REGULAR MEETING
DECEMBER 19, 1961
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8:00 P.M., December 19, 1961,
The Invocation was offered by Rev. Thatcher Jordan, Pastor of the Church
of the Good Shepherd,
Mayor Balser led in the pledge of allegianc~ to the flag,

MOTION by Councilman Camphouse, seconded by Councilman Phillips and
carried unanimously that the minutes of the Regular Meeting of November
21, 1961 as previously approved, be corrected by changing the figure of
$4950.00 appearing on page 5, under the heading "Bid Award - Truck
Loader" to $3995.00, and as thus corrected that they be approved,
MOTION by Councilman Phillips, seconded by Councilman Camphouse and
carried unanimously (with the exception of Councilman Reibold who abstained
due to absence from the December. 5, 1961 meeting) that the minutes of the
Regular Meeting of December 5, 1961 as submitted in writing be approved.
Mayor Balser declared the hearing open on the application of Mrs. I. M.
Hayes Specht for a variance from specified provisions of the Building Code
to allow the operation of a dress shop at 1110 South Baldwin Avenue on a
temporary basis, said property being in a C-2 zone, and inquired if anyone
in the audience desired to speak in favor of the granting of the requested
variance.
The applicant, Mrs, Specht, addressed the Council, stating that she had
nothing to add to the information presently in said application, In
answer to Councilman Phillips' query as to whether she was aware of the
eight conditions specified by the Director of Public Works and the
Superintendent of Building and Safety to be made a requirement of the
variance if granted, she replied that she was aware of said conditions
and that they were satisfactory.
To Mayor Balser's question as to whether anyone desired to speak in
opposition to the granting of the requested variance, Mr. Henry H, Hege,
651 Duarte Road, Arcadia, an attorney representing Arlinic Properties,
owners of property in the subject area, addressed the Council, stating
that he was not thoroughly familiar with the matter. He requested and
received permission to read the eight conditions mentioned above and
upon reading them' he stated in part that on behalf of his client he w~shed
to oppose the granting of the requested variance on the basis that the
subject building is old and that while his client is not opposed to a
retail dress shop in the area, it is felt that such a business should be
housed in a commercial building rather than in a residence.
Mrs. Specht then explained that the owner of the subject residence plans
the commencement of the construction of a commercial building adjacent to
the residence within six months and contemplates removing the residence in
order to provide parking for the commercial building; that she desires
locating in the subject residence in order to establish herself in that
area and contemplates moving her operation into the commercial building

To Mr. Hege's remark that prior to his client building in that area .they
were refused a similar variance, he was advised that in that particular
.instance a zone change was involved; that the subject residence is presently
in a C-2 zone and that if granted, will be for temporary occupancy only;
that there was assurance from the owner of the subject property that plans
for a new commercial building in that area are in process and that the
occupancy of the subject building under conditions as specified seemed to
be a better solution than permitting it to remain vacant.
The City Clerk read a communication dated December 14, 1961, from Edward
J, Markey, Trustee for the estate of the owners of the subject property,
which stated in substance,that he had read the conditions under which a
variance from the Building Code has been recommended for approval and that I
he agreed thereto,
No one else desiring to be heard Councilman Reibold MOVED that the hearing
be closed, Motion seconded by Councilman Phillips and carried unanimously.
Discussion ensued.
Councilman Reibold stated in part that he desired it understood that he
would not be willing to extend the requested variance but would be willing
to grant it for a year.
Councilman Phillips pointed out that inasmuch as condition No.4 states
that the property owner will commence construction of a commercial structure
on the site within six months from the date the variancesLarel'granted, that
if this condition is not met the variance would then be terminated.
Councilman Butterworth stated in part that inasmuch as the applicant has
indicated that the eight conditions are satisfactory, he MOVED that the
variance be granted from Sections 502 and l602(a) of the Uniform Building
Code, providing that the eight conditions as listed in the memorandum to the
Mayor and City Council from the Director of Public Works and the Superintendent
of Building and Safety, dated December 8, 1961 be made a condition of the
granting of the variance. Councilman Reibold seconded the motion.
Mayor Balser stated in part that he was strongly opposed to business in a
residential home in a business area; that there is a good business develop-
ment in West Arcadia and that he could see no justification in giving this
kind of a variance; that it is not compatible with the rest of the area.
Councilman Butterworth stated in part that the City needs business in West
Arcadia and the more business of the right type the better; that this
seems to be a good location and the applicant is apparently anxious to
become known at that location and that it is either an empty abandoned
building or a reasonable use thereof,
Councilman Camphouse stated in part that he was inclined to favor the six
months variance.
The City Attorney suggested that the variance be granted for six months
and automatically extended for an additional six months if the new
commercial building is started on the site within six months,

