Lyndon D, Cheeves, Pastor of the Arcadia Church of Christ. Mayor Camphouse led in the pledge of allegiance to the flag, PRESENT : ABSENT : Councilmen Balser, Butterworth, Reibold, Phillips, Camphouse None Motion by Councilman Phillips, seconded by Councilman Reibold and carried unanimously that the word "improper" be substituted for the word "impossible" in the next to the last sentence on page 6 of the minutes of the Regular Meeting of January 17, 1961, and with this substitution that the said minutes of the Regular Meeting of January 17, 1961 as submitted in writing be approved. Mayor Camphouse declared the hearing open on the application of Ormus F. Reid, 3562 East 7th Street, Los Angeles, California (former address stated in application: 6049 Allston Street, Los Angeles), representing Richard N, Parra, 126\ Santa Fe Avenue, Placentia, California, for a business permit to solicit 9:00 A,M, to 5:00 P,M" saturdays and Sund~ys only, the sale of driveway sealcoating. To Mayor Camphouse's inquiry as to whether anyone in the audience desired to speak with regard to the application, Mr, Reid, the applicant, J 1 73 addressed the Council and in answer to various questions, described his equipment, the materials used, which he stated were purchased from oil aNDEXEDcompanies and were the same type used on freeways and the like; that the cost to the purchaser depended upon the size of the job which, when completed, ,is left in a clean and safe condition, I It was the consensus of the Council that there was serious objection to solicitation on Sundays and to their inquiry as to whether it was essential that the applicant solicit on Sundays, he replied that he worked at another job during the week but, if necessary, would try to limit his solicitations to Saturdays. Councilman Reibold then moved that the hearing be closed, Councilman Butterworth seconded the motion which was carried unanimously. Councilman Butterworth stated that in view of the application stating that solicitations were to be made saturdays and Sundays he did not think this would be a good policy to establish and moved that the application be denied, To Councilman Reibold's question as to whether he would be willing to grant the application if the solicitation time was limited to Saturdays only, Councilman Butterworth answered in the negative and withdrew his motion. 1. 2-7-61 (Hearing Reid - Continued) RESOLUTION No, 3350 -~'".""'"'l.-::r> J!NDE-XED ZONE CHANGE (Sycamore' Avenue) ZONE CHANGE (Holly Ave,) VARIANCE (Duarte Rd.) Councilman Balser seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Balser, Reibold, Phillips, camphouse NOES: Councilman Butterworth ABSENT: None Mayor Camphouse requested the management to advise the applicant of the restrictions, I Councilman Reibold presented and read in its entirety Resolution No, 3350, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, COMMENDING MRS, CATHERINE MUNDY AND THE ARCADIA TRIBUNE", Councilman Reibold then moved that Resolution No. 3350 be adopted, The motion was seconded by Councilman Balser, and it being the consensus of the Council that the editors and publishers of the Arcadia Tribune and in particular Mrs, Catherine Mundy, the Editor of its Women's Section, are to be commended on the recognition accorded by the California News- paper Publishers' Association in its granting of a statewide award to Mrs, Mundy for the Women's Section of the Christmas Edition of the Arcadia Tribune, the motion was carried unanimously. Planning Commission Resolution No, 402 recommending Denial of request for change of zone from R-l to R-3 on south side of Sycamore Avenue east of Second Avenue; and Planning.Commission Resolution No, 403 recommending rezoning of property on west side of Holly Avenue south of Duarte Road from R-l to R-2 and that variance be granted to allow R-3 usage on certain property on both sides of Duarte Road west of Holly Avenue, Said matters requiring public hearings, Councilman Phillips moved that a hearing be scheduled for February 21, 1961 at 8:00 o'clock P,M, on Planning Commission Resolution No, 403, and March 7, 1961 at 8:00 o'clock P,M, on Planning Commission Resolution No. 402, Motion seconded by Councilman Butterworth and carried unanimously. Spencer & Jones Basic Bid $ 733.00 2,469.00 2,550,00 Alternate Bid $1,933.00 3,969.00 2,850,00 The basic bid is for the complete removal of the station by the contractor; the alternate proposal is for the removal of the station, salvaging and delivering the pumps and tanks to the City of Arcadia yards, Motion