The Invocation was offered by Mr. Maurice Meredith, Pastor of the Arcadia Church of Christ. Mayor Balser led in the pledge of allegiance to the flag. PRESENT : ABSENT: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser None MOTION by Councilman Phillips, seconded by Councilman Reibold and carried unanimously that the minutes of the Regular Meeting of February 6, 1962 be approved as submitted in writing. Mayor Balser declared the hearing open on the application of the American Lutheran Church for a zone variance to permit the erection of a church and related facilities at 110 and 118 West Duarte Road. (Planning Co~ission Resolution No. 436 recommending approval). The City Clerk read a communication from Mr. F. Duncan Eader, 111 West Magna Vista Avenue, dated February 15, 1962, which stated in substance that the granting of the requested zone variance be withheld pending the presentation of a solution by the Engineering Department of the sewage disposal and surface drainage problems not only of the subject property but of the entire group of properties fronting on the south side of West Duarte Road between El Monte and Santa Anita Avenue. (Communication on file in office of the City Clerk). The Planning Director displayed and explained an aerial photograph show- ing the subject property as well as the property for which the applicant had several months ago requested a zone variance for the purpose of erect- ing a church, which request had been denied, the City subsequently acquiring said property. The Planning Director continued that in compliance with the request of the Planning Commissi.on the staff prepared a study of the entire area and recommended land use compatible with those proposed and those in existance and likely to remain in existance for some time in the future, such as public and semi-public use in the area between a proposed auditorium and El Monte Avenue. That the subject church thereafter filed an application for a zone variance for the subject location, which site was approved by the Planning Commission subject to the following conditions: (a) That 12 feet be dedicated for the widening of Duarte Road. (b) That all existing structures be removed from the site. (c) That the driveways and parking lot be paved and a 6- foot masonry wall separating the driveway and parking area from adjacent residential property be constructed. (d) That drainage from the parking area be provided to the satisfaction of the Director of Public Works. 1. 2-20-62 1~:56l4 (e) That a suitable landscaped strip and tree planting along the south property line be provided. (f) That the plans be submitted to and be approved by the Planning Commission prior to the issuance of a building permit and shall be substantially in compliance with the plans and elevations submitted with the application. Brief discussion was held on the condition of drainage, including the drainage of the parking lot of the Library, and whether the site allotted to the proposed auditorium was sufficient in size to accommodate the proposed seating and corresponding parking. It was stated that a I facility would have to be designed to fit the property; that the parking at the library is actually double that contemplated and joint usage could- be made. At Mayor Balser's statement that the Council would hear first from those persons in support of the appeal and opposed to the requested zone variance, the following persons addressed the Council and stated in part: 'Mr. Jackson Tillman, 117 Magna Vista Avenue: That he felt the church property should be used in conjunction with the proposed civic auditorium rather than for a church; that the condition of Planning Commission Resolution No. 436 of a three foot landscape strip along the church's south property line is, in his opinion, insufficient to absorb water; that he had been informed that the Westman Corporation purchased consider- able property below the subject property and if the variance is approved in this instance said corporation will have a precedent if they desire to request a zone variance; that he had read in the Arcadia Tribune that when the City denied the Lutheran Church its first requested zone variance they were advised by the City to purchase property down the street and that the Council would favor a zone variance therefor. Mayor Balser replied that he had no recollection of such advice; that as a member of the Council he had made no such promise nor had he discussed the matter with anyone. Mr. Ronald H. Suess, 107 W. Magna Vista Avenue: That he had been present at the Planning Commission meeting when the Minister of the subject church had made the statement regarding Council's promise to act favorably upon a zone variance request on property they might purchase further down the street. That he also is concerned with the drainage problem; that during the recent heavy rains he had called the City Engineer's office regarding water standing in his yard which he believed was the overflow from the Library parking lot but that nothing had been done. That he is in the construction business and would like to know what will be done regarding the