'REGULAR MEETING
FEBRUARY 7, 1961
The City Council of the City of Arcadia met ,in regular session in the
Council Chamber of the City Hall at 8:00 o'clock P.M, February 7, 1961,
The- Invocation was offered by Rev. Lyndon D, Cheeves, Pastor of the
Arcadia Church of Christ.
Mayor Camphouse led in the pledge of allegiance to the flag,

Motion by Councilman Phillips, seconded by Councilman Reibold and
carried unanimously that the word "improper" be substituted for the
word "impossible" in the next to the last sentence on page 6 of the
minutes of the Regular Meeting of January 17, 1961, and with this
substitution that the said minutes of the Regular Meeting of January 17,
1961 as submitted in writing be approved.
Mayor Camphouse declared the hearing open on the application of Ormus F.
Reid, 3562 East 7th Street, Los Angeles, California (former address
stated in application: 6049 Allston Street, Los Angeles), representing
Richard N, Parra, 126\ Santa Fe Avenue, Placentia, California, for a
business permit to solicit 9:00 A,M, to 5:00 P,M" saturdays and Sund~ys
only, the sale of driveway sealcoating.
To Mayor Camphouse's inquiry as to whether anyone in the audience
desired to speak with regard to the application, Mr, Reid, the applicant,
J 1 73 addressed the Council and in answer to various questions, described his
equipment, the materials used, which he stated were purchased from oil
aNDEXEDcompanies and were the same type used on freeways and the like; that the
cost to the purchaser depended upon the size of the job which, when
completed, ,is left in a clean and safe condition,

It was the consensus of the Council that there was serious objection to
solicitation on Sundays and to their inquiry as to whether it was essential
that the applicant solicit on Sundays, he replied that he worked at
another job during the week but, if necessary, would try to limit his
solicitations to Saturdays.
Councilman Reibold then moved that the hearing be closed, Councilman
Butterworth seconded the motion which was carried unanimously.
Councilman Butterworth stated that in view of the application stating
that solicitations were to be made saturdays and Sundays he did not think
this would be a good policy to establish and moved that the application
be denied,
To Councilman Reibold's question as to whether he would be willing to
grant the application if the solicitation time was limited to Saturdays
only, Councilman Butterworth answered in the negative and withdrew his
motion.

Whereupon Councilman Reibold moved that the Council approve the appli-
cation of Ormus F;: Reid..and '.that a business permit be issued to him
to solicit door to door for sales of driveway sealcoating from 9:00 A,M,
to 5:00 P,M, saturdays only. Councilman Balser seconded the motion which
was carried on roll call vote as follows:

Councilman Reibold presented and read in its entirety Resolution No, 3350,
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
COMMENDING MRS, CATHERINE MUNDY AND THE ARCADIA TRIBUNE",
Councilman Reibold then moved that Resolution No. 3350 be adopted, The
motion was seconded by Councilman Balser, and it being the consensus of
the Council that the editors and publishers of the Arcadia Tribune and
in particular Mrs, Catherine Mundy, the Editor of its Women's Section,
are to be commended on the recognition accorded by the California News-
paper Publishers' Association in its granting of a statewide award to
Mrs, Mundy for the Women's Section of the Christmas Edition of the
Arcadia Tribune, the motion was carried unanimously.
Planning Commission Resolution No, 402 recommending Denial of request for
change of zone from R-l to R-3 on south side of Sycamore Avenue east of
Second Avenue; and
Planning.Commission Resolution No, 403 recommending rezoning of property
on west side of Holly Avenue south of Duarte Road from R-l to R-2 and
that variance be granted to allow R-3 usage on certain property on both
sides of Duarte Road west of Holly Avenue,
Said matters requiring public hearings, Councilman Phillips moved that a
hearing be scheduled for February 21, 1961 at 8:00 o'clock P,M, on
Planning Commission Resolution No, 403, and March 7, 1961 at 8:00
o'clock P,M, on Planning Commission Resolution No. 402, Motion seconded
by Councilman Butterworth and carried unanimously.

