CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
NOVEMBER 21, 1961
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8:00 P.M., November 21, 1961.
The Invocation was offered by Rev. Eugene E. Collins, Pastor of the
Arcadia Friends Church.
Mayor Balser led in the pledge of allegiance to the flag.

MOTION by Councilman Reibo1d, seconded by Councilman Butterworth and
carried unanimously that the minutes of the Regular Meeting of November
7, 1961 and the Adjourned Regular Meeting of November 10~ 1961, as
submitted in writing, be approved.
MOTION by Councilman Camphouse, seconded by Councilman Reibo1d and
carried unanimously that the protest and zoning hearing on the proposed
annexation to the City of Arcadia of certain territory adjacent and
contiguous to the present City limits, designated as "Annexation No.
28, Southeast Arcadia Uninhabited" be continued to the next regular
Council meeting (December 5, 1961).
Mayor Balser declared the hearing open on the report on the cost of
construction of curb and gutter (131 lineal feet on Live Oak Avenue
between E1 Monte Avenue and Las Tunas Drive) and inquired of the City
Clerk if any written protests had been received, or if anyone in the
audience desired to object or protest the cost of such construction.
No written protests having been received and no one desiring to be
heard, Councilman Camphouse MOVED that the hearing be closed. Motion
seconded by Councilman Butterworth and carried unanimously.
Councilman Butterworth MOVED ,that the Street Superintendent's report on
the cost of constructing curbs and gutters on the north side of Live
Oak Avenue east of Santa Anita Avenue be approved and the cost thereof
be assessed against the abutting property and be collected with the
forthcoming fiscal 1962-63 tax bill. Councilman Reibo1d seconded the
motion which was carried unanimously.
Mayor Balser declared the hearing open on the application of Michael L.
Richards, 1978 E. Orange Grove Blvd., Pasadena, for a business permit to
solicit door to door for sales and maintenance of E1ectro1ux products,
Mondays through Saturdays, 9:00 A.M. to 5:00 P.M. and evenings by
appointment; and inquired if anyone in the audience desired to address
the Council regarding the matter.
The City Clerk read two letters received from the applicant, one from
the E1ectro1ux Corporation, authorizing the applicant to solicit business

representative in the City, agreeing to applicant also soliciting in the
City; said letters having been submitted by the applicant in conformance
with the prior request of the Council.

Mayor Balser declared the hearing open on the application of Donald D.
Spencer, 1116 South Tenth Avenue, Arcadia, for a business permit to
install and operate two amusement games of skill at the Hofbrau, 29
East Huntington Drive (Shuffleboard and Pool Table).
In response to Mayor Balser's query as to whether anyone in the audience
desired to address the Council in regard to the matter, the applicant
spoke and advised in substance that he and his wife run and operate the
establishment known as the Hofbrau; that his business consists of selling
food, beer and soft drinks; that he sells no hard liquor; that in his
opinion amusement machines are the stock in trade of a tavern; that
such machines are operated in similar establishments in the City and,
therefore it is necessary that his establishment have such machines in
order to meet competition. That he is aware of the City's regulations
with regard to the operation of amusement games and that he will abide
by such regulations and will endeavor to function in such a manner as
will in no way reflect to the discredit of the City.
No one else desiring to be heard, Councilman Phillips MOVED that the
hearing close. Councilman Reibold seconded the motion which was
carried unanimously.
Councilman Butterworth stated in part that he could see no reason to
differentiate between this applicant and other operators of skill games
in Arcadia, but that for the benefit of the applicant he desired it
understood that the Council has under consideration the banning of all
skill games in Arcadia; that this is not in ordinance form as yet but
that the applicant should keep this in mind in the acquisition of any
such merchandise, and that under such circumstances, he MOVED that the
Council approve the application of Donald D. Spencer for a business
permit to install and operate two amusement games (Shuffleboard and
Pool Table) at the Hofbrau, 29 East Huntington Drive, Arcadia. Council-
man Reibo1d seconded the motion which was carried on roll call vote as
follows:

Councilman Reibo1d ~ that the recommendation of the Planning
Commission embodied in its Resolution No. 427 be approved and that the
petition of Harding's Garden1and, Inc. for a zone variance to use the
20 foot strip of land lying west of Second Avenue and between Sandra
Avenue and the alley to the south for storage of materials used in
connection with their nursery be approved upon the conditions recommended
by the Planning Commission, and that the City Attorney present a
resolution accordingly. Councilman Butterworth seconded the motion
which was carried on roll call vote as follows:

Whereupon the City Attorney presented, explained the content and read the
title of Resolution No. 3438, entitled: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A ZONE VARIANCE TO PERMIT
THE USE OF PROPERTY AT THE SOUTHWEST CORNER OF SANDRA AND SECOND AVENUES
FOR THE STORAGE OF SPECIFIED MAXERIAL USED IN CONNECrION WITH HARDING'S
GARDENLAND, INC."

