Duarte Road) .1-7553 INDEXED I ORDINANCE NO. 1157 (Introduced) J- rf63 IIllDEXED 14:5548 M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING DECEMBER 5, 1961 The City Council of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 P.M., December 5, 1961. The Invocation was offered by Rev. J. Davis Barnard, Pastor of the Arcadia Presbyterian Church. Mayor Balser led in the pledge of allegiance to the flag. PRESENT : ABSENT : Councilmen Butterworth, Camphouse, Phillips, Balser Councilman Reibold MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that the minutes of the Regular Meeting of November 21, 1961 and the Adjourned Regular Meeting of November 29, 1961, as submitted in writing, be approved. MOTION by Councilman Phillips, seconded by Councilman Camphouse and carried unanimously that the protest and zoning hearing on the proposed annexation to the City of Arcadia of certain territory adjacent and contiguous to the present City limits, designated as "Annexation No. 28, Southeast Arcadia Uninhabited" be continued to the Council, meeting 'of Janua:ry~ 2'; ;1'96lL.., ." Mayor Balser declared that pursuant to Resolution of Intention No. 3427, adopted by the Council on November 7, 1961, this is the time and place to hear any objections to the proposed vacation and abandonment of a portion of the first alley south of Duarte Road easterly from Second Avenue for street purposes, as more particularly described in Section 1 of said resolution. The City Clerk advised that she had on file affidavit of posting of notice of alley vacation and affidavit of publication of Resolution No. 3427; also that no written protests had been received. No one desiring to be heard Councilman Phillips MOVED that the hearing be closed. Motion sec~nded by Councilman Butterworth and carried unanimously. The City Council finding that the said portion of an alley known as the first alley south of Duarte Road (more fully described in said Resolution No. 3427) is no longer required and indicating its intention to vacate and abandon said property, the City Attorney presented, explained the content and read the title of Ordinance No. 1157, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF THE FIRST ALLEY SOUTH OF DUARTE ROAD EASTERLY FROM SECOND AVENUE IN SAID CITY." MOTION by Councilman Phillips, seconded by Councilman Camphouse and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1157 be waived: AYES: Councilmen Butterworth, Camphouse, Phillips, Balser NOES: None ABSENT: Councilman Reibold 1. 12-5-61 Hl;:ARING (Vacation - St. Joseph Street) :J- 9{ 5" 'I lNDEXED ORDINANCE NO. 1158 (Introduced) l' '3' ,; 'I CALL FOR BIDS (Pumping Unit) 14:5549 Councilman Phillips further MOVED that Ordinance No. 1157 be introduced, Motion seconded by Councilman Camphouse and carried on roll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Phillips, Balser NOES: None ABSENT: Councilman Reibold The City Manager advised that the City Council had previously indicated its desire to proceed with the proposed vacation upon various conditions, one being the installation of curbs and gutters along Front Street to connect to the existing curb and to extend the same northwesterly to St. Joseph Street, thence westerly along the south side of St. Joseph Street I to Santa Anita Avenue and to construct the curb return at the intersection of St. Joseph Street and Santa Anita Avenue. That all the conditions have been complied with, excepting the installation of curb and gutter and that the Engineering Department is presently recommending delaying such installation until Santa Anita Avenue, between Huntington and Colorado is improved. Mayor Balser then declared that pursuant to Resolution of Intention No. 3428, adopted by the Council on November 7, 1961, this is the time and place to hear any objections to the proposed vacation and abandonment of a portion of St. Joseph Street for street"purposes, as more particular- ly described in Section 1 of said resolution. That District No, 9 owes the City approximately $1000 of the original ,$5800 advanced for the installation of steel standards; that since this money is being repaid by a 100% charg~'of maintenance cost to the District, it will be necessary to continue this as a separate District until all money due is repaid. . Whereupon Councilman Butterworth ~ that the City Engineer file a report on December 19, 1961 in accordance with the provisions of the Municipal Lighting Maintenance District Act of 1927, Division 14, Part 3 of the Streets and Highways Code. Coundilman Phillips seconded the motion which was carried unanimously, Upon Councilman Camphouse requesting that the recommended installation of boulevard stop signs, to stop northbound and southbound traffic on Oakwood Drive at Sycamore Avenue, be held in abeyance pending a further survey of the traffic pattern in the area, Councilman Phillips MOVED that the