard if furnished to the City Manager's office will receive prompt attention. It was suggested that the City might adopt an ordinance similar to that adopted for the elimination of the commercial raising of chickens; or the enactment of legislation restricting the raising of parakeets to a hobby only and the number that would constitute a hobby. Mr. Lloyd Porter, 229 West Las Tunas Drive, addressed the Council and advised in substance that he has been breeding and raising parakeets as a hobby for approximately 13 years and has never heard any complaints registered by his neighbors; that in his opinion complaints as to noise could be eliminated by proper screening, such as a wall or hedge. He requested the Council not to restrict such a hobby as to numbers inasmuch as it is necessary to have about 200 to successfully enter such birds in shows, etc, He suggested as an alternative to restricting numbers that the matter be handled on a nuisance basis. Mrs. E. S. Fisher, 485 West Wistaria, addressed the Council, and stated in part that she agreed with the Co1vins that the breeding and raising of parakeets .on a commercial basis in a residential area is a detriment to the neighborhood, She added that the subject area where the parakeets are housed is in an unkempt condition as well as being noisy; that there is no screening, and agreed with the question asked of her, that a six foot solid brick wall would reduce the noise factor. After further discussion, some restrictive measures Balser ordered the matter it being the consensus of the Council that should be adopted on the subject matter, Mayor referred to staff for study and report. MOTION by Councilman Butterworth, seconded by Councilman Reibold and carried unanimously that Council approve the recommendation of Councilman Camphouse and direct the City Manager to write to Supervisor Bonelli requesting his assistance in lighting the baseball diamond in the County Park in Arcadia, making night games possible. Councilman Camphouse called attention to the fact that low water pressure hindered the work of the firemen at the recent Bel Air fire and suggested that the staff and Fire Department investigate and have available current data on necessary equipment to handle fire emergencies, including pertinent information on water pressure. Mayor Balser advised that the Civil Defense Board was duly inaugurated October 31, 1961 and that he had appointed Councilman Butterworth as Council's liaison with said Board.