drainage problem if the requested variance is approved and also would like to have the right to approve anything proposed to be done in that regard. That the subject church sold two acres on Camino Real we of Baldwin Avenue to a contractor, upon which they could have built their church. Also that nothing has been mentioned regarding the excess of 35, foot height as per the Code, to wit: 43 feet and that this additional height will obstruct his view. He added that the Council should consider the area of the proposed civic auditorium which might prove insufficient. In answer to Councilman Reibold he stated that in his opinion the drainage problem from a technical standpoint could be satisfactorily solved. Councilman Butterworth stated in part that the Council could not delegate its responsibility to Mr. Suess for approval of a public work, but that Mr. Suess could consult with the City officials; that the condition that drainage from the parking area be provided to the satisfaction of the Director of Public Works provides some measure of safety for the land owner. 2. 2-20-62 1(,:5615 Mr. Ba~nett Goldman, 101 Magna Vista Avenue: That his principal concern is drainage; that the number of parking places specified for the number of seats in the proposed civic auditorium did not seem sufficient and consideration should be given to extending parking facilities which could be used for dual purposes and that should the subject property be used for pa~king the view would not be obstructed, Mr. F. Duncan Eader, III Magna Vista Avenue: That he did not approve of sump pumps to handle the important drainage problem, I Mr. Ba~ett Goldman spoke again and questioned the effect of public buildings on residential property values, adding that he felt the Council should seriously consider that phase, No one else desiring to speak in opposition to the requested zone variance Mayor Balser stated that the Council would now hear those in favor of the zone variance, Rev, Walter F. Dannaman, Pastor of the American Lutheran Church of Arcadia, addressed the Council and stated in part that the chief concern seemed to be drainage and that he was confident that the City would solve this problem; that the Church would comply with all City regulations and that the City will still have jurisdiction over the building,plans if the variance is granted, No one else desiring to be heard Councilman Reibold MOVED that the hearing be closed, Councilman Butterworth seconded the motion which was carried unanimously. Discussion ensued and the following comments in part were made: Councilman Phillips: That the church plot plan showed one story building toward the rear property line; that the 43 feet refers to a church spire on the Duarte Road side as contrasted to 35 feet of building. In answer to Councilman Butterworth's question as to the relationship between the number of people in an auditorium and parking spaces, the City Manager reiterated the ratio as set forth in a report dated July 18, 1961 submitted to the Council at its meeting of July 18, 1961, concerning a survey on area requirements for a civic auditorium if such a structure is constructed, stating in substance that 2500 seats would require 833 spaces on the basis of one parking space for each three seats. I Councilman Camphouse: That in answer to the comment regarding Council making a prior decision regarding the acquisition of property by the Church, to his recollection no such decision was made; that Council requested the City Manager and staff to work with the people from the church in an effort to help solve their problem which, in his opinion, is not tantamount to a decision, notwithstanding the fact that something to the contrary might have been stated in the newspaper; that it is difficult to discuss such a situation when it concerns a church as often comments are misconstrued; that he has been concerned about adequate parking space for churches; that it should be recognized that many ,churches in Arcadia have a parking problem and have been forced to purchase additional residential property for such purpose; that the property acquired by the City for the purpose of constructing a civic auditorium could more or less landlock the property and if sufficient parking space is not provided it will become a problem in the future, Councilman Reibold: That inasmuch as the parking facilities of the proposed church meet the standards of the City at this time, parking should not be an issue; that the principal problem at this time is that of water drainage which, being a condition of the zone variance, will be solved; that he does not approve of sump pumps either; that in his opinion the structure as proposed by the church would be a development in the right direction and that he would therefore MOVE that the Council 3, 2-20-62 HEARING (Weed Abatement 1962) J <7;"-</ ' , , INDEXED 14:5616 approve the recommendation of the Planning Commission in compliance with conditions in its Resolution No. 436 and authorize the requested zone variance of the American Lutheran Church to permit the erection of a church and related facilities at 110 and 118 West