Planning Commission Resolution No. 428 recommending the establishment of
certain requirements for disaster shelters if located within the required
front yard.
the Director of Planning advised in part that the Planning Commission had
thoroughly. studied the conditions under which said shelters could be
constructed and had recommended that permits for construction be issued
only upon those requirements.
In the discussion that ensued the subject of locking such shelters in
order to keep them from becoming an attractive nuisance to children was
explored. It was suggested that a locking device enclosed in glass with
an alarm system when broken be made a condition. Also that inasmuch as
such "structures could interfere with the appearance of city streets, that
it be a condition that they should be constructed in back yards if ample
space existed.
It was the consensus of the Council that this matter should be referred
to the Civil Defense Board for their study and recommendation, but that
due to the urgent nature of the matter, that Council accept ,the recommen-
dations as presently set forth in said resolution; that the granting of
permits be based on such other regulations as the Council may adopt after
consideratipn of further recommendations from other appropriate agencies.
~hereupon Councilman Phillips MOVED that the Council accept the recommen-
dation of the Planning Commission as contained in its Resolution No. 428;
that said resolution be referred to the Civil Defense and Disaster Board
for their recommendation for any future addendum. Councilman Reibo1d
seconded the motion which was carried unanimously.
Mayor Balser requested Councilman Butterworth, as Council's liaison with
said Civil Defense Board, to inform said Board as to Council's discussion
regarding the subject of locking disaster shelters.
Planning Commission Resolution No. 429, recommending the reclassification
of two lots at the northeast corner of Las Tunas Drive and Baldwin Avenue
from Zone R-1 to Zones C-2 and D; and Planning Commission Resolution No. 430,
recommending the reclassification of certain property on the north side of
Las Tunas Drive, east of Baldwin Avenue from Zone R-l to Zones C-2, D and
P, and denial of the requested C-2 reclassification for one lot on
Baldwin Avenue, north of Las Tunas Drive, requiring a public hearing,
Councilman Phillips ~ that the hearings be scheduled for December 19,
1961. at 8:00 P.M. Councilman Camphouse seconded the motion which was
carried unanimously.

Located at the southeast corner of Foothill Boulevard and Burnell Oaks

The Planning Director displayed a map of the proposed subdivision and
explained in part that the subdivider proposes a private service road
along Foothill Boulevard to avoid driveways opening to the boulevard,
and that the lot sizes are above the minimum requirement of Zone R-1.
After discussion as to the advisability or necessity of the street
being 50 feet wide with 5 foot planting and sidewalk easements on both
sides, and explanation by the Director of Public Works as to the reasons
therefor, Councilman Phillips MOVED that Council accept the recommen-
dation of the Planning Commission and grant approval of tentative map
of Tract No. 27037, subject to the above conditions. Councilman Reibo1d
seconded the motion which was carried on roll call vote as follows:

bids be awarded to Senk Construction Company, in the amount of $238,606.

The City Manager advised that Item 2 is for the additional concrete work
and fencing in connection with the utilization of the reservoir.'.roof for.,
four tennis courts and that due to some objections received from adjace~t
property owners regarding the construction of said tennis courts, it is
recommended that said Item 2 be held as a firm bid for 60 days; that
during the interim an attempt will be made to resolve the objections
and if resolved, said Item 2 can be awarded at a subsequent Council
meeting. .
MOTION by Councilman Camphouse, seconded by Councilman Reibo1d and
carried on roll ca11'vote as follows that Council accept the recommen-
dations of the City Manager, the Water Superintendent and Per1iter &
Soring; that a contract for Item I, for the construction of a 3.4
million gallon reservoir at the southeast corner of Orange Grove and
Baldwin Avenues be awarded to Senk Construction Company in the amount of
$238,606, funds for such construction being provided in the 1961-62
Water Department Budget; that all other bids be rejected; that any
irregularities or informalities in the bids or bidding process be waived,
and that the Mayor and City Clerk be authorized to execute such contract
on behalf of the City for the performance of the contract and in the
amount specified, in form approved by the City Attorney; and further
that the bid submitted by the Senk Construction Co. on Item 2 be held
firm for sixty days:

a revised fee schedule of $12 for the first four units plus 50~ per

each City Council and School District Boards of Trustees express their
views as to whether or not an election should be called .to determine

of the Arcadia Municipal Code to provide for a $20.00 fee to be paid
with each application for a permit from the Council for any business
for which such a permit is required, and that Section 6311.9.1 of said
Code, providing for the refund of unused portion, be repealed;