carried on roll call vote as follows that the Council accept the
recommendation of the City Manager and the Director of Public Works
and that a contract for the installation of conduit and alarm box
pedestals for the Fire Alarm System be awarded to Fischbach and Moore
in the amount of $4,352,00; that all other bids be rejected; that any
irregularities and informalities in the bid or bidding process be waived
and that the Mayor and City Clerk be authorized to execute a contract on
behalf of the City for the performance of the contract and in the amount

carried on roll call vote as follows that the Council accept the
recommendation of the City Manager and the Director of Public Works
and that a contract for the removal of the 1:exaco',Serv1ce::Station be
awarded to the Mead House Wrecking Company of pasadena, california, in
the basic bid amount of $733.00, funds for which are provided in the
present Capital Improvement Projects funds; that all other bids be
rejected; that any irregularities and informalities in the bid or bidding
process be waived and that the Mayor and City Clerk be authorized to
execute a contract on behalf of the City for the performance of the
contract and in the amount specified, in form approved by the City
Attorney:

The City Manager read in its entirety a report of the study made by the
staff regarding the request of the Arcadia Pony-Colt Baseball League to
light the Bonita Park ball diamonds, and his recommendations in regard
thereto. He also read in its entirety a communication dated February 1,
1961 from Mrs. Nelle M. Nickel, 162 Alta Avenue, expressing in substance
opposition to lighting Bonita Park for night games. (Report and
communication on file in office of the City Clerk).
After considerable discussion, and it being the consensus of the Council
that there is need for additional facilities for ball playing in the City,
and that such need can presently be met with the least inconvenience and
disturbance to adjacent residents, by the utilization of the Bonita Park
ball diamonds at night, Councilman Phillips moved that the Council accept
the recommendation of the City Manager and approve the request of the
Pony League to install lights on the Bonita Park ball diamonds when plans
are approved by the City Engineer and installation agreed to by the School
District; that the Pony League be granted permission to provide concession
stand facilities at the site under a plan to be approved by the City
Council and the School District; and that the City Manager be authorized
to establish a charge to cover the cost of current to light said field,
the charge to be paid by any users of the facility. Councilman Reibold
seconded the motion which was carried on roll call vote as follows:

on roll call vote as follows that the Council accept the recommendation
of the City Manager and the Director of Public Works; that the plans and
specifications for the following street improvements adjacent to the
Library Site be approved as submitted: installation of concrete sidewalk
on Duarte Road and Santa Anita.Avenue and curbs, gutters and widening ,of
the pavement on Duarte Road; and that the City Clerk be authorized to call
for bids for such work in conformance with said specifications, funds for
same having been appropriated in the capital Improvement Projects Fund,
said bids to be opened at'll:OO o'clock A.M. February 20, 1961:

of the City Manager and the Director of Public Works; that the plans and
specifications for the beautification of Santa Anita Avenue from
Huntington Drive to Camino Real Avenue prepared by the firm of Burge and
Roach, Architects (Project designed in accordance with previously
approved sketches and layouts) be approved as submitted; and that the
City Clerk be authorized to call for bids for such work in conformance
with said specifications, funds for such project being included in the
Capital Improvements Projects Fund, said bids to be opened at 11:00
o'clock A,M., March 6, 1961:

$60,000 from Major projects - Other projects Account in the Water Fund
to Major Projects - Item 3, Transmission Main Installation Peck Road,
to cover the proposed construction of a transmission main from Longden
well site to the Peck Road property south of the Rio Hondo:

The City Manager presented an invoice from the Los Angeles County Flood
Control District requesting an additional amount of $1342.96 for
reimbursement of betterments constructed at the intersection of
Huntington Drive and Fifth Avenue in conjunction with the Santa Anita I
Wash project, said betterments having been authorized under an agreement
dated November 14, 1958 between the Cities of Arcadia, Monrovia and the
Los Angeles County Flood Control District, and said reimbursement being
required because final unit prices were higher than those estimated in
the preparation of the original agreement,
Motion by Councilman Phillips, seconded by Councilman Balser and carried
on roll call vote as follows that the Council accept the recommendation
of the City Manager and the Director of Public Works and authorize the
payment of the invoice as presented and the transfer and appropriation
of $1342.96 from Reserve from Capital Projects Account No. 285 in the
General Fund to Capital Improvement Projects Fund - Fifth Avenue Improve-
ment Account No, 209:

The City Manager presented and read a report dated January 24, 1961
on the account balances for Library Capital Projects as of January
23, 1961 as prepared by the City Controller, and the recommended
additional appropriations,

of the City Manager and the City Controller and authorize the amount of

The City Manager submitted a report dated January 31, 1961 on the
progress to date re the proposed adoption of the ,County Health Code
and stated that the staff will proceed to prepare recommended
amendments to the ordinance for submission to the Health and
Sanitation Commission prior to making recommendations to the City Council,
Councilman Reibold moved that the above mentioned report be received
and filed, Councilman Phillips seconded the motion which was carried
unanimously,
The City Manager advised that Assemblyman Flournoy has requested that
the position of the City Council regarding Assembly Bill No, 354 be
conveyed to him, That the text of said bill is as follows:
"An act to add Section 1773,2 to the Labor Code,. relating
to city public works projects,
"The people of the State of California do enact ,as follows:
"SECTION 1, Section 1773,2 is added to the Labor Code, to
read:
"1773,2, Publication by a city once a year of a schedule
of the general prevailing rates of wages for coritracts for
public work~shall be deemed compliance with the provision
of Section 1773 requiring such information in all bids for
public work, The annual publication may be made once each
fiscal year or each calendar year, whichever is deemed most
prac tical,
"The schedule shall be posted at all times at the city hall,"
Motion by Councilman Butterworth, seconded by Councilman Reibold and
carried unanimously that the City Clerk be authorized to inform the
Honorable Houston I. Flournoy, Assemblyman, Forty-Ninth District that
the City of Arcadia strongly supports Assembly Bill 354 introduced
by him at the present session of the Assembly,
It being the consensus of the Council that chest or clip type micro-
phones would result in Council discussions being more readily
distinguishable to the Council audience, Councilman Balser moved that
eight chest or clip type microphones, including installation of

In compliance with Council's request of January 17, 1961, the City
Attorney presented an opinion on Council sessions, stating in substance
that said opinion analyzes the legislative history of the City Charter,
the Brown Act and the Government Code sections in effect at the time of
the adoption of the Charter; that it attempts to reconcile and correlate
the provisions of the Charter, the general law and of the Brown Act;
that it discusses the problems that have been raised with respect to the
manner in which meetings and conferences have been held; that it
divides meetings into four classes and explains the applicability of
the Charter, the Brown Act and the Government Code to the various four
classes,

The City Attorney continued, stating in part that the principles of the
Brown Act are sound; that the Brown Act did not enact anything that was
not already sound practice and ethical procedure; that the conduct of
the various sessions recited have, in his opinion, been perfectly legal.
That the opinion likewise contains certain admonitions, precautionary
statements, the points at which danger can readily be approached and
innocently so, and proceeds to answer the questions of the one Council-
man who submitted questions in writing, That it is nonpartison and very
conservative, and that by adhering to the concepts that are set forth
and explained therein, he thought the Council can proceed without any
undue fear that they are violating either the City Charter or the Brown
Act provisions of the Government Code,
The City Attorney then requested Council's permission to make the Opinion
public, and it being the concensus of the Council that interested persons
should be given a copy, Councilman Butterworth moved that the Opinion be
made available to the public, Councilman Phillips seconded the motion
which was carried unanimously,