Duarte Road. Councilman Phillips seconded the motion. Councilman Butterworth commented in part that while he favored the said ~esolution he was aware of the drainage problem, which was no doubt aggravated by the exceptional rain; that he has every confidence in the City officials to provide the necessary drainage and that he noted that Planning Commission Resolution No. 436 makes special provision for the fact that the church must provide drainage to meet the approval of the Director of Public Works. I the City Attorney stated that he wanted to dispel the inference that "to the satisfaction of the Director of Public Works" might mean to his personal satisfaction; that such expression means that the Director of Public Works must be satisfied that such problems are solved in accordance with engineering principals and the provisions of the Code, which has specific detailed provisions about drainage. That it does not ~efer to just personal satisfaction. Councilman Reibold: That he assumed the aforementioned three foot plant- ing area was not in any way connected with the absorption of water and the Planning Director replied that this was merely for the purpose of landscaping. Mayor Balser: That he felt the church will be a good development in the area and will not detract from property values to the south; that with regard to the possible parking problem, Council is aware of the financial factOrs' involved in building churches; that the parking situation is ~sually ,a' one-day problem and that generally the Council will have to overlook this Sunday parking; also that the Council has faith in the Director of Public Works' ability to solve the drainage problem and that Mr. Suess is welcome to review and discuss this matter with the staff. the following roll call was then taken of the motion made and seconded: . AYES: Councilmen Butterworth, Reibold, Phillips, Balser NOES: Councilman Camphouse ABSENT: None Mayor Balser declared the hearing open on the weed abatement program for 1962 and stated that this is the time and place to hear and consider all objections to the proposed removal of weeds, rubbish and refuse from lots in the City of Arcadia in accordance with the provisions of Resolution No. 3459. Mrs. Edna Sullivan, 210 West Lemon Avenue, addressed the Council, inquir- ing about the purpose and procedure of the Weed Abatement Act, and spoke at length about the unkempt appearance of the premises at the southwest corner of Norman and El Monte Avenues. The City Attorney summarized the provisions of the Weed Abatement Act and explained that City forces do not always remove things that might be construed as objectionable by neighbors; that the City recently adopted a regulation providing for the abatement of unsafe structures and in the near future that ordinance will begin to be enforced to take care of the type of situation referred to by Mrs. Sullivan. I No one else desiring to be heard Councilman Butterworth MOVED that the hearing be closed. Councilman Reibold seconded the motion which was carried unanimously. Councilman Butterworth further MOVED that the Superintendent of Streets be authorized to proceed with the work of weed abatement pursuant to the Weed Abatement Act and in accordance with Resolution of Intention No. 3459. Councilman Camphouse seconded the motion which was carried unanimously. 4. 2-20-62 HEARING (Curb Painting - Hellen) -733 SfFP; 14:5617 Mayor Balser declared the hearing open on the application of Harwood Hellen, 3570 Valley Meadow Road, Sherman Oaks, California, doing business as Veterans House Addressing Service, P. O. Box 63, Alhambra, California, for a business permit to solicit door to door for printing of house numbers on curbs Monday through Saturday, 8:00 A.M. to 5:30 P.M. painting and 3:00 P.M. to 8:30 P.M. soliciting, and inquired if anyone desired to address the Council on the matter. Mr. Hellen, the applicant, addressed the Council, and in answer to aNnEXED various questions, advised in substance that he had obtained a permit from the City approximately three years ago for the same type of work; that his present method has been improved in that the numbers are reflected at night and the work is performed by a machine; that there is no charge to the residents but that after the work is completed the residents are solicited to pay whatever they wish, which is usually $2.00; that he hires only veterans through veteran associations and that he proposes to paint house numbers on curbs uniformly throughout the City. I I HEARING (Auc tion - Howard) ~(, f rC- ~ if;- ,. ~ INDEXEL In the discussion that ensued Councilman Butterworth stated in part that in his opinion to do the work first without the resident's permission and then to solicit for payment embarrasses people and that such approach does not appeal to him. Councilman Reibold commented that the numbers are painted on curbs which are City property. The City Manager stated in part that curb painting permits have been issued to various individuals in the past but that those individuals had not covered the entire City and that in his opinion, if the work is permitted it should be uniform