by Councilman Reibold, seconded by Councilman Butterworth, and carried on roll call vote as follows that the Council accept the recommendation of the City Manager and the Director of Public Works and that a contract for the removal of the 1:exaco',Serv1ce::Station be awarded to the Mead House Wrecking Company of pasadena, california, in the basic bid amount of $733.00, funds for which are provided in the present Capital Improvement Projects funds; that all other bids be rejected; that any irregularities and informalities in the bid or bidding process be waived and that the Mayor and City Clerk be authorized to execute a contract on behalf of the City for the performance of the contract and in the amount specified, in form approved by the City Attorney: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, Camphouse NOES: None ABSENT: None The City Manager read in its entirety a report of the study made by the staff regarding the request of the Arcadia Pony-Colt Baseball League to light the Bonita Park ball diamonds, and his recommendations in regard thereto. He also read in its entirety a communication dated February 1, 1961 from Mrs. Nelle M. Nickel, 162 Alta Avenue, expressing in substance opposition to lighting Bonita Park for night games. (Report and communication on file in office of the City Clerk). After considerable discussion, and it being the consensus of the Council that there is need for additional facilities for ball playing in the City, and that such need can presently be met with the least inconvenience and disturbance to adjacent residents, by the utilization of the Bonita Park ball diamonds at night, Councilman Phillips moved that the Council accept the recommendation of the City Manager and approve the request of the Pony League to install lights on the Bonita Park ball diamonds when plans are approved by the City Engineer and installation agreed to by the School District; that the Pony League be granted permission to provide concession stand facilities at the site under a plan to be approved by the City Council and the School District; and that the City Manager be authorized to establish a charge to cover the cost of current to light said field, the charge to be paid by any users of the facility. that the plans and specifications for the beautification of Santa Anita Avenue from Huntington Drive to Camino Real Avenue prepared by the firm of Burge and Roach, Architects (Project designed in accordance with previously approved sketches and layouts) be approved as submitted; and that the City Clerk be authorized to call for bids for such work in conformance with said specifications, funds for such project being included in the Capital Improvements Projects Fund, said bids to be opened at 11:00 o'clock A,M., March 6, 1961: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, camphouse NOES: None ABSENT: None Motion by Councilman Butterworth, seconded by Councilman Reibold and carried on roll call vote as follows that Council accept the recommen- dation of the City Manager and authorize the transfer of the sum of $60,000 from Major projects - Other projects Account in the Water Fund to Major Projects - Item 3, Transmission Main Installation Peck Road, to cover the proposed construction of a transmission main from Longden well site to the Peck Road property south of the Rio Hondo: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, Camphouse NOES: None ABSENT: None The City Manager presented an invoice from the Los Angeles County Flood Control District requesting an additional amount of $1342.96 for reimbursement of betterments constructed at the intersection of Huntington Drive and Fifth Avenue in conjunction with the Santa Anita I Wash project, said betterments having been authorized under an agreement dated November 14, 1958 between the Cities of Arcadia, Monrovia and the Los Angeles County Flood Control District, and said reimbursement being required because final unit prices were higher than those estimated in the preparation of the original agreement, Motion by Councilman Phillips, seconded by Councilman Balser and carried on roll call vote as follows that the Council accept the recommendation of the City Manager and the Director of Public Works and authorize the payment of the invoice as presented and the transfer and appropriation of $1342.96 from Reserve from Capital Projects Account No. 285 in the General Fund to Capital Improvement Projects Fund - Fifth Avenue Improve- ment Account No, 209: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, camphouse NOES: None ABSENT: None 4. 