HomeMy WebLinkAboutMARCH 15,1960 NVOCATION PLEDGE ROLL CALL MINUTES (3-1-60 and 3-8-60) HEARING (Caler) j bll,~ ).~\J 1- 1 1/1D 9 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA REGULAR MEETING MARCH 15, 1960 The City Council of ,he City of Arcadia, California, met in regular session in the Council Chamber of the City Hall at 8:00 o'clock P.M., March l5, 1960. The Invocation was offered by the Rev. St. Elmo Nauman, Pastor of the Arcadia Congregational Church. Mayor Reibold led in the pledge of allegiance to the flag. PRESENT: ABSENT: Councilmen Balser, Camphouse, Jacobi, Phillips, Reibold None Motion by Councilman Phillips, seconded by Councilman Jacobi and carried unanimously that the minutes of the Regular Meeting of March 1, 1960 and the Regular Adjourned Meeting of March 8, 1960, as submitted in writing, be approved. Mayor Reibold declared the hearing open on Planning Commission Resolution No. 359 recommending denial of the application of Paul B. Caler and others for a change of zone from Zone R-3 to Zone C-3 on property located on the north side of Duarte Road from 745 to 917 West Duarte Road and inquired if anyone desired to speak in opposition to the recommendation of the Planning Commission. Mr. Henry W. Shatford, 410 South Drake Road, Arcadia, an attorney represent- ing some of the applicants, addressed the Council, displaying photographs of a portion of the area in question which were taken facing the existing business area, including parking lots, a church and certain commercial buildings. He stated in part that the requested zone change covered an area within the radius of an established commercial zone; that after Duarte Road is widened it will not be conducive to the construction of multiple family dwellings in which children would reside; that if not rezoned properly the area will deteriorate in value but that if zoned commercial a business development could be constructed benefiting the entire city; that he does not believe the recommendation of the Planning Commission would be of benefit to both the community and the residents. In answer to Councilman Camphouse's question as to whether the owners of the property contemplated developing the entire area as a total project or on an individual basis, Mr. Shatford stated in substance that he was not certain but in his own opinion thought that in order to develop the area properly the owners would have to do so jointly. The following persons also addressed the Council in opposition to Planning Commission's recommendation and requested consideration: Mrs. Basil G. Carmack, residing at 805 West Duarte Road Mrs. James C. Greer, residing at 901 West Duarte Road Mrs. Miriam H. Mayor Reibold then inquired if anyone desired to speak in favor of Plan- ning Commission's recommendation. Mr. C. R. Johnston, owner of property at 833 West Duarte Road, addressed the Council, stating in part that he had received excellent loan commit- ments from several insurance companies; that his building plans for an apartment house to cost approximately $lOO,OOO.OO had been approved by the City; that construction is only awaiting Council's decision in this zoning matter; that the prices the owners of the property in the subject area are asking for their property for business purposes are prohibitive and that in his opinion the area would stagnate if zoned commercially; and that in his opinion the Planning Commission's recommendation is just. No one else desiring to be heard at this time, Councilman Camphouse commente that he thought it would be desirable to continue the hearing in order that the Council might have time to familiari~e themselves with the situation and to receive 'additional information from the staff. Mayor Reibold suggeste that the matter be held in abeyance until after the April 12, 1960 Municipal Election, inasmuch as there is now a zoning referendum on the ballot. Councilman Camp house moved that the hearing on Planning Commission Resolution No. 359, recommending denial of the application of Paul B. Caler and others, for a change of zone ~s set forth in 'said resolution, be continued to the next regular Council meeting on AprilS, 1960. Councilman Phillips seconded the motion and it was carried unanimously. The City Attorney presented for the second time, discussed the content and read the title of Ordinance No. 1077, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING ORDINANCE NO. 760 OF SAID CITY BY ADDING A NEW SECTION THERETO, SECTION 6.5, 'R-3-R' RESTRICTED