throughout the City. The applicant stated that he would prefer doing the work on a contract basis with the City, and in such event would contract for 35 cents per house. No one else desiring to be heard Councilman Camphouse MOVED that the hearing be closed. Councilman Butterworth seconded the motion which was carried unanimously. Councilman Camphouse further MOVED that in view of the discussion and the attitude of the Council indicating that the contract phase be explored, the request of Harwood Hellen for a business permit to solicit door to door for printing of house numbers on curbs be denied and the matter referred to staff for the purpose of investigating the contract phase. Motion seconded by Councilman Reibold and carried unanimously. Mayor Balser declared the hearing open on the application of Harry H. Howard, 312 E. Valley Blvd., El Monte, for a business permit to hold a public auction of machinery, equipment and office furniture of Fenner- Bartley Electronics Engineering Company, at 36 LaPorte Street, Arcadia, February 22, 1962 from 10:00 A.M. to 5:00 P.M.,and inquired if anyone in the audience desired to address the Council in regard to this matter. Mr. Howard, the applicant, addressed the Council and advised, in answer to various questions, that equipment will be brought in for the auction; that the equipment to be auctioned is machinery, hand tools, office furniture and the like. No one else desiring to be heard Councilman Phillips ~ that the hearing be closed. Motion seconded by Councilman Reibold and carried unanimously. Councilman Phillips further MOVED that Council approve the application of Harry H. Howard for a business permit to hold a public auction of machinery, equipment and office furniture as set forth in his application, said auction to be held for the Fenner-Bartley Electronics Engineering Company, at 36 LaPorte St., Arcadia. Councilman Butterworth seconded the motion which was carried unanimously; 5. 2-20-62 HEARING (Pawn Shop - Pomerantz) J qqJ INDEXED 14:5618 Mayor Balser declared the hearing open on the application of Morris Pomerantz, 13630 Sunset Blvd., Pacific Palisades, California, for a business permit to operate a jewelry and loan business with collaterals, merchandise and pawn shop at a location not not,yet.'seles:ted, 'pending approval by the Council, and inquired if anyone in the audience desired to address the Council. '_ The City Clerk read a letter dated February 19, 1962 from Lee's Shoe Store, 40 E. Huntington Drive, signed by Harry Mendel, which stated in substance that he opposed the granting of a permit for such a business on the basis that it would be detrimental to the business district and might bring an undesirable element to the City. I The applicant, Mr. Pomerantz, addressed the Council and advised, in answer to various questions, that he formerly resided in Arcadia and desired to do so again as well as to operate a business here; that he proposed conducting his business in accordance with State and City laws, and to grant loans on personal property, such as jewelry, under the Small Loans Act; that the maximum interest rate on $10.00 would be 29% per annum. No one else desiring to be heard Councilman Phillips ~ that the hearing be closed. Councilman Butterworth seconded the motion,which was carried unanimously. Councilman Phillips stated in part that the City has previously denied applications for pawn shops; that there is presently one such business in the City on Huntington Drive and Baldwin Avenue which, in his opinion, is not compatible with the business interests along Huntington Drive. Councilman Phillips then ~ that the request of Morris Pomerantz for a business permit to operate a jewelry and loan business be denied. Councilman Reibold seconded the motion. Councilman Butterworth spoke at length on the subject matter, stating in substance that in his opinion it is not within the Council jurisdiction or power to determine whether there is a sufficient number of certain types of businesses in the City nor that certain types of businesses 'are good or bad for the City; that he could not see how the application could be denied. Discussion ensued regarding Councilman Butterworth's contention., The City Attorney explained the procedure for obtaining business permits for a number of businesses which by their nature require scrutiny, regulation and/or prohibition, as set forth in the Arcadia Municipal Code, and that as set forth, it is within the jurisdiction of the Council to determine if the conduct of a certain business would be injurious to the public health, welfare, etc. of the inhabitants of the City, and in making such determination would consider pertinent matters that are of I common knowledge. Councilman Reibold stated in part that in his opinion this type of business would be detrimental to the public welfare of the City and that it is unnecessary to give specific reasons at this time. Councilman Butterworth further commented that the applicant could mandamus the City Council if he should desire to go to that expense, and Council- man Phillips made reference to an adjacent city that had such an experience with another type of business; however, the city still does not permit such operation. Mayor Balser stated in part that in his opLnLon it is Council's prerogative to deny a business permit for a business that would in the best interests of the City and that the subject business fall in this category. not be would 6. 