The Invocation was offered by Rev. Walter F. Dannaman, Pastor of the American Lutheran Church of Arcadia. Mayor Balser led in the pledge of allegiance to the flag. PRESENT : ABSENT : Councilmen Butterworth, Reibold, Phillips, Balser Councilman Camphouse MOTION by Councilman Butterworth, seconded by Councilman Reibold and carried unanimously that the minutes of the Regular Meeting of December 19, 1961 be corrected by changing the vote of Mayor Balser to "No" on the introduction of Ordinance No. 1163, and as thus corrected that they be approved. Mayor Balser declared the hearing open on the application of Jack Rouse & Son, Inc., 463 South Robertson Boulevard, Beverly Hills, California, by Allan Tolle, Office Manager, for a business permit to allow a public auction to be held January 11, 1962 at Cory Machine Shop, Inc., 32 Front Street, Arcadia, from 10:30 A.M. to 5:00 P.M., and inquired if anyone in the audience desired to speak in favor of the granting of the requested permit. Mr. Allan Tolle addressed the Council and in answer to various questions advised that nothing would be sold other than that already on the premises; nothing would be brought in; that the merchandise proposed to be auctioned consisted of machinery, tools, shop equipment, fixtures, office equipment and the like; that the auction would be conducted inside the building within which the shop is located. No one desiring to speak in opposition and no one else desiring to be heard Councilman Phillips ~ that the hearing be closed. Councilman Reibold seconded the motion which was carried unanimously. Councilman Phillips further MOVED that Council authorize the granting of a business permit to Jack Rouse & Son, Inc. to hold a public auction January 11, 1962 at the Cory Machine Shop, Inc., 32 Front Street, Arcadia, from 10:30 A.M. to 5:00 P.M. Councilman Reibold seconded the motion which was carried unanimously. Planning Commission Resolution No. 434 recommending rezoning from C-2 to R-3 on property located at the southeast corner of Live Oak and Lenore Avenues. The Director of Planning displayed a map of the general area and pointed to an area outlined in red as the area proposed to be changed from C-2 to R-3, and an area outlined in green which is proposed to be annexed to the City. He stated in part that as a result of public hearings held before the Planning Commission it recommended that the property immediately at the southeast corner of Lenore Avenue and Live Oak Avenue be changed from zone C-2 to R-3 subject to a condition of approval that the 20 foot alley that now exists between Hempsted and Lenore Avenues be extended 1. 1-2-62 HEARING (Annexation No. 28, S.E. Arcadia Uninhabited) 1- -: INDEXED 14:5570 from its dead end position westerly to Lenore Avenue; also that if the area proposed to be annexed is annexed to the City that it be placed in zone PR-2 which would permit the existing parking lot to continue and also permit the church to use the 67 foot parcel for construction of a parsonage. Also in connection with the area proposed to be annexed, that the Planning Commission recommended that the 24 foot strip, which is under the same ownership as the adjacent property to the north, be placed in zone PR-2 and that a covenant be filed with the City that it will be maintained in common ownership with the parcel to the north when that is approved. The City Attorney explained in part that the properties involved in the green area, for which annexation proceedings are presently under way, are all under common ownership with properties that were annexed in the so-called Live Oak annexation and would have been included in that annexation had the staff understood the exact extent of the ownerships in the area. Also with regard to the property on the corner, in red, the owner of that property was the owner of the majority of the property to the west and had the Council realized that this was included under the same ownership as the others they might very well have accorded CM zoning at the time. I The City Manager pointed out that he felt the Council should be aware that Mr. Harris does not desire to develop his property with the alley extension and have his property divided, and that if the recommendation of the Planning Commission is accepted he desires to withdraw his application for R-3 zoning. Mayor Balser declared the hearing open on Planning Commission Resolution No. 434 and inquired if anyone in the audience desired to address the Council either in fav9r of the recommended rezoning or in opposition thereto. No one desiring to be heard Councilman Butterworth MOVED that the hearing be closed. Councilman Reibo1d seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse General discussion ensued. Councilman Butterworth stated that under the circumstances, it not being in the best interests of the City to extend the alley south of Live Oak Avenue sO that it connects with Lenore Avenue, he MOVED that Council approve Planning Commission Resolution No. 434 recommending rezoning from C-2 to R~3 on property located at the southeast corner of Live Oak and. Lenore Avenues, with the exception of Section 2 of said resolution which conditions the rezoning upon the extension of the alley to Lenore Avenue. Councilman Phillips seconded the motion which was carried on roll call votel as follows: AYES: Councilmen Butterworth, Reibo1d, Phillips, Balser NOES: None ABSENT: Councilman Camphouse " ~ Mayor Balser declared the hearing open on the proposed annexation to the City of Arcadia of certain territory adjacent and contiguous to the present City limits and the zoning thereof, said territory being situated near the southeasterly portion of the City and designated as "Annexation No. 28, Southeast Arcadia Uninhabited" and that this is the time set when the Council will hear protests made by any person owning real property within t~e said territory. He added that the matter of zoning to be placed on said proposed annexation would be determined prior to the protest hear- ing on t~e proposed annexation, and inquired if anyone desired to address 2. 