CITY COUNCIL OF THE CITY OF ARCADIA
REGULAR MEETING
NOVEMBER 1, 1960
The City Council of the City of Arcadia met in regular session in the
Council Chamber of the City Hall at 8:00 o'clock P.M.. November 1, 1960.
The Invocation Was offered by Councilman Balser.
Mayor Camphouse led in the pledge of allegiance to the flag.

Mayor Camphouse acknowledged the presence in the audience of students
from Arcadia High School, and commented that the Council appreciated the
interest shown by the school faculty and the students in the function of
local government and the fact that it is deemed a part of education.
Motion by Councilman Phillips, seconded by Councilman Reibold and carried
unanimously, with the exception of Councilman Butterworth who abstained
from voting regarding the minutes. of October 4, 1960, that the Council
Minutes of the Regular Meetings of October 4. 1960 and October 18, 1960
as submitted in writing be approved.
Mayor Camphouse declared the hearing open on the application of Henry C.
Gossenberger. residing at 5725 Vineland Avenue. North Hollywood, and
representing the Rand L Advertising Agency, 164% West San Bernardino
Road. Covina. California. for a business permit to allow him to solicit
business firms in the City of Arcadia for advertising to be placed in
coupon books to be sold via telephone to residents of Arcadia. Mayor
camphouse then inquired if anyone desired to address the Council either
in favor of or in opposition to the granting of such permit.
Mr. Henry C. Gossenberger, the applicant. addressed the Council and in
answer to various questions. advised that his method of operation is to
contact merchants for advertising in a certificate book containing values
equivalent to $300.00 in material and service if every certificate in the
book is used; that there is no charge to the merchant, whose only expense
is the value of the merchandise he wishes to give the customer to bring
him into his place of business. That the residents of the area are then
solicited by telephone for the purchase of 'the certificate book at a cost
of $6.99 each.
Mr. Gossenberg continued, that a contract is executed between the merchant
and his company. said contract stipulating, if so desired, the number of
books to be sold, the number of certificates in the book, the type of
certificate and the expiration date. That the merchant retains a copy
of the contract and receives a copy of the certificate book; that the
merchant is protected. That he has engaged in the subject business for
approximately a year, has never been involved in litigation as a result
thereof; and that he intends to check with the local Chamber of.Commerce.
He then submitted to the Council a copy of the proposed certificate
booklet.
The City Attorney suggested that the applicant submit a copy of the
aforementioned contract and a statement showing compliance with the

provisions of Sections 17700 and 17701 of the Business and Professions
Code relating to the sale of coupons. He commented that it would be of
interest to hear more direct testimony as to the precise approach made
in the proposed sale of the booklet after the advertising is obtained.
Mayor Camphouse commented on the fact that the City has a Hostess program
which functions under the Chamber of Commerce and at his request Mr. Hal
Wentworth, Manager of the Arcadia Chamber of Commerce, addressed the
Council and stated in part that he had insufficient information to enable
him to comment on the subject application, but that there presently is
operating in the City similar operations which are not beneficial to the
merchant or to the purchaser of the coupon book. Mr. Wentworth continued
that he understood that one of the operations being investigated is I
purportedly selling via the telephone coupon books for $6.95 said to be
worth $300.00 in merchandise for which the merchant pays $12.50 for
advertising in such book; that with an estimated 4000 books distributed
it is possible for a merchant to obligate himself for $50,000.00 worth
of advertising, which in his estimation is an excessive advertising
budget for the average business; and that it is the aim of the Chamber of
Commerce to have regulations enacted controlling the number of coupon books
sold.
Upon the suggestion of the City Attorney that the hearing be continued for
.the purpose of obtaining additional information and the filing of additional
reports which would be helpful to the Council in making a decision,
Councilman Butterworth moved that the hearing be continued to the next
Council meeting of November 15, 1960; that in the interim the applicant
forward to the City an explanation of the particular subdivision of
Sections 17700 and 17701 of the Business and Professions Code under
which he purports to qualify, and a copy of the contract proposed to be
executed between his company and the merchant in this connection. Council-
man Phillips seconded the motion which was carried on roll call vote as
follows:

Mayor Camphouse declared the hearing open on the application of Grant A.
Kendell, residing in Anaheim, California, for a business permit to allow
him to buy, sell and loan on jewelry and diamonds at 101 East Huntington
Drive, and inquired if anyone desired to address the Council either in
favor of or in opposition to the granting of said permit.
Mr. Grant A. Kendell, the applicant, addressed the Council, and in answer
to various questions of the Council, advised that he presently operates a
retail jewelry store in Arcadia; that prior thereto he operated in Long
Beach; that he proposed, if permitted so to do, to lend money only on
watches, jewelry and diamonds as distinguished from a pawn shop which
lends money on many other items; that the prime purpose of his business
would be retail sales, which would amount to approximately two thirds of
the total business; that he would not advertise or in any manner hold
himself up as being in the lending or pawnshop business, but would have
the right to make loans if an opportunity presented itself, and that he
could continue to remain in the retail jewelry business if the requested
permit was not granted.