2- 20-62 HEARING (Carnival - Kreutel) I d- <6' W H' lNDEXED I 14:5619 The following roll call was then taken: AYES: Councilmen Camphouse, Reibold, Phillips, Balser NOES: Councilman Butterworth ABSENT: None Mayor Balser declared the hearing open on the application of Earl L. Kreutel, dba E & M Amusement Rentals, for a business permit to allow the erection and operation of rides, ferris wheel and various kiddie rides on April 6 and 7, 1962 between the hours of 12 noon and 10:00 PM at the parking area located at the rear of 21 East Huntington Drive, for the Civil Air Patrol Fund Raising Campaign, activity to be conducted on a carnival basis, and inquired if anyone desired to address the Council with regard thereto. The City Clerk read a communication dated February 15, 1962 from Stuart Henderson, President of Downtown Arcadia Business Association, stating in substance that said association has agreed to co-sponsor the carnival project of the Civil Air Patrol Cadet Band Booster Club, and requesting Council's consideration of their request to stage a carnival on the City parking lot on Wheeler Street and that all license fees be waived for this fund raising project. The City Attorney explained that if the lots proposed to be used are those under the jurisdiction of the Board of Parking Place Commissioners, permission would have to be obtained from them as they are required by law to operate such lots for the benefit of the persons and property owners who were assessed for their acquisition; however, if the lots are those acquired by the City then it is a matter of judgment as to whether they may be used for the purpose under consideration. That he has stated in the past that the use of public parking lots for fund raising ventures not related to the businesses served by the lots is basically improper. Mr. Frank Barber, 201 E. Grandview Avenue, Sierra Madre, addressed the Council and advised that he is a member of the Li'l Gabriel Booster Club of the Civil Air Patrol; that their purpose in requesting permission to conduct this carnival is to raise funds to enable their group to be represented at the World's Fair in Seattle. The applicant, Mr. Kreutel, addressed the Council, and in answer to various questions, advised in part that his company rents carnival equipment and in this instance proposes to do so on a certain flat fee and percentage basis. He explained the operation of his business and advised that it carries public liability insurance on its property of $100,000-200,000. No one else desiring to be heard Councilman Phillips ~ that the hearing be closed. Motion seconded by Councilman Reibold and carried unanimously. General discussion ensued and it was the consensus of the Council that the amount of public liability insurance carried by the applicant was inadequate. It was ascertained that the Police report dated February 15, 1962 on the applicant was a part of the record of this hearing; that the lots proposed to be used are under the jurisdiction of the Board of Parking Place Commissioners and their permission would be necessary; that the Civil Air Patrol is to be commended upon what they wish to achieve but that several factors regarding the situation do not make it in the best interests of the City to grant the requested permit. The City Manag~r stated that from a public liability standpoint, traffic control and other problems, it would be his recommendation that' the application be denied. 7. 2-20-62 AMENDMENT COUNTY MASTER PLAN OF HIGHWAYS _xI /~ INDEXED CALL FOR BIDS (Weeds) /L J 8')s'! INDEXEb CURBS AND GUTTERS (El Sur Ave.) .'l- - ql'!j llIDEXED 14:5620 Councilman Phillips ~ that the Council find and determine that the granting of the permit and the conduct of the business for which the permit was requested will be detrimental to the public welfare of the City of Arcadia and the inhabitants thereof and that Council deny the application of Earl Kreutel, dba E & M Amusement Rentals for a business permit to allow the erection and operation of various rides, etc; on April 6 and 7, 1962 at the parking area located in the rear of 21 East Huntington Drive. Councilman Camphouse seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Butterworth, Camphouse, Reibold, Phillips, Balser NOES: None ,ABSENT: None I The Planning Director advised that the Los Angeles County Regional Planning Commission has submitted Amendment No. 458 to the Regional P1anning'Commission Master Plan of Highways which outlined certain changes in the Master Plan (to remove Durfee Avenue, a parkway, between Lower Azusa Road and the East Hondo Parkway, and Durfee Avenue, a secondary, between East Hondo Parkway and Arrow Highway; change Durfee Avenue, a parkway, between San Bernardino Road - Ramona Boulevard - and Lower Azusa Road to a secondary highway), that a public