RIVER 1961 on the proposed San Gabriel River Freeway the predominent request

The City Clerk read a letter dated November 16, 1961 from Mrs. J. R.
Grime, 208 Cabri110 Road, referring in part to a fatal accident which
occurred on said street on November 15, 1961, wherein a car struck a
pedestrian, and requesting street lights at corners, intersections and
crosswalks; also stop signs on Hugo Reid Drive and Cabri110 Road and
regular police patrol in that area in an effort to stop speeding cars.
The City Manager advised that he had been informed that the accident was
due partially to the vehicle being on the wrong side of the road and
that a manslaughter charge has been lodged against the driver. He added
that with regard to street lights, representatives of the Village had
conferred with the Engineering Department and that the Edison Company
has assigned a street lighting engineer to work with said representatives
for the purpose of developing a street lighting system in that area.
Also, that it was his understanding that the subject area was developed
during the war when there was a shortage of underground cable but that
at such time approximately $20,000 was placed in trust by the developers
for the purpose of installing street lights.
A general discussion then ensued regarding the need for adequate street
lighting for the entire City, and it was the consensus of the Council
that the matter needed consideration.> Whereupon Mayor Balser referred
the subject to the City Manager, commenting that special attention be
given the placing of lights in front of schools and churches.
Councilman Camphouse MOVED that No. 1149, inadvertently assigned to an
ordinance earlier in the evening, be changed to Ordinance No. 1146.
Motion seconded by Councilman Phillips and carried unanimously.
Councilman Camphouse suggested that Mayor Balser send a letter of
commendation to the respective units, such as the County Fire Department,
County Forestry Service and the City Fire Department, responsible for
the quick action taken last week in preventing what could have resulted
in a major fire in the foothill area, and Mayor Balser stated that this
would be done.

MOTION by councilman Butterworth, seconded by Councilman Camphouse and
carried on roll call vote' as follows that the Council accept the recommen-
dation of the Civil Defense and Disaster Board and authorize the transfer
from Account No. 409-28 in the General Fund to Account No. 423-10 in the
General Fund of the sum of $2500 for Civil Defense purposes, including
the purchase and mailing of publications to the residents.
To Mayor Balser's inquiry as to whether the Council had any'comments to
make with regard to the audit report and financial statement as of June
30, 1961, made ~y Lybrand, Ross Bros. and Montgomery, and accepted by
the Council at the Council Meeting of November 7, 1961, Councilman
Butterworth referred to that portion of the audit wherein the auditors
state that the Council is proceeding ineptly along the line of depreCiatiol
in connection with the fixed assets of the Water Department, and stated
in part that inasmuch as this same statement has been made by these
auditors in other reports" he did not understand either their reason
therefor, nor Council's reason for not adhering thereto. That if the
Council did not agree with' the recommendation perhaps another auditing
firm should be employed for comparison purposes. He also inquired as to
whether there might be any individual liability of Councilmen in under-
taking certain courses of action contrary to recommendation.
The City's method of depreciation with regard to the Water Department
was discussed at length and also the fact that it is probably a matter
of judgment as to how detailed the accounting should be for the purpose
of arriving at a depreciation reserve figure, in which event there would
be no legal liability. \
Councilman Camphouse ~ that the Mayor's committee on auditing confer
with Lybrand, Ross Bros. & Montgomery regarding the depreciation phase
as well as the question of Council's individual responsibility in
connection therewith.
There being no second to the above motion, Councilman Butterworth
suggested that said auditing firm be invited to address the Council at
perhaps a pre-council meeting to explain their position in the matter.
Mayor Balser thereupon requested the City Manager to make the necessary
arrangements.
Mayor Balser distributed to the Council and the City Clerk copies of the
Special Audit.
MOTION by Councilman Phillips, seconded by Councilman Camphouse and
carried unanimously that in view of the Council's directive to the
City Attorney to prepare an ordinance banning all live stock except
horses, the Planning Commission be requested to consider the
elimination of the keeping of live stock as a use pe~ssible in the
single family residential zone.
At 10:01 P.M. Councilman Camphouse MOVED that the meeting adjourn to
November 29, 1961 at 7:00_P.M. Councilman Phillips seconded the motion
which was carried unanimously. '