carried unanimously that the Council accept the recommendation of the
City Attorney and authorize the Mayor and City Clerk to execute a quit
claim deed on behalf of the City of Arcadia, quit claiming any"right,'
title or interest in and to that certain property located at the south-
west corner of Camino Real and Baldwin Avenues, which the City might :,
have acquired solely by virtue of that ,certain covenant or agreement
made August 12, 1957 by and between John W, Bernard, carolyn Bernard,
Ralph Edwards, Harry N, Hudson, Mary Lucile Hudson, H, 0, Wroten and
Fanny I. Wroten,
The City Manager advised that the Personnel Board considered a proposal
from Fire Chief Laurence J. Way that the class specification for Captain
(Fire Department) be revised to allow a Fireman to be promoted to
captain without going through the present intervening step of Engineer;
that ',che:', Fireman being promoted to Captain would be required 'to pass
a written examination covering hydraulics and engineering but would
not be examined on ability to manually operate a fire truck and pumps;
that it is felt a Captain must have the administrative knowledge of
engineering but need not have actual operating engineering eXperience as
required by the position of Engineer; that the present five year' minimum
period for becoming a Captain would not be changed,
Motion by Councilman Reibold, seconded by Councilman Phillips and carried
unanimously that the Council approve the recommendation of the City
Manager and the Personnel Board as contained in its communication of
January 19, 1961 and authorize a change in that portion of the class
specification of Captain (Fire Department) to read from:
"A captain must have had at least three years of fire-
fighting experience as a Lieutenant or Engineer;" to
"A Captain must have had at least five years of fire-
fighting experience on the Arcadia Fire Department from
the date of probationary appointment,"

The City Manager advised that the Personnel Board considered a proposal
to change Personnel Rule-IX, Section 4, lines 6 and 7; that Personnel
Rule VIII, Section 1, was recently revised to change the probationary
period for Policemen from six months to twelve months and that the
proposed change restores the same sick leave privileges which were in
effect p~ior to the change in Rule VIII as well as restoring the same
sick leave privileges given to other employees.
Motion by Councilman Phillips, seconded by Councilman Balser and carried
unanimously that Council accept the recommendation of the Personnel Board
and authorize the change of Personnel Rule IX, Section 4, lines 6 and 7
as follows:

Councilman Reibold moved that permission be granted the Arcadia Chapter
of the American Red Cross to put up approximately 60 pole posters in
Arcadia and 40 in West Arcadia during the month of March, said posters
to be 25" x 271f", -:encircle the lampposts approximately three feet from
the ground, Councilman Balser seconded the motion which was carried
by the Aye vote of Councilmen Balser, Reibold, Phillips and camphouse;
Councilman Butterworth abstained due to a member of his family being on
the Board of the Arcadia Chapter,
The City Clerk read in its entirety a communication dated January 27, 1961
from the Arcadia Chamber of Commerce, which in substance expressed the
appreciation of the people of the City of Arcadia for Council's support
of the 1961 Tournament of Roses Parade Float, and enclosed a check for
$100,00 ~epresenting a surplus in the float fund.
The City Council accepted said check with thanks and again expressed
their admiration for the manner in which the Chamber of Commerce and
the Float Committee had conducted the entire program,
Councilman Phillips and the Director of public Works were authorized to
attend the next regular meeting of the Independent Cities of Los Angeles
County on February 15, 1961 at the Rodger Young Auditorium, Los Angeles,
California,
With reference to the request of the Arcadia correspondent for the Daily
News Post to be notified of all meetings of the Arcadia City Council, it
was the consensus of the Council that this request would be granted.
Councilman Reibold moved, seconded by Councilman Phillips and carried on
roll call vote as follows, that the Mayor and City Clerk be authorized
to refund the following sums, being the unused portions of investigation
fees deposited in connection with applications for business permits:

Mayor Camphouse ordered filed the following notices of annexation

Mr. Ervin H, Golisch, Planning Commission's liaison with the City Council,
advised that the Planning Commission is studying the effect of the freeway
on residences and the subsequent removal and movement of houses into, out
of or within the City of Arcadia due to the encroachment of the freeway;
also that study is being given to possible constructive revisions of the
City's ordinances pertaining thereto, and that recommendations to the
Council will be forthcoming in the near future.