hearing on the matter is to be held before the Regional Planning Commission in the near future, and that it is the recommendation of the Planning Commission that the amendment be approved and a representative of the City be present at the public hearing. MOTION by Councilman Phillips, seconded by Councilman Camphouse and carried unanimously that the Council.approve the recommendation of the Planning Commission as presented above. MOTION by Councilman Reibold, seconded by Councilman Phillips and carried unanimously that the Council accept the recommendation of the Director of Public Works; that the specifications for the removal of debris and weeds from lots in the City of Arcadia for the year 1962 be approved as submitted; that the City Clerk be authorized to call for bids for such work in conformance with said specifications, said bids to be opened March 5, 1962 and submitted to the Council at the regular meeting of March 6, 1962. Discussion was held on the appeal of Mrs. Elsie Fuehr, 1001 El Sur Avenue, to waive the condition of a lot split granted on her property that she install curb and gutter, inasmuch as no other property on said street had this improvement, and the cost and hardship involved, which matter had been continued to ,this meeting for a staff report regarding a survey of the thinking of the property owners on the street regarding the installation of curbs and gutters on the entire street. The City Manager advised that a letter and reply card had been sent to the 17 owners of record of properties abutting on El Sur Avenue but thatl sufficient favorable replies had not been received to proceed under the 1911 Improvement Act. Mr. Guy E. Hemmings, 1125 El Sur Avenue, addressed tpe Council and advis in part that he and his neighbor, Mr. Richard L. Bateman, 1126 El Sur Avenue, had not yet sent in their cards as they were not familiar with the functions of proceedings under the, 1911 Act; however, that they did favor the street being improved due to its narrow width, the heavy traffic thereon and the fact that lack of curbs and gutters caused the street to erode. The City Attorney explained in substance that the 1911 Improvement Act is a statutory procedure for the installation of improvements under contract handled by the City and the cost or such portion thereof as determined at the outset of the proceedings, is assessed upon the properties benefited by the improvement. That the property owners 8. 2-20-62 I CROSSWALK (Santa Anita at Alta St.) d:~ ':.ciOEXEJ) I 14:5621 assessed have the option of paying cash within 30 days after confirmation of the assessment or having the matter go to bond; that the staff or interested parties in the area may circulate a 1911 Act, petition; that the Council can overrule a protest, Also that the City pays the cost of the street improvement. Mr. Hemmings and Mr, Bateman thereupon submitted their cards indicating their approval of the installation of curb and gutter under the 1911 Act. Mr. Hemmings requested that with the petition an explanation of the 1911 Improvement Act be included, Councilman Reibold ~ that the staff be instructed to prepare such papers as are necessary for circulation of a petition by Messrs, Hemmings and Bateman, together with an explanation of the 1911 Act, the approximate cost of the improvement and the method of payment. Council- man Camphouse seconded the motion which was carried unanimously, Mrs, Elsie Fuehr, 1001 El Sur Avenue, addressed the Council and stated in part that in her opinion and in the opinion of many of her neighbors, curbs and gutters on her street would detract from the rural appearance of the street which they desired; also that she did not think the street was heavily trafficked, and that the cost involved would be burdensome. It was explained that the work would be done under contract after the taking of bids advertised publicly, which bid must be awarded to the lowest responsible bidder; that it is a little more expensive than the people themselves negotiating the lowest possible bid due to the City's coSt 'to conduo,t ,1911', ,Act proceedings, and that as stated, no action would be taken until a staff report is made on the progress of the petition. Mayor Balser then MOVED that the appeal of Mrs, Elsie Fuehr be continued until a further staff report on the progress of the 1911 Act is received by the Council, Councilman Camphouse seconded the motion which was carried unanimously. The City Manager read a report dated February 14, 1962 from the Chief of Police and the Director of Public Works regarding the request that a painted crosswalk be installed on Santa Anita Avenue at the south side of Alta Street for the convenience of the members of the Senior Citizens Club in crossing the street at that point to attend meetings at the Assistance League. Said report stated in part that according to the California Vehicle Code a crosswalk is any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface; also that a driver of a vehicle shall yield the right of way to a pedestrian cross- ing the roadway within any marked crosswalk or within any unmarked cross- walk at an intersection.