1-2-62 I I RESOLUTION NO. 3430 .-1 ~.1. -<r Ie INDEXED , ". ',: ' 14:5571 the Council with regard to Planning Commission Resolution No, 433 recommen- ding interim emergency zoning of PR-2 upon certain conditions concurrent with the annexation, Rev. Eugene E. Collins, Pastor of the Arcadia Friends Church, 5705 Lenore Avenue, addressed the Council, and in answer to questions of the Council stated in part that it is the desire of said church to build its parsonage on a portion of the property proposed to be annexed. No one else desiring to be heard Councilman Phillips MOVED that the hear- ing be closed. Councilman Reibold seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse Councilman Phillips further MOVED that Council accept the recommendation of the Planning Commission as contained in its Resolution No. 433, with the exception that the northerly 24.66 feet of the subject property be zoned R-3 to conform with the"rest of the ownership and the recommended covenant be eliminated. Councilman Reibold seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse Mayor Balser stated that the matter of the annexation would now be heard. The City Clerk advised that no written protests had been received regard- ing the proposed annexation and that notice of same had been given as required by the Government Code, Inasmuch as only the owners have the right of protest and since both owners have indicated their approval of the annexation and have not protested in writing, Councilman Reibold ~ that the hearing be closed. Councilman Phillips seconded the motion which was carried unanimously. It being the Council's desire to proceed with the proposed annexation, the City Attorney presented, explained the content and read the title of Resolution No. 3430, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FINDING AND DECLARING THAT A MAJORITY PROTEST HAS NOT BEEN MADE WITH RESPECT TO ANNEXATION NO. 28, SOUTHEAST ARCAD LA UNINHAB ITED ." Councilman Reibold MOVED that the reading of the full body of Resolution No. 3430 be waived. Duarte Rd.) rL "'. .:r ~ ~;ya-- INDEXED 14:5572 MOTION by Councilman Phillips, seconded by Councilman Reibold and carried on roll call vote as follows that Council accept the recommendation of the City Manager and authorize a contribution of $1000.00 to the Tournament of Roses Parade Float Fund, said amount to be appropriated from Council's Contingency Fund: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse Mayor Balser commented that many cities pay a portion of the cost of their floats and some cities pay the entire cost and that he would favor Arcadia budgeting $1000 yearly as a contribution to a float fund as an I incentive for Arcadia to continue its participation iri the Tournament of Roses parade, but that he was aware that this Council could not bind future Councils. Mayor Balser then asked Mr. Harold Roach, the Chairman of the Float Committee, to convey to the Chamber of Commerce Council's appreciation for their efforts on behalf of the float, and Mr. Roach thanked the Council for its cooperation. Upon being advised that due to change of ownership it will be necessary that Council reapprove Tract No. 26743 for recording purposes, said tract having previously been approved by the Council on August IS, 1961, Councilman Reibold~, seconded by Councilman Phillips and carried unanimously that Council accept and reapprove final map of Tract No. 26743, located between Longden Avenue and Wistaria Avenue, east of Baldwin Avenue, containing 18 lots, subject to all the conditions contained and set forth in Council's former approval of said tract on August IS, 1961. The City Manager advised that the City has secured possession of 68 West Duarte Road and that the premises are suitable for rental after interior painting; that it is estimated that the painting and removal of numerous chicken houses will cost approximately $950; that at the Council meeting of December 19, 1961 the Council approved the transfer and appropriation to Capital Improvement Account No. 615, Duarte Road Property, the sum of $850.for painting and minor repairs to the property at 56 West Duarte Rd. which is immediately east of 68 West Duarte Road, which the Controller advised should not be considered as a capital improvement. Whereupon Councilman Reibold ~ that Council accept the recommendation of the City Manager and rescind its motion of December 19, 1961 (page 9, under heading "56 Duarte Road") wherein authorization was granted to transfer and appropriate the sum of $850 to Capital Improvement Account No. 615. Councilman Phillips seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse I Councilman Butterworth then MOVED that Council further accept the recommendation of the City Manager and authorize the painting, minor repairing and shed removal at 56 and 68 West Duarte Road, at a cost estimated at $1800, said sum of $1800 to be paid from the Council Contingency Fund, and further that the City Manager be authorized to lease said premises under lease terms prepared by the City Attorney. Councilman Phillips seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse 4. 