With the consent of Councilman Reibold, Councilman Butterworth amended his
motion to incorporate the City Attorney's suggestion to read as follows:
That a variance be granted from the provisions of Sections 502 and l602(a)
of the Uniform Building Code for a period of six months from date hereof
upon condition that the eight conditions listed in the December 8, 1961
memorandum to the Mayor and the City Council from the Director of Public
Works and the Superintendent of Building and Safety be complied with, said
variance to be extended for an additional six months if the proposed new
commercial building on the site be commenced within six months after date
hereof, and if so commenced and all of the eight conditions have been
complied with during said six months' period, the variance hereby granted
shall automatically be extended for an additional six months upon the

condition 4 as thus incorporated by reference;

Planning COllUllission Resolution No. 429 recommending reclassification
from Zone R-l to Zones C-2 and D (Architectural Overlay) Northeast corner
of Las Tunas Drive and Baldwin Avenue.
Planning COllUllission Resolution No. 430, recommending as follows:
(a) Approval of C-2, D and P at 525, 529, 601, 603 and 615 Las Tunas
Drive;
(~) Denial of zone change request at 2612 South Baldwin Avenue and at
525 Las Tunas Drive.
The Planning Director displayed an aerial map of the area and pointed
to the'subject lots. He explained the thinking of the Planning Commission
in making its recollUllendations (contained in said resolutions Nos, 429
and 430) and suggested that both the above Planning Commission resolutions
be considered at the same time.
Whereupon Councilman Reibold~, seconded by Councilman Camphouse and
carried unanimously that the hearings on Planning COllUllission Resolutions
Nos. 429 and 430 be consolidated, and that all testimony presented as to
the subject matter of either of said resolutions be received and made
part of the record as to each of said matters.
Mayor Balser then declared the hearing open on Planning COllUllission
Resolutions Nos. ,429 and 430.
The City Clerk read a communication dated December 18, 1961 from Fred B.
and Patricia Heartt, 479 Woodruff Avenue, stating in substance that they
approve the recommendation of the Planning COllUllission as to the property
at the northeast corner of Las Tunas Drive and Baldwin Avenue and oppose
the commercial variance requested by Mr. Stogsdill for Baldwin Avenue
north from Las. Tunas Drive.
Mayor Balser inquired if anyone in the audience desired to address the
Council in favor of the zone changes, and the following persons spoke:
Mr. Henry Shatford, 410 Drake Road, Arcadia, an attorney representing
Mr. Ralph D, Stogsdill, spoke at length, stating in part that he hoped
the Council would follow the recommendation of the Planning COllUllission
except as to the easterly 25 feet of lot 17 and the westerly 25 feet of
lot 16; that the conditions imposed are satisfactory to the applicant
except as to the condition with regard to air conditioning, which should
be subject to ordinary engineering and construction.
That with regard to the recommendation of the Planning COllUllission as to
Lot 2 on Baldwin Avenue, that said Baldwin Avenue is considered an
arterial highway; that directly across the street from lot 2 the develop-
ment is commercial; that in the opinion of the County of Los Angeles
planning experts C-2 backed up to R-l is not archaic but is compatible
and that the owner of lot 1 is agreeable to the requested zone change,
Mr. Robert E, Heale, 2604 South Baldwin Avenue addressed the Council,
stating that he is the owner of the property illUllediately north of lot 2
and that he favored it being rezoned to C-2; also that he intended apply-
ing for a zone change for his property.

