CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
MARCH 20, 1962
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8:00 P.M., March 20, 1962.
The Invocation was offered by Rev. St. Elmo Nauman, Pastor of the Arcadia
Congregational Church,
Mayor Balser led in the pledge of allegiance to the flag.

MOTION by Councilman Phillips, seconded by Councilman Butterworth and
carried unanimously that the minutes of the Regular Meeting of March 6,
1962 be approved as submitted in writing,
Hearing on the application for a business permit of Marsh Dozar, to hold
a public auction for the Union Bank and Trust Company of Los Angeles of
real property located at 1919 Wilson Avenue, was continued at the Council
meeting of March 6, 1962, pending receipt of further information from the
Union Bank and Trust Company as to their reply to the Realty Board.
The City Clerk reported that a communication had been received from the
applicant dated March 19, 1962, in which he stated in substance that until
further notice, he desired to cancel his application for a business permit
to hold a public auction of real 'estate in ,the 'City :oF-Arcad,fa. '
Whereupon Councilman Butterworth stated that in view of the said letter
from the applicant, withdrawing his application, he MOVED that the
application of Marsh Dozar for a business permit to hold a public auction
for the Union Bank and Trust Company of Los Angeles of real property
located at 1919 Wilson Avenue be denied, Motion seconded by Councilman
Phillips and carried unanimously.
Mayor Balser declared the hearing open (Section 9123.5.1 Arcadia Municipal
Code) on the appeal of James H, Keith from Planning Commission recommen-
dation for denial of Lot Split No, 357, and inquired if anyone desired to
be heard on the matter,
The appellant (Mr. Keith) stated that he did not wish to add anything to
the information presently on record.
No one else desiring to be heard Councilman Butterworth MOVED that the
hearing be closed. Motion seconded by Councilman Phillips and carried
unanimously.
Mayor Balser advised that a communication, appealing the decision of the
I~D Planning Commission, dated March 2, 1962, had been received from the
appellant and had been made a part of the record,
Councilman Phillips stated in part that he had personally viewed the
subject property; that the statements in Mr, Keith's letter of March 2,
1962 are substantially correct; that there is a house across the street
from the desired lot split; that during the Planning Commission hearing

there was no denial made that a lot split had been granted at one time
which did not materialize due to Mr. Keith's failure to file a lot split
map. He continued that there can be no certainty of a street being cut
through, efforts to do so in the past having failed; that eventually, in
order to clear the back lots, the street may have to be extended into a
longer cuI de sac, citing as a precedent Encino Avenue, and suggested that
the Council give the matter further thought in light of the extenuating
circumstances that exist in this matter, including thought of a possible
equitable deposit to be made by those persons granted lot splits to help
pay for their secondary means of ingress and egress.
It being the consensus of the Council that Councilman Phillips' statements
and suggestions were well taken, Councilman Camphouse ~ that the matter I
' be referred to staff for study and report as to a possible equitable
solution, including the cost that would be involved. Councilman Phillips
seconded the motion which was carried unanimously.
Mayor Balser declared that since no action can be taken until time for
appeal elapses the zone variance request of John T. and Nadine O. Waterhouse
to allow a third dwelling on the lot at 734 and 738 West Longden Avenue in
Zone R-l, (Planning Commission Resolution No. 441 recommending denial) will
be held over until the appeal period has passed and that the matter will
appear on the agenda for the Council meeting of April 2, 1962.
Planning Commission Resolution No. 442 recommending approval of a chain
link fence construction at Harding's Gardenland, Inc. (Southwest corner of
2nd and Sandra Ave.).
The Planning Director explained that a zone variance had been granted to
permit the use of the subject property for the storage of material (except
fertilizer) used in connection with Harding's Gardenland upon specified
conditions, one of the conditions being that "all but the easterly 23 feet
thereof be fenced with a concrete block wall, grape stake fence or similar
type of fence to screen the stored materials from view"; that doubt has
arisen concerning the meaning, purpose and intent of the said condition
concerning the type of fencing required to fulfill the same and a chain
link fence around the area specified was constructed; that the applicant
is willing to covenant that only live plant material will be stored upon
the subject property.
Councilman Reibold ~ that under the circumstances explained by the
Planning Director and subject to the execution and delivery of a covenant
restricting the use of the subject property to the storage of only live
plant material, the Council accept the recommendation of the Planning
Commission as contained in its Resolution No. 442, and approve a chain link
fence construction at Harding's Gardenland, Inc. Councilman Camphouse
seconded the motion which was carried unanimously.
The City Attorney thereupon presented, explained the content and read the I
title of Resolution No. 3480, entitled: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA APPROVING A CHAIN LINK FENCE AT THE
SOUTHWEST CORNER OF SANDRA AND SECOND AVENUES AS FULFILLING THE PURPOSE,
INTENT AND SPIRIT OF AND COMPLYING WITH THE FENCING CONDITIONS SPECIFIED
IN A VARIANCE HERETOFORE GRANTED."
MOTION by Councilman" Reibold, seconded by Councilman Phillips and carried
on roll call vote as follows that the reading of the full body of Resolution
No. 3480 be waived:

The City Manager explained that the prices quoted are on a "keep filled"
basis, and the cost per gallon will be determined by the total storage
capacity at each location and not by the number of gallons delivered each
time to each location, which means that the prices charged the City will
not be increased for deliveries smaller than 400 gallons as is usually
the case. Also that the City rarely orders regular gasoline and that
regular gasoline was included in the specifications only to make it avail-
able if needed.
In answer to Councilman Butterworth's query as to the surcharge over the
County price the City Manager answered that based upon the estimated need
of 100,000 gallons for the coming year it would amount to a total of
$218.00.
Councilman Phillips MOVED that the Council accept the recommendation of the
City Manager and the Purchasing Officer; that a contract for supplying the
City of Arcadia with gasoline for one year commencing April 1, 1962 and
terminating March 31, 1963 be awarded to the low bidder on premium gasoline,
Richfield Oil Corporation; that all other bids be rejected; that any
irregularities or informalities in the bids or bidding process be'waived,
and that the Mayor and City Clerk be authorized to execute such contract
on behalf of the City for the performance of the contract, in form
approved by the City Attorney. Councilman Camphouse seconded the motion.
Councilman Butterworth observed as follows: "I am gratified it is $218
rather than $1500 differential in cost. Nonetheless I think the principle
remains the same and appears to me to be an unnecessary expenditure of
funds. Personally I am inclined to believe that it may tend to impede our
fight against Metropolitan Government by attaching to the fight a surcharge
that passes on to the taxpayer. This is sma.ll but if we keep on this way
it might be a sizeable amount. I think we can more effectively fight
Metropolitan Government by not getting involved in these tax surcharge
situations. For this reason I would oppose the awarding of this bid and
would recommend we take the lowest bid available for gasoline."

The City Manager explained ,hat the Larson Equipment Company did not
include the pavement breaking tools and points in their quotation, and
the Davey Compressor does not conform to the City's specifications; that
although Southland Machinery did include the tools in its bid, the
Jaeger Compressor for which it quoted is not in strict conformance with
the specifications.

Councilman Butterworth MOVED that the Council accept the recommendation of
the City~Manager, the Director of Public Works and the Purchasing Officer;
that a contract for the purchase of the air compressor and tools be awarded
to the Engine and Equipment Company which submitted the lowest bid in
strict conformance with the City's specifications; that all other bids be
rejected; that any irregularities or informalities in the bids or bidding
process be waived, and that the Mayor and City Clerk be authorized to
execute such contract on behalf of the City for the performance of the
contract and in the amount specified, in form approved by the City Attorney.

Manager and authorize the waiving of a license fee in the matter of the
application of A1 J. Kayda to operate a circus to be sponsored by the
California National Guard, permission for such operation having previously
been granted by the Council on March 6, 1962.

RACES appropriation of $8,232 for traffic control of the harness races which

The City Manager reported that an agreement has been submitted by the
Atchison, Topeka and Santa Fe Railway Company providing for the installa-
tion of crossing gates controlling traffic on First Avenue and for
flashing lights to control the traffic at Santa Clara Avenue, the
estimated cost of $14,678 covering the same to be shared equally by the
City and the railroad and the maintenance cost thereof to be the sole

responsibility of the railroad; also median curbs to be installed in the
approaches to the intersection for both Santa Clara and First Avenue at
an estimated cost of $1100 to be paid by the City.

MOTION by Councilman Phillips, seconded by Councilman Butterworth and
carried on roll call vote as follows that Council accept the recommendation
of the City Manager and the Director of Public Works and authorize the
Mayor and City Clerk to execute' an agreement in form approved by the City
Attorney between the City of Arcadia and the Atchison, Topeka and Santa Fe
Railway Company covering the cost apportionment and agreement as to
responsibility for installation and maintenance at the First Avenue Grade
Crossing; and also that the sum of $8500 be transferred and appropriated
from Reserve for Capital Projects Account No, 285 iri' the'General, Fund to
Capital Improvement Projects Account No, 220, Crossing Gates - First and
Santa Clara, et al:

cooperate in gathering data for the Los Angeles Rapid Transit Survey,
referred to as LARTS. That funds are available from the Federal Government
under Section 701 of the Housing Act of 1954, as amended providing for its
financing of two-thirds of the cost; that the Planning Department has

lJ', ~~--- maximum of $2,333.33 would be paid by the Federal Government.
-~~That in reviewing an agreement received from the State, it was noted that
among other things, free access to all records in connection with the
INDEXED project and to the extent feasible, kept separate and apart from all other
documents, must be maintained by the City; also that all maps, reports
and other documents completed pursuant to the agreement shall carry the
following statement:

The City Manager added that all the information required for LARTS became
a necessary part of information needed to produce the City's land use map
and report and that a great many future maps and reports will be based
on this information, and that under the circumstances, he could not
recommend entering into the agreement for Federal Funds.