1-2-62 ...', 14:557 The City Manager reported that pursuant to the Council meeting of November 29, 1961, at which time authorization was granted to advertise for bids for a platform and ladder truck after January 1, 1962 and the staff instructed to consider the possibility of insulating the basket on the boom of the truck, the Fire Chief made further investigations which resulted in the determination that such insulation would not be beneficial, and that the notice to bid on the subject equipment will proceed on the basis of the present specifications unless otherwise so ~'I~ advised. FIRE DEPARTMENT (Platform & Ladder Truck) :J INDEXEr I CAPITAL IMPROVEMENT PROJECTS FUND The reason for such determination not being clear, it was explained that when a water line is installed the purpose of the insulation is defeated; that the use of insulation precludes the use of electric lines to the basket, or communication systems since there is no way of preventing a ground on these items; that if the basket were insulated the water lines, electrical lines and communication systems would have to be rendered inoperative and would hinder the operation of the unit. Whereupon Councilman Phillips MOVED that the City Manager's report be received and filed. Councilman Reibold seconded the motion which was carried unanimously. MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried on roll call vote as follows that Council accept the recommendation of the City Manager and the City Controller and authorize that available balances in the Capital Improvement Projects Fund be 1) transferred to those accounts requiring additional appropriations and 2) made available ~ ( ~AAA~A~or future appropriations as set forth in the memorandum dated December ~ '~~~~14, 1961 submitted to the City Manager by the City Controller on the ~~v- subject of Capital Improvement Project Appropriations: . Lee from Civil Defense Board) , .b' - ......./ 14:5576 The City Attorney distributed to the Council and members of the staff present copies of a proposed final draft of Ordinance No. 1150 regarding house moving, and requested that any comments or suggestions to be made by the Councilor staff be presented to him within eight or nine days in order to permit sufficient time to incorporate them and to submit such revisions to the Council prior to the next Council meeting. The City Attorney presented for the first time, explained the content and read the title 'of Ordinance No. ll64, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF J\RCADIA, CALIFORNIA, AMENDING SECTION 6428.6 OF THE ARCADIA MUNICIPAL CODE AND REPEALING SECTION 6428.7 THEREOF." Motion seconded by Councilman Reibold and carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Counc ilman Camphouse MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that the recommendation of the Civil Defense and Disaster Board for an addendum to Re&olution No. 3439 (shelters in front yards) requiring that a suitable lock be required for front yard shelters that can be operated from the inside, even by children, as well as from the outside, be referred back to staff for analysis and recommendation. '. . MOTION by Councilman Butterworth, seconded by Councilman Reibold and carried unanimously that the communication of the Arcadia Civil Defense and Disaster Board to the Council of December 21, 1961, wherein said Board recommends that Council not send a similar resolution to the one adopted by the City of South El Monte urging sister cities of Los Angeles County to adopt resolutions requesting the President of the United States to support a vigorous and effective national leadership in the field of civil defense due to the positive action now being taken by the Federal and other Governmental agencies, be received and filed. MOTION by Councilman Phillips, seconded by Councilman Butterworth and carried unanimously that the resignation of James R. Lee from the Civil Defense and Disaster Board be accepted with regret. The City Clerk was requested to advise as to the Councilman re~ponsible for recommending an appointment to fill the vacancy occasioned by the resignation of Mr. Lee. Councilman Butterworth seconded the motion which was carried unanimously. 8. 1-2-62 CHAMBER OF COMMERCE (Communication) 14: 5577 Mayor Balser ordered received and filed the communication dated December 27, .1961 from the Arcadia Chamber of Commerce expressing appreciation for the City's cooperation during the recent storm drain project. AUDIENCE PARTICIPATION (Horton) I jV. 5- P SALARY SURVEY j. fC\ '. ~ I INDEXED BUSINESS PERMIT (Bench) J:/~- ~I Mr. Thomas Horton, 430 Fairview Avenue, addressed the Council, and spoke at length regarding the City's ordinance on all-night parking and one-way traffic south-bound on Holly Avenue during the racing season. He stated in part that he favored Council's directive to enforce the all-night parking ordinance and was disappointed to subsequently learn that said directive had been rescinded pending further study. That his street was lined with parked cars at all hours, which has resulted in a hazardous traffic situation for both. pedestrians, particularly children, and motor vehicles, and in fact resulted in one fatality. Also that the street in front of his home has not been cleaned for 26 weeks, and that the noise of automobiles starting and stopping during the night is