2-7-61 LIBRARY (Appropri- ations) .J 'I7ch INDEXED I LOS ANGELES COUNTY HEALTH CODE INDEXED ASSEMBLY BILL No, 354 (Labor Code) a,'~ INDEXED I MICROPHONES (Council Chamber) (1" ~' tINDEXED 5255 The City Manager presented and read a report dated January 24, 1961 on the account balances for Library Capital Projects as of January 23, 1961 as prepared by the City Controller, and the recommended additional appropriations, Motion by Councilma~ Balser, seconded by Councilman Phillips and carried on roll call vote as follows that the Council approve the recommendation of the City Manager and the City Controller and authorize the amount of $7,400 to be transferred and appropriated from Reserve for capital Projects Account No. 285 in the General Fund to the following Library Project Accounts in the Capital Improvement Projects Fund: 501 Designs, Plans, Spec, 503 Construction 504 Library Furn, & Equip, $2,400,00 2,000.00 3,000,00 $7,400.00 AYES: Councilmen Balser, Butterworth, Reibold, Phillips, camphouse NOES: None ABSENT: None The City Manager submitted a report dated January 31, 1961 on the progress to date re the proposed adoption of the ,County Health Code and stated that the staff will proceed to prepare recommended amendments to the ordinance for submission to the Health and Sanitation Commission prior to making recommendations to the City Council, Councilman Reibold moved that the above mentioned report be received and filed, Councilman Phillips seconded the motion which was carried unanimously, The City Manager advised that Assemblyman Flournoy has requested that the position of the City Council regarding Assembly Bill No, 354 be conveyed to him, That the text of said bill is as follows: "An act to add Section 1773,2 to the Labor Code,. relating to city public works projects, "The people of the State of California do enact ,as follows: "SECTION 1, Section 1773,2 is added to the Labor Code, to read: "1773,2, Publication by a city once a year of a schedule of the general prevailing rates of wages for coritracts for public work~shall be deemed compliance with the provision of Section 1773 requiring such information in all bids for public work, The annual publication may be made once each fiscal year or each calendar year, whichever is deemed most prac tical, "The schedule shall be posted at all times at the city hall," Motion by Councilman Butterworth, seconded by Councilman Reibold and carried unanimously that the City Clerk be authorized to inform the Honorable Houston I. Flournoy, Assemblyman, Forty-Ninth District that the City of Arcadia strongly supports Assembly Bill 354 introduced by him at the present session of the Assembly, It being the consensus of the Council that chest or clip type micro- phones would result in Council discussions being more readily distinguishable to the Council audience, Councilman Balser moved that eight chest or clip type microphones, including installation of 5, 2-7-61 (Microphones - Continued) OPINION (Council Meetings) a;~ ~ INDEXED ORDINANCE No, 1117 (Adopted) ~ 11)-,">' tU'IDEXED 5256 connections and a switch type of shut-off for each microphone, be purchased at the quoted price of $750,00, said price to be adjusted to offset the existing microphones not being traded in as first anticipated in the quoted price, and that the cost be charged against Account No, 409-28, Mayor Camphouse seconded the motion which was carried on roll call vote as follows: AYES: Councilmen Balser, Butterworth, Reibold, Phillips, camphouse NOES: None ABSENT: None In compliance with Council's request of January 17, 1961, the City Attorney presented an opinion on Council sessions, stating in substance that said opinion analyzes the legislative history of the City Charter, the Brown Act and the Government Code sections in effect at the time of the adoption of the Charter; that it attempts to reconcile and correlate the provisions of the Charter, the general law and of the Brown Act; that it discusses the problems that have been raised with respect to the manner in which meetings and conferences have been held; that it divides meetings into four classes and explains the applicability of the Charter, the Brown Act and the Government Code to the various four classes, I The City Attorney continued, stating in part that the principles of the Brown Act are sound; that the Brown Act did not enact anything that was not already sound practice and ethical procedure; that the conduct of the various sessions recited have, in his opinion, been perfectly legal.