No one else desiring to be heard Councilman Balser moved that the hearing
be closed.. Councilman Butterworth seconded the motion which was carried
unanimously.
Councilman Balser further moved that in view of the information on file
in this matter and the fact that the applicant stated he could operate
as well without the requested permit that he moved that the request of
Grant A. Kendell for a business' permit to allow him to buy, sell and loan

requiring a public hearing Councilman Reibold moved that the hearing.,be
scheduled for November 15, 1960. Motion seconded by Councilman Balser

Councilman Reibold stated that he desired a schematic of the proposed
construction and its relationship to the area and Councilman Butterworth
requested a copy of Planning Commission Resolution No. 386.

on roll call. vote as follows that Council accept the recommendation of

conditions:
Remove all buildings and all trees from the street right of way.
Remove all buildings from the tract with the exception of the
dwelling on lot 1 and the rumpus room garage on lot 2.
Dedicate a 5 foot planting and sidewalk easement along each side
of "A" Street.
Dedicate lots 9 and 10 in fee to the city.
Install all street improvements required by the Subdivision
Ordinance including drainage facilities, according to plans

Hege, attorney for applicant Arlinic Properties, requesting that the
date for the public hearing to be scheduled on applicant's request for
a change of zone from PR-3 to C-2 on the rear portions of properties
located at 1104 and 1108 South Baldwin Avenue (Planning Commission
Resolution No. 390 recommending approval), be indefinitely postponed
until there is a determination regarding a Master plan for the City of
Arcadia, Councilman Butterworth moved that the matter be continued to
November 15, 1960. Councilman Reibold seconded the motion which was

Mayor Camphouse stated that item 7 on the agenda (recommendation from
Planning Commission re Ordinance No. 1105) would be taken up later in
the meeting and called for Item 12 to be taken up at this time prior to
item 8.
The City Attorney presented for the second time, explained the content
and read the title of Ordinance No. 1104, entitled: "AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTIONS
6220.56, 6426.2 AND 6426.6 OF THE ARCADIA MUNICIPAL CODE AND ADDING
THERETO NEW SECTIONS 6220.56.1 AND 6421.3."

The City Manager advised that the City of Temple City has approved the
request of the Superior Concrete Block & Building Supply Company to
detach lots 4 and 5 of Tract No, 10260 from said City so that said
property may be included within the City of Arcadia, as said company
owns property in Arcadia immediately adjacent to these two lots, their
operations covering the lots in question, and they are desirous of having
all tneir properties in one governmental jurisdiction, That it is his
recommendation that the requested annexation be approved,

The City Manager referred to Ordinance No. 1103 which was adopted on
October 4, 1960 as an emergency measure in light of a proposed develop-
ment of three-story dwelling units on Huntington Drive in a CoO zone.
He stated in part that after reviewing reports from the Staff it would
appear, in his opinion, that the development merits favorable
consideration on the part of the Council. That the staff reports
classes of hazards have been protected; that although the proposed
structure will be three stories in height the manner of the unit layout
provides for much open area; that high quality of construction material
is proposed to be utilized, He also pointed out the fact that only
75 units will be constructed whereas 100 two~story units:,could'be< :
built;'in;',the sari1e,:area under its CoO zoning, He added that consideration
should be given to the requirement of sidewalks in all CoO and multiple
unit zones,
The City Attorney stated in part that if the Council desired to allow
construction as now under discussion, it would be necessary to repeal
or amend Ordinance No, 1103; that said Ordinance No, 1103 was aimed
primarily at the possible hazards of high story frame construction with
its attendant problems, which might not apply in this situation; that
in order to retain some control over multi-story residential
construction in other CoO areas Ordinance No, 1103 could be amended to
permit construction of residential buildings to a height of three
stories provided the plans were approved by the City Council after
staff reports were submitted indicating that all hazards have been
eliminated or reduced to a minimum,
General discussion ensued, after which Councilman Reibold moved that the
City Attorney be instructed to prepare an amendment to Ordinance No,
1103 for presentation at the earliest possible time, the effect of

Company agrees to pay the cost of any inspection charges incurred by the
City after December 16, 1960.

Councilman phillips moved that the financial report for the fiscal period
July 1, 1959 to June 30, 1960 be received and placed on file.
Councilman Reibold stated that before the above motion is seconded he
felt it important to point out the following with regard to the financial
status of Arcadia: That the condition of the City is good; the dependence
on ad valorem tax dollar is low compared to national statistics;
temporarily idle funds have produced $58,379.17 in interest; the net
bonded debt per capita is $6.13 and is extremely low and is a reflection
of the"souildc::liiilancial condition of Arcadia; that to be able to continue
on a "pay-as-you-go" policy on capital improvements, in respect to both I
general improvements and water system expansion, is extremely desirable;
and Arcadia's sound financial condition is again pointed up wherein the
total bonded indebtedness is only 1.9% of the maximum bonding capacity.
Councilman Balser then seconded the motion which was carried unanimously.
Motion by Councilman Phillips, seconded by Councilman Reibold and carried
unanimously that Council grant the request of El Rancho Markets, Inc.
dated October 26, 1960 and permit them to erect a tent at the north end
of the shopping center to be used for the sale of Christmas Trees and
Ornaments through the month of December, 1960, said tent to be removed
before the end of the year.
Motion by Councilman Reibold, seconded by Councilman Balser and carried
on roll call vote as follows that the Mayor and City Clerk be authorized
to refund the following sums to the following persons, being the unused
portions of the investigation fees deposited in connection with their
application for business permits:

Mayor Camphouse ordered filed notices of annexation proposals by the
City of El Monte, San Gabriel and West Covina as they have no effect
on the City of Arcadia.
The City Clerk read a communication dated October 25, 1960 from ~tt.
Nissem Sam Isreal, 4013 West Boulevard, Los Angeles, protesting the
adoption of Ordinance No. 1104, regarding a reduction in the license
fee charged for the sale of tip sheets on race track property from
$600 to $300 for a 90 day period. (Letter on file in office of the
City Clerk).
Mr. Isreal then addressed the Council and reiterated in substance his
opposition, as stated in his communication, adding that he represented
Turfcraft Publications, licensed by the City of Arcadia for the past
ten years; that it Was his desire to continue doing business in Arcadia
but with the elimination of and restrictions placed on certain
locations, it would not be economically feasible for him to pay $600
per seaSon and also pay for the use of private property; that he felt
the license fee should be uniform for those persons selling tip sheets
on private property whether on the race track or elsewhere; also that
his company always takes out two permits at $600.00 each.
It was explained that the action of the Council in reducing the permit
fee for operations conducted upon the track is a logical distinction
inasmuch as the bulk of the supervision heretofore accorded by the City
police force will be taken over by the operators of the track but that
the same amount of police supervision will have to be accorded those
who elect to obtain a permit outside the track.
Mayor Camphouse requested the City Clerk to submit to the Council
copies of a communication dated October 31, 1960 from Southwest
Arcadia property owners, signed by Mrs. J. W. Erickson, regarding the
rezoning of the Southwest Arcadia area on Live Oak, said matter to be
placed on agenda for November 15, 1960.
The City Attorney presented for the first time, explained the content and
read the title of Ordinance No. 1105, entitled: "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTIONS 9122, 9122.2,
9122.3.3, 9122.3.4 AND 9122.4 OF THE ARCADIA MUNICIPAL CODE AND ADDING
THERETO NEW SECTIONS 9122.5.1, 9122.6, 9122.6.1, 9122.6.2, 9122.6.3,
9122.6.4, 9122.6.5, 9122.7 AND 9122.8."

unanimously that Resolution No. 3314 be taken under advisement and
continued to the Council meeting of November 15, 1960. Said resolution
pertains to. zoning and special use for property located on Baldwin Avenue
from Camino Real Avenue to Callita Street. It Was suggested that the
resolution be broken down into three resolutions covering the separate
items of zoning.
The City Attorney advised that Arce Bros. and others have requested the
withdrawal of their application to annex to the City of Arcadia their
property abutting City owned property on Peck Road, and in that" ""
connection he presented and read the title of Resolution No. 3313,
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, I
CALIFORNIA, RESCINDING RESOLUTION NO. 3309 AND TERMINATING THE PROCEED-
INGS THEREIN DESCRIBED" adding that this will terminate the annexation
proceedings of the property referred to above and described in
Resolution No. 3309 as Annexation No. 21, Southwest Arcadia

Officer Jack R. Renner of the Arcadia Police Department was involved,

The City Attorney commented that he is still holding Resolution No. 3302
pertaining to the hospital site for the proposed construction of a build-
ing for the Chamber of Commerce, and also Ordinance No. 1102 which is
being held pending the signing of a covenant regarding the reclassifi-
cation of property on Sixth Avenue.
Motion by Councilman Balser, seconded by Councilman Phillips and carried
on roll call vote as follows that Council grant permission to the Elks
Lodge to place one banner advertising its Fourth Annual Charity Ball,
across Huntington Drive in front of the Arcadia Elks Lodge, said ball

Mayor Camphouse submitted to Councilman Phillips a letter and requested
that he report to the Council later thereon.
Mayor Camphouse advised that an invitation had been received from
Consolidated Electro-Dynamics Corporation to attend its official
Junior Achievement opening of its northeast business center in the
Southern California area at 521 E. Green Street, Pasadena on November
3, 1960 at 4:30 P.M.
Mayor Camphouse requested the staff to answer a letter received from
a resident of Arcadia who compliments the community but has a problem
relating to the lights on Baldwin Avenue from the recently opened shoe
store, and to render a report to the Council with regard thereto.
Motion by Councilman Phillips, seconded by Councilman Reibold and carried
unanimously that the meeting adjourn at 10:07 P.M.