Traffic Engineer be directed to investigate the matter and the traffic problem which might occur if said recommended boulevard stop signs were installed and to submit his report to the Council. Motion seconded by Councilman Butterworth and carried unanimously. Easterly extension of Magna Vista Avenue and its connection to LeRoy Avenue, west of El Monte Avenue - 9 lots. MOTION by Councilman Phillips, seconded by Councilman Butterworth and carried unanimously that the Council accept and approve final map of Tract No. 26537, subject to all the conditions set forth in the approval of the tentative map of said tract as of February 21, 1961; that the City Clerk be and she is hereby authorized and directed to endorse in due form such approval and acceptance on said map and affix thereto the Corporate seal of the City of Arcadia, and to certify to the adopcion and passage of this minute order at such time as there shall be deposited with the City of Arcadia a good arid sufficient Surety Bond guaranteeing certain improvements in said Tract No. 26537 pursuant to Section 9114.2 of the Arcadia Municipal Code. The City Attorney thereupon presented, explained the content and read the title of Resolution No. 3442, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DEDICATING REAL PROPERTY FOR STREET AND HIGHWAY PURPOSES TO BE KNOWN AS MAGNA VISTA AVENUE." The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1155, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 6311.9 OF THE ARCADIA MUNICIPAL CODE AND REPEALING SECTION 6311.9.1." Live Oak, Councilman Camphouse MOVED that the Pickup) matter be referred to the City Manager for contact with said market and ~, .,1-P~'_/~that he advise them of the City's regulations in this respect and mention ~: ~;-----~the fact that such separation is practiced by all other markets in the City. Pi<- INDEXED CIVIL DEFENSE 1,,"',', .OJ ...J MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that Council approve the ,request of the Arcadia Masonic Lodge and grant them permission to attach to the light standards in the business sections of Arcadia by cords, posters about 2 x 3 feet in size a short time before and remaining up during the Public Schools Week of April 30. through May 4, 1962, the posters to inform the public of the open house of the Arcadia Public Schools; that the above permission be subject to their obtaining approval of the Southern California Edison Co. for installation on their light standards; that such posters be removed by midnight of May 6, 1962; and that they obtain an encroachment permit from the State Highway Division if required. MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that the copy of a resolution receiyed from the City of South El Monte extending support for federal leadership in civil defense to the President of the United States be referred to the Arcadia Civil Defense and Disaster Board. I lNDEXED FIRE The Resolution from the City of Sierra Madre expressing appreciation for Arcadia's aid and assistance given their city in the recent mountain fire was received with thanks and ordered filed by Mayor Balser after copies of said resolution were distributed to the Council and appropriate I departments. FALLOUT SHELTERS 1- 'C3~ ~ IifDEJrED MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that the petition bearing 35 signatures, dated October 30, 1961, from home owners on Anita Crest Drive, requesting study as to the feasibility of constructing fallout shelters for the citizens of Arcadia, said study to be completed within 90 days, be referred to the City's Civil Defense and Disaster Board for action, and that the City Manager address a reply to the appropriate moving party or parties of said petition advising of, the,stuoy being'undertak&n. 5. 12-5-61 VARIANCE REQUEST (1110 S. Baldwin) J- g: ~-<6 INDEXED TOURNAMENT OF ROSES (Arcadia I s Float) JV, s, P. UNIFORM TRAFFIC ORDINANCE (Section 11.8) !'/. c;, p, 14:5553 Mrs. Ida May Specht, 1263 'E. Calaveras Street, Altadena, addressed the Council, requesting permission to conduct a ladies dress shop on a temporary basis in a residence located at 1110 South Baldwin Avenue (property located in a C-2 zone). Mrs. Specht explained that the owner of the residence has plans for the construction of a commercial building adjacent to said address and contemplates removing the restdence in order to provide parking for the new commercial building. - That she desires locating the subject business in the existing structure pending the completion of the new building, at which time she will be able to move her operation into the new structure. Also that all business activities will be restricted to the I first floor of the structure. The City Attorney advised that pursuant to Section 204-A of the Uniform Building Code of the City, as amended by Section 8130.2 of the Arcadia Municipal Code, Mrs. Specht must first