MULTIPLE-FAMILY ZONE." Motion by Councilman Phillips, seconded by Councilman Jacobi and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1077 be waived: AYES: Councilmen Balser, Camphouse, Jacobi, Phillips, Reibold NOES: None ABSENT: None Councilman Phillips further moved that Ordinance No. 1077 be adopted. O The City Clerk read in full a communication from Mr. Philip Smith of 28 I' West Sycamore Avenue regarding some of the recommendations made by the ~ Planning Commission. ~~ In answer to Mayor Reibold's inquiry as to whether there was anyone in the ~ audience to represent the church, Mr. Herbert I. Chambers, of 1653 Perkins ,~Drive, addressed, the Council, stating that he represented the congregation ~~i-~ of said church. In the general discussion that ensued, in which Mr. Philip ~ ' Smith also joined, it was agreed that the church is willing to comply with Mr. Smith's request for 10 feet of landscaping to be installed adjacent to a six foot masonry wall along the north line of Lot 77 to act as a buffer between Lot 77 and Mr. Smith's lot No. 73. Mr. Smith commented that he thought it would be better if the church would buy the existing lease of the service station on the corner as that property would permit sufficient area for the church, the pastor's residence and parking. 1 SPECIAL USE (Trampoline) lONE ARIANCE (Service Station) BID AWARD (Weeds) ~h~ '/ 'I!>-~1>' Councilman Phillips stated that both the Planning Commission and Council ,have demonstrated an effort to try to solve the problem of the corner in question in a manner that will be in the in~erest of good planning, and that he moved that the recommendations of the Planning Commission as contained in its Resolution No. 361 be modified as follows: That final plot, building and landscaping plans be submitted to the Planning Commission for approval, that a planting area 10 feet in depth be maintained along the northerly side of Lot 77 adjacent to Lot 73 adjacent to a six foot masonry wall; that as thus amended the Council approve the recommendation of the Planning Commission as contained in its Resolution No. 361. Councilman Jacobi seconded the motion and it was carried on roll call vote as follows: AYES: Councilmen Balser, Camphouse, Jacobi, 'Phillips, Reibold NOES: None ABSENT: None Motion by Councilman Camphouse, seconded by Mayor Reibold and carried on roll call vote as follows that Council accept the recommendation of the Planning Commission as contained in its Resolution No. 365 that a trampoline center should be classified as a special use under Section 17 of Ordinance No. 760: AYES: Councilmen Balser, Phillips, Reibold NOES: Councilmen Camphouse, Jacobi ABSENT: None The City Attorney commented that a ,resolution regarding the' above will be ready by the next Council meeting. Mayor Reibold declared that since no action can be taken until time for appeal elapses (March 18, 1960) the zone variance request of P. L. McNutt and others for a zone variance to allow construction of a service station at 1104 West Huntington Blvd., Planning Commission Resolution No. 366, will be held over'until the appeal period has passed. Motion by Councilman Balser, seconded by Councilman Camphouse and carried on roll call vote as follows that the City Council accept the recommendation of the City Manager and the Director of Public Works; that a contract for the removal of weeds and debris for the year 1960-61 be awarded to John C. Councilman Jacobi seconded the motion and it was carried unanimously. ' Mayor Reibold thereupon appointed a committee for such purpose consisting of Councilman Balser, Planning Commissioners Michler and Norton, and Mr. Mel Pratt, a businessman in that area, and also a Commissioner of Vehicle Parking District No.1, to work with the City Manager, the City Attorney and such staff members as they may choose. Motion by Councilman phillips, seconded by Councilman Balser and carried on roll call vote as follows that the City Council approve the recommen- dation of the City Manager and the Director of Public Works and authorize payment to Alderman and Swift, Engineers, of $3,015.00 from Abatement Receivable Account, this being 90% of one-half of the agreed engineering fee of $6,700,00 for the Arcadia Avenue Street Opening project: AYES: Councilmen Balser, Camphouse, Jacobi, Phillips, Reibold NOES,: None ABSENT: None The City Manager advised that in checking the plans for the Arcadia Wilderness Park Recreation Center the Building Department found that