'/'.A (, .-J -- , v INDEXED 14:5648 M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING APRIL 3, 1962 The City Council of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 P.M., April 3, 1962. The Invocation was offered by Rev. Eugene E. Collins, Pastor of the Arcadia Friends Church. Mayor Balser led in the pledge of allegiance to the flag. PRESENT: ABSENT : Councilmen Camphouse, Reibo1d, Phillips, Balser Councilman Butterworth MOTION by Councilman Phillips, seconded by Councilman Camphouse and carried unanimously that the minutes of the Regular Meeting of March 20, 1962 be approved as submitted in writing. Planning Commission Resolution No. 441, recommending denial of the application of John T. and Nadine O. Waterhouse for a zone variance to allow a third dwelling on the lot at 734 and 738 West Longden Avenue in Zone R-1. The Planning Director, after submitting to the Council a plot plan of the proposed construction, explained that the subject property is developed with a residence and two car garage on the front portion with another residence and garage and a separate driveway located mid- way back on the lot; that the lot is zoned R-1 and has a frontage of 70 feet, a depth of 300 feet, and an area of 21,000 square feet; that the area is part of Annexation No. 17-A and was originally developed under County standards, and that although it is possible to place the third house on the subject property, there are other large properties in the immediate vicinity and elsewhere throughout the City that do not enjoy the extra dwelling privilege. Councilman Phillips then ~ that the recommendation of the Planning Commission embodied in its Resolution No. 441 be approved and that the petition of John T. and Nadine 0, Waterhouse for a zone variance for the purposes and affecting the property therein described be denied. Councilman Camphouse seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Camphouse, Reibo1d, Phillips, Balser NOES: None ABSENT: Councilman Butterworth Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 3482, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING A REQUESTED VARIANCE TO ALLOW A THIRD HOUSE ON THE LOT AT 734-738 WEST LONGDEN AVENUE IN SAID CITY." The deed restrictions of Tract No. 13113 shall be released or so modified that residences on lots 1, 2 and 3 will not be in violation. 2. The subdivider shall make every effort to secure 10 feet dedication for street purposes, including the corner cutoff, from the property at 2112 E1 Monte Avenue,' south of "A" Street. If the dedication is not received the subdivider shall remove that portion of the unused private driveway within the dedicated street and shall install an appropriate radius curb return to the satisfaction of the Director of Public Works. If, in the future, the property at 2112 E1 Monte Avenue is divided, the necessary dedication shall be required and the short radius curb return shall be removed and a standard radius curb return shall be constructed at the expense of the applicant for the division of the lot. 3. Dedicate a one foot strip along the south side of "A" Street in fee to the City, or in trust to a title company along with the establish- ment of a subdivision trust. 4. Dedicate a 10 foot drainage easement along the south line of lot 3 and construct the necessary drainage facilities to drain the street to the Arcadia Wash. 5. Dedicate all necessary rear line utility easements. 6. The front setback line on lots 1, 2 and 3 shall be 25 feet.. The side setback for lot 1 shall be..20 feet.. 7. Remove all buildings from the tract. Remove all trees from the street right of way. 8. Install all street improvements, including drainage facilities, required by the subdivision ordinance and Public Works Department I in accordance with plans and to grades satisfactory to the Director of Public Works. Duarte Road -' 22.8 ft.) 1 ~ 2,.0 INDEXED I FOOTHILL FREEWAY (Off-Ramp) '1 ~ 1\ 14: 5650 feet wide, which do not. comply with Zone R-O requirements, but are well above those of Zone R-1; that the portion of the tract in R-O is subject to deed restrictions covering Tract No. 13113, which re- strictions require, among other things, one 'single-family dwelling on a building site containing 15,000 square feet and expire January 1, 1970; that the street is shown as a standard 60 foot width. After discussion Councilman Reibo1d MOVED that Council accept the recommendation of the Planning Commission and grant approval of tentative map of Tract No. 27186, subject to the above conditions. Councilman Phillips seconded the motion which was carried unanimously. The City Manager advised that with regard to Resolution No. 3316 granting a variance and/or special use permit for a convalescent home at 1601-1609 South Baldwin Avenue and particularly subsection 6 of said resolution. requiring a six foot masonry wall to protect the privacy of adjacent property owners from the occupants of the convalescent home, a question has arisen due to changes made in the grade between the subject property and adjacent property. That in cases where the fill occurs the wall, if constructed at a 6 foot elevation above adjacent property grades, would not afford the protection originally contemplated and that it is recommended that Resolution No. 3316 be modified. Councilman Reibo1d MOVED that the Council accept the recommendation of the City Manager and that the following minute resolution be adopted: RESOLVED, that Resolution No. 3316 be modified to provide that the wall to be constructed shall provide a six foot height above adjacent properties where cuts were made on the convalescent home site and a six foot height above the convalescent home property where fills are made. Councilman Phillips seconded the motion which was carried unanimously. The City Manager advised that an offer of $400.00 has been made by Mr. and Mrs. Barnett Goldman to purchase the south 22.8 feet of City-owned property at 100 West Duarte Road. He explained that 100 West Duarte Road is the westerly property owned by the City and is 22.8 feet south of the south line of the balance of City-owned land and that acceptance of the Goldman offer would square up the south line of all the City's land, and would permit the City to continue the existing wall in a straight line. He also submitted information regarding the assessed valuation of the property, the total purchase price, land cost to the City. land area, land proposed to be sold, etc., (Information on file in office of the City C1erk)and recommended that the subject south 22.8 feet be sold to Mr. and Mrs. Barnett Goldman. Whereupon Councilman Phillips ~ that the Council accept the recommendation of the City Manager and authorize the sale of the south 22.8 feet of the property owned by the City at 100 West Duarte Road to Mr. and Mrs. Barnett Goldman for the sum of $400.00 and that the Mayor and City Clerk be authorized to execute a deed for same. Motion seconded by Councilman Reibo1d and carried on roll call vote as follows: AYES: Councilmen Reibo1d, Phillips, Balser NOES: Councilman Camphouse ABSENT: Councilman Butterworth The City Manager explained the displayed four proposed plans for exit ramps of the Foothill Freeway, and recommended Plan 4 which showed the location of the off-ramp for westbound traffic at Santa Anita Avenue adjacent to Forest Avenue, stating that Forest Avenue would be closed at that point to eliminate it being used as a thoroughfare. 3. 4-3-62 CAMPUS DRIVE IMPROVEMENTS w INDEXED FIRE DEPARTMENT (Scroll ) C6:~' iINDEXED TREES (Harding's Garden1and, Inc.) 1 ~ 0 :2.... rINDEXED 14:5651 Discussion was held on the different aspects of the plans, their advantages and disadvantages, and it being the consensus of the Council that they concurred in the City Manager's recommendation that Plan 4 would be in the best interests of the City, Councilman Phillips MOVED that.P1an No.4, indicating westbound off-ramp exiting into Santa Anita Avenue be approved. Councilman Camphouse seconded the m~tion which was carried on roll call vote as follows: AYES: Councilmen Camphouse, Reibo1d, Phillips, Balser NOES: None ABSENT: Councilman Butterworth The City Manager advised that pursuant to Council instructions six I designs have been prepared to provide improved unloading facilities on the north side of Campus Drive opposite the Arcadia High School; That the plans for installation of curb, gUtter and widening of the north side of Campus Drive from Santa Anita west to the existing curb and gutter are complete with the exception of this faCility. The City Manager added that the staff recommends plan No.4 on the basis that islands at this location would project into what would normally be the parking lane and would present a serious traffic hazard if the parking lane was used as a traffic lane. Whereupon Councilman Camphouse MOVED that Council approve the recommen- dation of the City ~~nager and the staff and accept Plan No.4 for the improvement of unloading facilities on the north side of Campus Drive opposite the Arcadia High School. Councilman Reibo1d seconded the motion which was carried unanimously. Mayor Balser requested that the scroll containing a Resolution from the Board of Fire Commissioners of the City of Los Angeles expressing their gratitude and thanks to the City of Arcadia and every member of the Arcadia Fire Department for its contribution in connection with the major fire that started on November 6, 1961 be forward to the Fire Chief for mounting in fire headquarters, and added the congratu- 1ations..of the Council. The City Manager advised that due to adverse growing conditions the past winter, Harding's Garden1and, Inc. is unable to furnish the follow- ing parkway trees to the City by March 31, 1962 in accordance with specifications: 100 Victorian Box, 100 Italian Stone Pine and 139 Holly Oak. That said company has suggested that 1) the order for the 100 Victorian Box be deleted from the contract; 2) the contract be augmented by ordering an additional 100 Magnolia Grandif10ra; and 3) extend the contract to permit the Italian Stone Pines and Holly Oaks to grow to specification size. The City Manager added that the above suggestions are acceptable to the Department of Public Works providing that 1) the delivery of the I trees be prior to May 20, 1962 or after February 1, 1963 and 2) that all trees subjected to forced growth be hardened in a lath house a minimum of two weeks before delivery. Discussion followed and Councilman Camphouse suggested that in future tree planting programs Dr. Stewart of the Los Angeles County Arboretum be contacted for his suggestions as to trees particularly adaptable to the climate in this area as well as uniquely suitable for Arcadia in order to add significance to the City. The City Manager commented that he had spoken with Dr. Stewart about certain specimen trees and seeds that had been received from Australia and Africa whose growing habits would be studied and that Councilman Camphouse's suggestion would be conveyed to Dr. Stewart. 