file a written application stating the variance requested and the reasons therefor with the City Clerk; thereafter the City Engineer and the Chief Building Inspector shall investigate the premises and make their written report to the Council; also that the owners of real property within 50 feet shall be notified that such application has been made and that a public hearing wilL-be held after receipt of report from the City Engineer and Chief Building Inspector. Whereupon Councilman Butterworth MOVED that Mrs. Specht proceed in the manner prescribed by said Section 8130.2 of the Arcadia Municipal Code and that the City Engineer and Chief Building Inspector submit their report to the Council at the next Council meeting (December 19, 1961)'. Councilman Phillips seconded the motion which was carried unanimously. Mr. Wendell Bradbury, editor of the Arcadia Tribune, addressed the Council, stating that he represented Mr. Harold Roach, Chairman of the Arcadia .Tournament of Roses Float Committee, and requesting permission for volunteers from the Y-Teen groups of the High School to appear at all business areas of Arcadia between 4:00 and 8:00 P.M., beginning December 11, 1961, for the purpose of selling roses at $1.00 each to assist in reaching the goal set for Arcadia's float fund. MOTION by Councilman Camphouse, seconded by Councilman Butterworth and carried unanimously that Council grant the request of the Arcadia Tournament of Roses Float Committee and authorize a permit be granted to conduct the operation as described by Mr. Bradbury and that all fees otherwise applicable be waived. Discussion was held concerning protests received regarding the enforcement of Section 11.8 of the Uniform Traffic Ordinance (overnight parking) as ordered by the Council November 7, 1961. Several suggestions were made, among them being that a survey of the I regulations of other cities in this regard be made; that the Planning Commission restudy the City's parking requirements; that parking regulations apply on a zoning basis; that the ordinance involved be repealed and after a survey a new ordinance adopted. ' It being the consensus of the Council that no further action be taken regarding the aforementioned directive of the Council pending further study and report, Councilman Butterworth ~ that Council's action of November 7, 1961, regarding intensified enforcement of Section 11.8 of the Uniform Traffic Ordinance be rescinded pending the conclusion of further study and report by the City Manager of a survey of other cities' regulations in this regard, said report to be forthcoming not later than the first Council meeting in February, 1962. ADJOURNMENT I 14:5554 Upon the suggestion of Councilman Butterworth, Mayor Balser requested that the dissemination of the Civil Defense publications to be received from the Federal Government, be held in abeyance until the first week of January, 1962. Discussion was held on the lighting of the baseball diamond in the Arcadia County Park. The City Manager reviewed a construction schedule as submitted by Mr. Ronald Paige, Park Development Coordinator of the Los Angeles County Department of Parks and Recreation (copy on file in office of the City Clerk), and on the possible usage of the adjacent 40 foot strip on Huntington Drive. Council expressed concern over points of ingress and egress to the new parking areas. The City Manager advised that he will endeavor to secure and submit to the Council a preliminary final plan as proposed by the County officials. Proposed ordinances affecting abandoned buildings, amusement games and household pets were discussed. The City Attorney requested Council's opinions and guidance before making final drafts of the various ordinances. He suggested that bird owners advise him by telephone or letter as to the reasonable number of birds needed by breeders of show birds. It was suggested that in the matter of prohibiting the keeping of any animals, except horses, a period of six months after adoption of such an ordinance be allowed for o~ers to adjust numbers of pets, birds and animals to meet the new requirements. Mrs. Daniel Scanlon, 461 Palm Drive, addressed the Council and requested that prior to any final determination' by the Council as to the number of birds that could be kept as a hobby, a public hearing be held to enable interested persons to be heard on the subject. She added, in answer to a query, that in her opinion the minimum number should be approximately a hundred; however, that the keeping and raising of birds was her daughter's hobby and that she was more versed on the subject. She was advised that the Council would welcome information regarding quantity and it was suggested that her 'daughter and any of her friends or anyone else interested submit in writing what in their opinions would be a reasonable number of birds that could be kept as a hobby.