one of the three separate roofs proposed to be constructed is of a non-fire- retardant material as required by the Arcadia Building Code; however, that a variance is recommended to allow said roof to be constructed of an alternate material as per plan for the reason that the open style pavillion provides substantially more exit width than the usual B-4 building; that the remote location would not increase the fire hazard to any surrounding structures; and that the Arcadia Fire Department and the United States Forest Service have been contacted and do not consider this change to be hazardous in this location. He added that there being no private property owners within 50 feet of this property no hearing has been scheduled or is required. Water Co.) /VI7~ RESOLUTION No. 3230 I )~ 55 ;~~ j '\.~~ \\.0 \f Motion by Councilman Phillips, seconded by Councilman Jacobi and carried unantmously that the Council grant the request of the West Arcadia Business Association for a permit to conduct a "Sidewalk Sale" on Satu~day, March 26, 1960 between the hours of 10:00 A.M. and 5:00 P.M., subject to the conditions and information submitted in their communication of March 15, 1960, signed by James R. Weitz and addressed to the City Manager. The City Manager advised that a resolution had been received from the Library Board of Trustees setting forth that plans, specifications and cont~act documents for the proposed new Arcadia City Library had been reviewed by them and with minor exceptions noted were approved, and requesting the City Council to also approve said documents and authorize a call for bids thereon. I A general discussion ensued and it was noted that said plans and spectfications had not yet been received by the Staff in completed, bound form and until such time final approval should not be given. That those porttons of the plans and specifications that had been received were in plan-check; that tentative approval on some of the items could be given but that as part of the bidding process involves formal approval by the Council of plans and specifications which are put out to bid, the completed documents as a whole should be in their hands prior to such time. Councilman Phillips commented that it would be advantageous to the City to secu~e bids as quickly as possible, this being an unusually favorable bid- ding period, and that he would be ready to meet at any time final check has been made of the documents. Mayor Reibold then stated that as soon as appropriate Council could meet as a committee of the whole in order to expedite the matter. Motion by Councilman Camphouse, seconded by Councilman Balser and carried unanimously that Council authorize the Mayor and City Clerk to execute an agreement by and between the City of Arcadia and the Southern California Wate~ Company for the utilization of fire hydrants in Annexation No. 19 at a charge of $2.00 per month for a period of five years, commencing July 1, 1960 and ending June 30, 1965; said agreement to be subject to the approval of the City Attorney as to form and content. The City Attorney presented, explained the content and read the title of Resolution No. 3230, entitled: "A RESOLUTION OF THE CITY COUNCIL OF TIlE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE FOR TIlE CONSTRUCTION, MAINTENANCE AND OPERATION OF A CHURCH AND FOR CHURCH PARKING AT TIlE NORTH- WEST CORNER OF SANTA ANITA AVENUE AND FOOTHILL BOULEVARD." The City Attorney explained that this resolution, if adopted, would grant a variance to the Shepherd of the Hills Evangelical Lutheran Church, as preViously determined by the Council. Councilman Phillips advised that a communication has been received from Mr. Corson W. Ide, Mayor ,of the City of San Marino, stating in substance that a petition submitted by the residents of said city requested that all cities in Los Angeles County that have not increased local taxes in the J- ' past several years be invited to ,attend a joint meeting with the County 'f Board of Supervisors for the purpose of demanding a hold-the-line policy ,i on taxation; that although their council does not feel this would be <:7: appropriate they invited Arcadia's response and comment. Councilman ~~ Phillips then suggested that Mayor Reibold write to the Mayor of San ~~~~~ Marino expressing the City of Arcadia's deep concern and sympathy with San Marino's position, and that it is the intention of the Arcadia Council to personally make the same appeal to the Supervisor from this dis tric t.