4. 4-3-62 RECREATION DEPARTMENT (Backstop improvements and Fencing) I (f ( lfaJvo 14:5652 Councilman Reibo1d MOVED that the Council accept the recommendation of the City Manager and the Purchasing Officer and approve the proposals of Harding's Garden1and, Inc. as amended by the Department of Public Works and that the existing contract be amended accordingly. Councilman Camphouse seconded the motion which was carried unanimously. MOTION by Councilman Phillips, seconded by Councilman Reibo1d and carried on roll call vote as follows that the Council accept the recommendations of the Recreation Commission as contained in its memorandum to the City Manager dated March 30, 1962, authorize the appropriation of the sum of $2,900 from the Parks and Recreation Facilities Fund for backstop improvements and fencing at Bonita, Hugo Reid and Vista Parks, and approve the further recommendations 1 through 9 set forth in said memorandum (memorandum on file in office of the City Clerk): INDEXED AYES: Councilmen Camphouse, Reibo1d, Phillips, Balser NOES: None ABSENT: Councilma~ Butterworth SIDEWALKS (f:~ INDEXED ORDINANCE NO. 1172 (Adopted) / I RESOLUTION NO, 3481 / Dtscussion was held on the recommendation of the City Manager that five foot sidewalks be installed in all R-2, R-3-R and R-3 zones, said zones to be added to Section 7212 of the Arcadia Municipal Code, and the justifications for such recommendations as outlined in his report dated April 2, 1962 (report on file in office of the City Clerk) and it was the consensus of the Council that the matter required further study, particularly with regard to moving trees in that it was felt there were many beautiful old trees in the subject zones that should not be removed. Councilman Camphouse MOVED that the above matter be referred to staff for additional information. Councilman Phillips seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Camphouse, Reibo1d, Phillips, Balser NOES: None AESENT: Councilman Butterworth The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1172, entitled: "AN ORDINANCE OF THE C!TY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION .6312.1 OF THE ARCADIA MUNICIPAL CODE," (Public Hearings) MOTION by Councilman Phillips, seconded by Councilman Camphouse and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1172 be waived: AYES: Councilmen Camphouse, Reibo1d, Phillips, Balser NOES: None AESENT: Councilman Butterworth Councilman Phillips further ~ that Ordinance No. 1172 be adopted. Mrs. Ella R. Mi1fert, 721 W. Ca11ita Street, addressed the Council, questioning the location of a wall proposed to be constructed between her property and that of the convalescent home to be constructed at 1601-1609 South Baldwin Avenue; that if said wall connects with the existing wall it will extend upon her property.. She was assured that the subject wall would not extend on her property but would jog prior to connecting with the existing wall. I Mr. Charles R. Fields, 717 West Ca11ita Street, addressed the Council on the same subject of the wall, but as it pertains to its height where cuts or fills occur on the convalescent home property. He was informed that the subject wall would be constructed to provide a six foot height above adjacent properties where cuts were made on the convalescent home site and a six foot height above the convalescent home property where fills are made. The City Manager also gave Mr. Fields a copy of an elevation map of the subject property. MATTERS FROM CITY OFFICIALS (City-owned property on Baldwin Ave.) / ~1{P7~ INDEXED Upon the City Manager advising that proposals have been received to purchase the city-owned property on Baldwin Avenue formerly occupied by the Fire Department, and his recommendation that he be authorized to develop a proposal for submission to the Council for the disposal of said property, Councilman Phillips MOVED that Council approve the recommendation of the City Manager and authorize him to proceed upon such recommendation. Councilman Camphouse seconded the motion which was carried unanimously. (Ordinances on Discussion was held on the proposed ordinances for the regulation of birds & anima1s)birds and animals, drafts for same having previously been submitted to the Council for study, and mention was made of a communication on the subject from Mr. Colvin. / ORDINANCE NO, 1173 (Introduced) I The City Attorney explained, in answer to various comments and questions, that in his opinion, to require a permit at any level for animals in excess of ten when dealing with birds, would be an administrative impossibility; that the administrative burden will be lightened in that I the proposed ordinances will supply means of coping with complaints; that complaints will be informal, merely calling the'matter to the attention of the City officials, and can be instigated by either three private citizens or one public servant. It being the consensus of the Council that the minimum number of birds shall be 200 and that the ordinances be presented for introduction at this meeting, the City Attorney presented, explained the content and read the title of Ordinance No. 1173, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY ADDING TO PART 3 OF CHAPTER 1 OF ARTICLE IV THEREOF A NEW DIVISION 9 ENTITLED 'ANIMAL AND BIRD NUISANCES~."