With reference to the petition dated March 10, 1962, containing
approximately 156 signatures of Arcadia residents, proposing that the
City use the now vacant library building on North First Avenue as a
community youth center administered by the Recreation Department, the
City Manager recommended that the request be referred to staff and the
Recreation Commission for study and report; that among the matters to
be included in the staff report would be the following:

1. Maintenance cost for building.
2. Operation cost for program.
3. Effect of proposed use on downtown Arcadia.
4. Effect of downtown Arcadia on proposed use.
5. Existing agreement with Arcadia Board of Realtors
for sale or lease of property.
And the Recreation Commission could report on the following:
1. Need for such a facility in Arcadia.
2. Program content if the building was used for purposes outlined.
3. Extent of use for youth activities.
4. Extent of use for other purposes.
5. Effect on Recreation budget.
6. Utilization of Volunteer help in the program.
MOTION by Councilman Reibold, seconded by Councilman Camphouse that the
Council approve the City Manager's recommendation as set forth above.
A general discussion ensued and the following comments in part were
made by the Councilmen:
Councilman Butterworth: That he felt the request had merit but that he
would like to study the matter further; that he concurred in the City
Manager's recommendation that the Recreation Commission be given the
opportunity to consider the matter.
Mayor Balser voiced his concurrence.
Councilman Phillips: That in his opinion the staff should give
particular attention to the effect upon downtown Arcadia, as pointed
out by the City Manager; that the Central Planning Committee, a new
organization formed for the promotion of downtown Arcadia, has just
gotten under way and nothing should be done that might stifle its,.
ef forts.
Councilman Reibold: That he felt the Recreation Commission should give
its opinion as to the requirements for such a facility independent of
the old library building; that if a need is established perhaps a
suitable building should be constructed specifically for such purpose.

The consensus being that the City Manager in his recommendation had
covered all points pertaining thereto, the following roll call was
taken of the above motion:

Mrs. John Arozena, 1020 S. Eighth Avenue, addressed the Council, advising
that she is the official observer for the League of Women Voters, a non-
partison organization which encourages participation of citizens in
government. She submitted to the Council a supply of pamphlets on facts
for voters of Arcadia and also a map of the Districts in Los Angeles
County. She mentioned that the pamphlet had been distributed to various
organizations and that a supply is availablel.at the City Clerk's office.
Mayor Balser commended the League for its continued interest in the City.
The following persons addressed the Council with regard to the proposed
use of the old library building for a youth center, which matter had
earlier been referred to the Recreation Commission and staff for further
study and report:

Mr. Walter E. Gockley, 49 E. Huntington Drive, representing the Downtown
Businessmen's Association, stated in part that this organization desired
to go on record as protesting the use of the library building as a youth
center; that it did not object to a youth center in Arcadia, but that
the organization felt that a business use of the library property would
be more advantageous to the businessmen in the area as well as to the
City by way of additional tax reve~ue.
(Bandurrago) Peter' Bandurrago, representing the Arcadia student body, stated in
substance that a poll taken of students in Arcadia indicated a definite
need fo~ a youth center in Arcadia; that if the library building is not
used there should be some definite area assigned where students could
meet for social activities afcernocns, early evenings and during the
S'i..lmmer.

Mrs. James Garkie, 2223 South Third Avenue, stated in part that she wished
to clarify one point in the reference to a youth center; that it was
proposed that it should be a commu~itj center rather than just a youth
center. She mentioned that there is presently no meeting place in Arcadia
for organizations such as the Camp Fire Girls or the YWCA; that the library
building was being emphasized because it exists; that the community needs
a center, not just for youtns but for many activities.

The Planning Director advised that a report on che matter of zoning on
Live Oak and Louise Avenues, as requested by the Council, has been
completed by the Planning Department and is in process of being submitted
to the Council and the Planning Commission; that meetings have been
arranged for the staff to meet with the neighborhood associations, the
South Arcadia businessmzn as well as the original applicants who requested
a change of zone.
CITY ATTORNEY The City Attorney submitted to the Council for its study prior to
(Ordinances) introduction, drafts of proposed ordinances on the matter of bird and
animal regulations, as discussed at the March 6, 1962 Council meeting,
adding that he would welcome any suggestions or questions of the Council.

I
At Mayor Balser's request the City Clerk read a letter dated March 14,
1962 from the Assistance League of Arcadia, signed by Mrs. Homer A. Murphy,
President, which stated in substance that inadvertently the Assistance
League has been mentioned in certain corr.espondence to the Council and
circulated in the Arcadia area concerning the use of the old library
property as a youth center; that the League has made no endorsement or
recommendations in connection with this proposal.
At 8:50 P.M. Mayor Balser adjourned the meetin~.