Mrs. Pearl G. Shermerhorn, owner of the lot south of lot 2, addressed
the Council, stating in part that she favored the rezoning of lot 2 to
C-2.
No one else desiring to be heard Councilman Butterworth MOVED that the
hearing be closed. Councilman Phillips seconded the motion which was
carried unanimously.
Discussion ensued with reference to the conditions as outlined in said
resolutions, particularly with reference to the requirement of the
concrete block wall to be constructed along the north end of lot 21
and that any commercial building on said lot shall be set back 20 feet
south of the north lot line. It was stated that the construction of I
the wall might preclude the development of the adjoining lot for parking;
also if that requirement were eliminated it should be contingent upon it
being used for parking as long as it remains residential use.
Councilman Camphouse MOVED that the Council accept the recommendation of
the Planning Commission with respect to its Resolution No, 430 and
accept its recommendation contained in Resolution No. 429 except that the
requirement of subdivision h of section 3 be modified as follows:
"That concurrent with the construction of any commercial building on
lot 21 the concrete block wall when and if constructed shall be constructed
on the north line of said lot, leaving the fence requirement, provided,
however, that said wall may be eliminated the full length of lot 2
during such time as the southerly portion of lot 2 is developed and used
as a parking lot under applicable transitional use." Councilman Reibold
seconded the motion.
the City Manager commented on a point which was considered by the Planning
Commission in requesting the 20 foot setback, namely that if the lot is
zoned commercial a commercial building ~an be built out to the front
property line; that the Planning Commission was trying to protect the
adjacent residential lot by requiring access to the parking via the northerly
20 feet of the commercial lot and that he believed the recommendation of
the Planning Commission for the 20 foot setback was sound.
Ascertaining that Mr. Stogsdill was the owner of lot 2, he was asked if
this would be agreeable and he stated that he had no objection to remov-
ing the 20 foot setback, In answer to Councilman Butterworth's question
as to whether he understood that the Council was referring to the
recommendation of the Planning Commission with respect to lot 21 to ~he
south of him, and that by eliminating the requirement that any commercial
building put there must be set back 20 feet from the north lot line the
possibility exists that there will be commercial property out to the curb
line while :R~l':zoti.ing must be maintained on lot 2 to the north, Mr,
Stogsdill replied that he understood.
Whereupon, at the request of Councilman Butterworth that Councilman
Camphouse's motion be withdrawn and restated, Councilman Camphouse with- I
drew his motion and Councilman Reibold withdrew his second.
Councilman Phillips then MOVED that the recommendation of the Planning
Commission as contained in its Resolution No. 430 be approved, Councilma
Reibold seconded the motion which was carried on roll call vote as
follows:

Councilman Phillips further MOVED that the recommendation of the Planning
Commission as contained in its Resolution No. 429 be modified by
eliminating therefrom the condition contained in subsection h of section

Mayor Balser declared a recess at 9:25 P.M.
The meeting reconvened at 9:32 P.M.
Planning Commission Resolution No. 433 recommending interim emergency
zoning, if annexed, of PR-2 upon certain conditions concurrent with its
annexation to the City of Arcadia of certain property on the east side
of Lenore Avenue, south of Live Oak Avenue and north of Lynrose Street,
and abutting the southerly boundary of said City; and
Planning Commission Resolution No. 434, recommending the reclassification
upon certain conditions from Zone C-2 to Zone R-3 of property at the
southeast corner of Live Oak Avenue and Lenore Avenue;
requiring a public hearing, Councilman Phillips ~ that the hearing
be scheduled for January 2, 1962, Motion seconded by Councilman Reibold
and carried unanimously.
Upon the City Clerk advising that a request had been received from the
subdividers of Tract No. 17508, dated December 14, 1961, that Council
postpone its decision on said tract, Councilman Reibold MOVED that said
request be granted. Councilman Camphouse seconded the m~ which was
carried unanimously.
The City Clerk advised that a letter dated December 11, 1961 had been
received from the subdivider of Tract No. 26655 requesting withdrawal of
consideration of said tract. Whereupon Councilman Camphouse MOVED
that said request be granted, Councilman Reibold seconded the motion
which was carried unanimously.
TRACT INDEXED The Planning Director displayed and discussed a map of proposed Tract
NO. 26938 No. 26938 located on Third Avenue, south of Duarte Road, containing 25
(Tentative - lots. He explained that the opening and improvement of this street will

purposes and any future development of the property at 220 East Duarte
Road.should also provide alley dedication to complete the alley between

and that this parcel should be included in this tract, or the north

MOTION by Councilman Butterworth, seconded by Councilman Reibo1d and
carried unanimously that Council accept the recommendation of the Planning
Commission as contained in its memorandum to the Council dated December 13,
1961, subject to the following conditions:
1. Remove all buildings and structures within this tract or across
the tract boundary.
2. Provide rear line utility easements.
3. Dedicate the south 20 feet of lot 25 for alley purposes.
4. Dedicate the north 12 feet of the property at 220 E. Duarte Road
for street purposes.
5. Dedicate one foot in fee to the City along the north side of "A"
Street west of lot 24.
6, Install all street improvements required by the Subdivision Ordinance
in accordance with the plans and to grades satisfactory to the

that any irregularities or informalities. in the bids or bidding process
be waived, and the Mayor and City Clerk be authorized to execute such