distracting. With regard to the one-way traffic on Holly Avenue during the racing season, Mr. Horton stated in part that he felt the use of a residential street as an outlet for traffic from the race track would result in the deterioration of property values on Holly Avenue as a residential street; that it caused inconvenience to residents in the area; and that such traffic in his opinion should be channeled to Baldwin and Santa Anita Avenues. He.also mentioned that perhaps sidewalks would help. Mayor Balser advised that the City Manager had been requested to study the overnight parking situation and to report to the Council on the matter in the near future. Mr. Horton was also advised that some apartment buildings were constructed at a time when sufficient parking was not designated and that a.strict enforcement of the ordinance would work undue hardship in such cases, and that such buildings were constructed not knowlingly in violation of the law. The City Manager advised that the matter of all night parking would be on the agenda for the Council meeting of January 16, 1962. The City Manager advised that prior to the adoption of the 1961-62 budget the Council authorized across the board increases in salaries for City employees and instructed his office to prepare a complete salary survey to determine any ine~uities. That such a survey was completed and copies thereof and an' analysis of same have been submitted to the Council and to the Personnel Board for its consideration. Councilman Reibold MOVED that the City Council having instructed the staff to review the salary structure of the City with the intent of correcting any existing inequities at the beginning of 1962, it is hereby determined that if any increases are granted to correct such inequities that said increases shall become effective January 7, 1962. Councilman Phillips seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: None ABSENT: Councilman Camphouse MOTION by Councilman Butterworth, seconded by Councilman Phillips and carried unanimously that Council approve the application of the United Bench Adv. Inc. for a permit to install a bench on the southeast corner of Huntington Drive at Sunset Blvd., said location being approved by the Director of Public Works. !INDEXED 9. 1-2-62 SANTA ANITA SCHOOL (Traffic Signals) 115P LEAGUE OF CALIFORNIA CITIES 11SP CONFERENCE (Phillips) ll. sA::J LEAGUE OF CALIFORNIA CITIES (General Meeting 1-18-62) it5rF ADJOURNMENT 14:5578 The City Manager advised that pursuant to Council's request that a report be submitted regarding a cost analysis of signals on Santa Anita at Wistaria Avenues (at the school), the situation has been studied and that due to the balance of the Santa Anita Improvement matter to come before the Council for authorization to advertise for bids the latter part of February, such improvement to commence in the near future, that to proceed with a part of construction now would be costly. The City Manager then suggested that as an alternative to a stop sign at said location that actuated traffic signals be installed; that although the cost would be considerably more than stop signs, the cross- ing guard could be eliminated at that location which in a short time would amortize the cost of traffic signals and provide better traffic I control. Also, that in lieu of any construction and pending decision to instalj traffic lights, that a portion uf the parking area be barricaded and a stop sign installed in the median strip for northbound Santa Anita traffic at Wistaria with a stop sign on the curb side on a pedestal as a permanent installation. Whereupon Cou~cilman Reibold MOVED that the City Manager be authorized to proceed along the lines suggested above. Councilman Phillips seconded the motion which was carried unanimously. The City Attorney advised that he had been requested to submit his comments on a resolution to be presented at the meeting of the Board of Directors of the County Division of the League of California Cities, urging legislation that will offset the effect of the Supreme Court case in the Carol Lane decision. The City Attorney continued, stating in substance that he felt it would be helpful if Council would authorize and instruct the Arcadia representative who will attend the meeting to press for the adoption of such a resolution. Councilman Phillips ~ that Mayor Balser, as the official representative of Arcadia, support the proposed suggested resolution of the Los Angeles Chapter of the League and to vigorously oppose any further encroachment of the State, at the state level, upon home rule. Councilman Reibold seconded the motion which was car~ied unanimously. MOTION by Councilman Reibold, seconded by Councilman Butterworth and carried on roll call vote as follows that Councilman Phillips be authorized to attend the Special Conference on Metropolitan Government in Sacramento, February 1 and 2, 1962; the expenditures in connection therewith to be paid by the City and substantiated by an itemized expense account upon his return: AYES: Councilmen Butterworth, Reibold, Balser NOES: None ABSTAINED: Councilman Phillips ABSENT: Councilman Camphouse I Councilman Reibold MOVED that members of the Planning Commission and the Chairmen or- their choice of alternates of the other Boards and Commissions be invited to attend, at City expense, the League of California Cities general meeting to be held at the Los Angeles Turf Club on January 18, 1962 and that the City Manager be authorized to invite certain department heads.
