HomeMy WebLinkAboutDECEMBER 28,1960 I !lOLL CALL PECK !lOAD PROPERTY (Agreement 12- 28-60) J70{ INDEXED ARCADIA AVENUE (Faubua Construction) .1q{:~' 5220 M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA ADJOURNED REGULAR MEETING DECEMBER 28, 1960 Pursuant to the order of adjournmint of the regular meeting of the City Council of December 20, 1960, the City Council of the City of Arcadia met in regular adjourned session in the Council Chamber of the City Hall at 7:30 P.M. December 28, 1960. PRESENT : ABSENT: Councilmen Balser, Phillips, Camphouse Councilmen Reibold, Butterworth Motion by Councilman Balser, seconded by Councilman Phillips and carried on roll call vote as follows that the Council accept the recommendation of the City Manager and approve an agreement dated December 28, 1960 between the City pf Arcadia and Arcadia Industries, Inc. covering the sale by the City to said corporation of certain property abutting and west of Peck Road and south of the Rio Hondo in the City of Arcadia, more fully described in said agreement as presented by the City Manager, for acceptable commercial and industrial uses, upon terms and conditions as set forth, and authorize the Mayor and City Clerk to execute said agreement on behalf of the City: AYES: Council~n Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold The City Manager reported on the matter of the Faubus Construction Company's request for a building permit to construct a 44 unit apartment house at 646 Fairview Avenue, which matter was discussed at the Council meeting of December 20, 1960. He prefaced his report by remarking that there seemed to be some impression of the residents of Arcadia Avenue that the Council would consider the opening of Arcadia Avenue to LaCadena Avenue at this meeting, and that this was not the case; that the 1913 Act proceedings had been terminated some time ago on the basis of the cost to the property owners being excessive, but that since then the City has acquired some of the more valuable pieces of property by grant deed. I The City Manager then explained the adjustments made in the plans as INDEXED submitted by the Faubus Construction Company and added that after conferring with the representatives of said company that day that he felt their problem had been resolved to the satisfaction of all concerned, and that he Wished to express his appreciation for their cooperation. After discussion by the Council of the various phases of the plans for said building and the adjustments made, Councilman Phillips moved that the Council approve the plans as outlined by the City Manager and authorize him to proceed with the negotiations along those lines. Mr. Wm. After lengthy discussion, during which Mr. Gold was advised that such conditions were contained in an ordinance in effect during his time of construction and since rescinded, it'was suggested that he confer with the staff who would endeavor to resolve his situation. Councilman Balser then seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen B"tterworth, Reibold I Discussion was held regarding the report of the City Manager that the Los Angeles County Board of supervisors were planning to dispose of approximately 4-1/2 acres of surplus Flood Control District land lying north of the Rio Hondo and east of Tyler Avenue ~y January 31, 1961; that the original price quoted for this land had been $4500.00 per acre. 11ayor Camphouse suggested that the City Manager and the Director of Public Works contact the Board of Supervisors for the purpose of requesting that they withhold action in disposing of the property until the City has had an opportunity to survey the use of this property for recreational and other purposes, this delay to occasion no obligation on the part of the City. It being the consensus of the Council that the suggestion was in order, Mayor camphouse moved that the Council authorize the staff to pursue the matter further in line with the above suggestion. Councilman Phillips seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold In answer to Councilman Phillips' suggestion that the remaining chicken ranch owners be advised that in accordance with Ordinance No. 952, December 31, 1960 is the last day for the operation of chicken ranches, the City Manager'advised that under date of July 12, 1960 notices were sent to all remaining chicken ranch owners and a second notice had been sent to them on December 1, 1960, and that immediately after January 1, 1961 the offices of the City Manager and the City Attorney would begin work on the matter. With reference to the amount of in-lieu parking credit to be allowed to Arlinic Properties, Inc. because of the opening of Arcadia Avenue, the City Manager reported that the 30 feet to be dedicated would normally provide for 28 parking spaces. Motion seconded by Councilman Phillips and carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold The City Attorney presented, explained the content and read the title of Resolution No. 3338, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DESIGNATING THE INTERSECTIONS OF CALIFORNIA STREET, GENOA STREET AND EL DORADO STREET WITH THIRD AVENUE AS STOP INTERSECTIONS AND DIRECTING THE PLACING AND MAINTAINING OF' STOP SIGNS,THEREAT." Motion by Councilman Phillips, seconded by Councilman Balser and carried on roll call vote as follows that the reading of the full body of Resolution No. 3338 be waived: AYES: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold Councilman Phillips further moved that Resolution No. 3338 be adopted. Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold The City Attorney presented, explained the content and read the title of Resolution No. 3339, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 3 OF RESOLUTION NO. 3267 OF SAID CITY BY CHANGING THE SALARY OF STOREKEEPER IN THE WATER DEPARTMENT." Motion by Councilman Balser, seconded by Councilman Phillips and carried on roll call vote as follows that the reading of the full body of Resolution No. 3339 be waived: AYES,: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold Councilman Balser further moved that Resolution No. 3339 be adopted. Motion seconded by Councilman Phillips ,and carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold Mayor Camphouse declared his intention not to recognize the requests of Mr. p. J. Derkson and Mr. Wm. Gold to address the Council, stating in part that Mr. Gold had been advised as to his remedy earlier that evening and that Mr. Derkson's remarks would not be pertinent to the issues under consideration at this adjourned regular meeting. upon failure to heed, Mayor Camphouse declared a recess at 8:l5 P.M. .J f ~ & The Regular Adjourned Meeting of the Arcadia City Council reconvened at p; 8:17P.M. INDEXED ADJOURNMENT ", Mr. Derkson and Mr. Gold again requested and received permission to address the Council, and Mr. Derkson reiterated at length his statements made at previous Council meetings, to the effect that the property owners on Arcadia Avenue are 100% opposed to the extension of Arcadia Avenue and that the Council had indicated that proceedings so to do had been abandoned; and Mr. Gold reiterated his statements made earlier that evening and was again advised to confer with the staff in an effort to resolve his problems. Councilman Phillips then moved that the staff prepare a complete resume of the happenings in the Arcadia Avenue situation from the time the emergency ordinance was adopted through the abandonment of the I 1913 Act proceedings and to date, and that such resume be made a matter of record. Councilman Balser seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Balser, Phillips, Camphouse NOES: None ABSENT: Councilmen Butterworth, Reibold Mr. John R. Street, 515 West Duarte Road, addressed the Council and inquired if the Council has abrogated its position taken in August, 1960 regarding the abandonment of the proceedings for the opening of Arcadia Avenue. Whereupon Mayor Camphouse and Councilmen Balser and Phillips restated the position of the Council; that it has not abrogated its position; that the proceedings(under the 1913 Act) in question were abandoned with the understanding that if and when any property owner wished to cooperate with the City on the opening of Arcadia Avenue the Council would be willing to consider the matter; that the action taken in the Arlinic matter was done so with the cooperation of the property owner; that nothing has -been done to invade the property rights of owners farther east who have no desire to participate; that the area that has 'been..opene"d"will' benefit' the business"district and aid in the flow of traf fic. Mr. Henry Hege, the attorney representing Arlinic Properties, Inc. addressed the Council and stated that he wished to go on record on behalf of his client that there has been no coercion used in the dedication and that it is one of mutual benefit to his client and to the City.