The City Manager advised that the City has received notice of Tax
Delinquent Land Sale listing a 5 foot parcel abutting Holly Avenue,
and that the County of Los Angeles will conduct early in 1963 an
auction sale of tax delinquent properties; that this was apparently
an error in subdivision of land; that governmental jurisdictions may
acquire parcels for public use at low cost prior to such auction.
That if this 5 foot stt~p'should be acquired by other than the City
or the adjacent property owners they could be blocked from access to
Holly Avenue, That the two adjacent property owners have been advised
of the pending auction and requested to investigate the matter.
The City Manager advised further that to eliminate any possibility of
said property being purchased by outsiders the County of Los Angeles
has been notified of the City's intent to acquire parcel 505 prior to

be followed by the City in the acquisition of such tax delinquent land.
Whereupon Councilman Reibold MOVED that the Council accept the recommen-
dation of the City Manager and authorize the Mayor and City Clerk to
execute an "Agreement to Purchase" said parcel for street purposes and
to forward seven executed copies of said agreement to the Board of
Supervisors of Los Angeles County, Councilman Phillips seconded the

Mayor Balser ordered the notices of annexation proposals by the City of
El Monte, Nos, 266, 267, 268, 269, 271, 272, 273, 275, 276 and 277
filed, inasmuch as they have no effect on Arcadia.
Interest was expressed in El Monte annexation proposal No, 270 on the
east side of Peck Road about three blocks south of the present Arcadia
City boundary and reference was made to the McBean tract with respect
to which annexation proceedings were instituted by Arcadia and
subsequently terminated at the request of the owners,
The City Attorney explained the procedural differences between inhabited
and uninhabited annexations, pointing out that one property owner in the
McBean tract had the controlling right of protest or consent in any
uninhabited proceeding involving only the McBean tract, whereas this
situation would not prevail in an inhabited annexation including similar
adjacent properties, for the reason that land only and not improvements
is the basis for protest in an inhabited annexation,

He also explained that property owners within the McBean tract had
discussed annexation of their properties with both cities, their

in the original description of El Monte annexation No, 244 but had to be

annexation at some future time although, under the law, this could not
occur for some six months; that it would be possible, however, with the
owners' consent, to annex the McBean tract to the City of El Monte at
any time under an uninhabited proceeding.

The City Attorney suggested that a meeting between representatives of the
two Councils concerning this 'area might be desirable. It was the
consensus of the Council that the City Attorney should convey to the
El Monte City Council Arcadia's continuing interest in annexing the
McBean tract,

The City Clerk reminded the Council of the forthcoming annual League of
California Cities meeting on January 18, 1962, to be held at the Santa
Anita Turf Club at which meeting Arcadia is the host City.
Mayor Balser submitted to the City Manager for filing letters of
appreciation from the United States Department of Agriculture, Forest
Service and the Los Angeles County Fire Department for the assistance
rendered by Arcadia Fire Department in the recent fire in the Chantry
Flats Foothill area.

Mayor Balser requested the City Manager to submit to the Council at the
January 2, 1962 Council meeting a report regarding the apportionment of
gas tax money going to the County and distributed to t~e cities.
Discussion was held regarding additional safety measures that might be
taken by the City with regard to a hazardous traffic condition in the
vicinity of the Santa Anita School, which matter had been brought to the
attention of the Council by the Santa Anita P.T.A. and discussed at the
Council meeting of May 16, 1961, after which some precautionary measures
had been taken,
Mayor Balser requested the City Manager to submit a report on the
situation, including an estimate of cost,
A suggestion was also made that the parking at the Highland Oaks School
be studied with the thought of using a similar method at the Santa Anita
Schoo 1.