The City Manager read in full that portion of a legislative bulletin dated
February 3, 1961 received from the League of California Cities, which in
part stated that on February 14, 1961, the Assembly Committee on
Governmental Efficiency and Economy will hear AB 127 (Luckel, et al,),
which bill, if enacted,will require all meetings of local legislative
bodies to be open even if held solely for the purpose of discussion and
no action is to be taken or no decision is to be made on the subject

~- pending, proposed or anticipated litigation with the city attorney or

It was the consensus of the Council that letters appear to be more
effective than resolutions and that' since the intervening time is so
short, that the matter be left to 'the discretion of each individual
Councilman for any action he may desire to take,
The City Manager advised that a problem has arisen at the Turf Club
regarding the distribution of tip sheets, particularly with regard to
Section 6426.4 of the Municipal Code, which restricts the distribution
between the hours of 4:00 and 7:00 P,M" and suggested that said section
6426,4 be amended as follows to permit those who are licensed to sell at
the race track to distribute free at the track only:

"No person shall disseminate, distribute, pass out, give away, hand out,
sell, offer for sale or solicit for the sale of any of said materials
described in section 6220,56 of this Code at any place within the City
within the hours of 4:00 o'clock P,M, and 7:00 o'clock P,M, on any, day,
except upon property owned and controlled by any racing association duly
licensed by the State to ~onduct horse racing under and in accordance
with the laws of the State relating to such matters and in conjunction
with which such property is used by such racing association by any , .'
person who is licensed to engage in business thereat pursuant to Section
6220.56" ,
Councilman Phillips moved that the City Attorney be instructed to prepare
an ordinance incorporating the above sentence. Councilman Reibold
seconded the motion which was carried on roll call vote as follows:

The City Manager advised that a communication had been received from the
Division of Highways drawing attention to the Los Angeles Regional
Transportation Study, He then submitted copies of the prospectus dated
September, 1960 from said Division of Highways to the Council, adding
that additional copies were also being given to various departments,
including the office of the City Clerk, the Engineering and Planning
Departments, and that should the Council have any questions after review-
ing the prospectus he would takel.them up with the Division of Highways.
The City Manager advised that a communication dated February 7, 1961 had
been received from the Los Angeles Turf Club, Inc, requesting permission
for Helicabs, Inc, to land helicopters on the vacant ground to the north-
east of the City Hall as an experimental service to the race track for
the balance of the racing meet to determine the public's acceptance,
Said communication also described the helicopters proposed to be operated
and that an area 75' x 200' would be barricaded adjacent to Huntington
Drive; also that they would obtain the necessary permits' from the Federal I
Aviation Agency and the California Aeronautics Commission to operate
from said location; that they would name the City as additional assureds
on their liability insurance policy in the amount of $2,000,000 and
would furnish a Hold Harmless Agreement to the City,
After general discussion regarding precautionary measures that might be
necessary by reason of the attractive nuisance features to children and
others in the landing of helicabs at the requested site, Councilman
Butterworth moved that the Council authorize the City Manager to work
with the Los Angeles Turf Club and Helicabs, Inc. to the end that full
protection would be given to anyone who might be attracted because of
the landing at said location, Councilman Reibold seconded the motion
which was carried unanimously,

Council Contingency Fund to a special account designated as the Library
Dedication Fund to cover incidental expenses that will be necessitated
by reason of the dedication ceremonies planned for the opening of the
new City Library the week of April 16, 1961:

To Councilman Reibold's suggestion that during the dedication ceremonies
might be an opportune time for the distribution of publicity regarding

factory date in February for the dual purpose of a report on the plans
,for the dedication ceremonies and the matter of presenting to the public
the story of the City,
Mayo~ Camphouse requested Co~ncilman Phillips and the City Manager to
check the status of the appointment of independent auditors for the
fiscal year and report back to the Council at the next meeting,
The City Clerk read a communication dated February 3, 1961 from the
Bowling Proprietors Association of Southern California, Inc, of Los
Angeles, California requesting a hearing on the matter of the bowling
centers in Arcadia conducting their business with certain limitations
on the use of their Alcoholic Beverage licenses,
Mayor camphouse requested the City Clerk to advise said corporation
regarding the City's procedure.
The City Attorney presented for the first time, explained the content
and read the title of Ordinance No, 1121, entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION
6426,4 OF THE ARCADIA MUNICIPAL CODE," which incorporates the sentence
read earlier by the City Manager regarding tip sheet distribution at
the track only,
Motion by Councilman Reibold, seconded by Councilman Phillips and carried
on roll call vote as follows that the reading of the full body of
Ordinance No, 1121 be waived:
